It mandates that cases involving Ministers, MPs and MLAs require prior consent of Chief Justice

In an unusual move, the Madras High Court has issued a circular directing its officials in the principal seat of the court in Chennai as well as the Madurai Bench not to entertain cases in which Union as well as State ministers, Members of Parliament and Members of Legislative Assemblies have been cited as parties, without obtaining the prior consent of the Chief Justice.

P. Rajamanickam, Registrar (Judicial) of the principal seat of the High Court in Chennai, issued the circular dated March 21 with a clear direction that the Appeal Examiners and Heads of the Filing Sections of the Registry, both in Chennai and Madurai, should number the cases involving Ministers, MPs and MLAs only after getting the Chief Justice’s approval.

Time-consuming process

 “As directed by the Honourable Acting Chief Justice, all the Appeal Examiners/Heads of the Filing Sections of the Registry, both in the principal seat and the Madurai Bench, are hereby directed to submit the entire papers at the SR stage [the stage when a temporary number is assigned to a case] in respect of the cases wherein MLAs, MPs and sitting Ministers (both Central and State) are parties before the Hon’ble Chief Justice for Lordship’s approval and only after such approval, the same may be numbered,” the circular read.

The Registrar had also ordered that the instructions issued by him should be adhered to scrupulously by the officials concerned.

Surprised over the ‘peculiar’ circular, some court officials said that it would be a time-consuming process to send the case bundles filed in the Madurai Bench to Chennai and await their return with the approval before numbering those cases and listing them for hearing before the judges holding the portfolio concerned.

They pointed out that the instructions contained in the circular had already been adhered to with respect to a public interest litigation (PIL) petition filed recently with a plea to disqualify Chief Minister Edappadi K. Palaniswami, Minister for Forests Dindigul C. Srinivasan, School Education Minister K.A. Sengottaiyan, Cooperation Minister ‘Sellur’ K. Raju and Minister for Food and Civil Supplies R. Kamaraj for allegedly running the government at the instructions of convicted party leader V.K. Sasikala. “The entire case bundle related to that PIL petition filed by T. Analagan, son of former AIADMK MLA R. Thamarai Kani, was sent to Chennai in accordance with the circular and was numbered only after obtaining the CJ’s consent. However, when the case was listed before a Division Bench of Justices A. Selvam and N. Authinathan on Tuesday, they adjourned the hearing to April 11 for deciding its maintainability,” an official said.

He also pointed out that this was the first time that the High Court was insisting upon prior consent of the Chief Justice before entertaining cases in which Ministers, MPs and MLAs were parties. “The circular does not state that only cases filed against those Constitutional authorities require prior consent of the CJ. It states that all cases in which they were parties must be forwarded for approval. So we don’t know whether cases filed by those authorities as petitioners should also be sent for CJ’s approval,” he added.

Pointing out that the Appeal Examiners were well-trained in scrutinising the case papers before numbering them, another official said that the recent circular would only burden the Chief Justice with the additional work of going through the case bundles in which the Ministers, MPs and MLAs were parties.

Jio gets 72m paid customers under Prime membership

Reliance Jio announced 72 million paid subscribers on Friday, a day before the company starts billing customers.

The 4G-only company criticised by rivals for its freebies -decided to offer complimentary services for another three months under `Summer Surprise' plan. This would be for customers who sign up for its `Prime' offering and pay for the flagship monthly-billing scheme of Rs 303 or above before April 15. The next payment will need to be made in August, company officials said. The new scheme follows the company's two initial plans -`Welcome Offer' and `Happy New Year'.

To sign up for a Prime membership, a customer needs to pay Rs 99 as annual fee, and then opt for various recharge or monthly post-paid plans, starting from Rs 149.The Rs 303 plan was being touted very aggressively by the company as it guarantees unlimited data downloads across the month. “In just one month, over 72 million (and still counting) Jio customers have signed up for Jio Prime. We, at Jio, are honoured and grateful for this tremendous response,“ Reliance Industries chairman Mukesh Ambani said in a letter to the customers.

“Over the past few days, we have been deluged by millions of customers queuing up to purchase Jio's popular Rs 303 and other tariff plans. This nationwide trend indicates that very many customers are still in the process of purchasing Jio Prime and their first paid tariff plan,“ he said, after announcing a 15-day extension (till April 15) for customers to opt for the Prime plan.

Jio said users who do not recharge by April 15 will experience degradation andor discontinuation of services.Those who do not opt for Prime membership can still continue with the services by opting for non-Prime tariff plans, but these would come with lower benefits.

