Pondy hikes MBBS fee in govt college steeply

The Puducherry government has steeply hiked the fees for MBBS programme in the Indira Gandhi Government Medical College and Research Institute (IGMC & RI) from the academic year 2018-19, much to the distress of the students and parents.

A committee constituted by Perunthalaivar Kamaraj Medical College Society, which manages the government college, has hiked annual fees from ₹75,000 to ₹1.37 lakh for the first year MBBS, from ₹52,500 to ₹1,00,500 for the second year and from ₹35,000 to ₹67,000 for the third and fourth years. The fee for the additional batches has been hiked from ₹17,500 to ₹33,500. The committee has also decided to start collecting academic fees (₹10,000 per semester). The revised fees will be utilised for training of students and research projects among other expenses, according to the minutes of the committee meeting.

Batting for establishing more medical education institutions, both at the state and central level Madras high court has said, “It is imminent on account of the current needs of the nation and that the governments are expected to do so by performing their duties as expectedunder theDirectivePrinciples of State Policy enumerated in the Constitution.”

Justice S M Subramaniam made the observation while dismissing a batch of pleas moved by MBBS doctors seeking to include their names in the merit list for admission to PG medical courses under state quota. Their plea was dismissed since they have already allotted seats under All-India quota.

“Right to participate in the process of admission is a fundamental right. Equal opportunity to participate in the admission process is a constitutional mandate. However, such an opportunity providedto participate in the process of admission or selection will not confer any legal right for choosing a place of their choice or a branch, which is not contemplated either under the statute or under the prospectus issued to these students.They had acceptedthe prospectus and the terms and conditions stipulated therein. In the event of any violation of terms and conditions stipulated in the prospectus, then alone the petitioners can move a petition for redressal of their grievances. Contrarily, they cannot come out with a writ petition by stating that more chances are to be given to them for purpose of choosing the branch of study or choice of their place,” Justice Subramaniam said.

According to the petitioners, they had not been given an opportunity to avail the state quota as per the scheme of admission provided for PG degree/diploma courses, since the process was delayed by the state government.

Refusing to accept the contentions, the judge pointed out that the state is not responsible for non-publication of state merit rank list to fill up its quota. The delay was actually because of pendency of litigations before this court.

This being the factum of the case, this court is of an undoubted opinion that the writ petitionershave notestablished any legal right, to consider the reliefs, as such, sought for in these batch of writ petitions. The grounds raisedin respectof the choice of the students are also untenable, the court concluded.
Student gets HC nod to sit for three retests

In a rare gesture, Madras high court has permitted a Class XI girl of a city-based CBSE school to take re-examination in three subjects in the recently concluded public examination, in which she failed due to ill-health.

However, the court has made it clear that the re-examination is allowed only to clear transfer certificate and that she cannot insist to continue in the same school since similarly placed other students who were already issued transfer certificates could not be prejudiced.

Justice S Vaidyanathan passed the order on a plea moved by P Sharon Nivedita of Padma Seshadri Bala Bhavan Senior Secondary School at K K Nagar. She had failed to clear physics, chemistry and mathematics in the 2017-18 batch of public examination for Class XI.

Citing ill-health for her inability to clear the subjects, the petitioner wanted the court to direct the school to allow her to take reexamination of all the three subjects and permit her to pursue Class XII in the same school during 2018-2019.

Pointing out that in many instances, the CBSE has allowed students to take re-test in two subjects, the petitioner wanted the court to permit her to take retest in three subjects as a special case.

When the plea came up for hearing, counsel for the school submitted that even though the school has erred in permitting students who have failed in two subjects, to take up re-examination, the petitioner will not have any right to appear in three subjects, as CBSE Regulations does not permit it. Even in case the petitioner clears all the three subjects in the re-examination, she shall not insist the school management that she will continue in the same school, as students who have already taken transfer certificate with the remarks ‘Detained’ could not be prejudiced and it would amount to discrimination, the school added.

As the petitioner agreed to the condition, the court directed the school to permit her to sit for the examinations and, in case she clears, provide a transfer certificate to enable her to join Class XII in some other school.
Dogs bite 3, Ambattur residents fear rabies

Chennai: Three attacks by stray dogs in two days have left Ambattur on tenterhooks, fearing that the dogs that bit a senior citizen and two children could have been rabid. The city corporation played down the situation, saying it had caught the dog that bit a woman in her sixties on Monday. But Ambattur zone veterinary surgeon Dr Selvaraj said the trapped dog was with the SPCA, and that the corporation had yet to ascertain if the dog is rabid.

