 Coimbatore : A village administrative officer jumped into a pond, with DVAC sleuths hot on his heels, with a bribe money of ₹3,500 on Friday night. The sleuths jumped in too and arrested him. He has been identified as M Vetrivel, 32, of Theni district, the VAO of Mathvarayapuram village in Coimbatore district. According to a DVAC source, an elderly woman named Marathal, a cancer patient, had applied for a legal heir certificate after the demise of her husband. “The VAO demanded ₹5,000 from her for arranging the certificate. The woman had paid ₹1,000 to the VAO last month. When the VAO demanded that the woman pay the remaining ₹4,000, she approached her sonin-law Krishnasamy, 62, of Mathvarayapuram. He came to us and we laid a trap by asking him to hand over chemical coated currency notes to the VAO.” As instructed by DVAC, Krishnasamy contacted the VAO and asked him to wait near Perur tahsildar office around 8pm on Friday. “Vetrivel reached the spot around 8pm. Krishnasamy met him and gave him the chemical coated currency notes,” the source said DVAC officials, who were hiding nearby, caught the VAO redhanded. But, he managed to escape on his motorcycle. “Vetrivel fell on the road. Before the sleuths caught him, he jumped into Perur Periyakulam. Once in the pond, he threw the notes into the water,” the source said. The sleuths could not trace the currency notes.

Chennai : A village administrative officer (VAO) has been booked for issuing a death certificate for a 50-yearold woman who disappeared from her house in 2021 but is alive. Police booked the woman's son too for approaching the VAO to issue the death certificate. Janaki alias Lakshmi, who lived with her husband Ragu, 55, and their sons at Elavur near Gummidipoondi, suddenly disappeared from her house in 2021. Ragu died later due to a few illnesses. Lakshmi’s son Vignesh, 24, approached Aathupakkam VAO, Raja, to issue a death certificate for his mother. The VAO conducted an “inquiry” and issued the death certificate. 

Vignesh then transferred the ancestral property to his and his brother’s names. Last year, some NGOs found Lakshmi and took her home. She learned that Vignesh had obtained her death certificate from the VAO and filed a complaint with the Gummidipoondi taluk office. Tahsildar Rajendran conducted an inquiry and found that the VAO did not follow the prescribed norms before issuing the death certificate to Vignesh. Based on the complaint filed by the tahsildar to Gummidipoondi police, a case was registered against Raja, the VAO, and Vignesh. The tahsildar ordered Raja placed under suspension on Friday. The Supreme Court on Wednesday (Nov. 27) held that an employee whose promotion was not effectuated before his retirement would not be entitled to retrospective promotion and the notional benefits attached to the promotion.

The bench comprising Justice PS Narasimha and Justice Sandeep Mehta observed that “promotion only becomes effective upon the assumption of duties on the promotional post and not on the date of occurrence of the vacancy or the date of recommendation.”

The Bench heard the appeal filed by the State of West Bengal against the grant of notional benefits to respondent No. 1 employee, whose promotion to the post of Chief Scientific Officer (CSO) was approved post-superannuation.

The High Court approved the Administrative Tribunal decision which found that due to delay and laches on the appellant's part, respondent no.1 promotion was not effectuated before his superannuation though recommended before superannuation. Therefore, instead of directing retrospective promotion under Rule 54(1)(a) of the West Bengal Service Rules, 1971, the Tribunal directed the appellants to provide the benefits of the promotional posts.

The Supreme Court considered the question of “whether respondent No.1, who was recommended for the promotion before his retirement but did not receive actual promotion to the higher post due to administrative delays, is entitled to notional financial benefits of the promotional post after his retirement?”

Before the Supreme Court, the appellant-State Government contended that service jurisprudence does not recognize retrospective promotion without a specific enabling provision, therefore, notional promotion cannot be granted retrospectively unless there exists a specific rule or exceptional circumstances. It argued that in the present case, Rule 54(1)(a) of the West Bengal Service Rules, precludes retrospective promotion, therefore respondent no.1 would not be entitled to even notional benefits.

Finding force in the appellant's argument, the judgment authored by Justice Mehta answered the question negatively and observed that it would be unjustified to grant even a notional benefit to respondent no.1 because he had not assumed the office of the promoted position (CSO) and didn't serve in that capacity.

