TC issue: HC orders notice to school

A Head Constable has moved Madurai Bench of the Madras High Court seeking relief for his children after they were issued transfer certificates for non-payment of fine for delay in paying school fees. Taking up the petition for hearing, Justice R. Mahadevan directed notice to the school authorities.

The petitioner, P. Selva Muruga Prabhu, said that the private school in Madurai, where his two children were enrolled, had imposed a fine for delay in payment of fees. When complained about the exorbitant fine charged, the school agreed to deduct the amount from the second instalment after initial mediation. However, it did not deduct the fine amount, as promised.

When the school authorities demanded payment of the second instalment in full, the petitioner said he refused. Following which the school issued transfer certificate to both his children studying in fifth and first standards. The petitioner said that the children were being expelled in the middle of the academic year. This was in violation of the Right to Education and Section 16 of the Right of Children to Free and Compulsory Education Act, 2009 (No child admitted to school can be expelled). Section 3 of the Tamil Nadu Schools (Regulation of Collection of fee) Act, 2009, which prohibited collection of excess fee, had also been violated, said the petitioner.

The petitioner approached the court seeking a direction to the school to allow his children to continue their studies and write the term examinations and that the transfer certificates be declared null and void.

‘People’s lives haven’t been made better by AIADMK’

He is the son of the soil and has campaigned across the constituency on foot. Marudhu Ganesh is very confident of winning the byelection despite complaints of money distribution by various political parties to the voters. Ganesh spoke to B Sivakumar a few hours before the campaign ended.

How confident are you of winning?

I am winning this bypoll. People want better infrastructure, drinking water and sanitation. They are angry with former chief minister J Jayalalithaa for not providing them basic facilities. There are areas in the constituency which do not have a single bank.

Are you worried about money distribution to voters?

Not all voters want money. A majority of them are workers and earn their money. Our party is not giving any money to the voters. People who want the constituency to develop will definitely vote for the DMK.

Why have the people of RK Nagar preferred the AIADMK continuously since 1996?

People have been carried away by the promises the AIADMK had made. I have seen people standing in queues for nearly one hour on Tuesdays. They used to pay ₹100 to write a petition seeking job, house or ration cards. They used to pay ₹300 to get a place in the queue. But their lives have not been made better by the AIADMK. Voters have been cheated.

Did you get support from your party leadership and the allies during the campaign?

All senior leaders from my party including Thalapathi [M K Stalin] campaigned for me. Similarly all alliance party leaders campaigned.

You don’t have experience in the legislature and your party is in opposition. Why should people vote for you?

I have been a journalist and have written about the problems faced by the people. Almost all party leaders used to call me to complain about problems in their areas. My leader has promised to adopt RK Nagar. Thus there is no problem in getting the government to solve problems of the people.

If elected, what are the things you would do for the constituency?

Drinking water is a big problem here. Our leader has said water from the Minjur desal plant will be supplied to the constituency and this will solve the water problem. Other things include building a crematorium, desilting the Buckingham Canal and restrict running of goods train to night to prevent traffic blockade during daytime.

‘Disqualify wrong-doers, we’ve no second opinion’

The AIADMK has the highest stakes in the RK Nagar byelection and has left no stone unturned to ensure it bags the seat represented by the late J Jayalalithaa. Sweeping aside allegations of money distribution, fisheries minister D Jayakumar tells Julie Mariappan why people will ensure that the party wins with a ‘thumping majority’.

There are allegations against the AIADMK for distributing money. What’s your reaction?

We never thought of winning elections through shortcuts. It is the DMK which introduced the notorious ‘Thirumangalam formula’. Both the DMK and T T V Dhinakaran seek to influence voters with money. People are clear and content under the AIADMK.

How crucial is this election given that the party approached the EC to ensure smooth conduct of polls?

