Death penalty justified in crimes against women which shock, repulse community: SC

Noting that crime against women are on the rise and courts are too soft on the perpetrators, the Supreme Court held that in heinous crimes which both shock and repulse society, the extreme punishment of death is justified.

An unforgiving Supreme Court declared this while confirming the death penalty of two men who gang-raped and brutally murdered a 22-year-old BPO employee on November 1, 2007 night after she was picked by her company cab to the office.

The cab driver Purushottam Borate and his friend Pradeep Kokate drove her to a nearby jungle despite her protests, raped her and smashed her head, killing her instantly and then drove back to town after a hiatus of two hours to pick up the next employee to work.

The court said the duo exploited their “position of trust” to commit an “extreme act of depravity” and then acted in a “calculated and remorseless” manner after the commission of the offence.

“This depravity would attract no lesser sentence than the death penalty,” a three-judge bench led by Chief Justice H.L. Dattu held in a verdict on Friday.

Noting that the crime falls within the “rarest of rare”, the court held that the collective conscience of the community is so shocked by this crime that imposing a lesser sentence, even life imprisonment, would fail justice.

The court noted how in recent years, the rising crime rate, particularly violent crimes against women has made the criminal sentencing by the courts a subject of concern.

“The sentencing policy adopted by the Courts, in such cases, ought to have a stricter yardstick so as to act as a deterrent. There are a shockingly large number of cases where the sentence of punishment awarded to the accused is not in proportion to the gravity and magnitude of the offence thereby encouraging the criminal and in the ultimate making justice suffer by weakening the system’s credibility,” the Chief Justice observed.

Citing a precedent, Chief Justice Dattu held that “the extreme punishment of death would be justified and necessary in cases where the collective conscience of society is so shocked that it will expect the holders of judicial power to inflict death penalty irrespective of their personal opinion”.

AICTE norms violation: colleges in Telangana at a loss to explain ‘shared’ faculty


Allegations the handiwork of rival groups’

In the midst of barren lands in a remote village in Nalgonda district of Telangana, the small building is the only concrete structure around. There is hardly any movement of students or faculty in the building to reflect that it is an educational institution. The silence around it is punctured occasionally by the rural youngsters riding bikes to reach their villages.

The Adusumilli Vijaya College of Engineering in Maisireddypalli village in Bommlaramaram Mandal and the Adusumilli Vijaya Institute of Technology and Research Centre share 15 faculty members, as per the data from the All India Council for Technical Education (AICTE), extracted and analysed by the public data website ‘Factly’. These were among the 174 colleges recently denied permission by the Telangana government to admit students for lack of faculty and infrastructure.

Zero admissions

The college had zero admissions in the last three years, but it has managed to attract a group of students from Kerala in the management quota for the Petroleum Engineering course. “We have facilities and faculty required for the course,” is all that the director of the college, who refused to identify himself, told The Hindu by way of explanation.

In West Godavari district of neighbouring Andhra Pradesh, the 100-acre Sri Vishnu Educational Society campus at Bhimavaram has an exclusive community FM radio station and concrete structures, and students and faculty members praise the facilities. Yet Sri Vishnu Institute of Technology and Smt. B. Seetha Polytechnic College run by the society share 17 faculty members, as per the data. Generally, M. Tech students pursuing correspondence courses conduct classes for polytechnic students, society’s director D. Suryanarayana explained. After completing the M. Tech course, they are employed by the Vishnu Institute of Technology to conduct lab sessions and summer classes. “Out of negligence,” the polytechnic college staff could have failed to update the list of such faculty members and continue to list them to be on their rolls, Mr. Suryanarayana said.

In Kanyakumari district of Tamil Nadu, the KNSK College of Engineering at Therekalputhoor and NSK Polytechnic College at Chenbagaramanpudur, which would appear to share 11 teachers, are nine km apart. K. Thanappan, chairman of the Vellalar Trust that runs the two institutions, besides an Industrial Technical Institute, claims that it is a false allegation aimed at maligning the name of the trust. He said it might be the handiwork of rival groups within the trust.

Official data from eight major States shows that over 90 per cent of engineering colleges have at least one teacher whose name also features on the rolls of another college, and there are at least 50,000 such ‘duplicate’ teachers.

It has long been an open secret that engineering colleges ‘share’ faculty members to meet official norms; now there is data to prove it. Official data from eight major States shows that over 90 per cent of engineering colleges have at least one teacher whose name also features on the rolls of another college, and there are at least 50,000 such ‘duplicate’ teachers.

All accredited engineering colleges must submit to the All India Council for Technical Education (AICTE) the names of their faculty members, and colleges are not supposed to share faculty.

Open data campaigner Rakesh Reddy Dubbudu and his team at the public data website ‘Factly’ downloaded faculty data from the AICTE site for eight States and searched them for duplicates. They shared their findings with The Hindu.