“promotion only becomes effective upon the assumption of duties on the promotional post and not on the date of occurrence of the vacancy or the date of recommendation. Considering that respondent No. 1 superannuated before his promotion was effectuated, he is not entitled to retrospective financial benefits associated to the promotional post of Chief Scientific Officer, as he did not serve in that capacity.”, the court said.

Reference was drawn to the case of Bihar State Electricity Board and Others v. Dharamdeo Das (2024), where the Court held that promotion is effectuated only when it is granted. The Court clarified that promotion would not be effectuated from the date when a vacancy occurs on the subject post or when the post itself is created.

The Court's reasoning was based on the fact that when the employee was not even borne in the cadre then how he can be promoted to the said cadre retrospectively.

The Court took into account Rule 54(1)(a) of the West Bengal Service Rules which prevent retrospective grant of promotion to an employee when his promotion was not even approved.

“In the instant case, it is evident that while respondent No. 1 was recommended for promotion before his retirement, he could not assume the duties of the Chief Scientific Officer. Rule 54(1)(a) of the West Bengal Service Rules, clearly stipulates that an employee must assume the responsibilities of a higher post to draw the corresponding pay, thus, preventing posthumous or retrospective promotions in the absence of an enabling provision.”, the Court said.

Accordingly, the appeal was allowed.

பார்வைகள் பலவிதம்..!

எந்த ஒரு விஷயத்தையும் பல கோணங்களில் இருந்தும், வேறுபட்ட பார்வைகளின் மூலமாகவும் அணுகுதல் வேண்டும். ஒரு விஷயத்தை பற்றிய நமது எண்ணங்களும், உணர்வுகளும் பிறருடைய எண்ணங்களுடனும், உணர்வுகளுடனும் ஒத்துப் போகாது. இதுவே பார்வைகள் பலவிதம் எனப்படும்.

ஒரு விஷயத்தை நாம் பார்ப்பதற்கும் மற்றவர்கள் பார்க்கும் கோணத்திற்கும் நிறைய வித்தியாசம் இருக்கும். நாம் பார்க்கும் கோணம்தான் சரி என்று வாதிட முடியாது. நம்மைப் பொறுத்தவரை சரியாக இருக்கலாம். மற்றவர்களுக்கு இது தவறான எண்ணமாகத் தோன்றலாம். ஒருவர் ஒரு விஷயத்தை நேர்மறையாக பார்த்தால் மற்றொருவர் அதை நேர்மறையாகதான் பார்க்க வேண்டும் என்ற அவசியம் இல்லை. எதிர்மறையாகவும் பார்க்கக்கூடும்.

நமக்குப் பிடித்த பொருளோ, விஷயமோ, செயலோ மற்றவர்களுக்கும் பிடிக்கவேண்டும் என்ற அவசியம் இல்லை. விருப்பு, வெறுப்பு, நல்லது, கெட்டது எல்லாம் அனைவருக்கும் ஒன்று போலவே இருப்பதில்லை. சிலர் மற்றவர்களுக்கு உதவி செய்வதாக நினைத்துக்கொண்டு தொந்தரவு செய்வார்கள். இவரைப் பொறுத்தவரை அது உதவியாக தோன்றும். ஆனால் எதிரில் இருப்பவருக்கோ தொந்தரவு தருவதாக இருக்கும்.

இவன் ஏன் நம் விஷயத்தில் தேவையில்லாமல் தலையிடுகிறான் என்று எண்ணத் தோன்றும். எனவே எதையும் நம் கோணத்தில் இருந்து அணுகாமல் அடுத்தவர் கோணத்திலிருந்து பார்த்து அவர்கள் எதிர்பார்ப்பதை செய்யும் மனப்பக்குவம் இருந்தால் போதும்.

ஒவ்வொருவரும் தனக்கே உரிய பார்வையில் தனக்குத் தெரிந்த புரிதல்கள் மூலமும், அனுபவங்கள் மூலமும் ஒரு விஷயத்தை அணுகுகிறார்கள். பறவைகள் பலவிதம் என்பதுபோல் மனிதர்களும் பலவிதம். மனிதர்களுடைய எண்ணங்களும், பார்வைகளும் பலவிதம். எனவே நாம் புரிந்து கொள்வதைப் போலவே மற்றவர்களும் புரிந்துகொள்ள வேண்டும் என்று நினைப்பது தவறு.

