Bench scraps post-graduate medical counselling list, sees slant

CHENNAI: Setting the stage for another round of litigation over  post-graduate medical admissions, the Madras High Court on Friday struck down the counselling for post-graduation courses and asked it to prepare a fresh merit list within three days to conduct the counselling again.

The hard hitting order, passed by a bench consisting of justices Rajiv Shakdher and R Suresh Kumar, said the State government had arbitrarily classified areas as “remote or difficult” to favour government doctors in getting the chunk of the post graduation seats in government and private colleges. Soon after the verdict was pronounced, the health minister C Vijaya Basker said the State would appeal against the high court verdict in the Supreme Court.

Counselling for PG courses was held last month after two rounds of litigation in the high court, which  ruled that the counselling should be conducted only as per the rules of Medical Council of India and the State cannot have its own set of rules awarding incentive marks to all doctors who served in government hospitals. However, then the court gave freedom for the state to define which all areas would fall under “remote or difficult” category and incentive marks may be granted only to those doctors who served in government hospitals in these areas.

The high court on Friday did not mince words when it highlighted how the State had arbitrarily included areas as “remote or difficult” to ensure they get the incentive marks and hence they secure nearly all of the post graduation seats. “For example, in the District of Nilgiris, the District Headquarters Hospital, located at Uthagamandalam (Ooty), cannot be described as remote and/or difficult area by any stretch of imagination. One can take judicial notice of the fact that Ooty is a hilly destination, which has all the facilities of a township, and is easily accessible by road,” the order said.

Trashing another argument of the State that  Thanjavur, Nagapattinam and Ramanathapuram are classified as a difficult area since they were affected by the Tsunami, the court said the natural calamity struck these places way back in 2004.

While regulations of Medical Council of India granted complete freedom to the States in classifying remote and difficult areas, the court said the State had not followed any criterion in doing so. The order noted that the arbitrary selection of areas as remote and difficult has led to the government doctors taking away almost the entire PG medical seats. While 700 government doctors got selected for the PG degree courses in government colleges, just 34 non-service candidates got selected.

Pointing that out of 383 students from Tamil Nadu who joined under the All India Quota, only eight were in-service candidates, the court said, “We have, quite clearly, a number of meritorious candidates have opted for the All India Quota, as they have been denied their chosen speciality, on account of award of weightage to in-service candidates.”

Highlighting the SC orders detailing how “remote and difficult” areas must be identified, the order directed the State to reconfigure the merit list within three days.

Post Graduation Medical Counselling: Government to file appeal in Supreme Court

CHENNAI: The Tamil Nadu government will appeal against the Madras High Court order quashing the Post Graduation Medical Counselling that was conducted last month, said health minister C Vijaya Basker on Friday.

Speaking to reporters after the verdict was out, he said: “the government has conducted the counselling for PG medical courses as per the Medical Council of India and Madras High Court orders. So, we will appeal in the Supreme Court against today’s order. We will see that in-service doctors are not affected.”

Meanwhile, another official said the government may consider releasing the revised merit list to comply with the three-day deadline set by the high court.

The government doctors community in the State has already started blowing the protest bugle.
“Attitudes of Supreme Court and Medical Council of India are complicating the issue. They are grabbing the power of states in medical education,” claimed G R Ravindranath, general secretary, Doctors’ Association for Social Equality (DASE).

He demanded the Central government to bring in an ordinance to amend MCI regulations and grant 50 per cent reservation for government doctors, as was followed in Tamil Nadu so far.

He also urged all political parties to join hands to retrieve the rights of the State in the medical education sphere.

Students’ Diploma Post Graduation Association immediately announced a dharna on Saturday at Madras Medical College demanding the government to protect the rights of service candidates.

Also, the Tamil Nadu Government Doctors Association (TNGDA) would convene its general body meeting to discuss the next course of action.

Changes in train schedule

The Railways have announced changes in the operation of trains in the Salem – Jolarpettai section in Salem Railway Division due to track maintenance works at Karuppur Railway Yard and in the Erode – Tiruchi section due to construction of limited use sub-way between Moorthipalayam and Karur stations on the Erode – Tiruchi Fort section on June 18. Train No. 07115 Hyderabad – Kochuveli special train will be halted either at Karuppur station or Tinnapatti station and will reach Podanur after a delay of 30 minutes.

