தீபாவளி பண்டிகையான நேற்று, காலை புத்தாடை அணிந்து, குடும்பம் சகிதமாக கோவில்களுக்கு சென்றனர். கிராமங்களில், கோவில் மற்றும் பொது மைதானங்களில் வெடி வெடித்து ஆரவாரமாய் பண்டிகை கொண்டாடினர். வீட்டில் தயாரித்த இனிப்பு, காரம் வகைகளை உறவினர்களுக்கும், நண்பர்களுக்கும், பக்கத்து வீட்டாருக்கும் பரிமாறி பண்டிகை மகிழ்ச்சியை வெளிப்படுத்தினர்.

தீ விபத்தில்லா தீபாவளி!கடந்த ஆண்டுகளை ஒப்பிடுகையில், இந்த ஆண்டில் பட்டாசு சத்தம் சற்று குறைவாகத் தெரிந்தது. கோவையில் கடந்த இரண்டு ஆண்டுகளாக தீ விபத்தில்லா தீபாவளியாக இருந்தது. இந்தாண்டு, தீயணைப்புத்துறை சார்பில் முன்னெச்சரிக்கை நடவடிக்கையாக பட்டாசு வெடிப்பது குறித்து விழிப்புணர்வு ஏற்படுத்தினர்.

தீ விபத்தை தவிர்க்க மாவட்டம் முழுவதும், 24 தீயணைப்பு மற்றும் மீட்பு வாகனங்கள் தயார் நிலையில் வைத்திருந்தன. ஆனால், இரு நாட்களில் தீ விபத்து ஏதும் இல்லை. அதனால், இந்தாண்டும், தீ விபத்தில்லா தீபாவளியானது.

கடலூர் பழைய வண்டிப்பாளையத்தை சேர்ந்தவர் குணசேகரன் (53). இவர் ஒரு விவசாயி. இவருடைய மாமனார் தண்டபாணி கடந்த 28 ஆண்டுகளுக்கு முன்பு இறந்து விட்டார். இந்த நிலையில் குணசேகரன் தன்னுடைய மாமனார் தண்டபாணி இறப்புச் சான்றிதழ் கேட்டு நீட்திமன்றத்தில் மனு அளித்திருந்தார்.

இதற்காக கடலூர் நகராட்சி அலுவலகத்தில் இருந்து அவருக்கு இறந்து போன தண்டபாணியின் இறப்பை பதிவு செய்யவில்லை என சான்றிதழ் தேவைப்பட்டது. இதனை அடுத்து குணசேகரன் நகராட்சி பிறப்பு - இறப்பு சான்றிதழ் பிரிவில் உதவியாளராக இருக்கும் கடலூர் அன்னவெளி மாரியம்மன்கோவில் தெருவைச் சேர்ந்த ராமன் (39) உதவியை நாடினார்.
பின்னர் அவரிடம் என்னுடைய மாமனார் இறப்பை பதிவு செய்யவில்லை என சான்றிதழ் அளிக்குமாறு கேட்டுக்கொண்டார்.

அதற்கு உதவியாளர் ராமன், குணசேகரனிடம் ரூ.3 ஆயிரம் இலஞ்சம் தந்தால் உனக்குச் சான்றிதழ் தருகிறேன் என்று திட்டவட்டமாக கூறியுள்ளார். மேலும் அவருக்கு சான்றிதழ் கொடுக்காமல் காலம் தாழ்த்தி வந்தார். பின்னர் இது பற்றி குணசேகரன் கடலூர் இலஞ்ச ஒழிப்பு துறை காவல்துறையினருக்குத் தகவல் தெரிவித்தார்.

இதைத்தொடர்ந்து இலஞ்ச ஒழிப்பு காவல்துறையினர் கூறிய அறிவுரைப்படி, இரசாயன பொடி தடவிய ரூ.3 ஆயிரத்தை கடலூர் நகராட்சி அலுவலகத்தில் பிறப்பு - இறப்பு சான்றிதழ் பிரிவில் இருந்த ராமனிடம் வெள்ளிக்கிழமை குணசேகரன் வழங்கினார்.

அப்போது அங்கு மறைந்து இருந்து கண்காணித்த இலஞ்ச ஒழிப்பு காவல்துறை இன்ஸ்பெக்டர்கள் சதீஷ், திருவேங்கடம், திருமால் ஆகியோர் ராமனை கையும், களவுமாக பிடித்து கைது செய்தனர்.

