In a significant ruling, the Madras High Court Bench here on Friday held that it could not compel a school to admit a meritorious student if the institution happened to give paramount importance to discipline than marks and was not satisfied with the student’s character.

Justice S. Vadiyanathan made the observation while dismissing a writ petition filed by the father of a girl who had scored 489 out of 500 marks in her Class X examinations but was not allowed to pursue Class XI in the same school since she was allegedly disobedient and disrespectful. “In this country, parents think that they are the best judges to judge their children but practically it is not so. Teachers are the best judges as students spend most of their time only with teachers and it is easier for them to assess the behaviour of each of the students,” the judge said.

He went on to state: “It is no doubt true that education is the panacea for all the evils in the world but education having no moral values and behaviour will definitely vouchsafe reversal attitude. Knowledge is not given but earned and character is not granted but cultivated.”

“Since the respondent school has stated that their educational institution is known for its integrity, discipline, values and virtues, this court cannot compel them to relax their slogan to suit to a particular student,” the judge said after the management refused to relent from its decision to deny admission.

Recording the statement of the school’s counsel, S. Srinivasa Raghavan, that it could not tolerate indiscipline on its campus, the judge said that the student might not feel comfortable even if she succeeded in getting admitted to the institution through court orders. He said that the petitioner, his daughter and the teachers of the school would always suffer from “some mental block and there will not be a healthy atmosphere” if the student happened to be awarded lesser marks in school level examinations after her admission.

“The principal and correspondent of the school being nuns have sacrificed their lives for the cause of society and student community in particular. Therefore, it cannot be said that they refused to admit the petitioner’s daughter with some ulterior motive,” the judge added.

Abrupt Mail on Expired Membership Irks 3 RGUHS Syndicate Members

BENGALURU: Three syndicate members of the Rajiv Gandhi University of Health Sciences (RGUHS), Bengaluru were told they were no longer members just a few hours before the syndicate was due to meet on Friday. The university informed them of their status through emails, which it described as “thanks-giving letters”.

Questioning the university’s action, the three members said they would fight it legally. Speaking to Express, Dr Ramesh Reddy, a recipient of the mail, said, “On Thursday evening, we got the mail saying our syndicate membership has expired, and we don’t need to attend the meeting scheduled to be held on Friday.”



The email stated that the university has sought legal opinion, and cited a judgement in a similar case of Bangalore University in 1999, he said. “But the Act and Statute of Bangalore University and RGUHS are different. As per the RGUHS Act, the senate, syndicate and academic council have to be reconstituted once in three years. If it is a reconstitution, then this applies to all the nine members, who are nominated by the governor, the senate and the Vice-Chancellor (VC). But only three of us received the communication,” Dr Reddy said. The three members were elected from the senate to the syndicate.

“They mention in the mail the senate has been reconstituted from June 12, 2015. If that is so, what were they doing all these days?” Reddy said.

The members said they got this mail minutes after they met university authorities and inquired why they had not received the agenda for the syndicate meeting on Friday.

The mail, a copy of which is available with Express, says, “The considered opinion of the experts is that the senate of RGUHS shall be reconstituted wef 12.6.2015 for three years. Hence, the term of members of senate and syndicate, except of the ex-officio members, shall come to an end on 11.6.2015 as per Section 31 of RGUHS Act, 1994.”

When contacted, VC of RGUHS Dr K S Ravindranath said, “Most of them knew their term has ended. We had intimated them. One member said he has three-four months’ time as his election was late, following which we took legal advice. We communicated the same to the members through a mail just to clarify it.”

CHENNAI: It's advantage Class 12 students of previous batches in MBBS admissions this year in Tamil Nadu with the Madras high court on Friday ruling that they cannot be barred from taking up seats. If students fail to secure admission to the professional course of their choice in the first attempt, they cannot be declared ineligible for admission in the subsequent year, the court said, dismissing petitions filed by the students who passed out this year.

The students of the 2014-15 batch had moved the court saying taking advantage of low cutoff marks this year, more than 4,670 students from previous years had applied for MBBS counselling this year. Their counsel V Raghavachari submitted that at least 50% of the available 2,200-odd MBBS seats in government colleges would be garnered by candidates from previous years. The court had restrained the state government from issuing admission cards to Class 12 students selected for MBBS course this year.

Following the verdict, the selection committee started issuing admit cards to the students who were allotted seats in the first phase of counselling held from June 19 to June 25. The directorate of medical education said about 1,653 students from the current batch and 544 from the previous years have secured admission.