“There is no need to panic,” he said. “There are no rabid dogs roaming the streets of Ambattur.” Kamalapuram Colony resident R Ambujam, however, may not be be quite reassured — a stray dog having attacked her unprovoked as she was attending to household work in her backyard on Monday. “She had no time to react. The dog bit her in multiple places,” Ambujam’s son R Srinivasan said. “We rushed her to a nearby hospital.”

Srinivasan said locals had complained to the corporation about the stray dog situation. “During the weekend, strays bit two children who had come to a Sai Baba temple in the neighbourhood,” he said.Mathew Varghese, a resident of Ambattur, said the complaints to the civic body evoked no response. “We had been complaining about the stray dog trouble for the past few weeks,” he said, adding that corporation officials did not send anyone to respond to the complaints.
Failure to pay rent: Landlord locks up woman tenant, 65

A 45-year-old landlord allegedly locked up his 65-year-old tenant at the house in Kasimedu as she failed to pay the rent for the last four months. The woman called up her relatives over phone, who freed her from the house.

Papathi, was residing alone in the first floor of a building at Kasima Nagar in Kasimedu. Ranganathan, a fisherman had rented his house to Papathi a few years ago. The landlord visited her on Saturday to collect the rent was disappointed after she sought some more time to remit the rent for this month. The police sources said that the landlord was frustrated as every month, the tenant came up excuses without paying the rent.

As soon as he left at 9pm, the lady retired to sleep. Only on Sunday, when she decided to go out to the market, she realized that she was locked up by Ranganathan.

Papathi, tried to reach out to neighbours seeking their help, but in vain. Then she phoned up her relative Vijaya who informed the police about the incident. A team of police personnel reached the spot and broke the lock of the house and rescued the woman. Based on her complaint, Kasimedu police have launched a hunt for the landlord.

“Ranganathan had locked her inside the house and had gone to his native place along with his family on Saturday night. He did not receive rent for nearly four months,” said an investigating officer. “We will question him when he returns to his house,” said the officer.
NEXT may be must for foreign med graduates

Foreign medical graduates keen on practising in India may have to clear the National Exit Test instead of Foreign Medical Graduates Exam from next year.

In an attempt to streamline medical education and maintain uniformity in quality of doctors practicing in the country, the health ministry is planning to merge FMGE with NEXT, which has been proposed to assess quality of MBBS graduates.

Currently, foreign medical graduates are required to write the FMGE and show MCI eligibility certificates to become eligible to practise here. Now the government is planning to merge FMGE with NEXT and scrap the MCI eligibilty score. Graduates from abroad will also have to take NEET and then NEXT to qualify for practice in the country.

The proposal of NEXT is part of the National Medical Commission Bill, 2018, which is likely to be taken up in the monsoon session of Parliament. The bill, which was amended following recommendations of the parliamentary standing committee on health, now proposes a uniform national exit test in the final year of MBBS course to test the quality of the graduating MBBS students.

Ministry may use NEXT to assess quality of passouts

According to the health ministry, in 2015-16, only 610 out of 5,863 Indian students who pursued medical graduation abroad passed the screening test conducted by the MCI. However, the number of such students going abroad, mainly to China, are constantly increasing because while seats in government medical colleges in India are limited, pursing MBBS in private colleges here is a very high cost affair.

The ministry is now also considering a proposal to scrap FMGE and instead use NEXT to assess the quality of foreign medical pass outs as well. “This will ensure a uniform yardstick for assessing all doctors practicing in India, which precisely is the objective of an exit exam,” an official said. FMGE are conducted twice a year – in June and December - – and require a minimum of 50% marks to clear.

Earlier this year, the ministry had also made it mandatory for Indian students to clear the National Eligibility cum Entrance Test (NEET) if they want to pursue medical studies outside the country. According to the new rules, students going abroad to study would no longer need eligibility certificates from the Medical Council of India if they want to study abroad and later return to India to write the FMG test and practise medicine. Instead, they will have to produce NEET score before writing NEXT.

The idea is to improve the quality of foreign medical graduates returning to India to practice.