We are confident. There is a great awakening in the party, especially after reclaiming the symbol and party name. This is our first election (after the passing away of Jayalalithaa) and people are happy about our feat (union). Though we don’t call it crucial, we are hoping for a Himalayan victory.

Going by some surveys, TTV seems a threat. Will you pull it off?

TTV is not at all a force to reckon with. How will people accept him when he contests against Amma’s party and ‘two leaves’? Surveys never reflect the truth and 2011 assembly poll is a classic example. We will win with a thumping majority.

The heads of government and administrative machinery are focusing on one constituency for a fortnight. Doesn’t it reflect desperation?

How could we not work for the party’s victory? Party and government are our eyes. It is our responsibility to strive hard for the party’s welfare. At the same time, we ensure the administration runs smoothly. While the corporation and police heads act as commission officials, the others are undisturbed.

There is a growing demand to disqualify candidates indulging in malpractice? Does the AIADMK agree with this?

I totally agree. Whoever commits the offence should be punished and my party endorses the view. Let the election commission find out the wrongdoers. We do not have a second opinion on disqualifying.

R K Nagar seems to have set a precedent on corruption and voter bribing. Is this here to stay?

We are law-abiding people with faith in democracy. But our rivals wander the streets to distribute money for votes. People will not accept them.

‘My win will bring change in government, politics’

He lost the battle for ‘two leaves’ but for T T V Dhinakaran the war is not over. The rebel AIADMK leader, who claims that the ruling dispensation is scared of him, tells Julie Mariappan why his victory is a ‘foregone conclusion’.

You said ‘two leaves’ is dead and the ‘hat’ too, but the ‘cooker’ symbol reached the electorate. How did you manage that?

People were waiting for the bypoll to elect me in whichever symbol I contest. Minutes after I was allotted cooker on December 7, residents of Cherian Nagar welcomed me with cookers. The sound of cooker reverberates everywhere. The government will be punished for ignoring Amma’s constituency.

The April bypoll was cancelled on voter bribery charges. Rivals have accused you of repeating the offence.

There is no need for me to bribe voters. If I am elected, people know the constituency will benefit and the aspirations to see a change in government and politics realised. The poor are aware of the political developments and my arrest. They want my victory.

The AIADMK has complained to the EC that you and the DMK are colluding to bribe voters and blame it on the AIADMK.

Why would I bribe to help Madhusudanan win? Instead we might as well boycott the byelection like our opponents did when Amma (Jayalalithaa) contested in 2014. This is the height of betrayal. We do not have any tie-up with the DMK.

The I-T department raided a popular cooker store in North Chennai. Your comment?

They even checked a showroombound truck loaded with cookers. It shows the fear of the ruling camp. The state and central governments are making all attempts to see that I am defeated. I give neither cookers nor cash for votes. My victory is a foregone conclusion.

The cabinet worked for your victory in April. You have none this time. What is your prospect?

The fact that they are not with me is a massive victory. People like us because these traitors don’t stand beside us. When I visited Anitha’s residence (NEET petitioner, who committed suicide), they allowed me, but not ministers and MLAs.

If you win, what would it imply?

The victory will bring in a massive change in politics and government within a short span. My victory will be an endorsement of the people of Tamil Nadu.

Karnan to walk out of prison today

Chennai: “He is bold, happy and confident” is how a friend described retired judge Justice C S Karnan, on the eve of his release from aKolkata jail.

A former judge of the Madras and Calcutta high courts, Justice Karnan became the first serving HC judge to be jailed for contempt of court in June. Having served his sixmonth term, he is set to step out of the Presidency Correctional Home in Kolkata on Wednesday. “When exactly he will be released is not clear. It could be morning, or late in the evening, if they insist on him completing the last day in jail,” said the former judge’s confidante M Malaviya.



‘Karnan stands by what he stated prior to imprisonment’

“The judge said he felt as if he was in jail even while he was in service. Such were the job-related restrictions. He also said that the Kolkata jail was, after all, in India and not in America,” Malaviya said.

