நிர்பயா என்ற மருத்துவ மாணவி கடந்த 2012-ம் ஆண்டு ஓடும் பஸ்சில் 6 பேர் கொண்ட கும்பலால் கொடூரமாக பலாத்காரம் செய்து கொல்லப்பட்டார்.

நாடு முழுவதும் பெரும் அதிர்ச்சியை ஏற்படுத்திய இந்த சம்பவத்தில் ராம்சிங், மகேஷ்சிங், வினய் சர்மா, பவன்குப்தா, அக்தர் தாக்கூர் ஆகியோரையும், 16 வயது சிறுவன் ஒருவனையும் போலீசார் கைது செய்தனர்.

சிறுவனுக்கு சிறார் நீதி சட்டப்படி அதிகபட்சமாக 3 ஆண்டு சிறை தண்டனை விதிக்கப்பட்டது. மற்றொரு குற்றவாளியான ராம்சிங் திகார் சிறையில் தற்கொலை செய்து கொண்டான். மற்ற 4 பேருக்கும் விசாரணை நீதிமன்றம் தூக்கு தண்டனை விதித்தது. இதை டெல்லி உயர்நீதிமன்றமும், உச்ச நீதிமன்றமும் உறுதி செய்தன.

இந்த நிலையில் தூக்கு தண்டனையை நிறைவேற்ற டெல்லி திகார் சிறையில் ஆள் இல்லை என்ற தகவல் வெளியானது.

இந்த பணிக்கு நான் தயார் என ராமநாதபுரம் போலீஸ் ஏட்டு தெரிவித்துள்ளார். இது தொடர்பாக திகார் சிறையின் தலைமை இயக்குநருக்கு கடிதமும் அனுப்பி உள்ளார்.

அவரது பெயர் சுபாஷ் சீனிவாசன் (வயது 42). ராமநாதபுரம் மாவட்ட காவல் பணியிடை பயிற்சி மையத்தில் தலைமை காவலராக பணியாற்றுகிறார்.

அவர் திகார் சிறை அதிகாரிகளுக்கு எழுதியுள்ள கடிதத்தில் கூறியிருப்பதாவது:-

நிர்பயா வழக்கில் தண்டனை பெற்ற 4 பேரை தூக்கிலிட திகார் சிறையில் ஆள் இல்லை என்பதால், தண்டனை தள்ளிப்போவதாக செய்திகள் வருகின்றன.

சம்பந்தப்பட்ட குற்றவாளிகளுக்கு விரைவில் தண்டனை நிறைவேற்றப்பட வேண்டும் என்ற நோக்கத்தில் நான் அந்தப் பணியை செய்ய விருப்பம் தெரிவிக்கிறேன்.

மேற்கண்டவாறு அந்த கடிதத்தில் குறிப்பிடப்பட்டுள்ளது.

Rare micro-surgery for infant in Salem GH

The girl child born to Ms Haripriya, wife of one Nagarajan, at the Salem GH on November 13 was found to be suffering from breathing difficulty.

A team of the hospital's pediatric surgeon Dr Ravichandran had successfully undertaken this "very challenging surgical procedure called Thoracoscopy correction" on the infant girl, said the Salem GH dean Dr Balaji Nathan, speaking to reporters here on Friday.

Salem: The Mohan Kumaramangalam government hospital here has successfully performed a rare and technically intricate chest aperture surgery on a ten-day-old infant to correct a congenital defect called 'hiatus hernia (protrusion of an organ, typically the stomach or intesntine through the oesophageal opening in the diaphragm) using 'Thoracoscopy'.

A team of the hospital's pediatric surgeon Dr Ravichandran had successfully undertaken this "very challenging surgical procedure called Thoracoscopy correction" on the infant girl, said the Salem GH dean Dr Balaji Nathan, speaking to reporters here on Friday.

In medical parlance, 'Thoracoscopy' is "visual examination of the lung surfaces and pleural space through a viewing tube" and 'Thoracoscopy' can also be used for certain surgical procedures.

