PG medical admissions: Setback for unaided minority colleges

Court says seats should be given based on NEET merit list

In a setback to unaided minority medical colleges, the Karnataka High Court on Thursday made it clear that admission to all postgraduate medical courses has to be made through a Common Counselling Authority under the Medical Council of India’s (MCI) regulation, on the basis of the merit list of the National Eligibility-cum-Entrance Test (NEET), irrespective of whether the medical institutions are run by minorities or non-minorities.

“In view of MCI’s Regulation 9A, no admission to postgraduate medical courses under any kind of quota, like Scheduled Castes, Scheduled Tribes, Other Backward Classes, non-resident Indians, management quota etc., can be made without the seat being allotted by the Common Counselling Authority on the basis of merit list of the NEET,” the court clarified.

A Division Bench comprising Justice H.G. Ramesh and Justice John Michael Cunha passed the interim order while rejecting an application filed by Bengaluru-based St. John’s National Academy of Health Sciences for vacating the stay order against admitting candidates to PG course based on its own admission procedure.

The academy had claimed that it had right to prescribe its own admission process as the Article 30(1) of the Constitution provides liberty to minority communities to establish and administer educational institutions.

Citing apex courts verdicts, the Bench said that it is now well settled that rights conferred under Article 30(1) of the Constitution are “not absolute” but they are “subject to regulatory measures for the maintenance of standards and excellence in education, which are necessary in the national interest”.

Rachana Kishore Ubrangala, an MBBS graduate from Mangaluru, had questioned the academy’s own selection process, which include practical test score and marks for interview in addition to the NEET ranking, while complaining that those ranked below her had found place in the selection list.
The Bench said that the “common counselling mandated under Regulation 9A will check minority and non-minority institutions from choosing students arbitrarily from within the sources they are entitled to choose from”.

Meanwhile, the Bench permitted the academy to participate in the common counselling and to admit students for the academic year 2017-2018 on allotment of seats. The Bench also permitted the students stated to have been given admission to the academy to participate in the counselling, subject to they fulfilling eligibility criteria.

However, the Bench said that an unaided minority medical educational institution is entitled to indicate its choice of preferences, with regard to status of minority candidates, to the common counselling authority to fill up its entire sanctioned intake while making it clear that the State does not get any right under Regulation 9A to appropriate any seats available for admission in an unaided minority medical educational institution.
The Court adjourned further hearing to decide the question on whether the MCI’s regulation 9A is legal or not.

More seats for State students in PG medical, dental courses


Additional 363 medical, 173 dental seats from pvt. colleges, deemed universities

Nearly 64% of the total 2,281 postgraduate medical seats and 55.54% of the 929 postgraduate dental seats in the State have been reserved for students from Karnataka.

With the State government implementing the Karnataka Professional Educational Institutions (Regulation of Admission and Determination of Fee) Amendment Act, 2017, which mandates that 30% of the seats under the institutional quota should go to Karnataka students, the number of seats for State students in private colleges and deemed universities has shot up.

With this move, an additional 363 medical seats and 173 dental seats from private colleges and deemed universities are available for Karnataka students. This is in addition to the 1,096 government quota medical and 343 dental seats available for State students. All the seats will be available in the centralised counselling, which will be conducted by the Karnataka Examinations Authority (KEA) currently under way for PG seats for the 2017-2018 academic year.

However, students choosing seats that are part of the institutional quota will get no concession with regard to the fees. They will have to pay the fees based on the consensual agreement signed by colleges with the government in case of private colleges and deemed universities.

Minister for Medical Education Sharan Prakash Patil, at a press conference on Wednesday, had said that this clause was brought into the Act with the advent of the National Eligibility cum Entrance Test (NEET), which came into effect for medical and dental seats for the 2016-2017 admissions. “We did not want students from our State to be at a disadvantage,” he said. However, if the number of Karnataka students is less, then other students can be admitted in the institutional seats.

Postgraduate seat aspirants have welcomed the move and feel it would help them bag seats in medical colleges in the State. Shwetha S., who is aspiring for a PG medical seat, said, “With NEET, the seats in medical and dental colleges in the State are open to students across the country, so this reservation will help in ensuring the interests of students from the State.”