No. 56320 Coimbatore – Nagercoil passenger, No. 56712 Palakkad Town – Tiruchi passenger, No. 16790 / 16688 Sri Mata Vaishnodevi Katra – Tirunelveli Express and No. 56825 Erode – Tirunelveli passenger trains will be diverted via Erode, Salem, Namakkal and Karur. These four trains will have stoppages at Sankagiri, Salem, Rasipuram, Namakkal and Mohanur and will reach Karur after a delay of two hours.

No. 56821 Mayiladuthurai – Tirunelveli passenger will be rescheduled to leave at 1.25 p.m. two hours behind the scheduled departure at Mayiladuthurai.

No. 56842 Erode – Tiruchi passenger will be detained at Moorthipalayam station for 10 minutes.

No. 56826 Tirunelveli – Erode passengers is partially cancelled between Karur and Erode and will be diverted via Karur – Salem.

No. 56846 Erode – Jolarpet passenger is partially cancelled between Erode and Salem. It will depart from Salem.

No. 56713 Tiruchi – Palakkad Town passenger will be rescheduled to leave at 4 p.m. at Tiruchi junction with a delay of three hours.

No. 56319 Nagercoil – Coimbatore passenger will be rescheduled and will leave Nagercoil at 8.30 a.m. after a delay of one hour.

The Service Doctors and Post Graduate Association will hold a dharna at the Madras Medical College on Saturday demanding that the State government protect the rights of service candidates.

The Madras High Court on Friday quashed the merit list for PG admissions in medical and dental courses offered in the State.

The Doctors’ Association for Social Equality has blamed the Centre’s policies that usurped the State government’s autonomy. Association general secretary G.R. Ravindranath said the Centre should immediately bring an ordinance to provide 50% quota for service candidates and enable States to follow their rules of reservation.

K. Senthil of Tamil Nadu Government Doctors Association said it would cause chaos if the court order were to be complied with.

Fresh merit list and counselling needed; court faults weightage criteria

The Madras High Court has quashed the merit list notified by the State government dated May 6 for admissions to PG medical courses in the State quota.

As a consequence, the entire admission process for over 1,000 seats in government colleges and government quota in self-financing colleges, which was concluded on May 31, has to be redone by the State government after preparing a fresh merit list, strictly in according with the regulations of the Medical Council of India (MCI).

A Division Bench of Justices Rajiv Shakdher and R. Suresh Kumar passed the interim orders on a batch of pleas moved by S. Praneetha and others assailing the legality of the merit list issued by the State.

Considering the urgency of the issue, the court directed the State government to reconfigure the merit list strictly in accordance with the regulations of the MCI, particularly in awarding incentive marks to in-service candidates, within three days.

‘Flawed procedure’

The weightage, which the State can accord, ranges between 10% and 30% of the marks obtained by a candidate in the NEET-PG.

The primary allegation is that the State, while preparing the final merit list, has accorded weightage, without providing criteria for identifying remote/difficult areas where candidates had served.

“Therefore, if, such areas eligible for incentive marks are not identified, based on known, reasonable or rational criteria, there is every chance of weightage-marks being given to undeserving candidates,” the petitioners added.

When the pleas came up for hearing, the Bench noted that the State government has added to the list of areas (remote and difficult), a number of other areas including PHCs located in rural areas, government hospitals, and government medical college hospitals located in Tiruvarur, Nagapattinam and Ramanathapuram (TNR) districts.

The court observed that the entire exercise of according weightage to in-service candidates was flawed.

“To our minds, a hilly/rural area can be a remote and/or difficult area, but every hilly/rural area need not, necessarily, be a remote and/or difficult area,” the judges added.

‘Eroding merit’

Further pointing out the admission statistics provided by the government, the Bench said, this presents a startling state of affairs. The PG degree course, which comprises twenty four (24) specialities, admitted 700 in-service candidates, as against 34 non-service candidates in government colleges. The position was no better with regard to the self-financing colleges.

Similarly, with respect to the PG Diploma course offered in government colleges, for 15 speciality courses, 299 in-service candidates were admitted, as against 33 non-service candidates. As against this, in self-financing colleges, 11 in-service candidates were admitted, whereas, only five non-service candidates were admitted.

Weightage granted to the candidates working in rural PHCs, government hospitals and government medical college hospitals, located in TNR Districts, will, accordingly, have to be reconfigured, the Bench added.

