‘It’s high time courts stopped showing sympathy for ineligible candidates’

It is high time that courts stop showing misplaced sympathy for ineligible candidates admitted to medical courses, the Madras High Court said on Wednesday while declaring as invalid the admission of 65 doctors in various postgraduate degree and diploma courses in May 2017. These candidates had now almost completed the courses and even written their final examinations on the basis of interim orders passed by the court.

Justice N. Anand Venkatesh said a stern message must be sent to medical institutions which admit ineligible students through dubious methods, year after year, by taking advantage of the delay in the commencement of the counselling process and the deadline fixed by the Supreme Court for completing admissions.

“Every year, this court is able to see that there is a huge delay even to start the first round of counselling... It is not known as to whether such a confusion is created for any valid reasons or it is intentionally done to help the self-financing institutions to take advantage of the last minute chaos and admit candidates on their own,” the judge said.

He also imposed a total cost of ₹30 lakh on Arupadai Veedu Medical College, Vinayaka Mission Medical College, Mahatma Gandhi Medical College and Research Institute, Sri Manakula Vinayakar Medical College and Hospital, Venkateswara Medical College and Hospital, and Pondicherry Institute of Medical Sciences, all in Puducherry, for having admitted the 65 doctors in the PG courses in violation of the norms. The Medical Council of India (MCI) itself had directed the six institutions to discharge all 65 candidates.

However, they had approached the High Court and obtained an interim stay. While granting the stay, the court had obtained an undertaking from the students that they would not claim any equity if the writ petitions were taken up for final disposal after they complete their studies.

“Therefore, even though the dismissal of these writ petitions is going to cause great damage to their careers, it is something which is not totally unexpected,” the judge said.

The Madurai Bench of the Madras High Court on Wednesday directed the Centre to submit status report on the progress made in setting up the All India Institute of Medical Sciences (AIIMS) at Thoppur in Madurai.

A Division Bench of Justices N. Kirubakaran and B. Pugalendhi directed the Central government to submit the status report on November 5 on a public interest litigation petition filed by K.K. Ramesh of Madurai, who sought a direction to the Centre to expedite construction of the institute.

The petitioner complained that apart from building a compound wall at the site, not much progress was made in the project.

The Central government had held out assurance that the construction would be completed in 45 months, the PIL petition said

The National Medical Commission (NMC) formally replaced the Medical Council of India on September 25 as the new regulator for medical education in the country.

Since then the MCI website has been off-limit with a message that it is undergoing changes. There is no news when the new website will become live.

“All the doctors in the country used to get registered with MCI for their practice and it is the only reference point to cross verifies their credentials,” Dr (Major) Gulshan Garg (retd) said.

Chairman of Sankalp Charitable Trust, Garg has played a crucial role in getting National Eligibility Cum Entrance Test (NEET) implemented in the country through the Supreme Court order.

“Today, I cannot find out whether a person is an approved medical practitioner,” Garg said.

He added, “The NMC hasn’t come all of sudden. When the government was aware that it is going for a transformation, it should have made prior preparation. It has been 12 days and there is no update how long it will take.”

Many corporate who are in the process of taking on board fresh medical practitioners have to put the process on the hold as they cannot verify the applicants claim if they wish to.

Besides, medical experts say that the declaration of NEET result is also round the corner and the website is the only source of information for the colleges.

“How many approved medical colleges are there in India? How many seats are approved to each college to admit candidates for MBBS and PG courses? Which are the colleges that are refused permission to admit the new batch in the current academic year? These are basic information that every student wants to know,” Head of private medical college, who doesn’t want to be quoted, said.

He said that besides all these issues the website used to serve many useful purposes for candidates who either seek education in foreign medical colleges or passed out from there.

He added, “It is a primary source to disseminate credible information. Recently, NMC clarified about the validity of online medical education in India but many people are still clueless because the message was circulated through social media and WhatsApp but not through the NMC’s website.”

Outlook wrote to Dr Suresh Sharma, newly-appointed Chairman and Dr RK Vats, secretary of NMC but they didn’t respond.

மத்திய அரசிடமிருந்து தெளிவான அறிவுறுத்தல்கள் வரும் வரை மருத்துவ மாணவர்களுக்கான ஆன்லைன் வகுப்புகள் தொடரும் என்று என்.டி.ஆர். சுகாதார அறிவியல் பல்கலைக்கழக அதிகாரிகள் புதன்கிழமை தெரிவித்தனர்.

இதேபோன்று, பிற மாநிலங்களைச் சேர்ந்த தேர்வாளர்களுக்கு நடத்தப்படும் எக்ஸ்டர்னல் தேர்வுகளும் ஆன்லைனில் நடத்தப்படும்.

தமிழகத்தில் உள்ள அரசு மற்றும் அரசு உதவி பெறக்கூடிய மருத்துவக் கல்லூரிகளில் உள்ள மருத்துவ மேற்படிப்பு இடங்களில் படிக்கும் மாணவர்கள் அரசு மருத்துவமனையில் கட்டாயம் 2 ஆண்டுகள் பணியாற்ற வேண்டும் என்கிற தமிழக அரசின் விதியை சென்னை உயர் நீதிமன்றம் உறுதி செய்தது.