மேலும், ஏற்கனவே தயாராகி இருந்த 100 பிறப்பு - இறப்பு சான்றிதழ்களையும் இலஞ்ச ஒழிப்பு காவலர்கள் கைப்பற்றினர். அந்த சான்றிதழ்களை ஏன்? இன்னும் சம்பந்தப்பட்டவர்களுக்கு வழங்கவில்லை என்றும் இலஞ்ச ஒழிப்பு காவல்துறையினர் விசாரணை நடத்தி வருகின்றனர்.

இதில் நகராட்சி அதிகாரிகளுக்கு தொடர்பு உள்ளதா? என்றும் இலஞ்ச ஒழிப்பு காவல்துறையினர் விசாரணை நடத்தவுள்ளனர்.

HC rescues woman employee from fraudulent marriage

The Madras High Court has come to the rescue of a woman who was fraudulently shown as being married to a former colleague.

The court found that a human resources executive in a private firm, in which the woman was employed as an engineer, used documents she had signed for some other purpose to register a fictional marriage between them. The executive had obtained her signatures on some papers in the guise of giving her a transfer from Thoothukudi to Chennai.

Allowing a writ petition filed by the woman, Justice M. Govindaraj quashed the registration of the supposed “marriage” and directed the Marriage Registrar, Chennai North, to “delete, cancel and remove” the entry made on September 15, 2014 in the Marriage Register.

The judge said it would be “unfair” to direct the petitioner to go to a Family Court seeking declaration of the marriage as null and void since it would cause further mental agony to the woman who was already in distress.

He noted that the woman was recruited as a Trainee Engineer in a private power plant in Thoothukudi in 2014 and was desperate to get transferred to its Chennai office. The HR Executive, T. Mohamed Fahmi, took her to the company’s office at Egmore in Chennai and obtained signatures in a couple of papers on the promise of finding a suitable position for her.

Subsequently, he made a volte face, citing lack of vacancies in Chennai. The petitioner left the job in March 2015 as she was unable to cope with the work pressure in Thoothukudi.

It was only before the Assembly elections in May this year that the petitioner found that her name had been included in the voters’ list of Srivaikuntam constituency in Thoothukudi district, mentioning her as the wife of Fahmi.

On enquiry, she came to know that he had included her name as his wife in his passport as well as family card.

Further, probe revealed that such documents had been created on the basis of the registration of a ‘marriage’ that took place between them in the office of Chennai-based advocate K. Ameer Batcha and duly registered with the Registrar of Marriages.

Shocked over such allegations, the High Court on August 2 included the advocate as well as the Bar Council of Tamil Nadu and Puducherry as respondents to the case and ordered notices to them.

The Bar Council rushed to the court to inform that advocate Batcha “was a person known for his chamber activities of solemnizing and registering the marriages and that he had solemnized lot of marriages at the chambers and acted as a priest contrary to the oath taken before the Bar Council.”

However, neither the HR Executive Fahmi nor the lawyer Batcha entered appearance despite the court serving notice on them and the Bar Council contended that they would not appear before the court since the registration was per se illegal.

The petitioner’s counsel brought it to the notice of the court that the marriage had been reported to have been performed under Section 7A of the Hindu Marriage Act, 1955 which was a special provision with respect to solemnisation of self respect marriages between Hindu couples and not applicable to couples professing different religions.

High Court favours employment of widow of temporary worker

Empathising with the widow of a temporary municipality employee who died before his services could be regularised, the Madras High Court Bench here has directed the Commissioner of Paramakudi Municipality in Ramanathapuram district to sympathetically consider her plea for accommodating her in some temporary post as expeditiously as possible and communicate the decision to her.

A Division Bench of Justices M. Sathyanarayanan and J. Nisha Banu passed the order while dismissing a writ appeal preferred by the widow J.K. Shanthi challenging the refusal of a single judge to direct the Commissioner of Municipal Administration and that of the Municipality to disburse the terminal benefits due to her husband who had served as Pump Operator, in a temporary post, in the local body since August 16, 1989.

The Bench held that the single judge had rightly refused to issue such a direction since the petitioner’s husband J.R. Kannan had died on January 29, 2006 even before his services were regularised by the State Government on the basis of a proposal forwarded to it by the municipality. They also pointed out that he had lost the chance of regularisation by a whisker since other similarly placed employees got regularised on February 23, 2006.