“While there is no gainsaying that incentives have to be given, to ensure that, in the very least, primary health care is made available in remote and/or difficult areas, it cannot be done in a manner, that it completely erodes merit. Our sense of the matter is, in the instant case, merit has been given a complete go-by.”

Two Gulbarga University professors arrested

The university police arrested two professors of Gulbarga University — Ramesh Rathod, an English professor, and Veeresh Rachappa Badiger, professor and chairman of the Department of English — and produced them before the jurisdictional court here on Friday. The court has remanded them in judicial custody. A student of the university, in her complaint, accused Mr. Rathod, of sexual harassment, while Mr. Rathod, lodged a complaint against Mr. Badiger accusing him of caste-based harassment.

IAS officer's death: CBI registers murder case

The CBI on Friday registered a murder case in mysterious death of IAS officer Anurag Tewari. The 2007 batch Karnataka cadre officer was found dead on the roadside near a government guest house in Hazratganj area of Lucknow on May 17.

The central agency has registered the FIR against two unidentified persons on the charges of murder, said CBI spokesperson RK Gaur. He also said the agency had officially taken over the case and would now begin the probe.The CBI sources also revealed that the case had been given to an ASP-rank officer. Senior police officers privy to investigation told TOI that after taking over the case, the CBI has sought documents relating to the case from the Lucknow police.

The mystery element in the case was added after the officer's postmortem examination report had revealed six injuries on his body . Besides, Tewari died due to asphyxia but the report failed to specify the reason which caused it. A day after Tewari's death, the Lucknow SSP had formed an SIT comprising four inspectors and a deputy SP .

But on May 22, the UP government handed over the case to the CBI after Tewari's family lodged a formal FIR in Lucknow. On May 29, the SSP had stated the deceased officer's preserved organs would be sent to Chandigarh's Central Forensic Laboratory for tests, along with viscera and other samples.

The SIT has also visited the official residence of Tewari in Bengaluru on June 3 and had recovered a laptop, medical details and other samples which was also sent to the Chandigarh lab.

Aadhaar must for bank accounts, transactions of

The government has made the Aadhaar card mandatory for opening bank accounts and conducting financial transactions of `50,000 and above, while making it mandatory for those with existing accounts to submit the unique identification number by December.Those who do not submit the details by the end of December run the risk of their accounts turning invalid.
While the income tax department had earlier announced the decision to make Aadhaar mandatory for banking and financial purposes, the new regula tions were notified through amendments to rules related to maintenance of records under the Prevention of Money Laundering Act.
The move came around the time the Supreme Court upheld the validity of an I-T Act provision making Aadhaar a must for allotment of PAN cards and for filing income tax returns.
The apex court had granted “partial relief “ to those who do not have an Aadhaar number or an Aadhaar enrolment ID, ruling that the PAN of such individuals will not be cancelled for the time being.
The notification mandated quoting of Aadhaar along with PAN or Form 60 by individuals, companies and partnership firms for all financial transactions of `50,000 or above with effect from June 1.
After June 1, if a person does not have an Aadhaar number at the time of opening of account, then he has to furnish proof of applica tion of enrolment for Aadhaar and submit the Aadhaar number to the bank within six months of opening of the bank account.
So far, it was mandatory to provide PAN number or Form 60 to banks while opening accounts or for high value transactions.
For companies opening bank accounts, Aadhaar number of managers or employees holding an attorney to transact on the company's behalf will have to be provided.
In all other cases, identity should be verified while carrying out transaction of an amount equal to or exceeding `50,000, and in any international money transfer operation.

10L duplicate ration cards eliminated by Aadhaar

The state government has eliminated about 10 lakh duplicate family (ration) cards after seeding of Aadhaar numbers in the database of beneficiaries for the distribution of smart cards. This means, some 1.4 crore names have been eliminated.

The seeding of Aadhaar number is done to distribute smart cards, an initiative launched by the previous AIADMK governments to replace the existing paper based family cards. The cards are in circulation since 2005 and the cards due for renewal in 2009. “The door-to-door verification of family cards in the last five years helped eliminate 5.45 lakh duplicate cards,“ food and civil supplies minister, R Kamaraj said. About 1.02 crore families have got smart cards.

The government launched smart cards at a cost of `330 crore.