The girl child born to Ms Haripriya, wife of one Nagarajan, at the Salem GH on November 13 was found to be suffering from breathing difficulty, Dr Balaji Nathan said. On examination it was found that the child had protrusion of the intestine, creating problems for the lungs. The right side of the lung had not developed as it should have due to the protrusion of the organ and pressing the heart and left part of the lungs, making it difficult for the child to breathe.

To correct this abnormality required a very sophisticated micro-surgery, a procedure involving a very fine 'aperture' (drilling a hole) on the chest, with the help of 'Thoracosopy' and pushing the protruded intestine into the stomach to help normalize the breathing function, explained the dean.

The procedure was done on November 24 and the child was given artificial respiration for two days, he said, adding, the child was now able to breathe normally. The 'Thoracoscopy' ensures that no scar or injury is caused to the child, he said, adding, such a procedure in a private hospital would have cost Rs. two lakh. But in the GH, it was done free for the benefit of the poor couple under the Chief Minister's Comprehensive Medical Insurance scheme, he added.

There are major questions being raised whether these killings will make women safer.

The Human Rights Forum demanded that all police personnel who participated in the killing of the accused must be arrested and prosecuted for homicide.

Hyderabad: Human rights groups have called it an ‘alleged encounter,’ ‘cold blooded murder’ and demanded that the police must be booked for homicide.

Civil Liberties Monitoring Committee general secretary, Lateef Mohammed Khan, said, “It is a cold-blooded murder which was meticulously planned and executed. The killing of the suspects has taken away the major clues which would have later shed light on the crime.”

“There are many questions which will remain unanswered forever as the case is now closed. Was there an attempt to save the others in the system? The crime was heinous, no doubt, but there are many lapses in the system which led to the crime. Is the cold blooded murder an attempt to hide these failures?” Mr Khan asked.

After the Nirbahaya incident, the Verma Commission had given a list which must be implemented in the criminal law system. Has that been done, ask the activists.

G. Madhava Rao, HRF’s Telangana state president, said, “The police have taken advantage of the sentiment of the people and carried out murder. This is the third incident of custodial killing and these are methodical slaying by the police in their physical custody. It is not justice of any kind. It is merely satisfying the collective conscience in an unlawful and murderous manner.”

In December, 2008, three accused in acid attack where murdered in Warangal. In October 20, 2007, two men accused in the murder of Bank of Indore branch manager were murdered by Vishakhapatnam police near Yendada.

Human rights activists state that the police claim of self-defence is farcical.

There are major questions being raised whether these killings will make women safer. The activists say No. Preventing crimes against women requires a long, sustained and complex battle and has to be fought at homes, educational institutes and also places of work.
13,000 fliers denied boarding between May and October

Citing technical, operational and bad weather conditions, more than 13,000 passengers were denied boarding in airplanes across airports in India between May and October. In a reply to the Lok Sabha, Hardeep Singh Puri, minister of state for civil aviation said that the top 5 airlines, including Air India, Indigo, SpiceJet, AirAsia and Vistara denied boarding to 13,071 passengers. And compensated these passengers with ₹563.7 lakh. More than 120 million passengers fly across airlines in India in a year.

Air India was the worst as it denied boarding to 9,978 persons and paid ₹434.02 lakh in compensation. Spicejet paid ₹86.04 lakh in compensation to 2,624 passengers while the country’s largest carrier Indigo denied boarding to 325 passengers and paid them ₹34.2 lakh. “Today an air passenger has lost his importance as the passenger charter introduced in February is toothless,” said D Sudhakar Reddy, founder of the Air Passengers Association of India (APAI).

“Globally, when a passenger is denied boarding it is rewarding for the passenger, right from upgraded tickets on an alternative date, luxury accommodation and free stay. Airlines in India do not care for passengers,” he said. As per the passenger charter, an amount equal to 200% of the booked one-way base ticket plus airline fuel charges, subject to a maximum of ₹10,000 for alternative flights booked within 24 hours has to be paid. And that compensation doubles to 400% if alternative departure is more than 24 hours. In case the passenger does not opt for alternate flight a refund of full value of the ticket and compensation of 400% of the booked one way basic fare plus airline fuel charges subject to a maximum of ₹20,000 has to be paid as compensation.