மற்றவர்களுடைய கருத்துக்களையும், உணர்ச்சிகளையும் மதிக்க கற்றுக்கொள்ள வேண்டும். ஒருவரை நம் பார்வை மூலம் அணுகாமல் அவர்களின் பார்வையில் புரிந்து கொள்ள முயல வேண்டும். பிறரையும் நம்மைப்போல் எண்ணி அனுதாப நோக்கத்துடன் புரிந்துகொள்ள முயல்வது வாழ்க்கையில் சிக்கலை ஏற்படுத்தாது.

வாழ்க்கை மீது தெளிவான பார்வை வேண்டும். வாழ்வில் எதுவும் நிலை இல்லை என்பதை புரிந்துகொள்ள வேண்டும். வாழ்வில் எதிர்ப்படும் ஒவ்வொன்றும் அதன் தன்மையில் இருந்து மாறிக்கொண்டே இருக்கும் பொழுது நம் பார்வையும் குறுகி விடாமல் விரிந்து சென்று கொண்டே இருந்தால்தான் நல்லது.

மனிதனுக்கு மனிதன் காலத்திற்கு ஏற்றார் போல், இடத்திற்கு ஏற்றார் போல் பார்வைகளும் கருத்துக்களும் மாறிக்கொண்டே தான் இருக்கும். மாற்றம் ஒன்றே மாறாதது. எனவே நம் பார்வையையும் மாற்றிக் கொள்ள பழகவேண்டும். இதனை சுலபமாக புரிந்துகொள்ள ஒரு வழியுள்ளது. எப்படி? தண்ணீர் ஒன்றுதான்.

ஆனால் அது மழையாகவும், புயலாகவும், மலையிலிருந்து கொட்டும் பொழுது அருவியாகவும், தேங்கி நிற்கும் பொழுது குளமாகவும், குட்டையாகவும் பார்க்கப்ப டுகிறதோ அதுபோல்தான் மனிதர்களின் பார்வையும் ஒரே மாதிரி அமைந்து விடுவதில்லை.

எதையும் பார்க்கிற கண்ணோட்டத்தில்தான் இருக்கிறது. பக்தனுக்கு தெய்வமாகத் தெரியும் கற்சிலைதான் சிலருக்கு சிற்பமாகத் தெரிகிறது. சிலர் சின்ன விஷயத்தைக் கூட பூதாகரமாக நினைத்து பயப்படுவார்கள். வேறு சிலரோ இதெல்லாம் ஒரு விஷயமாக என்று சாதாரணமாக எடுத்துக் கொள்வார்கள்.

இப்படி மாறுபட்ட சிந்தனையும் பார்வையும் இருப்பது சகஜம்தானே! பார்வைகள் பலவிதப்பட்டாலும் காலத்திற்கும் வாழ்நிலைக்கும் தகுந்த பார்வையை, கண்ணோட்டத்தை ஏற்று நடக்க வேண்டியது அவசியம்தானே!

இரண்டாயிரம் ஆண்டுகளுக்கு முன்னதாகவே, ‘யாதும் ஊரே... யாவரும் கேளிா்’ என்ற உயா்ந்த கருத்தை உலகுக்கு அளித்தனா் நம் முன்னோா்கள். அப்படி இருக்கும்போது, இன்று அண்டை வீட்டில் இருப்பவரையே யாா் என்று தெரியாமல் நாம் வாழ்ந்து வருகிறோம். வீட்டின் முன்பகுதியில் திண்ணையில் உட்காா்ந்து அக்கம்பக்கத்தாரும் மணிக்கணக்கில் பேசிக் கொண்டிருந்தவா்கள் நம் முன்னோா்கள். தனித்தனியாக வீடுகள் இருக்கும்போதுகூட நாம் அனைவருடனும் பேசி வந்தோம். அடுக்கு மாடிகள் ஆனவுடன், அடுத்த வீட்டுக்காரா் யாரென்று நமக்குத் தெரியவில்லை. தெரிந்து கொள்ளவும் விரும்பவில்லை. 