Traffic to be diverted from June 19

The traffic police have planned the following diversion from June 19, in view of repair work at Madley subway in T Nagar.Motorists heading from West Mambalam towards Thyagaraya Nagar can continue to use Madley subway , as there will be no change or diversion in traffic flow in that direction.
However, motorists on the other side heading from Thyagaraya Nagar towards West Mambalam will have to take South Usman Road, New Boag Road, 70 feet Road, Aranganathan subway or Madley Road, Muthurangam Salai, New Boag Road, 70 Feet Road and Aranganathan subway .

`Admit Students Provisionally Selected In Order Of Merit'

In a big relief to postgraduate medical students who had been asked to cough up fees ranging from ` 40 lakh to ` 50 lakh by deemed universities in Puducherry, Madras high court has said it would be enough if students paid `10 lakh as first year's fee and that final figures should be prescribed by a committee formed by the UGC and the Centre by June 19.“When self-financing private medical colleges can survive by charging a fee of `5.5 lakh per annum for students under state quota and `14 lakh for students under management quota, which is 50% of the total seats, we find it difficult to accept that the fee of ` 40 lakh to `50 lakh per annum charged by deemed universities, is reasonable,“ said the first bench of Chief Justice Indira Banerjee and Justice M Sundar on Friday.
Noting that it could not keep its eyes shut to the issue, the court said, “By rea son of exorbitant fee notified by deemed universities, there are still seats going vacant and students who have duly competed and succeeded in clearing the admission tests, and have undergone counselling, being deprived of an opportunity to pursue their higher studies by reason of prohibitive fees, which is prima facie unsustainable in law.“
The bench then directed the deemed universities to admit the students provisio nally selected in the order of merit, subject to the condition that the student should deposit `10 lakh each at the time of admission towards annual fee for the first year with CENTAC, and subject to other conditions that in the event of the fee determined by the fee committee constituted by the UGC and union HRD ministry being more, they should pay the differential amount.
As for students who have already take admission by depositing the full fee, the bench said if necessary they could claim refund or adjustment of the differential amount, against the fee that might be determined by the committee.
Making it clear that the present order offers only interim relief to students and that their fate would hinge on the final verdict on the is sue, the bench said the future of students, thus, would remain uncertain. To alleviate their suffering, the bench said, “there is immense urgency and we expect the UGC and the union HRD ministry shall forththwith constitute a committee to regulate the fee chargesable by self-financing deemed universities after giving all stake holders adequate opportunity of representation.“
The bench then adjourned the matter to July 14 for further hearing.
As for the fact that the PIL had been filed by an advocate VBR Menon, and not the affected students, the bench said: “This court can take note of the facts pleaded by a public spirited citizen in a PIL and suo motu pass orders to redress the grievances of the student community.“

While List A public health centres (PHCs) are those coming under the directorate of public health, List B and C pertain to PHCs and government hospitals, respectively , under directorate of medical and rural health services (DM&RHS). State health secretary J Radhak rishnan said the state would move the Supreme Court against the or der. “We followed Medical Council of India guidelines during the admission process. It will be difficult for us to redo the admission as deadline for admissions ended on May 31,“ he said.
Referring to the near-total takeover of all available PG medical seats over of all available PG medical seats by doctors in government service, the bench said it was startled by the admission statistics presented to it. “PG degree course, which comprises of 24 specialties, admitted 700 in-service candidates, as against 34 non-service candidates in government colleges.The position was no better with regard to the self-financing colleges, in which, 124 in-service candidates were admitted, as against 19 non-service candidates,“ the bench said.
“Unless the state government is able to demonstrate that the PHCs, which are located in rural areas can be classified as remote andor difficult areas, no weightage could have been given to the in-service candidates, who have rendered service in such PHCs,“ the court said.
As for PG diploma course at government colleges, for 15 specialty courses, 299 in-service candidates were admitted, as against 33 non-service candidates. In self-financing colleges, 11in-service candidates were ad mitted, whereas, only 5 non-service candidates were admitted.
When the state argued that incentives were given to encourage doctors to work in rural areas, the bench said: “While there is no gain saying that incentives have to be given, to ensure that, in the very least, primary health care is made available in remote and or difficult areas, it cannot be done in a manner, that it completely erodes merit. Our sense of the matter is, in the instant case, merit has been given a complete go-by.“ In the Nilgiris, the district head quarters hospital located at Ooty cannot be described as remote or difficult area by any stretch of imagination, the judges said, adding that similarly Othakadai in Madurai could not qualify to be a remote or difficult area since it is outskirts of Maudrai city . In fact, the Madurai bench of the high court itself was located there, the bench said. This demonstrates complete non-application of mind by the state government, it said.
“While the intention of the policyformulators was to reach a noble or just goal, the result reached in the instant case shows that the opposite happened. It is palpably clear that in this case, the manner in which the state government has exercised its powers to identify remote andor difficult areas, by design or otherwise, has led to unfair and inequitable results,“ the judges said.