“In India, we have the fine tradition of Shagun -offering gifts on auspicious occasions. For us, your first recharge is an auspicious moment.Therefore, we want to offer a token of our appreciation and gratitude to all Jio Prime members... the Jio Summer Surprise,“ he said.

As part of this, every Prime member -when they make their first paid recharge using the Rs 303 plan or above --will get services for the initial three months on a complimentary basis. “Your paid tariff plan will be applied only in July , after the expiry of the complimentary service,“ Ambani said. “We will add another 1 lakh towers to our network in the coming months.“

Allow affected students to appear for entrance'





All medical aspiring students can now appear for NEET this year irrespective of age as the SC removed the age cap of 25 years, fixed by CBSE for taking the entrance examination. A bench of Justices Dipak Misra and A M Khanwilkar said the decision taken by CBSE to fix upper age limit on the administrative instruction of Medical Council of India seemed wrong and students should not be barred from appearing in the entrance examination.

The court directed CBSE to open a window till April 5 for those above 25 years to apply for the NEET which is scheduled for May 7. The bench agreed with the submission of the ag grieved students who contended that the decision taken by the Board was illegal and unconstitutional as there were no rules or regulations for fixing upper age limit for medical entrance examination. Senior advocates Amrendra Sharan and Indu Malhotra, appearing for the students, told the bench that about 20,000 candidates were hit due to age restrictions and pleaded the court to allow them to appear for NEET.

“As we, prima facie, find, such an age limit could not have been determined by way of a notice on the basis of the instructions issued by the Medical Council of India. It is appropriate to direct that all the desirous candidates will be allowed to fill up the forms on the online portal of CBSE on or before April 5. Any form submitted beyond April 5 shall not be accepted,“ the bench said.
The court asked CBSE to take steps to make arrangements to allow the affected students to appear for the entrance test and provide additional centres to accommodate them. “...the collector of the concerned district or the commissioner of the city whoever is the authority will extend all the support so that the forms are accepted and the examinations are held on the date fixed by making different centres available,“ the bench said.

“CBSE shall be bound by the order passed by this court as far as the cut-off date is concerned. No high court in the country shall interfere with regard to any litigation pertaining to choosingallocation of centres,“ the court said.

Students' Job, PG Prospects In Question 

 

An engineering course is the primary benchmark for companies recruiting candidates with technical qualifications but fewer than 8% of engineering colleges in Tamil Nadu, which churns out graduates by the thousands, offer National Board of Accreditation (NBA)-approved courses. Of the 650 engineering colleges in Tamil Nadu, in cluding more than 540 colleges affiliated to Anna University, not a single course offered by 600 colleges has NBA accreditation.
All India Council for Technical Education (AICTE), the central body under the Union HRD ministry that oversees technical education nationwide, established NBA specifically to grant engineering colleges course-specific accreditation.

But a majority of engineering institutions in the state have long flouted the NBA stamp. NBA has accredited only 220 of around 3,000 courses (around 7%) that deemed and state-affiliated engineering colleges in Tamil Nadu offer.

Experts say this will have an adverse impact on graduates from engineering colleges in the state, restricting their employment opportunities in an increasingly competitive job market and their chances of admission to premier colleges abroad for postgraduate degrees. “National Board of Accreditation is entirely outcome-based and has done away with the old system of ranking based on students' grade point averages (GPAs),“ NBA accreditation team chairman G P Prabhukumar said. “It prescribes a comprehensive list of several parameters that each course must to fulfil in order to be graded. If an institution wants civil engineering [course approval], it has to show grades, projects, placements, professional performance of students, faculty research, etc for that course.“
“An institution has to score a minimum of 600 on 1,000 points in the assessment stage to receive a three-year accreditation period from NBA,“ he said. “ A score of 750 would extend this to six years. But colleges that don't meet the standards often circumvent this.“

Prabhukumar attributes colleges giving accreditation the go-by to the profitability of set ting up engineering colleges, leading to their proliferation over recent years.

Experts say a lack of course accreditation will lower the employability of students. Anna University former vice chancellor M Anandakrishnan said most engineering colleges only have NAAC accreditation.NAAC assesses and grades the quality of an institution on the whole and does not make course-specific evaluations.

“Recruiters prefer students with accredited courses, especially now with engineering jobs being at a premium,“ Anandakrishnan said, adding that for students aspiring to postgraduate degrees abroad, in universities of their choice, accreditation could be a make-or-break factor.
In several countries, he said, it is a legal requirement to hire only students who have completed accredited courses and are from approved institutes. That way , he said, is the only way for companies to ensure quality in recruitment of engineers.
