'மொபைல் போன் எண், வங்கிக் கணக்கு போன்றவற்றுடன், ஆதார் எண்ணை இணைக்க வேண்டும். 'பல்வேறு சமூக நலத் திட்டங்கள், மானியங்கள் பெறுவதற்கும் ஆதார் குறிப்பிடுவது கட்டாயம்' என்பது போன்ற மத்திய அரசின் உத்தரவுகளை எதிர்த்து, உச்ச நீதிமன்றத்தில் பல வழக்குகள் தொடரப்பட்டுள்ளன.

ஆதார் தொடர்பான வழக்கில், 'தனிநபர் சுதந்திரம், ஒருவரது அடிப்படை உரிமை' என, ஒன்பது நீதிபதிகள் அடங்கிய அமர்வு, சமீபத்தில் தீர்ப்பு அளித்திருந்தது.

Salem: Just recovering from a scary dengue sweep, this time it was ironically the turn of nurses to turn 'patients' at the Mohan Kumaramangalam government hospital in Salem. A good number of a group of 50 trainee-nurses of the government hospital turned in-patients on Thursday, with symptoms of vomiting and giddiness after they had taken dinner at the hostel mess, sources said.

About 300 trainee-nurses are staying in the hostel attached to the Salem government hospital. But 50 of the nurses suddenly took ill after they had taken dinner at the hostel mess late on Wednesday evening. Even as some of them suffered from diarrhea, a few hours after the meal, the affected nurses were all rushed to the government hospital early today.

As the health condition of 13 nurses worsened due to continuous vomiting, they were admitted as in-patients and are being treated. Nurses alleged that food poisoning in the hostel dinner possibly caused the illness and based on their complaint, officials have begun an inquiry with the hostel authorities.

Chennai: The District Consumer Disputes Redressal Forum, Chennai (North) has directed a private hospital to pay compensation of Rs 2.05 lakh to a woman for issuing her husband's medical records 10 months after his death following treatment in the hospital. In the petition, R. Mahalakshmi of Indira Nagar, Chrompet submitted that her husband V. Ravichandran and his brother met with an accident on July 4, 2010, near Vellappan Chavadi. Immediately, he was rushed to Vee Care Hospital, Thirumangalam, Anna Nagar. Ravichandran had swelling on his right knee and was unable to walk. He had no external injuries, no bleeding or any grievous injuries and he was very much conscious.

However, the hospital informed that immediate surgery was necessary. The surgeons performed operation and fixed a plate on his right leg. He was under the post-operative care in the hospital. Suddenly doctors informed that July 8, 2010 at 5.pm that he must be shifted to ICU for further treatment and an hour later they declared that he was dead.

She alleged that the hospital failed to provide proper medical care to him during the post-operative period and they allowed Ravichandran to develop fat embolism. The hospital was negligent in the procedures right from making entry in the accident register, obtaining the consent, post-surgical treatment procedures adopted by him.

Besides this, the hospital had not provided the medical records to her, even after repeated request. After a long struggle the hospital provided the documents to her. Later, she issued notice and filed this complaint claiming compensation for causing her mental agony and hardship.

In its reply, the managing director of Vee Care Hospital, denied the allegation and said that after surgery her husband was shifted to post-operative ward and his vital parameters were normal. Fat embolism would develop in the case of bone fracture and it happens only in some cases.

On July 8, 2010, he complained of chest pain breathlessness and collapsed around 5.45 p.m. He did not respond to resuscitation and he was declared dead at 6.30 p.m. The best treatment was provided to him and he died on account of cardiac arrest arising out of fat embolism. The hospital had not committed any negligence and deficiency in service and sought to dismiss the complaint with costs.

The bench comprising president K. Jayabalan and member M.Uyirroli Kannan said the hospital had not committed negligence in treatment accorded to Ravichandran. But, hospital furnished medical documents to her after a long struggle. Hence, the hospital committed deficiency in service for not furnishing the documents required by her immediately. The documents were furnished to her ten months after his death. The bench directed the hospital to pay Rs 2.05 lakh to her for providing the documents belatedly.

Bar council: 39,000 lawyers in Tamil Nadu may lose practice, vote

CHENNAI: In the biggest ever attempt to purify its rolls, the Bar Council of Tamil Nadu and Puducherry has announced that more than 39,000 lawyers would be suspended from practice as they were yet to complete their enrolment verification process and pay subscription fee for the advocates welfare fund. These lawyers will also become ineligible to contest or vote in any Bar council election, it said.

Advocate-General Vijay Narayan, who is chairman of the special committee of the council, said: "More than 30,000 lawyers had not subjected themselves to scrutiny; 9,000 advocates who have enrolled before April 1, 1993 have failed to pay their subscription fee for welfare scheme." 'Of 86K lawyers enrolled with council, only 56K submitted certificates for verification'

Notices have been issued to all those lawyers to pay their subscription and arrears with a token fine to avoid suspension, advocate-general Vijay Narayan said.

This apart, he added that efforts have been taken to cleanse the electoral rolls with dedicated committees comprising of designated senior advocates.

Though the Supreme Court had directed the state Bar councils to publish the electoral list by November 30 and hold the elections by December 31, a plea has been made by the council to provide more time.

Narayan also said that out of 86,000 lawyers enrolled with the council, as many as 56,000 submitted their certificates for verification, whereas the remaining 30,000 had not bothered to subject themselves for scrutiny.

The chairman also pointed out that 152 lawyers who have failed to clear the All India Bar Examination have been suspended and out of the 400 criminal cases pending against advocates as many as 56 cases have been referred to the newly created disciplinary committees for quick disposal.

Already, Bar Council of Tamil Nadu and Puducherry has issued prohibitory orders against a total of 742 advocates, as they had obtained a law degree without the mandatory requirement of a foundation degree. The decision was made under Rule 5 of the Legal Education Rules, 2008 and in the light of the order passed by Madras high court on October 25.
