VILLUPURAM: Students taking the Class XII State Board exams at the Government Higher Secondary school at Mampazhapattu village near Villupuram on Friday had a tough time. Not because they feared the Maths and Zoology papers, they couldn’t trace their allotted classrooms.

As the clock went past 10, when the exam was officially slated to begin, their surprise gave way to anxiety. Queries as to what was happening led them to discover that the exam-in-charge was nowhere to be found as he had forgotten all about the exam.

After frantic calls, he finally made it to the venue and with teachers pooled from nearby schools, the exam was conducted, albeit half-an-hour late.

The public exam began on March 4. Villupuram, one of the lowest ranked educational districts in the State, has 36,000 students appearing from 109 schools. The school at Mampazhapattu village is one such centre and Thirunavalur government high school headmaster Thangaraj was appointed as the superintendent of that exam centre.

After news spread, education department officials and chief education officer Mars rushed to the school for damage control and found that the centre superintendent and 17 teachers were missing. The CEO immediately called up Thangaraj, who was in his school at the time. Shocked education department officials desperately called teachers from nearby schools in Perumbakkam, Kanai and Kalpattu to set things in motion.

Parents of the students alleged that their wards were psychologically upset which could reflect in their marks. CEO Mars first denied this but later blamed the centre-in-charge and assured that an inquiry will be held. Last year, a board exam was delayed at Valavanur for the same reason.

Obscene acts in private place not offence under Indian law: Bombay HC

The Bombay high court has said that obscene act done in a private place is not a criminal offence under the Indian Penal Code, quashing a case against 13 men who were arrested for allegedly indulging in obscene acts with women in a flat.

A division bench of Justices N H Patil and A M Badar was hearing a petition recently filed by the men seeking quashing of the FIR registered against them by Andheri Police in December last year under IPC section 294 (anyone indulging in an obscene act in any public place or sings or utters any obscene songs or words in any public place causing annoyance to others).

According to police, on December 12, 2015, they received a complaint from a journalist about loud music emanating from a flat in the neighbourhood and that scantily dressed women were seen from the window dancing and men showering money at them.

On perusal of the complaint, the police raided the flat and found six scantily dressed women who were dancing and 13 men consuming liquor in the flat. All the men were taken into custody and an FIR was registered against them.

Petitioners’ advocate Rajendra Shirodkar argued that the flat in question cannot be said to be a public place where anyone had access.

The court accepted this argument and said, “Obscene act done in a private place or viewed in privacy is not covered by the provisions of section 294 of IPC. The flat in building owned by some private person meant for private use of such owner cannot be said to be a public place.”

“Section 294 of IPC is meant for punishing persons indulging in obscene act in any public place causing annoyance to others. As such, the places where such obscene act is committed needs to be a public place and meant for use of public at large.

“Public must have free access to such place so as to call it a public place. The place where public have no right rather a lawful right to enter into, cannot be said to be a public place for invoking the penal provisions of section 294 of IPC,” the court said.

பாஸ்போர்ட் பெறுவதற்கு விண்ணப்பம் செய்பவர்கள் விண்ணப்பத்துடன் இணைக்கவேண்டிய ஆவணங்கள் பற்றிய விவரங்கள் இணையதள முகவரியில் குறிப்பிடப்பட்டுள்ளது.

இதில் அடையாளம் மற்றும் முகவரிக்கான சான்று ஆவணமாக குடும்ப அட்டையும் (ரேஷன் கார்டு) இடம் பெற்றிருந்தது.

தற்போது முகவரிக்கான சான்றாவணத்தில் இருந்து குடும்ப அட்டை நீக்கம் செய்யப்பட்டுள்ளது.

மத்திய அரசின் நுகர்வோர், உணவு மற்றும் பொது வினியோக துறை கடந்த 2015 ஆம் ஆண்டு மார்ச் மாதம் 20 ஆம் தேதி வெளியிட்ட அரசாணையில் குடும்ப அட்டை வினியோகம் செய்யப்படுவது உணவு பொருட்கள் வாங்குவதற்காக தான்.

அதனை அடையாள அட்டை மற்றும் முகவரிக்கான ஆவணமாக பயன்படுத்தக்கூடாது என்று தெரிவிக்கப்பட்டுள்ளது.

மத்திய அரசின் இந்த ஆணையை இந்திய வெளி விவகார துறை ஏற்றுள்ளது. இதன் அடிப்படையில் குடும்ப அட்டையை அடையாளம் மற்றும் முகவரிக்கான ஆவணமாக ஏற்றுக்கொள்ளப்பட மாட்டாது.

இந்த புதிய விதிமுறை ஏப்ரல் 1 ஆம் தேதி முதல் அமலுக்கு வருகிறது. எனவே பாஸ்போர்ட் விண்ணப்பதாரர்கள் குடும்ப அட்டையின் நகலை அடையாளம் மற்றும் முகவரிக்கான ஆவணமாக இணைக்கவேண்டாம் என கேட்டுக்கொள்ளப்படுகிறார்கள். இவ்வாறு அதில் கூறப்பட்டு உள்ளது.

The representations by private companies and the Information Technology Department seeking to exempt them from declaring a holiday on the day of the elections (May 16) cannot be accepted, Chief Electoral Officer Rajesh Lakhoni on Saturday clarified and said that it would not be possible, as it was against the law.

Mr. Lakhoni said, “The IT Department has received representations seeking an exemption. It is not possible and cannot be accepted, as it is against the law governing elections.”

Elaborating on the plea of these companies, he said, “They have claimed that they were running three shifts within 24 hours and hence if they declare a holiday for the entire day, all three shifts would be affected. They asked if there could be a partial holiday. But, going by the rule, the entire day of polling should be declared a holiday.”

Even in a meme tweet posted in its official twitter handle @TNelectionsCEO, to a query posed by a person, “Sir, last time many corporate companies didn’t announce holiday on election day. What abt this time..?”, the reply given by the CEO was, “It will definitely be done this time.”

It may be recalled that the National Association of Software and Services Companies (NASSCOM), the apex body for Information Technology and Information Technology Enabled Services industry, too had sent a letter to the Election Commission, requesting an exemption from full holiday on May 16.

28,000 polling booths

According to the Election Commission, around 28,000 polling booths would be web streaming and another 10,000 of them would be video recorded during the May 16 polls.

மீன் கண்ணைத் திறந்து கொண்டே தூங்கும் என்று படித்தேன். 'ஆச்சரியமாக இல்லையா?' என்று ஒரு நண்பர் கேட்டார். ""இல்லை... ஆச்சரியமே இல்லை... மனிதர்களில் பல பேரும் விழித்திருக்கும்போதே தூங்கிக்கொண்டுதான் இருக்கிறார்கள்'' என்றேன் நான். இதுதான் உண்மை.

நம்மைச் சுற்றி என்ன நடக்கிறது? எப்படி எப்படி எல்லாம் நாம் ஏமாற்றப்படுகிறோம்? சுரண்டப்படுகிறோம், கொள்ளையடிக்கப்படுகிறோம்... என்ற விழிப்புணர்வே பல பேருக்கு இருப்பதில்லை. ஒவ்வொரு கணமும் விழிப்பாக இருப்பவர்களே உன்னதமானவர்கள். சரியானவர்கள்.