ஒவ்வொரு வினைக்கும் சமமான எதிர்வினை உண்டு என்கிற நியூட்டனின் மூன்றாம் விதியை, இயற்பியல் பட்டம் பெற்றவரான உச்ச நீதிமன்ற நீதிபதி ஜஸ்டி செலமேஸ்வர் நன்கு அறிந்திருப்பார். ஆனால், மேன்மையான மனிதர்களிடமிருந்து எந்தச் சூழலிலும் மேன்மையான எதிர்வினைதான் வரும் என்பதற்கு அவரே வாழும் உதாரணம்.

ஜனவரி 12, 2018 அன்று ரஞ்சன் கோகாய், மதன் பி. லோகுர், குரியன் ஜோசஃப் ஆகிய உச்ச நீதிமன்ற நீதிபதிகளுடன் சேர்ந்து ஊடகங்களுக்குப் பேட்டியளித்தார் செலமேஸ்வர். ‘இந்திய நீதித் துறை வரலாற்றில் முன்னுதாரணமற்றது’ என்று வர்ணிக்கப்பட்ட அந்தப் பேட்டியில், உச்ச நீதிமன்றத்தில் ஜனநாயகம் கேள்விக்குறியாகி இருப்பதை அம்பலப்படுத்தினார் செலமேஸ்வர். நீதித் துறையின் கோயில் என்று கருதப்பட்ட இடம் அப்படி ஒன்றும் புனிதமானதல்ல என்ற உண்மையை நாட்டு மக்களிடம் அப்பட்டமாகக் கொண்டுவந்தார்.

இதற்கான எதிர்வினையாக அந்த ஊடகச் சந்திப்புக்குப் பிறகு முக்கியத்துவம் வாய்ந்த எந்த வழக்கும் செலமேஸ்வருக்கு ஒதுக்கப்படவில்லை. இதுபற்றி ஊடகவியலாளர் கரண் தாப்பர் எழுப்பிய கேள்விக்கு செலமேஸ்வர் அளித்த பதில் இதுதான்: “சிறந்த விஷயங்களைச் சின்ன வழியில் செய்ய முடியும். சின்ன விஷயங்களையும் சிறந்த வழியில் செய்ய முடியும் என்பதை நான் நம்புகிறேன். ஒரு நீதிபதியின் முக்கியத்துவம் அவருக்கு ஒதுக்கப்படும் வழக்குகளின் தன்மையை வைத்து தீர்மானிக்கப்பட வேண்டியதில்லை.”

ஆம், எதிர்ப்புக் குரல் எழுப்பியதற்காக அவர் பழிவாங்கப்படுகிறார் என்று பலரும் பேசியபோதும் அதை அவரே உணர்ந்திருந்தபோதும்கூட நீதித் துறை மீதோ தலைமை நீதிபதியின் மீதோ ஒரு சுடுசொல்கூட பிரயோகிக்கவில்லை செலமேஸ்வர். அவர் நீதித் துறையை, நீதிமன்றம் என்ற அமைப்பை அவ்வளவு மதித்தார். அந்த மதிப்புக்கு இழுக்கு ஏற்பட்டுவிடக் கூடாது என்பதற்காகவே பேசினார். தலைமை நீதிபதிக்கு எதிரான பதவிநீக்க நடவடிக்கையும்கூட அவர் ஆதரிக்கவில்லை. சீர்திருத்தத்தையே அவர் விரும்பினார், சீர்குலைவை அல்ல.

திருப்பங்கள் நிறைந்த திரைக்கதை

அமைப்பை விமர்சிப்பவர்கள் அனைவரையும்விட அதிக சுய ஒழுக்கம் கொண்டவர்களாக இருக்க வேண்டும். அதை உணர்ந்திருக்கிறார் செலமேஸ்வர். ஓய்வுக்குப் பின் எந்த அரசுப் பணியையும் ஏற்க மாட்டேன் என்று அறிவித்திருக்கிறார். பல நீதிபதிகள் ஓய்வுக்குப் பின் ஆளுநர்களாகவும் விசாரணைக் குழுத் தலைவர்களாகவும் நியமிக்கப் படும்போது பணிக்காலத்தின்போது அவர்களது நேர்மை யும் நடுநிலையும் கேள்விக்குள்ளாகியிருக்கின்றன. செலமேஸ்வர் அந்தக் கேள்விகளுக்கு இடம்தரவில்லை. ஜனவரி 12, 2018 செலமேஸ்வரின் பணி வாழ்வின் உச்சம். அந்த உச்சத்துக்கு முன்பும் பல திருப்பங்கள் நிறைந்த திரைக்கதையைப் போன்றதுதான் அவரது வாழ்க்கை. ஆந்திர பிரதேசத்தின் கிருஷ்ணா மாவட்டத்தில், பெத்தமுட்டெவி கிராமத்தில் ஜூன் 23, 1953 அன்று ஒரு வழக்கறிஞரின் மகனாகப் பிறந்தார் செலமேஸ்வர். வீட்டிலிருந்து 25 கி.மீ. அப்பால் இருந்த பள்ளியில் படித்தார். சென்னை லயோலா கல்லூரியில் இயற்பியல் பட்டம் பெற்றவர், 1976-ல் ஆந்திர சட்ட பல்கலைக்கழகத்தில் சட்டம் படித்தார்.

