Lawyers consume beef on HC campus to protest Maharashtra ban

CHENNAI: The ban on sale and consumption of beef in Maharashtra by the state's BJP government provoked reactions in Chennai on Friday, when a group of advocates held a 'beef eating protest' on Madras high court campus to drive home the point that governments had no business to decide the eating habits of citizens.

Though the canteens on the high court campus themselves are off-bound for non-vegetarian food, the protesting advocates brought beef preparations from restaurants and served them to demonstrators and onlookers. "We condemn the government of Maharashtra for bringing this communal legislation, it infringes on the fundamental rights of citizens to choose their own food," said a young lawyer. Maharashtra's new law extended the existing ban on cow slaughter to bulls and bullocks also.

The demonstration managed to attract the attention of only a small group of curious litigants and fellow lawyers, but the larger significance of the event was not lost on them.

"One cannot be oblivious to the caste angle in demands for non-vegetarian food items at public/government office canteens. But Maharashtra's cow slaughter ban has added a communal tinge to the issue, besides giving rise to apprehension that it would deny affordable non-vegetarian food to millions of citizens," said advocate M Antony Selvaraj, chairman, All India Association of Jurists.

But he said the protest could have been conducted better. "Involving intellectuals and activists from different fora would have given it more acceptance," Selvaraj said.

When informed about the protest, former judge of the Madras high court K Chandru told TOI: "The state can regulate a food trade, vegetarian or non-vegetarian, from a public health point of view, not on any other grounds."

A few years ago, a Supreme Court bench which included Justice Markandey Katju had said, "What one eats is one's personal affair, and it is a part of his right to privacy, which is included in Article 21 of the Constitution. It is a right to be let alone." The bench, however, concluded that closing butcher shops for nine days was not an excessive restriction.

Incidentally, Tamil Nadu has witnessed similar protests in the past. Activist-advocate P Rathinam had led demonstrations before the Madurai bench of the Madras high court demanding non-vegetarian dishes at the canteens there.

As for the Maharashtra rule, which obtained Presidential nod nearly 19 years after it was first enacted, Chandru said it would not stand the test of law. "It is more of a religious issue than food issue," he said, "How do you suddenly say you cannot eat beef."

Mass fish deaths off Singapore coast spark concern

By Tessa Wong

Last Sunday morning, Bryan Ang woke up onboard his floating fish farm on the Johor Strait between Malaysia and Singapore to find nearly all his stock had died.

"We woke up and saw all the fish floating belly-up," he said. "It's devastating."

He was not alone. Hundreds of tonnes of fish - both farmed and wild - died over the weekend in the eastern part of the strait. Fish farmers lost hundreds of thousands of dollars in stock overnight.

Floating out at sea and washing up on the beaches and mangroves, dead sea creatures began to appear, from sea snakes and seahorses to squid and moray eel.

Nature guide and environmental biology student Sean Yap - who supplied some of these pictures to the BBC - said he was jogging along the eastern Pasir Ris beach on Saturday evening when he smelt a foul stench.

It came from what he described as a "mass grave" - thousands of dead fish washed up on shore.

"There were cleaners present on the shore on Sunday morning to deal with the carcasses, but when we returned at night the high tide had brought in a new batch of bodies."

The environmental authorities said the deaths were due to a plankton bloom, where a species of plankton multiplies rapidly, damaging the gills of fish. It can be triggered by sudden changes in temperature, high nutrient levels in the water, and poor water circulation.

Government agencies were unable to provide the BBC with figures, but said they were "concerned" about the potential impact on marine biodiversity and were taking steps to investigate and help farmers clean up.

Mr Yap said he found it alarming that even species such as catfish and burrowing gobies, which are considered to be more resilient, were found dead. The deaths of "invertebrates like worms is also alarming, as it may mean that the base of the food chain is affected," he said.

There have been similar mass fish deaths in the past five years. This time round, the authorities had given an early warning to farmers - giving them time to move their stock into protective nets, activate pumps to keep the water moving or even float their entire farm to safer areas.

Some managed to save their stock, but few had anticipated the intensity of the plankton bloom nor how quickly it would strike, killing the fish en masse within hours.

