நிர்பயா வழக்கு: குற்றவாளிகள் இருவர் தாக்கல் செய்த மனுவைத் தள்ளுபடி செய்தது டெல்லி நீதிமன்றம்: தண்டனையைத் தாமதிக்கத் திட்டம்; அரசுத் தரப்பு வாதம்

கடந்த 2012-ம் ஆண்டில் டெல்லியில் மருத்துவ மாணவி நிர்பயா பாலியல் வல்லுறவுக்கு ஆளாக்கப்பட்டு கொலை செய்யப்பட்ட வழக்கில் தூக்கு தண்டனை விதிக்கப்பட்ட குற்றவாளிகள் 4 பேரில் இருவர் தாக்கல் செய்த மனுவை டெல்லி பாட்டியாலா நீதிமன்றம் இன்று தள்ளுபடி செய்தது.

கடந்த 2012-ம் ஆண்டு டெல்லி மருத்துவக் கல்லூரி மாணவி, ஓடும் பேருந்தில் கூட்டுப் பலாத்காரம் செய்யப்பட்டுத் தூக்கி வீசப்பட்டார். அதன்பின் தீவிர சிகிச்சை அளித்தும் பலனளிக்காமல் அவர் உயிரிழந்தார்.

இந்த வழக்கில் முகேஷ் சிங், வினய் சர்மா, பவன் குப்தா, அக்சய் குமார் சிங் ஆகிய 4 பேருக்கு மரண தண்டனை விதித்து 2013-ம் ஆண்டு செப்டம்பரில் டெல்லி நீதிமன்றம் தீர்ப்பு வழங்கியது. தீர்ப்பை மறு ஆய்வு செய்யக்கோரித் தாக்கல் செய்த மறு ஆய்வு மனு, சீராய்வு மனு ஆகியவற்றை உச்ச நீதிமன்றம் தள்ளுபடி செய்தது.

குற்றவாளிகளில் ஒருவரான பவன்குமார் குப்தா குற்றச் சம்பவம் நடந்தபோது தான் பதின்வயது உடையவராக இருந்தேன் என்று கூறி தண்டனையை நிறுத்தி வைக்கக் கோரிய மனுவையும் உச்ச நீதிமன்றம் தள்ளுபடி செய்தது.

குற்றவாளிகளில் ஒருவரான முகேஷ் சிங் தாக்கல் செய்த கருணை மனுவையும் குடியரசுத் தலைவர் ராம்நாத் கோவிந்த் நிராகரித்தார். இதைத் தொடர்ந்து குற்றவாளிகள் 4 பேருக்கும் பிப்ரவரி 1-ம் தேதி காலை 6 மணிக்குள் தூக்கு தண்டனையை நிறைவேற்ற வேண்டும் என டெல்லி விசாரணை நீதிமன்றம் டெத் வாரண்ட் பிறப்பித்துள்ளது.

இது தொடர்பாகக் குற்றவாளிகள் வினய் குமார் சர்மா, அக்சய் குமார் சிங், பவன் குப்தா தரப்பில் வழக்கறிஞர் ஏ.பி.சிங், டெல்லி நீதிமன்றத்தில் நேற்று ஒரு மனுவைத் தாக்கல் செய்திருந்தார். அதில் ‘வினய் குமார் கருணை மனு தாக்கல் செய்ய வாய்ப்பு உள்ளது.

அதேபோல, அக்சய் குமார் சிங், பவன் குப்தா ஆகியோர் தனது தண்டனையை எதிர்த்து சீராய்வு மனு தாக்கல் செய்ய இன்னமும் வாய்ப்பு உள்ளது. ஆனால், சிறை அதிகாரிகள் சில ஆவணங்களைத் தர மறுப்பதால் மனுக்களைத் தாக்கல் செய்வதில் தாமதம் ஏற்படுகிறது. முக்கியமாக, 70 பக்கங்கள் கொண்ட வினய் குமாரின் டைரியை சிறை அதிகாரிகள் தர மறுக்கின்றனர். அதனை உடனடியாக தர சிறை அதிகாரிகளுக்கு உத்தரவிட வேண்டும்" என அந்த மனுவில் கூறப்பட்டு இருந்தது.

இந்த மனு டெல்லி பாட்டியாலா நீதிமன்ற கூடுதல் அமர்வு நீதிபதி அஜய் குமார் ஜெயின் ஆகியோர் முன் இன்று விசாரணைக்கு வந்தது.

அப்போது டெல்லி போலீஸார் தரப்பில் ஆஜரான வழக்கறிஞர் வாதிடுகையில், "குற்றவாளிகளின் வழக்கறிஞர் கேட்டதுபோல அனைத்து ஆவணங்களும் திஹார் சிறை நிர்வாகத்தினர் தரப்பில் வழங்கப்பட்டுள்ளது. ஆனால், குற்றவாளிகள் தரப்பு வழக்கறிஞர் தண்டனை தாமதப்படுத்தும் தந்திரத்தில் இந்த மனுவைத் தாக்கல் செய்துள்ளார்.