அடுத்த 19 ஆண்டுகள் வழக்கறிஞர் பணி. 1995-ல் ஆந்திர அரசின் கூடுதல் தலைமை வழக்கறிஞராக நியமிக்கப்பட்டார். இரண்டு ஆண்டுகளுக்குள் ஆந்திர உயர் நீதிமன்றத்தின் கூடுதல் நீதிபதியானார். 2007-ல் குவாஹாத்தி உயர் நீதிமன்றத்தின் தலைமை நீதிபதியாகப் பதவி உயர்வுபெற்றார். அதையடுத்து கேரள உயர் நீதிமன்றத் தின் தலைமை நீதிபதியாகவும் இருந்தார். 2011-ல் உச்ச நீதிமன்ற நீதிபதியாக்கப்பட்டார். தலைமை நீதிபதிக்கு அடுத்த நிலையில் இருந்தவர், தலைமை நீதி பதியாக முடியாமல்போனது இந்தியாவின் துரதிர்ஷ்டங்களில் ஒன்று என்றே சொல்ல வேண்டும்.

செலமேஸ்வருக்கு இன்னொரு சுவாரஸ்யமான முகமும் இருக்கிறது. அவர் ஒரு தேர்ந்த இலக்கிய வாசகர் என்பதுதான் அது. தன்னுடைய நூலகத்தை இளம் வழக்கறிஞர்களும் தன் அலுவலகப் பணியாளர்களும் எப்போது வேண்டுமானாலும் பயன்படுத்திக்கொள்ள அனுமதித்தவர் அவர்.

தீர்ப்புகளின் மூன்று பிரதான அம்சங்கள்

நீதிபதியாக இருந்த காலத்தில் மாற்றுத் திறனாளி களுக்கு கைகொடுத்துத் தூக்கிவிட வேண்டியதன் அவசியத்தை உணர்ந்தவராகவும், தனிநபர்களின் உரிமைகளை மதிப்பவராகவும் நீதித் துறைக்கு இறுதியான தலையீடற்ற அதிகாரங்கள் இருக்கக் கூடாது என்று நினைப்பவராகவும் செலமேஸ்வர் இருந்தார் என்பதை அவர் வழங்கிய முக்கியமான தீர்ப்புகள் வெளிப்படுத்துகின்றன.

இவற்றோடு நீதித் துறையில் ஒரு சில சீர்திருத்தங்களை விளைவித்தவராகவும் அவர் இருந்திருக்கிறார். மாற்றுத்திறனாளிகளின் உரிமைகளை உயர்த்திப் பிடிக்கும் பல தீர்ப்புகளை வழங்கியிருக்கிறார் செலமேஸ்வர். ‘ராஜீவ் குமார் குப்தா எதிர் இந்திய ஒன்றிய அரசு’ என்ற வழக்கில் பதவி உயர்வின் மூலம் மட்டுமே நிரப்பப்படும் பணிகளுக்கும் மாற்றுத் திறனாளிகளுக்கான இடஒதுக்கீடு பொருந்தும் என்ற தீர்ப்பு அவற்றில் முக்கியமானது.

தகவல்தொடர்பு தொழில்நுட்பச் சட்டத்தின் பிரிவு 66-ஏ-யை, அரசியல்வாதிகள் சமூக வலைதளங்களில் தங்களை விமர்சிப்பவர்களைக் கைதுசெய்து சிறையில் அடைக்கப் பயன்படுத்தினர். கருத்துச் சுதந்திரத்தின் குரல்வளையை நெரிக்கும் இந்தப் பிரிவை 2016-ல் ரத்துசெய்தது செலமேஸ்வரை உள்ளடக்கிய இரண்டு நீதிபதிகள் கொண்ட அமர்வு. 2015-ல் அரசின் நல உதவிகளைப் பெற ஆதாரைக் கட்டாயமாக்குவதையும் இவரது தீர்ப்பு தடுத்தது.