உறவுகள், நட்பு ஆகியவை விலைமதிப்பு இல்லாதவை. அவற்றின் அருமையை அவற்றை இழந்த பின்தான், நாம் உணரப் போகிறோம்.  தகவல் தொடா்பு வளா்ச்சியடைந்து மிக உயா்ந்த நிலையை எட்டிவிட்டது என்பதில் மாற்றுக் கருத்து இல்லை. ஆனால், அது இரு பக்கமும் கூரான கத்தி போன்றது. இன்றைய தலைமுறை அக்கறை காட்ட வேண்டிய விஷயம் தகவல் தொடா்பை ஒழுங்காக, சரியாகப் பேண வேண்டும் என்பதுதான்.

பேசுவது என்பது ஒரு கலை; பேசாதிருப்பது மற்றொரு கலை. எங்கே பேச வேண்டும்; எப்படிப் பேச வேண்டும்; எங்கே பேசக் கூடாது; எப்படிப் பேசக் கூடாது என்பதில்தான் வாழ்க்கையின் வெற்றி இருக்கிறது என்பதே உண்மை. இதை அறியாமல் தாங்கள் பேசும்முைான் சிறந்த தகவல் தொடா்பு என இன்றைய இளைய தலைமுறையினா் நினைத்துக் கொள்வது ஆபத்தான விஷயம். 

பெற்ற தாய், தந்தையிடம், கற்றுத்தரும் ஆசிரியரிடம், மனைவியிடம், கணவனிடம், அதிகாரிகளிடம் எப்படிப் பேசுவது என்பதே பலருக்குத் தெரிவதில்லை. அதனால்தான், சண்டைகள், வேறுபாடுகள் ஏன், தற்கொலைகள், கொலைகள், மண முறிவுகள் என எல்லாத் தரப்புப் பிரச்னைகளுக்கும், பேசும்விதமே அடிப்படைக் காரணமாகிறது என்பதே முழுக்க முழுக்க உண்மை. 

ஒருவா் பேசும் வாா்த்தைகளே அவா் குறித்த பிறரின் மதிப்பீட்டை உருவாக்குகின்றன. வாா்த்தைகளில் கவனம் வைத்துப் பேசினால், அவை ஒருவரின் நடத்தையை உருவாக்குகின்றன. அந்த நடத்தையே அவருடைய வாழ்வு ஆகிறது. ‘மனதில் உறுதி வேண்டும்’ என்று பாடிய பாரதி, ‘வாக்கினிலே இனிமை வேண்டும்’ என்கிறான். வாக்கினில் உறுதி வேண்டும் என்று சொல்லவில்லை. ‘மனதில் உறுதி... வாா்த்தைகளில் இனிமை’ இருந்தால், நினைவு நல்லதாகும்; நெருங்கிய பொருள் கைப்படும் என்கிறான்!

வள்ளுவா் சொல்கிறாா்: சொல்லுக சொல்லிற் பயனுடைய சொல்லற்க சொல்லிற் பயனிலாச் சொல்! ஒரே ஒரு வாா்த்தையினால் வாழ்வை இழந்தவா்கள் இருக்கிறாா்கள். வாழ்வை முடித்துக் கொண்டவா்கள் இருக்கிறாா்கள். வாழ்வைச் சவாலாக எடுத்துக் கொண்டு வாழ்ந்தவா்களும் இருக்கிறாா்கள். ஒரே ஒரு வாா்த்தையினால் உயா்ந்தவா்களும் இருக்கிறாா்கள்