Swathi murder case closed formally

Nearly a year after the sensational murder of a 24-year-old software professional at a city railway station, the `Swathi case' has attained finality, judicially. A city court has accepted the police report that it needs to be closed because the lone accused is dead.S Swathi, of Sourashtra Nagar in Choolaimedu, was murdered on June 24, 2016, at Nungambakkam railway station, and the accused, P Ramkumar, `committed suicide' in the Central Prison at Puzhal on September 19.
An investigating officer said, “We submitted a detailed closure report before the magistrate court in Egmore with substantial evidence to prove Ramkumar's death was a suicide.“
The XIV Metropolitan Magistrate B C Gopinath admit ted the copies and issued an order for formal closure of the case, he said.
The case, initially investigated by the Government Railway Police, was transferred to the Chennai city police.When a team cornered Ramkumar in his native village T Meenakshi Puram in Tirunelveli district on July 1, he his throat in a suicide bid.
He was brought to Chennai and lodged at the prison in Puzhal. Several appeals for bail were dismissed and Ramkumar `committed suicide' inside the prison after biting a live cable on September 19.

புதுடெல்லி: வெளிநாடு வாழ் இந்தியர்கள் (என்ஆர்ஐ) மூலம் மெகா கமிஷனுக்கு செல்லாத நோட்டு மாற்றுவது விறுவிறுப்பாக நடக்கிறது. என்ஆர்ஐ, ஏஜென்ட் கமிஷன் போக, ஒரு கோடி ரூபாய்க்கு 9 லட்சம் ரூபாய் தரப்படுகிறது. கருப்பு பணம் மற்றும் கள்ள நோட்டை தடுக்க பழைய ரூ.500, ரூ.1,000 நோட்டு செல்லாது என, கடந்த ஆண்டு நவம்பர் 8ம் தேதி நரேந்திரமோடி அறிவித்தார். இதன்பிறகு இவற்றை வங்கிகளில் டெபாசிட் செய்து மாற்ற 50 நாள் அவகாசம் தரப்பட்டது. இதுதவிர, ரூ.4,500 வரை ரொக்கமாக மாற்றவும் அனுமதிக்கப்பட்டது. இதில் முறைகேடுகள் நடப்பதாக தெரியவந்ததால் ரொக்கமாக மாற்றுவது நிறுத்தப்பட்டது.

'நீட்' தேர்வில் தவறான கேள்விகள் என புகார்

மதுரை: 'நீட்' தேர்வில் தவறாக கேட்கப்பட்ட கேள்விகளுக்குரிய மதிப்பெண் அனைத்து மாணவர்களுக்கும் வழங்க வேண்டும் என கோரிக்கை எழுந்துள்ளது.

கடந்த மே 7ல் மருத்துவப் படிப்பில் சேர விரும்பும் பிளஸ் 2 முடித்த மாணவர்களுக்கான, 'நீட்' தகுதி தேர்வு நடந்தது.11 லட்சம் பேர் எழுதினர். இயற்பியல், வேதியியல், உயிரியல் உள்ளிட்ட பாடங்களில் 180 கேள்விகள் கேட்கப்பட்டன. சரியாக பதிலளிக்கும் கேள்விக்கு நான்கு மதிப்பெண் வழங்கப்படும். தவறாக பதிலளிக்கும் ஒவ்வொரு கேள்விக்கும் ஒரு மதிப்பெண் குறைக்கப்படும்.

தேர்வு முடிவுகள் வெளியாகாத நிலையில், வினாத்தாளுக்கான பதில்களை சி.பி.எஸ்.சி., வெளியிட்டது. அதில், இரண்டு கேள்விகளுக்கு ஒன்றுக்கும் மேற்பட்ட பதில்கள் இடம்பெற்றுள்ளன என மாணவர்கள் தெரிவித்துள்ளனர்.