ஆதார் தொடர்பான விவாதங்களின் வழியாகத் தனியுரிமை இந்தியர்களின அடிப்படை உரிமையாக நிலைநிறுத்தப்பட்டதற்கும் செலமேஸ்வருக்கே முக்கியப் பங்கு இருக்கிறது. தனியுரிமை என்பது அடிப்படை உரிமையா என்ற கேள்விக்கு விடைகாணும் பொறுப்பை ஒன்பது நீதிபதிகள் கொண்ட அரசியல் சாசன அமர்விடம் ஒப்படைத்தது இவர்தான். தனியுரிமையை அடிப்படை உரிமையாக அங்கீ கரிக்கும் வரலாற்றுச் சிறப்பு வாய்ந்த தீர்ப்பை வழங்கிய அமர்விலும் செலமேஸ்வர் இருந்தார். நீதிமன்றங்களுக்கு நீதிபதிகளை நியமிக்கும் கொலீஜியம் முறையில், உச்ச நீதிமன்ற நீதிபதிகளின் தனி அதிகாரத்தைத் தடுக்கும் வகையில், ‘தேசிய நீதிமன்ற நியமன ஆணையம்’ என்ற அமைப்பை உருவாக்க முயன்றது மத்திய அரசு.ஐந்து நீதிபதிகள் கொண்ட உச்ச நீதிமன்ற அமர்வில் நால்வர் இந்த ஆணையம் அமைக்கும் முயற்சியை அரசியல் சாசனத்துக்கு எதிரானது என்று சொல்லி ரத்துசெய்தனர். ஆனால், அந்தத் தீர்ப்பிலேயே கொலீஜியம் முறையை விமர்சித்து நீதிபதிகள் நியமனத்தில் வெளிப்படைத்தன்மையைக் கொண்டுவரும் முயற்சிக்கு ஆதரவளித்தார் செலமேஸ்வர்.

கொலீஜியம் கூட்டங்கள் முறைப்படி நடத்தப்படுவதில்லை; அந்தக் கூட்டங்கள் ரகசியமாக நடத்தப்படுகின்றன என்று விமர்சித்தார் செலமேஸ்வர். கூட்டங்களில் பங்கேற்க மறுத்தார். கொலீஜியம் கூட்டங்களில் விவாதிக்கப்பட்டவற்றைப் பொதுப் பார்வைக்கு உட்படுத்த தலைமை நீதிபதி ஒப்புக்கொண்டதற்கு இதுவே காரணமாக அமைந்தது.

ஓயாத எதிர்ப்புக் குரல்

என்ன நேர்ந்தாலும் கடைசிவரை எதிர்ப்புக் குரலை எழுப்பிக்கொண்டே இருந்தார் செலமேஸ்வர். கடந்த மார்ச் மாதம், மத்திய அரசின் தலையீட்டால், கர்நாடக உயர் நீதிமன்ற நீதிபதி கிருஷ்ணா பட்டின் பதவி உயர்வு நிறுத்திவைக்கப்பட்டபோது, இதுகுறித்து தலைமை நீதிபதிக்கு கடிதம் எழுதினார். அதில் அரசுக்கும் நீதித் துறைக்கும் இப்படிப்பட்ட ‘நட்பு’ இருப்பது ஜனநாயகத்துக்குச் சாவு மணி அடிக்கும் என்று கடுமையாக விமர்சித்திருந்தார்.

அமைப்புக்கு உள்ளிருந்தபடியே சீர்திருத்தத்துக்கு முயற்சிப்பவர்கள் பல இடையூறுகளையும் இழப்புகளை யும் எதிர்கொண்டபடியே அதைத் தொடர்ந்து செய்கிறார்கள். தனது இறுதிக் காலம் வரை அப்படி குரலை எழுப்பிக்கொண்டே இருந்த செலமேஸ்வர் பணி வாய்ப்புகளை இழந்திருக்கலாம். ஆனால், தன் ஓய்வுக் காலத்தை எந்த உறுத்தலும் இல்லாமல் நிம்மதியாகக் கழிப்பார். புனிதப் பசுவாக நடந்துகொள்ளும் நீதித் துறையில் உள்ளிருந்துகொண்டு கலகக் குரல் எழுப்பியதற்காகவே வரலாற்றில் என்றும் நினைவுகூரப்படுவார் செலமேஸ்வர்.