"As soon as the verdict came we started issuing admit cards to the selected candidates. Things are proceeding smoothly and the second phase of counselling would begin in the third week of next month," said selection committee secretary Dr Usha Sadasivan.

On Friday, a division bench of Justice Sathish K Agnihotri and Justice M Venugopal said the prospectus for admission and provisions of the Tamil Nadu Admission in Professional Educational Institutions Act did not prevent students from previous years from taking part in counseling. The argument that the students of the latest batch would be prejudiced as there were fewer centum scores in relevant subjects in the Class 12 examination this year as compared to the previous year was not relevant, it said. "Securing marks in exam depended on several factors like question papers and evaluation. If more number of students have secured more marks that by itself cannot be a ground to take a view that the selection on merit would suffer," said the bench.

"The year of clearing the qualifying examination is irrelevant," the bench said. The rules only barred only those students who are already pursuing MBBS/BDS courses from participating in the admission counseling, it said.

The judges said the state had enacted the act for admission in professional institutions to regulate the admission process. As the constitutional validity of the act was not challenged, the court could not direct the authorities to conduct a common entrance test for admission, they said. Presently, students are admitted to medical and engineering colleges affiliated to state universities based on their Class 12 scores.

திட்டக்குடி அருகே உள்ள ஒரு கிராமத்தைச் சேர்ந்த மோகன் என்ற கல்லூரி மாணவர், பக்கத்து வீட்டில் இருந்த 15 வயது பெண்ணை கற்பழித்ததன் விளைவாக அவள் கர்ப்பமாகி, ஒரு குழந்தையையும் பெற்றெடுத்துவிட்டாள். மோகனுக்கு 7 ஆண்டுகள் தண்டனை விதிக்கப்பட்டு, 3 ஆண்டுகளுக்குப்பிறகு ஜாமீன் கேட்டவழக்கில், அந்த பெண்ணின் 22–வது பிறந்தநாளன்று இந்த தீர்ப்பு வழங்கப்பட்டுள்ளது. இந்த வழக்கில் பாதிக்கப்பட்ட பெண்ணுக்கு முன்பும், எந்த பாவமும் அறியாத அவள் குழந்தைக்கு முன்பும் ஒரு பெரிய கேள்விக்குறி நிற்கிறது. இதுபோன்ற வழக்கில் அந்த குழந்தையும் சூழ்நிலையால் பாதிக்கப்பட்டவள்தான். எந்த தவறும் செய்யாத அந்த குழந்தை, சமுதாயத்தில் அவமானத்தை சுமக்க பிறந்து இருக்கிறது. இது பெரிய துயரமாகும். இந்த குறிப்பிட்ட வழக்கை பொருத்தமட்டில், இருவருக்கும் இடையே ஒரு சமரசதீர்வு காணுவதுதான் சாலச்சிறந்ததாகும் என்று கூறி, சமரச நடைமுறை முடியும் மட்டும் மோகனை ஜாமீனில்விட உத்தரவிட்டார்.

எம்.பி.பி.எஸ். மற்றும் பிடிஎஸ் படிப்புகளில் சேர்வதற்கான கலந்தாய்வில் பங்கேற்க கடந்த ஆண்டு மாணவர்களுக்கு அனுமதி அளித்து சென்னை உயர் நீதிமன்றம் அதிரடியாக உத்தரவிட்டுள்ளது.

இந்த ஆண்டு நடைபெறும் மருத்துவக் கலந்தாய்வில், கடந்த ஆண்டு தேர்ச்சி பெற்ற மாணவர்களை அனுமதிக்கக் கூடது என்று கோரி, இந்த ஆண்டு பிளஸ் 2 தேர்வில் தேர்ச்சி பெற்ற சுமார் 60 மாணவர்கள் சென்னை உயர் நீதிமன்றத்தில் தாக்கல் செய்த மனுக்கள் தள்ளுபடி செய்யப்பட்டுள்ளது.

இந்த ஆண்டு கட் ஆப் மதிப்பெண் குறைந்திருப்பதால், கடந்தாண்டு மாணவர்களை கலந்தாய்வில் பங்கேற்க அனுமதித்தால், இந்த ஆண்டு படித்த மாணவர்களுக்கான வாய்ப்பு பாதிக்கப்படும் என்று கூறி 63 மாணவர்கள் சென்னை உயர்நீதிமன்றத்தில் வழக்கு தொடர்ந்தனர்.