அவர்கள் கூறியதாவது: விதிகள் படி, கேள்வித்தாளில் இரண்டு பதில்களை தேர்வு செய்யக்கூடாது. இதனால் பலர் தவறாக கேட்கப்பட்ட கேள்விகளுக்கான பதிலை தேர்வு செய்யாமல் விட்டு விட்டனர். ஆனால், தவறான கேள்விகளுக்கு ஏதாவது ஒரு பதிலை தேர்வு செய்திருக்கும் மாணவர்களுக்கு மட்டும் மதிப்பெண் வழங்க சி.பி.எஸ்.இ., திட்டமிட்டுள்ளது.
கேள்விக்கு பதில் அளிக்காதவர்களுக்கும் மதிப்பெண் வழங்க வேண்டும், என்றனர்.

தமிழக சட்டப்பேரவை இன்று காலை கூடியதும் உள்ளாட்சித்துறை மற்றும் மீன்வளத்துறை குறித்த மானியக்கோரிக்கை நடைபெற்றது. அப்போது, ராதாபுரம் எம்எல்ஏ இன்பதுரை பேசுகையில், நெல்லை மாவட்டம் இடிந்தகரையில் மீன் பதப்படுத்தும் பூங்கா அமைக்க வேண்டும் என்று கோரிக்கை வைத்தார். மேலும் அவர் பேசுகையில், இடிந்தகரை மீன்கள் சுவையாக இருக்கும் என்றார்.

சென்னையில் பல இடங்களில் திடீர் மழை

மதுரை: தமிழகத்தில் வெப்ப சலனம் காரணமாக மாநிலத்தின் பல்வேறு மாவட்டங்களில் மழை பெய்ய வாய்ப்பு உள்ளதாக வானிலை ஆய்வு மையம் தெரிவித்திருந்தது. இந்நிலையில் மதுரை மாவட்டம் திருமங்கலம், கள்ளிக்குடி, பேரையூர், செங்கம்படை,கப்பலுார் உள்ளிட்ட பல பகுதிகளில் பலத்த காற்றுடன் மழை பெய்தது.

தஞ்சையில் பலத்த மழை

பள்ளி அக்ரஹாரம்,அய்யம்பேட்டை, கீழவஸ்தா,சாவடி, உள்ளிட்ட பகுதிகளில் மழை பெய்தது. இதன் காரணமாக பெரிய கோயில் அருகே உயர் மின் அழுத்த மின் கம்பி அறுந்து விழுந்ததால் போக்குவரத்தில் பாதிப்பு ஏற்பட்டது.

சிவகங்கை மாவட்டத்தில் சிவகங்கை மற்றும் அதன் சுற்றுவட்டார பகுதிகளிலும் மழை பெய்தது.

சென்னையில், நுங்கம்பாங்கம் , எழும்பூர், கேயம்பேடு, தாம்பரம், ரயப்பேட்டை, ஈக்காட்டுத்தாங்கல், கிண்டி, ஆலந்துார், கே.கே.நகர் உள்ளிட்ட பல பகுதிகளில் பலத்த மழை பெய்கிறது.

முதுகலை மருத்துவ படிப்புக்கான மாணவர்கள் தகுதி பட்டியலை ரத்து செய்தும், புதிய தகுதி பட்டியலை 3 நாட்களுக்குள் வெளியிட வேண்டும் என்றும் தமிழக அரசுக்கு சென்னை ஐகோர்ட்டு உத்தரவிட்டுள்ளது. மேலும், தொலைதூர கிராமம், கடினமான பகுதி என்று வரையறை செய்த தமிழக அரசின் அரசாணையையும் ஐகோர்ட்டு ரத்து செய்துள்ளது.