In Andhra Pradesh and Telangana, nearly 8,000 names were repeated across more than one college, Mr. Dubbudu and his team found, which meant that a quarter of the total engineering faculty in the States consisted of duplicate names. In all, nearly 90 per cent of the over 1,500 accredited engineering colleges in the States had at least one ‘duplicate’ teacher on their faculty.

8,000 repeats in TN

In Tamil Nadu, over a fifth of all faculty names were repeated and over 8,000 teachers seemed to be working in more than one college. In Maharashtra, over a quarter of all faculty names consisted of repetitions and over 95 per cent of colleges had at least one such ‘duplicate’ teacher. In all, nearly 8,000 teachers in the State were present in the lists of multiple colleges’ faculty lists.

In Uttar Pradesh, over half of faculty names consisted of repetitions, while in Odisha it was 40 per cent. Every engineering college in the two States had at least one such repetition. Over 2,500 faculty members in Odisha and over 8,000 in U.P. were named in multiple colleges.

In Gujarat, over 2,000 teachers’ names were found in more than one college, while in Karnataka had 3,000 such 'duplicate' teachers. Over 97 per cent of colleges in Gujarat had at least one duplicate name while in Karnataka it was over 92 per cent.

AICTE silent

Neither the colleges nor the AICTE could offer an explanation. Despite phone calls and an emailed questionnaire, no AICTE official responded to The Hindu’s questions.

Even accounting for the probability of some people sharing the same name, the data, Mr. Dubbudu said, showed that norms were being flagrantly violated. “If people like us can find these trends using data on AICTE website, I am sure it is far easier for AICTE to find this out if they are willing to,” he said. The findings build a case for greater public access to official data, he said.

In Tamil Nadu’s Kanyakumari district, KNSK College of Engineering at Therekalputhoor and NSK Polytechnic College at Chenbagaramanpudur share 11 faculty members. Yet, Dr. K. Thanappan, chairman of the Vellalar Trust running the institutions, says it is a “false allegation.”

NAAC accredits 14 institutions with 'A' grade

COIMBATORE: The National Assessment and Accreditation Council (NAAC) has accredited 22 colleges and universities in Tamil Nadu. Of the 22, 14 institutions have been accredited with 'A' grade.

The Jaspal Sandhu-led committee assessed 118 colleges and universities across the country in the first cycle, and 157 institutions in the second and the third cycle. In the first cycle, the committee accredited 15 colleges, including one university. A total of eight institutions were given 'A' grade in the first cycle, and the rest were awarded 'B' grade. Periyar University, Salem is among the institutions that have been given 'A' grade in the first cycle.

In the second and third cycle, the Jaspal Sandhu committee assessed 157 institutions, and reassessed one institution after the end of the third cycle. Out of the 157 institutions, seven were from Tamil Nadu. While four were awarded 'A' grade in the second cycle, both colleges from Tamil Nadu that had applied for the assessment in the third cycle were given 'A' grade.

The 'A' grade from NAAC makes the institutions eligible for availing funding from the University Grants Commission to run vocational courses on skill based learning. This February, the UGC had announced that all private institutions that are accredited with NAAC 'A' grade are eligible to apply for funding to the UGC to run vocational courses. It had asked the universities to which the colleges are affiliated, to accept applications for vocational courses and funding.

The decision was taken to give boost to colleges under the National Skill Based Qualification (NSDQ) framework. The focus of these vocational courses would be to impart skill-based learning to students. While the Union government had decided to fund government institutions to start vocational courses, the UGC's decision to fund private institutions is expected to encourage these institutes to offer vocational courses.

ஜெ.வழக்கில் தீர்ப்புக்கு பிறகு என்ன நடக்கும்? - ஆச்சார்யா பரபரப்பு பேட்டி!

பெங்களூரு: சொத்துக் குவிப்பு வழக்கில் ஜெயலலிதாவின் மேல்முறையீட்டு மனு மீதான தீர்ப்பு வரும் திங்கட்கிழமை வழங்கப்பட உள்ள நிலையில், தீர்ப்புக்கு பிறகு என்ன நடக்கும் என்பது குறித்த கேள்விக்கு கர்நாடக அரசு தரப்பு வழக்கறிஞராக நியமிக்கப்பட்டுள்ள பி.வி. ஆச்சார்யா, பெங்களூருவில் இன்று செய்தியாளர்களுக்கு அளித்த பேட்டியில் பதிலளித்துள்ளார். 