 Crematorium in Chennai to go hi-tech with free Wi-Fi

 It will help live stream the last rites being performed

After all the announcements on free wi-fi at various public places, here’s the last place you’d expect to have the service — literally, the place where the dead go.
A crematorium on New Avadi Road, Anna Nagar, is all set to go hi-tech with a free wi-fi facility from Saturday.

While jokes have been cracked about whether this would allow communication with the dear departed, the organisers say that it serves a practical purpose.

The free wi-fi will help relatives of the deceased to live stream the last rites being performed at the crematorium back home or to relatives living abroad, and others who were unable to attend the funeral.

The facility will be inaugurated at the Greater Chennai Corporation Velankadu crematorium that is managed by the non-governmental organisation, Indian Community Welfare Organisation.
Its founder secretary, A.J. Hariharan, said the idea came to him after a recent incident where an old lady staying in London could not attend the funeral of a close relative in Chennai. Other relatives took pictures to send to her in London.

“This is when I thought about this option. If we provide free wi-fi here, then, a number of people might like to use it to stream videos of the proceedings to those who, for any reason, cannot be present.”


“This will also help relatives and friends living abroad to virtually visit the crematorium to view the proceedings through live streaming. We are getting high speed internet connectivity which will enable streaming. Also, we figured people can share the location of the crematorium with a GPS pin on social media sites, to help others reach the spot.

Sponsorship for one year

About 20 people will be able to use the facility during the working hours of the crematorium (8 a.m.- 6 p.m.). As of now, we have paid up for a year, thanks to our sponsors,” Mr. Hariharan said.
The facility is being sponsored by the Rotary Club of Meenambakkam for one year.
It would be extended to more hours depending on the patronage, said Mr. Hariharan.
There are also plans to facilitate live telecast some funerals on the web in the coming months, with the concurrence of the relatives, he added.
PUBLISHER IN SOUP - HRD minister condemns `sexist' text, orders action

On the back of a public outcry, HRD minister Prakash Javadekar called the description of a “perfect female body“ in a Class XII textbook as “sexist“ while ordering action against the pri vate publisher which has since decided to stop the printing and sale of the book. Excerpts from the `Health and Physical Education' book, authored by Dr V K Sharma, defining “36-24-36“ as the “best body shape for females“ went viral on social media on Wednesday, triggering demands that it be withdrawn.

“I condemn the remarks in the book as sexist. The text is non-defensible and unacceptable. We have taken serious note of it. I have instructed the officers to take appropriate action,“ said Javadekar. “We have taken strong exception to the news that a book for Class XII students has some sexist remarks ...This is not an NCERT book, neither it is an NCF compliant book. It is a private pub lisher's book and the matter is going to be probed,“ he said.

“This is the reason why we are urging the schools to subscribe to NCERT books and not go for books by private publishers,“ the minister said.

The book published by the New Saraswati House (NSH) gives graphic description on perfect body shape for a woman and man.

Javadekar said all efforts are being made to make NCERT books available on time which are “less expensive and of better quality“.

Earlier, Anil Swarup, secretary in the department of school education, MHRD, tweeted: “Neither a book approved by CBSE nor published by NCERT. Action to be taken against pvt publisher.“
College cut-offs may fall as HRD plans end to grace marks

The cutoffs for undergraduate admissions may come down if a consensus is reached among the various education boards in the country on the practice of awarding grace marks. The ministry of human resource development is planning to consult the states on scrapping the practice of awarding grace marks in certain papers if the questions are deemed to have been difficult.
 
The move comes after the Central Board of Secondary Education (CBSE) in December 2016 resolved to seek MHRD's help to get all state boards to develop a consensus on ending the marks moderation policy which leads to inflation of scores. Under the “moderation“ policy , examinees are awarded up to 15% extra marks in certain papers if the ques tions are deemed to have been difficult. In July 2016, TOI highlighted how CBSE gave as many as 16 extra marks in the Class XII maths exam this year in the all India set of papers and 15 marks in the Delhi set during the process of standardisation.

In nine subjects, marks were `standardised' by CBSE by more than 10%. As a result of the standardisation, a student with 77 marks in mathematics may have ended up getting 93 marks on the result sheet. Similarly, a student of business studies who would have otherwise got 80 marks, may have finally got as much as 92 marks in the subject.