மாறுபட்ட தீர்ப்பு

முதுகலை மருத்துவ பட்டப்படிப்புக்கான மாணவர்கள் சேர்க்கையின்போது, அரசு டாக்டர்களுக்கு சலுகை மதிப்பெண் வழங்கும்போது, இந்திய மருத்துவ கவுன்சில் வெளியிட்டுள்ள முதுகலை மருத்துவ பட்டப்படிப்பு ஒழுங்குமுறை சட்டத்தை பின்பற்றவேண்டும் என்று ஐகோர்ட்டு நீதிபதி புஷ்பா சத்தியநாராயணன் கடந்த மார்ச் 19-ந்தேதி தீர்ப்பளித்தார். இந்த தீர்ப்பு, கோவை மாவட்டத்தை சேர்ந்த அரசு டாக்டர் ராஜேஷ்வில்சன் என்பவர் தொடர்ந்த வழக்கில் பிறப்பிக்கப்பட்டது.

இந்த தீர்ப்பை எதிர்த்து தொடரப்பட்ட வழக்கை விசாரித்த டிவிசன் பெஞ்ச் நீதிபதிகள் கே.கே.சசிதரன், எஸ்.எம்.சுப்ரமணியன் ஆகியோர் மாறுபட்ட தீர்ப்பை வழங்கினார்கள். அதாவது நீதிபதி புஷ்பா சத்தியநாராயணா பிறப்பித்த தீர்ப்பை நீதிபதி எஸ்.எம்.சுப்ரமணியம் உறுதி செய்தார். இதற்கு எதிராக நீதிபதி கே.கே.சசிதரன் உத்தரவு பிறப்பித்தார்.

அரசாணை

இதையடுத்து 3-வது நீதிபதி எம்.சத்தியநாராயணன் இந்த வழக்கை விசாரித்து, நீதிபதி எஸ்.எம்.சுப்ரமணியன் பிறப்பித்த தீர்ப்பை உறுதி செய்து தீர்ப்பு அளித்தார். இதற்கிடையில், தமிழக அரசு, முதுகலை மருத்துவ படிப்பில் சேரும் அரசு டாக்டர்களுக்கு சலுகை மதிப்பெண் வழங்குவது தொடர்பாக கடந்த மே 6-ந்தேதி அரசாணை வெளியிட்டது.

அந்த அரசாணையில், முதுகலை மருத்துவ பட்டப்படிப்பு ஒழுங்குமுறை சட்டம், பிரிவு 9-ன்படி, தொலைதூர கிராமங்கள், மலைகிராமங்கள் மற்றும் கடினமான பகுதிகளை வரையறை செய்தது. இந்த பகுதிகளில் உள்ள அரசு ஆஸ்பத்திரியில் பணியாற்றும் டாக்டர்கள், முதுகலை மருத்துவ படிப்பில் சேரும்போது அவர்களுக்கு சலுகை மதிப்பெண்கள் வழங்கப்படும் என்று கூறியிருந்தது. மேலும் அரசாணைகளின்படி, முதுகலை மருத்துவ படிப்புக்கான மாணவர்கள் தகுதி பட்டியலை மே 7-ந்தேதி வெளியிட்டது.

சுகாதார நிலையம்

இதை எதிர்த்து, சென்னை ஐகோர்ட்டில் பிரணிதா என்ற டாக்டர் வழக்கு தொடர்ந்தார்.

அதில், ‘முதுகலை மருத்துவ பட்டப்படிப்பு மாணவர் சேர்க்கையின்போது, எளிதில் செல்ல முடியாத கடினமான பகுதி, தொலைதூரப் பகுதி, மலைப்பகுதிகளின் பணி புரியும் அரசு டாக்டர்களுக்கு மட்டுமே சலுகை மதிப்பெண் வழங்கவேண்டும் என்று இந்திய மருத்துவ கவுன்சில் வெளியிட்டுள்ள முதுகலை மருத்துவ பட்டப்படிப்பு ஒழுங்குமுறை சட்ட விதி கூறுகிறது. ஆனால், தமிழக அரசு, நகர் பகுதிகளுக்கு அருகேயுள்ள கிராமப்புறங்களில் உள்ள ஆரம்ப சுகாதார நிலையங்களை கடினமான பகுதி பட்டியலில் கொண்டு வந்து கடந்த மே 6-ந்தேதி அரசாணை பிறப்பித்துள்ளது. இதனால், முதுகலை மருத்துவ பட்டப்படிப்புக்காக மொத்தம் உள்ள 1,066 இடங்களில், 999 இடங்கள் அரசு டாக்டர்களுக்கே ஒதுக்கப்பட்டு விடுகிறது. எனவே, இந்த அரசாணை இந்திய மருத்துவ கவுன்சில் விதிகளுக்கு எதிரானது என்று அறிவித்து, அந்த அரசாணையை ரத்து செய்யவேண்டும்’ என்று கூறியிருந்தார்.

