Delay violates Constitutional right of the employees, observes High Court

Government servants are entitled to interest for delayed payment of salary, the Madras High Court Bench has held. It also ruled that courts can order payment of interest even in the absence of a specific provision in the service rules since such delay violates the Constitutional right of the employees.

Justice R. Subramanian passed the judgment while allowing a writ petition filed by a 71-year-old retired government servant B. Thirumoorthy of Madurai in 2013.The judge directed the Highways Department to pay interest at the rate of 10% per annum for paying in 2010 the monthly salary due to the petitioner in 1999.

After citing various Supreme Court rulings on the issue, the judge said: “Even in the absence of statutory rules or administrative instructions with regard to interest, the government servant concerned would be entitled to interest under Articles 14 (equality before law), 19 (right to carry on any occupation) and 21 (right to life) of the Constitution.

“Hence, I have no hesitation in allowing the writ petitions and quashing the impugned order of the second respondent (Director General, Highways Department) rejecting the request of the petitioner for payment of interest for a sum of Rs. 92,026 being the salary for the period from February 9, 1999 and October 22, 1999.”

The judge agreed with petitioner’s counsel P. Mahendran that the judgments passed by the Supreme Court as well as a Division Bench of the High Court granting interest for delayed payment of retirement benefits to the government servants would squarely apply even in case of delayed payment of salary too.

In his affidavit, the petitioner pointed out he was actually placed under suspension between February 9 and October 22, 1999 by the then Virudhunagar Collector without payment of subsistence allowance. However, on an application made by him, the Tamil Nadu Administrative Tribunal set aside the suspension order in August 1999.

In every live case at NIC 2017 -with or witho ut the moderator's prompting -the cardiologist announced the brand name of the product he was using and extolled its virtues. There was a scroll display of the product on the screen too.The preference for live cases over pre-recorded cases is because manufacturers pay handsomely for these `shows'. In fact, the preference for live cases, even though it in creases risk to patients, over pre-recorded cases is because companies manufacturing devices pay handsomely for their products to be featured during these `live' performances.

NIC 2017 came soon after India Live 2017 in February , yet another major cardiology conference that boasted 30 live cases. So, many of the multinational companies that shelled out crores as sponsorship for the first event were unwilling to support NIC 2017 to the same extent. Hence, one of the major sponsors of NIC 2017 is a Chinese stent company , a relatively new entrant in India. Senior cardiologists, who had earlier strongly supported multinational stents on the grounds that they had FDA ap proval, were happily promoting the latest entrant which does not have FDA approval, and which they obviously have little experience of using.

Not all doctors are comfortable with the practice of pushing products. Several cardiologists expressed their reservations to TOI but said they were helpless to stop it as it brings in huge amounts of money to organisers of these conferences. Also, the organisers are often “big-daddies“ in the discipline.

Both cardiologists and device manufacturers pointed out that brand boosting in live casts happened in other surgical disciplines like gastroenterology , neurology and orthopaedics.

Dr Amar Jesani, one of the founders of the Indian Journal of Medical Ethics, is a strong critic of live surgeries.“It raises risk for patients.Why can't it be pre-recorded if they want to use it for teaching purposes? But surgeons are flamboyant and want to show off their skills. Are doctors salespersons of the company to be promoting a specific product? The code of ethics says doctors cannot take money to promote a product,“ said Dr Jesani.

When he suggested on Wednesday that TN could adopt rural quota for NEET, Union health minister J P Nadda was perhaps unaware that the state had suffered three legal defeats in this regard.

In 1968, the Supreme Court quashed a district-wise quota for MBBS admissions as unconstitutional. Since there were only eight government medical colleges in 1967-68, such a selection was introduced.

In 1971, when the state was divided into six zones and separate selection committees were formed and a candidate was asked to apply to only one committee nearest to his place of residence, the SC struck it down saying it violated right to equality.