According to senior CBSE official, a unilateral scrapping of moderation would put its students at a disadvantage during undergraduate admissions and considered it important that all state boards agree to it
.
According to an official, “The ministry has called a meeting of all education secretaries and chairpersons of state boards on April 24 and the issue is likely to be taken up there. The CBSE recommendations will be taken into account and we will see if a consensus can be arrived at with the states.“
Magistrates cannot direct issue of birth|death certificates: HC

The Madras high court has unearthed a mega racket where touts, lawyers, judicial magistrates and unscrupulous litigants worked like a well-oiled machine to produce more than 4 lakh birth and death certificates without verification. A total of 4,13,751 applications had been ordered by various magistrates in Tamil Nadu from April 1, 2014 to September 30, 2015.
 
A shocked division bench of Justice S Nagamuthu and Justice PN Prakash has now banned judicial magistrates from directing revenue and corporation officials to issue birth and death certificates.Any such certificates issued in that manner after January 25, 2017 would be invalid, it said.
The racket works like this: `A' writes to corpora tionrevenue department saying his birth in a particular year is to be registered, and hence a certificate shall be issued. The department issues a `not traceable' certificate. Using it, `A' places an advertisement in a daily , and when no objection is received, files application in a judicial magistrate court, which directs officials to issue birth certificate bearing a particular date of birth.

The bench stumbled upon the racket after a Srivilliputtur man moved a magistrate court to obtain a birth certificate for his son, so that it could be used in a criminal case where his son was an accused. It would have helped the man's son evade life imprisonment, in the event of conviction, since he would be a `juvenile' now.

“Over a period of time, the legal fraternity has evolved “birth and death jurisprudence,“ said the bench, adding, “birth certificates so obtained are mostly used for extending the date of superannuation or to set up claims of juvenility in criminal cases.“
Holding that only executive magistrates can issue such certificates, the bench directed the government to issue necessary guidelines to executive magistrates who shall obtain reports from village administrative officers or revenue inspectors and conduct inquiry before issuing certificates.
Karnan summons CJI, 6 SC judges to his `home court'

In a move probably unprecedented in the country's legal history, Justice C S Karnan of the Calcutta high court said on Thursday that he had passed an order asking Chief Justice of India J S Khehar and six brother judges of the Supreme Court to appear before him at his residential court in Kolkata on April 28.
 
CJI Khehar and the six other judges had earlier initiated contempt proceedings against Justice Karnan and summoned him to appear before them on March 31. The constitutional bench had also issued a bailable arrest warrant against Justice Karnan.

“On 28.04.2017 at 11.30am, the Hon'ble seven judges as mentioned above will appear before me at my Rosedale Residential Court and give their views regarding quantum of punishment for the violation of the Scheduled Castes and Scheduled Tribes Atrocities Act,“ Justice Karnan told reporters.

The `suo motu judicial order' was passed from his residence which, the judge said, has now become his “makeshift court at Rosedale, New Town, Kolkata 700160“. Justice Karnan also told reporters that the seven judges on the bench that initiated contempt proceedings against him insulted him “wantonly and deliberately and with mala fide intention“. In his signed order, Justice Karnan has stated that on March 31 he had “pronounced a judgment wherein the hon'ble seven judges are accused under the Scheduled Castes and Scheduled Tribes Atrocities Act, 1989.

Justice Karnan's order further states that the CJI had raised a question regarding his mental health on March 31 and this was endorsed by the six other judges in the bench.The seven judges had insulted him by raising this question in the the open apex court, Justice Karnan claimed.
“The CJI also mentioned to me that I am not having a clear mind, hence the suo motu contempt proceeding is being adjourned for four weeks so I may clear my mind. This is an additional big insult to me in the open apex court and the same was endorsed by the six other hon'ble judges,“ Jus tice Karnan added.

This extraordinary tussle within the country's judiciary had started a few months ago after Justice Karnan had written letters to the CJI and Prime Minister, alleging that seven high court judges were corrupt. This had prompted the Supreme Court to initiate contempt proceedings against him.
After Justice Karnan spoke out against this, his judicial and administrative powers were withdrawn and he was asked to appear before the constitutional bench.When he refused to comply , the Supreme Court issued that warrant and directed the director general of police, West Bengal to execute it to ensure Justice Karnan's presence before the bench on March 31.

Justice Karnan did appear before the constitutional bench on March 31but reiterated his charges against the seven judges.