Several fish farmers told the BBC that rapid development in the western part of the strait in Johor, the Malaysian state closest to Singapore, was one of the factors affecting the water quality.

"The plankton bloomed this fast because the nutrient content in the sea is so high. And where are all these nutrients coming from? Land reclamation in Malaysia," said Frank Tan.

But tiny Singapore has also reclaimed parts of its northern coast, and dammed up estuaries in the northeast to create reservoirs. It has pumped millions of dollars into the fish farming industry to boost its domestic food security.

Latest government figures show there are now 117 fish farms in waters surrounding the island, spread out over 102ha - twice the amount of space compared to a decade ago.

Dr Lim Po Teen, a marine scientist with the University of Malaya, said climate change was in part to blame for the blooms, by affecting temperatures and weather patterns.

"But on a local level, you can see the number of farms increasing in the last few years", he said, which is directly increasing the level of nutrients in the water from fish food and waste.

"We need to have very strict controls and improve the water circulation."

Some of the farmers reeling from the loss of their stock were considering moving away altogether to less troubled waters.

"This weekend's incident was the worst I'd ever seen. Everyone is horrified." said Mr Tan. "We may have to relocate now." He said he was eyeing spots to the south of Singapore.

But many of the farmers were hoping to get through the year by restocking with new fry and selling what little they could save of their remaining stock. Said Mr Ang: "We are trying to explain to people that our fish is still edible. We just need to regain people's trust."

Singapore is friendliest place for Muslim tourists

Singapore has been named the friendliest destination for Muslim travellers among non-Muslim countries for the third successive year.

The Global Muslim Travel Index, released on Wednesday, gave Singapore high scores for its safe travel environment, ease of access to prayer spaces and number of halal dining options.

The index ranked 100 destinations based on nine criteria, such as family friendliness and accommodation options.

Singapore, which welcomed 3.2 million Muslim visitors last year, placed ninth on the overall list.

The top five spots were dominated by members of the Organisation of Islamic Cooperation – Malaysia came in first, followed by Turkey, United Arab Emirates, Saudi Arabia and Qatar.

According to the study, there were 108 million Muslim travellers last year, who spent S$145 bil (RM380bil).

This represents 10% of the global travel economy.

By 2020, the number of Muslim travellers is expected to reach 150 million and have a S$200bil (RM524bil) market value.

The Index was developed by payment company MasterCard and Muslim travel industry consultancy CrescentRating. — The Straits Times / Asia News Network

“Cheque dishonour plaint can be made only at drawee bank’s place”

In a major ruling, the Madras High Court has made it clear that a complaint of cheque dishonour is maintainable only at the place where the drawee bank is situated.

Justice S.Vaidyanathan said as per a Supreme Court ruling and Sections 138 and 142 of the Negotiable Instruments (NI) Act, a complaint is maintainable only at the place where the cheque stood dishonoured.

The Judge passed the order on a petition by one T.Thirumalai Nambi. The petitioner presented a cheque issued by Grishi Mango Products and Exports Tamil Nadu Pvt. Ltd., for encashment at the Karur Vysya Bank at the Tallakulam branch in Madurai. The cheque had been drawn at the bank’s branch at Erode. It was dishonoured stating that the balance in the account was insufficient. Mr.Nambi filed a complaint before the Judicial Magistrate, FTC, Madurai.

In September last year, the Magistrate returned the complaint stating that it should be presented only at Erode.

Counsel argued that though the cheque had been drawn at Erode, it could be presented at any of the branches of the bank. As the cheque was dishonoured at Madurai, that should be considered as the jurisdictional point.

Mr.Justice Vaidyanathan said it was true that the cheque was payable at par at all the bank's branches. However, the amount is to be paid only from the account of the person who had issued the cheque. Before encashing the cheque payable at par, the non-home branch was still required to verify from the home branch as to whether or not there was any impediment in encashing the instrument.

Therefore, the honouring or dishonouring of the cheque would be by the home branch alone. Hence, the place where the drawee branch was situated will be the jurisdiction to try the offence.

The Judge dismissed the petition as he did not find any irregularity in the magistrate's order.