The last attempt was made in 1996, when the government brought in rural quota without specifying casteregion. It was struck down by the Madras HC and confirmed by the SC.

No NEET exemption for TN: Union min

There will be no escape for any state, including Tamil Nadu, from holding the common National Eligibility-cumEntrance Test (NEET) for admission to medical and dental colleges this year, Union health minister J P Nadda declared here on Saturday .States, including Tamil Nadu, can, however, frame a reservation policy to accommodate students from the state board or rural areas, he told reporters outside the airport. NEET this year be held on May 7.

On January 31, health minister C Vijayabaskar had moved two bills in the assembly , seeking to exclude Tamil Nadu from NEET for admission to undergraduate and postgraduate medical and dental courses. Last month, a team of ministers and senior health officials from TN met Nadda, law minster Ravi Shankar and HRD minister Prakash Javadekar seeking the same exemption. This week, admission process for PG courses based on NEET scores has begun.

Since his visit Vijayabaskar had been saying he was hopeful of getting the exemption this year, but Nadda categorically ruled out any such favours. “Tamil Nadu feels students from a rural background will not be able to adjust to the NEET admission process. The state will have full freedom to have its own reservation policy for students of the state board or those from a rural background,“ he said.

Although he did not elaborate, senior state health department officials said this could mean the state can give grace marks to select group of stu dents apart from the 69% rule of reservation. “But it may be impossible to do it arbitrarily .Many rural areas in Namakkal and Rasipuram have schools that produce students with top ranks in Class XII,“ said an official.

In 2004, the state decided to admit students to MBBS and BDS courses on the basis of Class XII marks as the bulk of students appearing for the uniform examination came from rural areas and due to economic conditions struggle to access coaching class to equip themselves for the examination.

மத்திய கல்வி வாரியம் (சி.பி.எஸ்.இ.) நடத்தும் இந்த ‘நீட்’ தேர்வு அடுத்த மாதம் 7–ந் தேதி (ஞாயிற்றுக்கிழமை) நாடு முழுவதும் ஒரே நேரத்தில் நடத்தப்படுகிறது.

ஆனால், இந்த தேர்வுக்கு தமிழ்நாட்டில் பலத்த எதிர்ப்பு கிளம்பியுள்ளது.

மருத்துவ, பல் மருத்துவ படிப்புகளில் மாணவர்கள் சேருவதற்கு தேசிய அளவில் பொது நுழைவுத்தேர்வு நடத்தக்கூடாது என அனைத்து அரசியல் கட்சிகளும் கூறி போர்க்கொடி உயர்த்தி வருகின்றன.

இந்த பொது நுழைவுத்தேர்வில் இருந்து விலக்கு வழங்கக் கோரி தமிழக சட்டசபையில் கடந்த பிப்ரவரி மாதம் 2 மசோதாக்கள் நிறைவேற்றப்பட்டு, ஜனாதிபதி பிரணாப் முகர்ஜியின் ஒப்புதலை பெறுவதற்காக அனுப்பிவைக்கப்பட்டு உள்ளன.நுழைவுத்தேர்வு கட்டாயம்

இந்த நிலையில் மத்திய சுகாதாரத்துறை மந்திரி ஜே.பி.நட்டா, டெல்லியில் இருந்து நேற்று சென்னைக்கு வந்தார். விமான நிலையத்தில் அவர் நிருபர்களுக்கு பேட்டி அளித்தார்.

அப்போது அவர் கூறியதாவது:–

இந்த ஆண்டு முதல் நாடு முழுவதும் தேசிய தகுதி மற்றும் நுழைவுத்தேர்வு (‘நீட்’) கட்டாயம் ஆக்கப்பட்டுள்ளது. எல்லா மாநிலங்களிலும் இந்த தேர்வுகளை நடத்த வேண்டும், தமிழ்நாட்டிலும் அதை நடத்த வேண்டும் என்று நாங்கள் தெளிவுபடுத்தி விட்டோம்.