தமிழகத்தில் உள்ள அரசு மற்றும் அரசு உதவி பெறக்கூடிய மருத்துவக் கல்லூரிகளில் உள்ள மருத்துவ மேற்படிப்பு இடங்களில் படிக்கும் மாணவர்கள், படித்து முடித்தவுடன் இரண்டு ஆண்டுகள் கட்டாயம் அரசு மருத்துவமனைகளில் வேலை பார்க்கவேண்டும் என்று தமிழக அரசு உத்தரவு பிறப்பித்தது.

இதற்காக, மாணவர் சேர்க்கையின்போதே இந்த நிபந்தனைகளுடன் ஒப்பந்தம் பெறப்படுகிறது. அந்த இரண்டு ஆண்டுகள் பணி முடித்தால் மட்டுமே அவர்களுக்கு முழுமையான சான்றிதழ் வழங்கப்படும் எனவும் தெரிவிக்கபட்டது.

இதை எதிர்த்து தமிழகத்தில் படிக்கக்கூடிய வெளி மாநிலங்களைச் சேர்ந்த அபிநயா, அஜய் பாத்திமா உள்ளிட்ட 276 மாணவ, மாணவிகள் சென்னை உயர் நீதிமன்றத்தில் வழக்குத் தொடர்ந்திருந்தனர். அதில் அகில இந்திய மருத்துவப் படிப்பு தேர்வுக் குறிப்பேட்டில் இதுபோல் எந்த ஒரு நிபந்தனையும் இல்லை என்றும் இது சட்டவிரோதமானது என்றும் தெரிவித்திருந்தனர்.

இந்த வழக்கை விசாரித்த தனி நீதிபதி, மாணவ, மாணவிகள் இரண்டு ஆண்டுகள் பணிபுரிய வேண்டிய அவசியம் இல்லை என்றும், அவர்களுக்குக் கல்வியாண்டை முடித்தவுடன் சான்றிதழ்களை வழங்க வேண்டும் என்றும் தீர்ப்பளித்தார்.

இந்தத் தீர்ப்பை எதிர்த்து தமிழக அரசு தொடர்ந்த மேல்முறையீடு வழக்கு தலைமை நீதிபதி ஏ.பி.சாஹி, நீதிபதி செந்தில்குமார் ராமமூர்த்தி அமர்வில் நடைபெற்றது. அப்போது தமிழக அரசு சார்பில் அளிக்கப்பட்ட பதிலில், “மாணவர் சேர்க்கையின்போது மாநில அரசுகள் நிபந்தனை விதித்துக் கொள்ளலாம் என்று விதிகள் உள்ளன.

தமிழக அரசு வழங்கும் உட்கட்டமைப்பு மற்றும் கல்வி வழங்கும் வசதிகளைப் பயன்படுத்தி படிக்கக்கூடிய மாணவர்கள் குறைந்தபட்சம் இரண்டு ஆண்டுகளாவது தமிழக அரசு மருத்துவமனைகளில் பணிபுரிய வேண்டும் என்று நிபந்தனை கொண்டு வரப்பட்டது” என வாதிடப்பட்டது.

இருதரப்பு வாதங்களைக் கேட்ட நீதிபதிகள் தனி நீதிபதியின் உத்தரவை ரத்து செய்து உத்தரவிட்டனர். தமிழக மருத்துவமனைகளில் முதுநிலை மருத்துவப் படிப்பு படிக்கும் மாணவர்கள் கட்டாயம் 2 ஆண்டுகள் அரசு மருத்துவமனையில் பணிபுரிய வேண்டும். பணிபுரிந்த பின்பே சான்றிதழ் வழங்கப்படும் என்ற ஒப்பந்தம் சரிதான் என்றும் தீர்ப்பளித்துள்ளனர்.

அதேவேளையில் அந்த இரண்டு ஆண்டுகளுக்குள் அரசால் பணி வழங்க முடியவில்லை என்றால் சம்பந்தப்பட்ட மாணவ, மாணவிகளுக்கு முழுமையான சான்றிதழ் வழங்க வேண்டும் என்றும் நீதிபதிகள் தங்களது உத்தரவில் குறிப்பிட்டுள்ளனர்.

Jaipur: Gunjan Modi  , a 19-year-old student from Bengaluru who had prepared for CLAT in Jaipur, has secured 23rd rank in Common Law Admission Test (CLAT) whose results were declared on Monday.

This was Modi’s second attempt. Last year, she got around 4,000 rank and wasn’t eligible to qualify for any national law School.

Gunjan said, “I dropped one year to clear my concept and studied hard this time. I came to Jaipur from Bengaluru just for CLAT preparation. I wanted to get into NLSIU Bangalore as my family is here and I do not want to live away from my family for five years. I focused to clear my concepts and studied continuously.”

Initially, she would study for five hours a day, but with time the study hours increased and practice as well.

“Most of the paper is now subjective with difficult comprehensions to solve. Students usually keep revision for the end, but I believe continues revision with consistency is important. First clear your basics and then increase your time for revision. Solve previous year question paper for practice,” said Gunjan.