 சிருங்கேரி ஜகத்குரு மஹாஸ்வாமிகள் கூறுவாா்கள்: ‘தடியை எடுத்தால் மாடு ஓடி மறைகிறது; புல்லைக் காண்பித்தால், அதே மாடு தேடி வருகிறது. மனிதனும் இப்படித்தான்’. நல்ல வாா்த்தைகளைக் கூறி, பிறரின் மனத்தில் நம்பிக்கையை விதைத்து, நோ்மறை எண்ணங்களை உருவாக்கி, அவா்களைப் பாராட்டினால், அந்த மனிதன் வளா்வான். இதற்கு மாறாக, எப்போதும் எதிா்மறையாகப் பேசுதல், பிறரைக் கேலி செய்தல், குறைகாணுதல், எல்லாருடைய முன்னிலையிலும் மற்றவா்களை அவமானப்படுத்திப் பேசுதல் ஆகியவை கேட்பவரின் நம்பிக்கையைப் பாழாக்கி, அவா்களுடைய சிந்தனையைத் திசைதிருப்பி, நல்ல செயல்கள் நடைபெறாமல் தடுப்பதற்குக் காரணமாகிவிடுகின்றன. அப்படிப் பேசுபவா்கள் அரசியல், குடும்பம் மற்றும் நிறுவனங்களின் தலைவராக இருந்தாலும், அவா்களின் மீதுள்ள மதிப்பும், மரியாதையும் குறையவே செய்கின்றன.

பதவி, அதிகாரம் இந்த இரண்டினால் ஆடும் ஆட்டங்களும், ஆடம்பரங்களும், ஆடும் பம்பரங்கள் போன்றவை தான். சுற்றி முடிந்தபின் கீழே விழுந்தாக வேண்டும்! நல்ல வாா்த்தைகளின் அதிா்வலைகள் எங்கும் பரவும். அரசியல்வாதிகளைப் பற்றிக் குறிப்பிடும் போது, ஒருவா் சொன்னாா்: ஏன் பல அரசியல்வாதிகள், எவ்வளவோ ஊழல்கள் செய்தாலும், தீயவழியில் பயணம் செய்தாலும் வசதியுடன் நன்கு வாழ்கின்றனா் தெரியுமா? அவரைச் சுற்றியுள்ளவா்கள் அவரை எப்போதும் ‘வாழ்க’ , ‘வாழ்க’ என்று வாழ்த்துவதுதான். அந்த வாழ்த்துகளே அரசியல்வாதிகளை வாழ வைக்கின்றன’’ என்றாா். இதில் உண்மை இல்லாமல் இருக்கலாம். அரசியல்வாதிகள் உயா்ந்த வாழ்க்கை வாழ்வதற்கு வேறு பல காரணங்கள் இருக்கின்றன. ஆனால் நம்மைச் சுற்றியுள்ளவா்கள் நம்மிடம் நோ்மறையான கருத்துகளைப் பேசும்போது, நம் மனதில் நோ்மறை எண்ணங்கள் நிரம்பி வழிகின்றன. அது நம் வாழ்க்கையை உயா்வை நோக்கி முன்னேற்றுகிறது. இது அரசியல்வாதிகளுக்கு மட்டுமல்ல, சாதாரண மக்களுக்கும் பொருந்தும்.

“வெள்ளத் தனைய மலா்நீட்டம் மாந்தா்தம் உள்ளத் தனையது உயா்வு என்பதே உண்மை. ஆனால் அந்த உள்ளத்தை வெளிக்காட்டும் வாா்த்தைகள் சரியானதாகவும், பொருத்தமானதாகவும், உரிய காலத்தில், உரியவிதத்தில் வெளிப்படுத்தப்பட்டதாகவும் இருக்க வேண்டும். உண்மையைப் பேச வேண்டும். ஆனால் அது மனதுக்கு மகிழ்ச்சியைத் தருவதாக இருக்க வேண்டும். ‘நீ மடத்தில் இருக்கப் பிறக்கவில்லை. இந்த மானுடம் பயனுற, உலகம் செழிக்கப் பிறந்தவன்’ என்று கூறி விவேகானந்தரை வாழ்த்தி அனுப்பிய பரமஹம்சரின் வாா்த்தைகள்தான் உலகம் முழுக்கத் தெரிந்த விவேகானந்தரை உருவாக்கியது.  இப்படி நோ்மறை வாா்த்தைகளும் பாராட்டுகளுமே நம் எல்லாருடைய வாழ்வையும் வளமாக்கி, கனவை நனவாக்கி, மனித வாழ்க்கையை மகிழ்ச்சி நிறைந்ததாக்கும்.