Allahabad HC judge booked in medical college scam

The CBI has registered a case against seven people, including a sitting Allahabad high court judge, for allegedly taking a bribe to pass a favourable order to allow Prasad Institute of Medical Sciences (PIMS) to admit students. PIMS, on the Lucknow-Kanpur Road, was one of the 46 colleges barred from admitting students due to substandard infrastructure and not conforming to teaching criteria in 2017.

The FIR (registered on December 4) against Allahabad HC judge S N Shukla comes four months after the then Chief Justice of India, Ranjan Gogoi, gave the CBI sanction to book a serving HC judge. Along with Justice Shukla, the agency filed a case against a retired Chhattisgarh high court judge for corruption and criminal conspiracy. Justice Shukla’s prosecution is the first such case since the 1991 Supreme Court judgment allowing probes against judges. Justice Shukla is accused of favouring PIMS by extending the deadline for admission of students, a contravention of existing rules. The CBI said it conducted searches at the premises of all seven accused, including Justice Shukla, in Lucknow, Meerut and Delhi and recovered several “incriminating documents”.

The searches were carried out at the premises of Justice S NShukla in Vridavan Yojna and IM Quddusi’s residence in Lawrence Terrace. Similar searches were carried out at the premises of PIMS member B P Yadav and his son, Palash Yadav, at Eldeco Greens, and at the residence of co-accused Subhash Giri in Meerut. The searches, officials said, would continue in coming days. The FIR has alleged that Yadav and his son, who have been managing the PIMS trust, held several meetings with conspirators in the case. The agency had earlier arrested former Chhattisgarh HC judge I M Quddusi a day after it had registered the first FIR in the case in September 2017. TNN
SC: No pension for govt employees who resign

Making a distinction between voluntary retirement and resignation, the Supreme Court has said that government employees will not be entitled to pension if they resign from service as it forfeits their past service.

Referring to the Central Civil Services Pension Rules, a bench of Justices D Y Chandrachud and Hrishikesh Roy said that in case of resignation, the entire past service would be forfeited, and consequently, an employee would not qualify for pensionary benefits. The pension rules apply to government servants, including civilian government servants in the defence services, appointed before December 31, 2003.

The court passed the order on an appeal filed by BSES Yamuna Power Ltd challenging an order of the Delhi High Court directing it to provide pension to an employee who resigned after 20 years of service. The HC had said that the employee was entitled to get voluntary retirement after completing 20 years of service and he was, therefore, entitled to pensionary benefits after resigning. The apex court, however, said taking voluntary retirement and resigning from job are two different things and pension cannot be given in case of resignation.

“Where an employee has resigned from service, there arises no question of whether he has in fact voluntarily retired or resigned. The decision to resign is materially distinct from a decision to seek voluntary retirement. The decision to resign results in the legal consequences that flow from a resignation under the applicable provisions. These consequences are distinct from the consequences flowing from voluntary retirement and the two may not be substituted for each other based on the length of an employee’s tenure,” the bench said. The apex court said though both involve voluntary acts, they operate differently.

PRESERVE BODIES OF ACCUSED, HC TELLS STATE GOVT

The HC on Friday directed the state government to preserve bodies of the four accused till December 9. It said the post-mortem process must be videographed. The bench, headed by Justice MS Ramachandra Rao, and which included Justice K Lakshman, said videos must be submitted to district judge in Mahabubnagar by 6pm on December 9. The order was passed following representation filed by members of National Alliance of People’s Movements, Human Rights Forum activists and other women’s groups. The letter was converted into PIL by Justice Rao, who heard it as a house motion at his residence late Friday evening. “Video-record the post-mortem and furnish a copy in form of CD or pen drive to district judge of Mahabubnagar,” Justice Rao ordered.

Activists appealed to HC to direct formation of special team of autopsy surgeons — other than from Telangana and AP — to conduct independent videographing of post-mortem. They also sought formation of special forensic team for independent examination. “It would be a fallacy to even think that some kind of justice has been served by abandoning all due process,” the letter read. The activists requested HC to order that case be handed over to CBI. The next hearing is on December 9. TNN