கிராமப்புற மாணவ, மாணவிகள் இந்த தேர்வு எழுதுவதற்கு சிரமப்படுவார்கள் என்று தமிழக அரசு கருதுகிறது.கிராமப்புற மாணவர்களுக்கு இடஒதுக்கீடு

அதற்காகத்தான், மாநில கல்வி திட்டத்தின்கீழ் (பிளஸ்–2) படித்த மாணவர்களும், கிராமப்புறங்களை சேர்ந்த மாணவர்களும் மருத்துவ படிப்பு படிப்பதற்கு ஏதுவாக தங்களது மாநிலத்தில் உள்ள இடஒதுக்கீட்டு கொள்கையின்படி இடஒதுக்கீடு வழங்குவதற்கு முழு சுதந்திரம் உண்டு; அதன்படி அவர்கள் கிராமப்புற மாணவர்களுக்கு சிறப்பு இடஒதுக்கீடு செய்து கொள்ளலாம் என்று அவர்களிடம் (தமிழக அரசிடம்) கூறி இருக்கிறேன்.

இடஒதுக்கீடு என்பது மாநில அரசின் திட்டம் என்ற வகையில், இந்த ஒதுக்கீட்டை செயல்படுத்த வேண்டியது தமிழக அரசை சேர்ந்தது ஆகும்.

இவ்வாறு அவர் கூறினார்.விதிவிலக்கு கிடையாது

‘‘இந்த ஆண்டு நீட் தேர்வில் இருந்து தமிழ்நாட்டுக்கு விலக்கு அளிக்கப்படுமா?’’ என்று மத்திய மந்திரி ஜே.பி.நட்டாவிடம் கேள்வி எழுப்பப்பட்டது.

அதற்கு அவர், ‘‘இந்த ஆண்டு நீட் தேர்வு நடத்தியே ஆக வேண்டும் என்பதை கடந்த ஆண்டே நாங்கள் கூறி, தெளிவுபடுத்தி விட்டோம்’’ என்று பதில் அளித்தார்.

மேலும் அவர் கூறும்போது, ‘‘தமிழக சட்டசபையில் நிறைவேற்றப்பட்ட மசோதாக்கள் ஜனாதிபதிக்கு அனுப்பிவைக்கப்பட்டன. அவை மத்திய உள்துறை அமைச்சகத்தின் கருத்துகளுக்காக வந்துள்ளன. நீட் என்பது நாடு முழுவதும் ஒரே ரீதியிலான தகுதி தேர்வு, இது நல்ல பலன்களை தரும், நாம் அதில் தொடர்ந்து முன்செல்லவேண்டும் என்று கூறிவிட்டோம்’’ என்று குறிப்பிட்டார்.

இதன் மூலம் நீட் தேர்வில் இருந்து தமிழ்நாட்டுக்கு விதிவிலக்கு கிடையாது என்பதை அவர் தெளிவுபடுத்தி உள்ளார்.தடை இல்லை

இந்த நீட் தேர்வை சி.பி.எஸ்.இ. நடத்தி, முடிவுகளை அறிவித்து, அகில இந்திய அளவில் மாணவர்களின் தர வரிசை பட்டியலை (ரேங்க் பட்டியல்) மத்திய அரசின் பொது சுகாதாரப்பணிகள் இயக்குனரகத்துக்கு வழங்கும். அதை வைத்து தனது தரப்பிலான 15 சதவீத இட ஒதுக்கீட்டுக்கு மத்திய அரசு கவுன்சிலிங் நடத்தும். மற்றபடி மாநில வாரியான முடிவுகளை மாநிலங்களுக்கு சி.பி.எஸ்.இ. அனுப்பி வைக்கும்.