இந்த மனுவின் ஒட்டுமொத்தநோக்கமே சட்டத்தை ஏமாற்ற வேண்டும், தோற்கடிக்க வேண்டும் என்பதுதான். அவர்களுக்குத் தேவையான அனைத்து ஆவணங்களும் வழங்கப்பட்டபின் மீண்டும் மனு செய்துள்ளார்கள். சிறை அதிகாரிகள் வழங்கிய டைரியைக் கூட உங்களிடம் தாக்கல் செய்திருக்கிறோம். குற்றவாளிகள் ஒருவரான வினய்குமார் வரைந்த ஓவியங்களையும் புகைப்படம் எடுக்க அனுமதித்துள்ளோம். நீதிமன்றம் அனுமதித்தால் அனைத்தையும் வழங்கத் தயாராக இருக்கிறோம்" எனத் தெரிவித்தார்

குற்றவாளிகளின் வழக்கறிஞர் ஏ.பி. சிங் வாதிடுகையில், ''குற்றவாளி வினய் குமார் சிங்கிற்கு ஸ்லோ பாய்ஸன் வழங்கப்பட்டு அவர் மருத்துவமனையில் அனுமதிக்கப்பட்டுள்ளார். அவரின் மருத்துவ அறிக்கைகளைக் கேட்டால் சிறை அதிகாரிகள் வழங்க மறுக்கின்றனர். சில முக்கிய ஆவணங்கள் மட்டுமே வெள்ளிக்கிழமை இரவு வழங்கப்பட்டன. அவரின் டைரி, மருத்துவ அறிக்கை வழங்கப்படவில்லை.

சிறை அதிகாரிகள் அதுபோன்ற எந்த ஆவணங்களும் இல்லை என்று தெரிவிக்கிறார்கள். வினய் குமார் நன்றாக ஓவியம் வரையக்கூடியவர். அவர் ஓவியம் மூலம் கிடைத்த பணம் குறித்து குடியரசுத் தலைவரிடம் தெரிவித்து கருணை மனுத் தாக்கல் செய்ய இருக்கிறோம். மற்றொரு குற்றவாளி பவன் சிங் தலையில் பலத்த அடிபட்டு மருத்துவமனையில் அனுமதிக்கப்பட்டுள்ளார். அவரின் மருத்துவமனை அறிக்கையும் வழங்கப்படவில்லை. அக்சய் சிங் குமார் மருத்துவ அறிக்கையும் வழங்கப்படவில்லை" என வாதிட்டார்.

இருதரப்பு வாதங்களையும் கேட்ட நீதிபதி அஜய் குமார் ஜெயின், "சிறை அதிகாரிகள் ஆவணங்கள், ஓவியங்களை வழங்குவார்கள். அதில் தேவைப்படுவனவற்றை வழக்கறிஞர் புகைப்படம் எடுத்துக் கொள்ளலாம். அதற்கு எந்தவிதமான தடையும் இல்லை. இந்த வழக்கில் இதற்கு மேல் எந்தவிதமான உத்தரவும் பிறப்பிக்கத் தேவையில்லாததால் மனுவைத் தள்ளுபடி செய்கிறேன்" எனத் தெரிவித்தார்.

People bid farewell to Nepal hotel gas victims

He was known for his strong advocacy of family planning

T.V. Antony, former Chief Secretary of the Tamil Nadu government and a civil servant known for his strong advocacy of family planning, died at a hospital on Friday. He was 86, and is survived by his wife and two sons.

On the morning of Monday (January 27), a mass will be held at St. Louis Church in Adyar, followed by a burial at the Quibble Island cemetery, according to family sources.

His father T. A. Varghese, an officer of the Indian Civil Service (ICS), retired as Chief Secretary of the State government in November 1965.

Joining the Indian Administrative Service in May 1956, Mr. Antony, who held degrees in chemistry and law, served the State government in various capacities, like the Collector of Madurai, Tirunelveli and Thanjavur districts, before becoming the Special Officer of the Chennai Corporation in 1973. He was Secretary to the Rural Development and Local Administration Department for a year, and then went to the Centre, where he worked for four years as Joint Secretary in the Health Ministry. Returning to the State in 1982, Mr. Antony worked as Secretary, Planning and Development Department, for a year, after which he was made the Second Secretary in 1983. He had two stints as Chief Secretary – April 1985-July 1986 and January 1991-June 1991. When he retired in October 1991, he was holding the post of Chairman of the State Planning Commission.

For his work on population regulation and stabilisation and women’s empowerment, Mr. Antony was conferred the Padma Bhushan in 2004 and the Rajasthan State government’s award four years later.

P. N. Vedanarayanan, president of the Retired IAS Officers’ Association, who was senior to Mr. Antony by a year, says family control and planning, according to Mr. Antony, was one of the pre-requisites for overall development. Santha Sheela Nair, former civil servant, points out that Mr. Antony was equally attached to issues concerning cleanliness and sanitation. “He was the first to say how toilets, built for adults, were not comfortable for children,” she recalls, adding, “Hierarchy did not come in his way in connecting himself with problems of the common man.”