On October 5, 2006, the petitioner made an application to the Commissioner of Municipal Administration seeking compassionate employment and on March 22, 2007 a petition was submitted to the Commissioner of Paramakudi Municipality demanding the terminal benefits due to her husband. Both the requests were rejected on the ground that those benefits could be accorded only with respect to permanent employees and not temporary staff.

16 cats kept for meat rescued in Chennai

CHENNAI: Police and volunteers of People for Animals (PfA) rescued 16 catsfrom a narikorava settlement in Pallavaram here on Friday. The cats were kept for their meat.

PfA volunteer Sagar Sheth, who was part of the operation, said they received information that pet cats were trapped by the narikorvas, who on weekends skinned them and sold the meat to roadside eateries in and around Pallavaram. The meat was used in biryani.

Two PfA volunteers visited the settlement on Thursday. They befriended a couple of narikorava youths and asked them to demonstrate how the cats are trapped and then skinned. The demonstration was recorded by the volunteers. Later, the footage was shown to the Pallavaram police, who agreed to rescue the cats from the narikoravas.

On Friday morning, the police and PfA volunteers went to the narikorava settlement. All the 16 cats were kept in a single cage, and they were not provided water to drink.

Pallavaram police inspector G Venkatesan said they had received complaints about pet cats being stolen from various residential areas and kept in narikorava settlement. "When the PfA volunteers approached us for help, our team went and rescued the cats," he said.

The rescued cats were sent to in the PfA shelter in Red Hills. PfA co-founder Shiranee Pereira said the rescued cats were visibly shocked and dehydrated. They were not fed regularly. This was evident from their aggressive behaviour. "It will take at least a month for the cats to recover from the shock and behave normally," she said.

Land encroachment: Court issues notice to Chennai doctor

CHENNAI: A Kancheepuram district court has ordered notice to a doctor for allegedly encroaching a land and constructing a house on it.

Hugo John Gozamo, 74, from Kollam in Kerala alleged that Dr V Dharmalingam of Adyar in Chennai encroached his land measuring 6,450sqft in Pillaipakkam village in Sriperambudur taluk in June 2013.

After constructing a house, the doctor offered to pay the prevailing land price to Hugo. The doctor had to pay Rs 35.97 lakh, out of which, he paid Rs 5.5 lakh in advance, and promised to pay the rest in two months. After paying a total amount of Rs 10 lakh by April 2015, the doctor refused to pay the remaining amount.

Dharmalingam also constructed a building for manufacturing Siddha medicine on Hugo's land after entering into a joint venture project with the department of AYUSH.

Hugo then approached the second district court, which granted an interim injunction and restrained the doctor from letting out the property to any third party. The matter has been posted on November 2 for further hearing.

10,000 homes in old Pallavaram will be affected by ASI boundary

Chennai: It is going to be a dull Diwali for over 10,000 homes in old Pallavaram as the ASI has announced plans to put up boundary stones after November 5.

This will make it impossible for the families to either sell their land or carry out alterations to their houses as the area comes under one of the 23 megalithic sites in Chennai. Speaking to TOI on Friday, residents who had been living there for over five decades said they were not able to conduct a wedding in the area or sell a part of their land as the area was an archaeological site. The Ancient Monuments and Archaeological Sites and Remains (Amendment and Validation) Act, (AMASR) 2010, is under implementation in the area, and this restricts any activity in monuments protected by the ASI.

The high court recently directed the ASI to identify archaeological sites and constructions within 100 to 300 metres of these and submit a report to the court on November 5 after a resident of Subham Nagar petitioned the court that he could not sell his land. Residents living on the megalithic sites on the city outskirts, including Pallavaram, Tambaram and Sembakkam, are among those affected.

"We have been living here for more than five decades. We cannot sell a part of our land to get our daughters married and the land rates have plummeted due to this ban. The court and the authorities should come to our aid and end this ban," said G Vijaya, a resident.

Pallavaram is home to 34,450 people, many of whom began constructing houses in the area about two decades ago. Residents of survey numbers 56 and 63, surrounding parts of Shubham Nagar, Zameen Pallavaram, KGK Nagar and Kamakshi Nagar are among those affected.