இந்த வழக்கு விசாரணை நடந்து கொண்டிருக்கும் போதே, மருத்துவக் கலந்தாய்வை நடத்த அனுமதித்த சென்னை உயர்நீதிமன்றம், பழைய மாணவர்களும் கலந்தாய்வில் பங்கேற்க அனுமதித்தது. ஆனால், இட ஒதுக்கீட்டு ஆணையை மட்டும் வழங்க தடை விதித்திருந்தது.

இதற்கிடையே கலந்தாய்வில் கடந்த ஆண்டு தேர்ச்சி பெற்றவர்களில் சுமார் 500க்கும் மேற்பட்ட மாணவர்கள் பங்கேற்று மருத்துவப் படிப்புக்கான சேர்க்கைக்கு தகுதி பெற்றுள்ளனர் என்பது குறிப்பிடத்தக்கது.

மருத்துவ படிப்பு: சேர்க்கைக் கடிதம் எப்போது கிடைக்கும்?

எம்பிபிஎஸ் மற்றும் பிடிஎஸ் மருத்துவப் படிப்புகளுக்கான கலந்தாய்வில் பங்கேற்று சேர்க்கைப் பெற்ற மாணவர்கள், தங்களுக்கான சேர்க்கைக் கடிதத்தை இன்று 11 மணி முதல் கலந்தாய்வு நடைபெற்ற ஓமந்தூரார் அரசு பல்நோக்கு உயர் சிறப்பு மருத்துவமனை அரங்கில் பெற்றுக் கொள்ளலாம் என்று தெரிவிக்கப்பட்டுள்ளது.

மருத்துவக் கலந்தாய்வு குறித்து இந்த ஆண்டு தேர்ச்சி பெற்ற மாணவர்கள் தொடர்ந்த வழக்கில், கலந்தாய்வில் கடந்த ஆண்டு தேர்ச்சி பெற்ற மாணவர்களும் கலந்து கொள்ளலாம் என்று இன்று காலை சென்னை உயர்நீதிமன்றம் அதிரடி தீர்ப்பை வழங்கியது.

இதையடுத்து, இதுவரை கலந்தாய்வில் பங்கேற்ற மாணவர்களுக்கு சேர்க்கைக் கடிதம் வழங்கப்படாமல் இருந்த நிலையில், தீர்ப்பு வெளியானதை அடுத்து, இன்று முற்பகல் 11 மணி முதல், சேர்க்கைக் கடிதம் வழங்குவதற்கான ஏற்பாடுகள் செய்யப்பட்டுள்ளது.

சென்னையில் கடந்த ஒரு வாரமாக நடைபெற்ற மருத்துவப் படிப்புக்கான கலந்தாய்வில் 20 அரசு மருத்துவக் கல்லூரிகளில் தமிழக ஒதுக்கீட்டுக்கு உரிய அனைத்து 2,257 எம்.பி.பி.எஸ். இடங்களுக்கும் மாணவர்கள் தேர்வு செய்யப்பட்டனர்.

இதேபோன்று 8 சுயநிதி மருத்துவக் கல்லூரிகள் சமர்ப்பித்த 597 அரசு ஒதுக்கீட்டு எம்.பி.பி.எஸ். இடங்கள், சென்னை பாரிமுனையில் உள்ள அரசு பல் மருத்துவக் கல்லூரியில் தமிழக ஒதுக்கீட்டுக்கு உரிய 85 பி.டி.எஸ். இடங்களுக்கும் மாணவர்கள் தேர்வு செய்யப்பட்டனர்.

சென்னை ஓமந்தூரார் அரசு பல்நோக்கு உயர் சிறப்பு மருத்துவமனை அரங்கில் கடந்த ஜூன் 19-ஆம் தேதி தொடங்கிய எம்.பி.பி.எஸ், பி.டி.எஸ். படிப்புகளுக்கான முதல் கட்டக் கலந்தாய்வு வியாழக்கிழமை (ஜூன் 25) முடிவுக்கு வந்தது.

இதில் பங்கேற்று சேர்க்கை பெற்றவர்கள், அவர்களுக்கான சேர்க்கைக் கடிதங்களை நேரில் சென்று பெற்றுக் கொள்ளலாம் என்றும், மாலை அல்லது இரவு நேரத்தில் வந்தாலும் சேர்க்கைக் கடிதம் எந்த வித இடைநிறுத்தமும் இல்லாமல் எந்த நேரமும் வழங்குவதற்கு ஏற்பாடு செய்யப்பட்டுள்ளதாகக் கூறப்படுகிறது.