MKU VC confronts Controller as a stranger handles consolidated marksheets

Access to official documents at the Controller of Examination’s room by an unauthorised individual at the Madurai Kamaraj University (MKU) has created controversy.

Vice-Chancellor M. Krishnan confronted the Controller of Examination O. Ravi on Thursday evening after the individual owning a distance education centre in Periyakulam in Theni district was found handling a series of consolidated marksheets, according to a source privy to the conversation.

Following a tip-off from a source at the university, the VC who was going on rounds at around 7 p.m. reached the controller’s room and found the individual sorting through the marksheets belonging to various students of the university and keeping aside a set of these marksheets of students belonging to his centre.

The controller was also said to have been present inside the room at the time, according to the source.

“We have received similar updates of owners of centres walking into the controller’s room to receive their certificates without utilising the proper channels. It is widely known that these distance education centres are yet to pay their dues to the university. The matter is going to be investigated,” the source added.

The source said the VC had also received a written acknowledgement from the controller that an individual was seen handling consolidated marksheets.

“However, the controller in the letter had said that he was in the adjacent room on the phone while the individual was looking at the files and was not involved,” the source added.

Mr. Ravi refused to comment on the matter and said that the administration would handle the issue.

The source said the university administration was likely to constitute a committee to investigate such malpractices. It would raise the issue in the forthcoming Syndicate meeting, the source added. Mr. Krishnan said that he was likely to issue a statement on the matter on Saturday.

Govt.-sponsored NEET coaching classes register poor attendance
Dip in numbers is probably because of a series of holidays in the recent past: CEO

Although there are 15 centres providing Tamil Nadu government-sponsored National Eligibility-cum-Entrance Test (NEET) coaching in Madurai district, students who regularly attend classes are a very few, according to teachers conducting the classes.

According to an official from the Education department, a total of 980 students showed interest in being part of the State-sponsored coaching every weekend until the run-up to the exam in April.

However, there are no official records of the number of students regularly attending the classes. One of the teachers says that there are usually 40 to 50 children who are assigned to each coaching centre. Policy dictates that there should be at least one such centre for each union.

Writer and teacher Libi Aranya said that in some centres with a sanctioned strength of 40 students, not even one-fourth turns up to classes. He attributes them to a number of reasons and says that the government-sponsored coaching bears the mark of systemic failure.

“Government teachers are deputed on rotation basis for coaching in their respective unions. Without a dedicated set of teachers to understand the performance of these students, it may be impossible for specialised training and proper continuity of lessons,” he says.

He adds that another major flaw in the process of coaching is that students barely get between 30 and 40 sessions overall to supplement their regular education and later write the NEET.

“Anyone who has attempted the exam will clearly state that 30 sessions with a week’s gap will hardly make a difference to the preparation. Students need rigorous and intense training to crack this exam as their regular syllabus is different and as difficult to write. Science students especially have to study several volumes to get a good score in the board exam and later write NEET too,” he says.

State Coordinator of the Save Higher Education Movement of Tamil Nadu R.Murali says that though the idea is to appeal to students from rural areas to take up the exam, there is a confusion and fear taking up the exam based on the pass percentage from previous years. He says that lack of proper Tamil NEET coaching material is another barrier for socially disadvantaged students from rural areas.

Mr. Aranya says that the Tamil Ndu government is choosing to assess the success of those writing NEET exams based on those who have cleared cut-off whereas this must ideally be based on the number of these students getting seats in medical colleges.

“Through the previous system, rural students at least had proper windows to achieve their dreams. The teachers were trained in the syllabus and enough time was given for aspiring doctors with special a coaching on school campuses. However, with poor results and poorer enrolment rates for government coaching, the dream of becoming doctors may become inaccessible to these students,” he says.

District Chief Educational Officer (CEO) R. Swaminathan says that the dip in numbers is probably because of the series of holidays in the recent past.

He says that coaching is going on as scheduled for all students in these unions. Another source from the department says that Headmasters and Headmistresses from unions with poor attendance are personally called by District Education Officers and the CEO to boost the number of students attending these classes.

SMS to be sent to passport holders

The Ministry of External Affairs has commenced a new service to inform all passport holders on the date/month of expiry of their passports.

This is to ensure that all the passport holders renewed the passports on time.

Many of the passport holders forgot the month/year of expiry of their passports.

A majority of the countries insisted on a minimum of six months validity of the passports for the purpose of travel.

Hence, at the last moment, when passport holders realised that the month or year in the booklet had expired, the journey became impossible.

Hence, as a service, the Ministry of External Affairs had proposed to send SMS to the registered mobile numbers twice — at the ninth and seventh month prior to the expiry date to the passport holders, said Regional Passport Officer Arun Prasad in a press release issued here on Friday.