மாநில அரசின் அதிகாரம்

இந்த வழக்கை நீதிபதிகள் ராஜிவ் ஷக்தேர், ஆர்.சுரேஷ்குமார் ஆகியோர் விசாரித்து, நேற்று பிறப்பித்த உத்தரவில் கூறியிருப்பதாவது:-

முதுகலை மருத்துவ பட்டப்படிப்பு ஒழுங்குமுறை சட்டம் பிரிவு 9(4)ன்படி, தொலைத்தூர கிராமங்கள், மலைகிராமங்கள், கடினமான பகுதிகளை வரையறை செய்து, அங்கு பணியாற்றும் அரசு டாக்டர்களுக்கு சலுகை மதிப்பெண் வழங்கும் அதிகாரம் மாநில அரசுகளுக்கு உள்ளது.

அதன்படி தொலைதூரம் மற்றும் கடினமான பகுதி எது? என்பதை மாநில அரசே வரையறை செய்து நீட் தேர்வில் பெற்ற மதிப்பெண்ணில், 10 முதல் 30 சதவீதம் கூடுதலாக சலுகை மதிப்பெண் வழங்கலாம்.

ஆனால் தமிழக அரசு தொலைதூரம் மற்றும் கடினமான பகுதிகள் என்ற வரையறைக்குள், 1,747 கிராமப்புற ஆரம்ப சுகாதார நிலையங்களை கொண்டு வந்துள்ளது.

மதுரை ஒத்தக்கடை

அதுமட்டுமல்ல, திருவாரூர், நாகப்பட்டினம், ராமநாதபுரம் மாவட்டங்களில் உள்ள கிராமப்புற அரசு மருத்துவமனைகள், அரசு மருத்துவக் கல்லூரிகள் ஆகியவற்றையும் இந்த வரையறைக்குள் கொண்டுவந்து அரசாணை பிறப்பித்து, அதன் அடிப்படையில் தகுதி பட்டியலை வெளியிட்டுள்ளது.

இதற்கு உதாரணமாக சொல்லவேண்டும் என்றால், தொலைதூர, கடினமான கிராமம் என்ற பட்டியலில், மதுரை மாவட்டம், ஒத்தக்கடை ஆரம்ப சுகாதார நிலையம் இடம் பெற்றுள்ளது. இந்த ஒத்தக்கடை ஆரம்ப சுகாதார நிலையம், ஐகோர்ட்டு மதுரை கிளைக்கு மிக அருகில் உள்ளது. இது எப்படி தொலைதூர கிராமம் என்று கூற முடியும்? கிராமங்களை வரையறை செய்யும்போது தமிழக சுகாதாரத்துறை முதன்மை செயலாளர் தனது மனதை முழுமையாக செலுத்தவில்லை என்பது அப்பட்டமாக தெரிகிறது.

அரசாணை ரத்து

எனவே, தொலைதூர கிராமம், கடினமான பகுதி என்று வரையறை செய்து தமிழக அரசு கடந்த மே 6-ந்தேதி வெளியிட்ட அரசாணையை ரத்து செய்கிறோம். அந்த அரசாணையைப் பின்பற்றி கடந்த மே 7-ந்தேதி வெளியிடப்பட்ட மாணவர் சேர்க்கை தொடர்பான தகுதிப்பட்டியலில் ஒரு பகுதியை ரத்து செய்கிறோம்.

அதாவது, பொது சுகாதாரத்துறை மற்றும் மருத்துவத்துறை இயக்குனரகத்தின் கட்டுப்பாட்டில், மலைப்பகுதிகளில் செயல்படும் ஆரம்ப சுகாதார நிலையங்கள், மருத்துவத்துறை இயக்குனரகம் மற்றும் ஊரக சுகாதாரப் பணிகள் இயக்குனரகத்தின் கட்டுப்பாட்டின் கீழ் தொலைதூர மற்றும் கடினமான பகுதிகளில் உள்ள அரசு ஆஸ்பத்திரியில் பணிபுரியும் அரசு டாக்டர்களுக்கு நடத்தப்பட்ட கலந்தாய்வு செல்லும். மற்றவர்களது சேர்க்கை செல்லாது.
