சென்னை : 'உயிரை காப்பாற்றும் டாக்டர்கள், வேலை நிறுத்தத்தில் ஈடுபடலாமா; போலீசார், துப்புரவு பணியாளர்கள் வேலை நிறுத்தத்தில் ஈடுபட்டால், நாடு என்னவாகும்' என, சென்னை உயர் நீதிமன்றம் கேள்வி எழுப்பியது.

நோயாளியை கவனிக்காத அரசு டாக்டர் தாக்கப் பட்டதை கண்டித்தும், போராட்டத்தில் ஈடுபட்டதை எதிர்த்தும், ௨௦௧௭ல் குமரன் என்பவர் வழக்கு தொடுத்தார். மனு தாக்கல்பயிற்சி டாக்டர்களின் வேலை நிறுத்தத்தை எதிர்த்து, வழக்கறிஞர் வேலன் என்பவர், வழக்கு தொடுத்திருந்தார்.தற்போது நடக்கும் டாக்டர்களின் போராட்டம் முடிவுக்கு வர, நடவடிக்கை எடுக்கக் கோரி, வழக்கறிஞர் சூரியபிரகாசம் மனு தாக்கல் செய்தார்.

இம்மனுக்கள், நீதிபதிகள் எம்.சத்தியநாராயணன், என்.சேஷசாயி அடங்கிய, 'டிவிஷன் பெஞ்ச்' முன், நேற்று விசாரணைக்கு வந்தன.அட்வகேட் ஜெனரல் விஜய் நாராயண் ஆஜராகி, ''போராட்டத்தை வாபஸ் பெறுவதாக, டாக்டர்கள் அறிவித்துள்ளனர். அவர்களுடன் பேச்சு நடக்கிறது,'' என்றார்.இதையடுத்து, நீதிபதிகள் கூறியதாவது: போராட்டம் நடத்தக்கூடாது என, முழுமையான தடை ஏதும் இல்லை. அதேநேரத்தில், உயிரை காப்பாற்றும் பணியில், டாக்டர்கள் உள்ளனர்.

அதற்கு நீதிபதிகள், 'சுகாதாரம் குறித்து மக்களிடம் விழிப்புணர்வு வர வேண்டும். சாலைகளில் குப்பை கிடக்கிறது. முதல்வர் வீட்டின் அருகே கூட, குப்பை குவிந்து கிடக்கிறது. நாங்களும், அந்தப் பகுதியில் தான் இருக்கிறோம். குப்பையை அகற்றா மல் உள்ளனர்' என்றனர்.உடனே குப்பையை அகற்ற நடவடிக்கை எடுப்பதாக, கூடுதல் அட்வகேட் ஜெனரல் தெரிவித்தார். இதையடுத்து, இரண்டு வாரங்களுக்கு விசாரணையை, நீதிபதிகள் தள்ளி வைத்தனர்.

Rajasthan High Court held that MCI can distinguish Between Persons with Disabilities In MBBS Admissions

The Rajasthan High Court allowed the Medical Council of India (MCI) to distinguish between persons with disabilities for the purpose of admission in MBBS course.

On February 2, 2019, MCI promulgated the Regulation on Graduate Medical Education (Amendment), 2019 (the Regulation). As per Annexure H of the Regulation, candidates with locomotive disorder of upper limb disability or upper limb deformity are not eligible to pursue MBBS course. 


Based on the Regulation, the Petitioner, Manohar Lal Swami, who had qualified NEET, 2019 Examination in the OBC (NCL) category under PWD quota, was denied admission to MBBS. The Petitioner has congenital left upper limb disability (40% benchmark disability) and does not have the left thumb.

Finding merit in the Respondent’s arguments that it was the duty of MCI to ensure that aspiring students possess minimum functional abilities/ competencies which are required to complete the training programme of MBBS satisfactorily and that the patients are also safe under the care of such medical graduates, the division bench of Justice Mohammad Rafiq and Justice Narendra Singh Dhaddha dismissed the petition. The court concluded that”…the MCI can distinguish between various persons with disabilities for the purpose of admission in MBBS course and such determination by the MCI shall not be in conflict with the provisions of the Act of 2016″.
Signed carbon copy of document is permissible evidence, says SC

A signed carbon copy of a document prepared in the same process as the original is admissible as primary evidence, the Supreme Court has held in a recent order.

A Bench of Justices Deepak Gupta and Aniruddha Bose clarified the law while setting aside a Punjab and Haryana High Court decision of January 15 that a carbon copy signed by the parties in a dispute cannot be treated as primary evidence under Section 62 of the Indian Evidence Act.

The Section says “primary evidence means the document itself produced for the inspection of the court.”