எனவே தமிழ்நாட்டில் கிராமப்புற மாணவர்களுக்கு, குறிப்பாக மாநில கல்வி திட்டத்தின்கீழ் பிளஸ்–2 படித்த மாணவ, மாணவிகளுக்கு மாநில அரசு சிறப்பு இட ஒதுக்கீட்டை வழங்க தடை ஏதும் இல்லை என்பது குறிப்பிடத்தக்கது.

கேபிள் 'டிவி' விரோதத்தில் ஆசிரியை கொலை கொலையாளியின் தந்தையை அடித்து கொன்ற மக்கள்

தலைவாசல், கேபிள், 'டிவி' உரிமையை பெறுவதில் ஏற்பட்ட முன் விரோதத்தால், தனியார் பள்ளி ஆசிரியை, பிரவுசிங் சென்டர் உரிமையாளரால் கொலை செய்யப்பட்டார். சம்பவ இடத்துக்கு வந்த கொலையாளியின் தந்தை பொதுமக்கள் தாக்கியதில், பலியானார்.சேலம் மாவட்டம், தலைவாசல் அடுத்த, ஆறகளூரை சேர்ந்த, மாரியாப்பிள்ளை மனைவி சத்யா, 30. இவர், தனியார் பள்ளி ஆசிரியை. சத்யாவின் தாய் சாந்தி, 62, ஆறகளூரில் அரசு கேபிள், 'டிவி' நிறுவனத்தின் ஆப்பரேட்டராக இருந்து வருகிறார். இந்த தொழிலை, அவருடைய மருமகன் மாரியாப்பிள்ளை கவனித்து வந்தார். அதே பகுதியில், பிரவுசிங் சென்டர் நடத்தி வரும் விஜய், 33, கேபிள், 'டிவி' உரிமையை பெற முயற்சித்து வந்துள்ளார்

இதற்கிடையே, விஜயிடமிருந்த கத்தி நழுவியதை பார்த்த மக்கள், இருவரையும் பிடித்து தனி அறையில் அடைத்து, 'தர்ம அடி' கொடுத்தனர். தகவலறிந்த தலைவாசல் போலீசார், அடைத்து வைக்கப்பட்ட விஜய், ராஜேந்திரனை பிடிக்க உள்ளே செல்ல முயற்சித்த போது, பொதுமக்கள் போலீசாரை தடுத்து மறியலில் ஈடுபட்டனர்.அவர்களை போலீசார் அப்புறப்படுத்தி, சத்யாவின் உடலை மீட்டனர். தன் மகன் மற்றும் பொதுமக்கள் தாக்கியதில், ராஜேந்திரன் இறந்து கிடந்தார். விஜய் உயிருக்கு போராடிய நிலையில் இருந்தார். ராஜேந்திரன் உடலை கைப்பற்றிய போலீசார், விஜயை மீட்டு, சேலம் அரசு மருத்துவமனைக்கு சிகிச்சைக்கு அனுப்பி வைத்தனர்.

வீட்டை சூறையாடிய மக்கள்: ஆசிரியையை கொன்ற விஜயின் பிரவுசிங் சென்டரை, நேற்று காலை, 10:00 மணிக்கு, மக்கள் அடித்து நொறுக்கினர். இருந்தும், ஆத்திரம் அடங்காத மக்கள், விஜயின் வீட்டிற்கு சென்று, கதவை உடைத்ததுடன், வீட்டின் உள்ளே இருந்த பொருட்களை உடைத்து சூறையாடினர். மரக் கட்டில், கதவுகள், 'டிவி' போன்றவற்றை சாலையில் போட்டு, தீ வைத்து எரித்தனர்.இதனால், அப்பகுதியில் இருந்த குடிசை வீடுகளுக்கு தீ பரவ இருந்த நிலையில், மக்களே, தண்ணீர் ஊற்றி தீயை அணைத்தனர். அப்பகுதியில் பதற்றம் நிலவி வருவதால், போலீசார் குவிக்கப்பட்டுள்ளனர்.
