HC: Pregnant docs entitled to incentive marks in PG courses

Chennai: A division bench of the Madras high court has ruled that doctors, who availed maternity leave while working in remote and difficult areas, are entitled to obtain incentive marks for their post graduate courses. A division bench comprising of Justice Huluvadi G Ramesh and Justice M Dhandapani said, “The intention of the government to give incentive marks to in-service candidates for their services rendered in remote/hilly/difficult areas, taking note of the personal risk they would undergo in such areas, is a noble one.”

A group of in-service candidates filed a petition stating that they are entitled to avail maternity leave and related benefits and the leave period would be counted as service while pursuing PG courses. They claimed that the same yardstick should be applied for grant of incentive marks.

Opposing this, additional advocate general S T S Murthy said their absence during maternal leave would have an impact on the healthcare of poor people in these areas. Justice N Kirubakaran earlier said maternity leave should be treated as service period. Justice S Vaidyanathan in another case accepted Kirubakaran’s contention. TNN

HC enhances ₹20L relief to ₹45L for bilateral amputee

Chennai: The Madras high court recently enhanced the compensation awarded to a bilateral amputee from ₹20 lakhsto₹45lakhs, ashehasto depend on another person even for day-today tasks such as to attend nature’s call.

R Nagaraj, 32, who was a cleaner-cum-load man for a mini lorry, sustained severe injuries in a road accident involving a Karanataka State Road Transport Corporation (KSRTC) bus and a two-wheeler in 2009.

The accident was reported on Hosur-Bengaluru Highways. Both his legs had to be amputated in the subsequent surgical procedures during treatment.

Three years later, the Motor Accidents Claims Tribunal, Chennai awarded a compensation of ₹20.9 lakh to the accident victim.

Following this, the insurance firm, New India Assurances Company Limited which was to bear the costs, filed a civil miscellaneous appeal with the Madras high court against the tribunal’s order.

Hearing this petition last week, the division bench comprising Justices N Kirubakaran and R Pongiappan enhanced the compensation to ₹45 lakhs, as he would not bein a position to moveon his own and has to depend on attendants even for nature’s calls for the rest of his life.

Referring to a Supreme Court judgement, the bench said that the enhanced amount includes ₹10 lakhs towards attendant charges and nursing expenses, and another ₹5 lakhs to Nagaraj’s wife for loss of material pleasure.

The high court bench asked the insurance firm to deposit the entire amount or due amount (if a compensation has been paid already), along withinterest,tothe victim’s bank account within four weeks from the date of receipt of the order copy.

Cancel bail for Subbiah murder suspect: Plea

Chennai: A police inspector, investigating the sensational Dr Subbiah murder case, filed a petition in the Madras high court on Saturday, seeking to cancel the bail granted to one of accused in the case.

Subbiah was murdered in broad daylight by hired goons near Billroth Hospital at R A Puram in 2013. A case filed against 10 persons, including advocate B William, is under trial. Abhiramapuram inspector P Raja claimed in his plea that William tried to threaten and coerce a witness, Bensam, by offering him ₹10 lakhs for turning hostile, and warnedof direconsequenceif he deposed against them. Cops register case against S Ve Shekher, no arrest yet

Chennai: The cybercrime wing of the city police has registered a case against actor-turned politician S Ve Shekher under three IPC sections for posting inflammatory remarks about a woman journalist who complained against governor Banwarilal Purohit for patting on her cheek at a press conference early this week.

The cybercrime wing police registered a case based on the complaint of the journalists association and slapped a case against the BJP member under IPC Sections 504 (intentional insult to provoke breach of the peace), 505 (1) (c) (with intent to incite, or which is likely to incite, any class or community of persons to commit any offence against any other class or community), and 509 (Word, gesture or act intended to insult the modesty of a woman), and Section 4 of TN Prohibition of Women Harassment (Prevention) Act.

It all started when Shekher shared a derogatory Facebook post on women in media.

After huge criticism, he deleted the post and issued an apology.

Meanwhile, the police have registered a case against 30 journalists for throwing stones at Shekher’s house in Mandaiveli during a protest on Friday. A maid employed at the house was injured in the act.

While the agitations have been escalating everyday demanding the arrest of Shekher in the woman harassment case, a posse of police personnel deployed at Shekher’s house on Saturday evening created flutter in the political circle that Shekher may be apprehended. 





Can’t reject edu loan due to kin’s debt: HC

Madurai: The Madurai bench of the Madras high court has warned banks against rejecting educational loans based on the credit report of the applicant’s family, saying such actions would attract contempt of court proceedings.

Allowing the plea of M Hariharasudhan, the court asked Indian Bank to direct all its branches in TN to refrain from rejecting educational loan applications citing reasons outside the scope of the Centre’s scheme. Justice M S Ramesh said the court was constrained to observe that nationalised banks had been rejecting loan applications citing the CIBIL (Credit Information Bureau (India) Limited) reports of the student’s family members. “In my view, such reasoning would amount to wilful disobedience of the orders of this court, for which the concerned bank would be liable for contempt.”

‘Scheme was passed by Centre to help meritorious students’

The judge said the educational loan scheme was introduced by the central government with an objective to help meritorious students pursue his or her education with financial support from the banking system under reasonable terms and conditions. The student was the principal borrower and the loan was to be solely utilised for educational needs.

Hence, any reasonable restrictions imposed by the financial institution had to conform with the scheme’s objective.

“Any factor which is beyond the scope of the scheme as a bar for availing the loan could only be deemed to be prima facie illegal,” said the court while directing the Indian Bank’s branch at New Vilangudi in Madurai to positively consider the student’s plea in two weeks.

The petitioner who joined a five-year law course in a private institution had demanded ₹3.5 lakh as loan including ₹70,000 for the academic year 2017-18. As his application was not considered on time, he knocked on the doors of the judiciary. During the hearing, the bank’s counsel said that it had raised two clarifications with the petitioner – the reason for a year’s delay in admission to the course and the CIBIL report stating that the boy’s father’s score was 570 (which meant that the petitioner’s father might have committed default in repayment of money to either a bank or any trader

(s)). Hence it was unable to proceed any further on the boy’s request.