“We have not received any formal intimation, but our lawyer W Peter Ramesh Kumar informed us that he will be released on Wednesday,” said Malaviya. News agencies also quoted Justice Karnan’s wife as saying that she would fly down to Kolkata to accompany her husband back to Chennai.

Malaviya said that even during his last meeting with the ex-judge, the latter stood by what all he had stated prior to his imprisonment and reiterated that he had been jailed without being heard fully.

On May 9, citing his intemperate outbursts against serving judges and holding him guilty of contempt of court, a Supreme Court bench of Chief Justice of India J S Khehar, Justices Dipak Misra, J Chelameswar, Ranjan Gogoi, Madan B Lokur, P C Ghose and Kurian Joseph sentenced him to six months jail term: “We will create a blemish if we do not punish him just because he is a judge. Contempt has no different colours — for a common man or a judge.”

“ We cannot differentiate that he is a judge in a contempt case,” the bench had said.

But Justice Karnan went underground a few hours after the historic verdict was out. He remained at large till June 20, when he was tracked down in Coimbatore and remanded in custody as per the apex court

To curb graft, TN govt bans cash transactions at sub-registrar offices

Chennai: There will be no more cash transactions allowed in sub-registrar offices across the state, as the government has sent a detailed circular to registration offices asking them to adopt cashless transactions.

The move comes after the Madras high court censured the authorities and slammed them over rampant corruption plaguing the registration department.

On November 20, Justice N Kirubakaran sought to know if officials were aware that touts were engaged to collect money over and above the amount payable for registration of documents, and whether they had organised any raid in this regard.

Responding to the queries, inspector general of registration J Kumaragurubaran filed an affidavit on Tuesday informing the court about the government’s latest move to curb cash transactions in registrations in an attempt to check allegations of corruption.

Aadhaar-property linking not must

The Centre on Tuesday told Lok Sabha that there was no proposal to make Aadhaar linkage mandatory for property transactions. PM Modi’s crack down on “benami” properties had triggered speculation about mandatory linking of Aadhaar with property transactions. P 16

‘Raids in 155 offices in past 10 years, ₹70 lakh seized’

As to the details of raids conducted in such offices in the past 10 years, Kumaragurubaran said: “Out of 578 subregistrar offices, the DVAC has conducted surprise raids in 155 offices for the past 10 years and arrested 77 people. Out of 77 cases, 14 cases ended in conviction. The total amount seized during the surprise checkswas ₹70.01lakh. One person has been arrestedtwiceon thechargesof demanding and accepting bribe. Now, he had already been placed under suspension and further kept under extension of service.”

Not satisfied with the contents of the affidavit, Justice Kirubakaran directed the officer to file a better affidavit and directed the DVAC to file a response to the queries raised earlier by the court. He then posted the plea to December 20 further hearing.

This apart, as and when DVAC raids were conducted and reported, the entire staff were being transferred.

On November 13, thedepartment framed charges against on sub-registrar, Pallavaram for the reason of employing private persons, the affidavit added.

முன்னாள் முதல்வர் ஜெயலலிதாவின் மரணம் குறித்து ஓய்வுபெற்ற நீதிபதி ஆறுமுகசாமி தலைமையிலான ஆணையம் விசாரணை நடத்தி வருகிறது. சென்னை சேப்பாக்கத்தில் உள்ள இந்த விசாரணை ஆணைய அலுவலகத்தில், சென்னை மருத்துவக் கல்லூரி மருத்துவமனையின் முன்னாள் டீன் டாக்டர் எம்.கே. முரளிதரன் செவ்வாய்க்கிழமை ஆஜரானார். 