ஜெயலலிதா மீதான சொத்துக் குவிப்பு வழக்கு மேல்முறையீட்டு மனு விசாரணையில், அரசுத் தரப்பில் ஆஜரான சிறப்பு வழக்குரைஞர் பவானி சிங்கின் நியமனம் செல்லாது என உத்தரவிடக் கோரி, திமுக பொதுச் செயலாளர் க.அன்பழகன், உச்ச நீதிமன்றத்தில் வழக்குத் தொடுத்தார்.
இந்த வழக்கை விசாரித்த உச்ச நீதிமன்றம், பவானி சிங்கின் நியமனம் செல்லாது என்று தீர்ப்பு வழங்கியதை தொடர்ந்து,  அரசுத் தரப்பு சிறப்பு வழக்குரைஞராக பி.வி.ஆச்சார்யா நியமிக்கப்பட்டார்.

இதனையடுத்து உச்ச நீதிமன்ற உத்தரவின்படி,  18 பக்கங்கள் கொண்ட எழுத்துப்பூர்வமான வாதத்தை நீதிமன்றத்தில் ஆச்சார்யா தாக்கல் செய்தார்.

அதில் "ஜெயலலிதா, சசிகலா, இளவரசி, சுதாகரன் உள்ளிட்டோர் மீதும், அவர்கள் அங்கம் வகிக்கும் 35 நிறுவனங்கள் பேரிலும் சட்ட விரோதமாகச் சொத்துகள் குவிக்கப்பட்டுள்ளன. இதுதொடர்பாக சாட்சிகளின் வாக்குமூலங்கள் ஏற்கெனவே சிறப்பு நீதிமன்றத்தில் தாக்கல் செய்யப்பட்டன.

இதன்மூலம், ஜெயலலிதா, சசிகலா, இளவரசி, சுதாகரன் ஆகியோர் கூட்டுச் சதியில் ஈடுபட்டு, சொத்துகள் குவித்துள்ளது உறுதியாகியுள்ளது. இதையடுத்து, ஊழல் தடுப்புச் சட்டம் 120 பி-இன் கீழ் சிறப்பு நீதிமன்றம் ஜெயலலிதா, சசிகலா, சுதாகரன், இளவரசி ஆகியோருக்குத் தண்டனை வழங்கியது. அதை உயர் நீதிமன்றமும் உறுதிசெய்ய வேண்டும். 

மேலும் இந்த மேல்முறையீட்டு மனுவே சட்டப்பூர்வமானது அல்ல. இந்த வழக்கை நடத்தியது கர்நாடக அரசு. அவர்கள்தான் சிறப்பு நீதிமன்றத்தில் வழக்கறிஞரை நியமித்து வாதங்களை வைத்தார்கள். வழக்கின் தீர்ப்பு வந்து, மேல்முறையீட்டுக்கு இந்த வழக்கு போனது என்றால், எதிர் மனுதாரராகக் கர்நாடக அரசைச் சேர்த்திருக்க வேண்டும், அவர்களது பதிலை வாங்கி இருக்க வேண்டும். அப்படி கர்நாடக அரசுக்குத் தெரியாமல் மேல்முறையீட்டு மனுவைத் தாக்கல் செய்து விசாரணையை முடித்திருக்கிறார்கள். எனவே இந்த மேல்முறையீட்டு மனுவே செல்லாது' என்று கூறியிருந்தார். 

இந்நிலையில் இன்றைய பேட்டியில் தமது இந்த எழுத்துப்பூர்வ வாதத்தை மீண்டும் குறிப்பிட்டார். 

அதனைத் தொடர்ந்து, திங்கட்கிழமை தீர்ப்பு எப்படி இருக்கும் என்று செய்தியாளர்கள் கேட்டபோது, தம்மால் அதுமாதிரி யூகமாக எதையும் கூற முடியாது அது தொடர்பாக பதிலளிக்க மறுத்து விட்டார். 

"அதே சமயம் தீர்ப்பு தேதியன்று ஜெயலலிதா நீதிமன்றத்தில் நேரில் ஆஜராக தேவையில்லை. ஒருவேளை தீர்ப்பில் ஜெயலலிதா தாக்கல் செய்த மேல்முறையீட்டு மனுவை உயர் நீதிமன்றம் தள்ளுபடி செய்தாலும், அதற்கான உத்தரவு விசாரணை நீதிமன்றத்திற்கு செல்லும். பின்னர் விசாரணை நீதிமன்றம்தான் ஜெயலலிதா உள்ளிட்டோரை தனது கஸ்டடியில் எடுத்துக்கொள்ளும். அதே சமயம், தீர்ப்பு பாதகமாக வந்தாலும் உச்ச நீதிமன்றத்தில் அப்பீல் செய்து நிவாரணம் தேடிக்கொள்வதற்கான வாய்ப்பு ஜெயலலிதாவுக்கு உள்ளது"  என்று ஆச்சார்யா தனது பேட்டியில் மேலும் கூறினார்.