Second explanation

The apex court has applied the second explanation in Section 62 in this case, which states: “Where a number of documents are all made by one uniform process, as in the case of printing, lithography, or photography, each is primary evidence of the contents of the rest.”

The Evidence Act also gives an illustration: “a person is shown to have been in possession of a number of placards, all printed at one time from one original. Any one of the placards is primary evidence of the contents of any other, but no one of them is primary evidence of the contents of the original.”

The High Court had dismissed the case, saying there was no substantial question of law involved.

Allowing the appeal, the Supreme Court disposed of the case, which is a civil appeal between two private parties, and remitted it back to the HC.

“It is for the High Court to decide whether any substantial question(s) of law arises and the appellant before us is entitled to any relief or not,” the court ordered.
Air India’s Chennai-Jaffna flight service postponed by 10 days
Some paperwork and approvals need to be done: official

The -Jaffna international flight service of Air India’s Alliance Air, which was scheduled to kick off operations from November 1, has been delayed by about 10 days “due to paperwork and certain issues that are being sorted out,” according to officials.

“There is some paperwork going on at the moment and certain approvals need to be got,” an Air India official told The Hindu. “Since this is between two countries, a few issues are also being sorted out,” the official added.

“We will be finalising the date soon and we will give a couple of days for opening the booking process and make the necessary announcements soon,” the official said. A spokesperson for Alliance Air said a detailed announcement on the final plan would be made on November 4.

Air India officials, on the day of the inaugural flight on October 18, had spoken of a tax proposed by Sri Lanka on departing flights from the island to the tune of ₹3,000 per passenger. This tax, they reasoned, would make it expensive for people to travel on this route that was finalised keeping in mind the volume of traffic expected between the two destinations.

Sri Lanka’s plan is to make Jaffna airport a gateway to the rest of the world for the majority Tamil populace of the region and ease traffic at Colombo airport.
TTD releases online quota for February

The TTD on Friday released the online quota of 69,512 tickets for the month of February. Of these, while 1,01,112 tickets relating to Suprabhatam, Thomala and Archana, Ashtadala Padapadmaradhana seva and Nijapada darshanam tickets can be availed by way of online dip system, the rest will be made available under the general category.
Suspension of MKU exam official stayed

The Bench of the Madras High Court on Friday stayed the suspension order of M. Rajarajan, Additional Controller of Examinations, Directorate of Distance Education of the Kamaraj University (MKU). He was allegedly involved in a certificate scam.

Taking up the petition filed by Mr. Rajarajan, Justice V.M. Velumani granted a stay on the order passed by the MKU Syndicate and adjourned the hearing by four weeks.

In his petition, Mr. Rajarajan said the allegations against him were false, claiming that he was not given an opportunity by the Syndicate to respond to the allegations.

He sought copies of complaints against him, but they were not provided.

Without even ascertaining the genuineness of the complaints and before seeking an explanation, he was suspended from the post. He sought a stay on the order.

The Syndicate suspended three officials including, Mr. Rajarajan, for their alleged involvement in the certificate scam that involved issuance of fake mark sheets and provisional certificates to at least 500 candidates through the Directorate of Distance Education.
Maternity leave norms relaxed for govt. staff

Decision in response to representations from new recruits

Women employees of the Tamil Nadu government will be eligible for maternity leave even if they joined service after delivery recently, thanks to the government relaxing certain rules.

So far, married women among government servants (appointed in a regular capacity and yet to become permanent pending probation) were allowed to avail only their earned leave for maternity purposes.

With the government’s decision, women employees who are in service at the time of issue of the Government Order by the Department of Personnel and Administrative Reforms will be sanctioned 270 days maternity leave without deducting earned leave from their account.

As for those women who joined service after the delivery, the days between their day of delivery and the day they joined government service would be calculated for maternity leave.

Formula for calculation

For instance, if a woman was delivered her child on January 1 and joins the government service on January 10 the same year, the calculation on how many days’ maternity leave she will get will factor in this 10-day period. The exact details of calculation were not available on the GO.

An official explained that usually government servants would become permanent only after completing their regularisation and probation, which takes about two years since their joining service.

The State government’s recent decision followed representations from some of the newly-appointed government servants (non-permanent married women government servants appointed in a regular capacity), who joined the government service after delivery, seeking sanction of maternity leave.

As per the Rule 101(a) of the Tamil Nadu Fundamental Rules, maternity leave on full pay can be granted to permanent married women government servants (with less than two surviving children) not exceeding 270 days, which may spread over from the pre-confinement rest to post confinement recuperation.

As per the earlier rule, non-permanent married women government servants employed under the emergency provisions should have completed one year of continuous service including leave periods, if any, to become eligible for the grant of maternity leave.