அவரிடம், நீதிபதி ஆறுமுகசாமி 1 மணி நேரத்துக்கும் மேலாக விசாரணை மேற்கொண்டார். இதைத் தொடர்ந்து, டாக்டர் முரளிதரன் செய்தியாளர்களிடம் கூறியதாவது:

இன்று விசாரணை: தமிழக அரசின் முன்னாள் தலைமைச் செயலாளர்கள் ஷீலா பாலகிருஷ்ணன், ராமமோகன ராவ், வழக்குரைஞர் ஜோசப் ஆகியோருக்கு விசாரணை ஆணையம் அண்மையில் அழைப்பாணை அனுப்பி இருந்தது. 

இதையடுத்து, ஷீலா பாலகிருஷ்ணன் புதன்கிழமையும் (டிச. 20), ராமமோகன ராவ் வியாழக்கிழமையும் (டிச. 21) ஆணையத்தின் முன் ஆஜராகி விளக்கம் அளிக்க உள்ளனர். 

மேலும் 302 புகார் மனுக்கள்

ஜெயலலிதா மரணம் குறித்து விசாரித்து வரும் ஆணையத்தில் ஏற்கெனவே 120 புகார் மனுக்கள் அளிக்கப்பட்டுள்ளன. 28 பேர் பிரமாணப் பத்திரங்கள் தாக்கல் செய்துள்ளனர். இந்நிலையில், ஜெயலலிதா மரணம் தொடர்பாக தேனாம்பேட்டை காவல் நிலையத்தில் அளிக்கப்பட்ட 302 புகார் மனுக்களும் விசாரணை ஆணையத்திடம் செவ்வாய்க்கிழமை ஒப்படைக்கப்பட்டன. இந்த மனுக்களை ஆராய்ந்த பின் இதுகுறித்து நடவடிக்கை எடுக்கப்படும் என விசாரணை ஆணைய வட்டாரங்கள் தெரிவித்தன.

ஆட்டம் காணும் ஆளுமை!

அண்மைக் காலமாக சமூக ஊடகங்களைத் திறந்தால் கேலியும், கிண்டலும் கொந்தளிக்கும் அரசியல் மீம்ஸ்கள் கொட்டுகின்றன. அவற்றில் சிறப்பிடம் பிடிப்பவை அரசியல் தலைவர்களைப் பற்றியவைதான். அதிலும் தமிழக அரசியல் தலைவர்களைப் பற்றிய மீம்ஸ்களுக்கு குறைவில்லை. 

ஆளுங்கட்சி, எதிர்க்கட்சி என்ற வேற்றுமை இல்லாமல் சகட்டுமேனிக்கு வெளுத்து வாங்கும் இந்த மீம்ஸ்களுக்கு பொதுமக்களிடையே வரவேற்பு அமோகம். அந்த அளவுக்கு மீம்ஸ்களை உருவாக்கும் படைப்பாளிகளுக்கு தமிழக அரசியல் கட்சித் தலைவர்கள் "இரை'யாகி வருகின்றனர்.

மீம்ஸ்களைப் பார்க்கும்போதும், அவற்றுக்கான நறுக்கென்ற நாலு வரி கேலி வாசகங்களை படிக்கும்போதும் நகைச்சுவை உணர்வுக்கு பஞ்சப்பட்டவர்கள் கூட வாய்விட்டு சிரிக்க வேண்டியதாகி விடுகிறது. அந்த நகைச்சுவைகள் நம்மை சிரிக்க வைப்பதோடு மட்டுமல்லாமல் சிந்திக்கவும் வைக்கின்றன. ஆமாம், நாம் எப்படிப்பட்ட தலைவர்களால் ஆளப்படுகிறோம் என்ற சிந்தனை மனதை வேதனை கொள்ள வைக்கிறது. 

தலைவனுக்குள்ள தகுதிகள் என்ன? நீதி நூல்கள் கூறுவது: குற்றஞ்சாட்டப்படாதவனாக இருக்க வேண்டும். ஒரே மனைவியை உடையவனாக இருத்தல் வேண்டும். கொடியவன் என்றோ அடங்காதவன் என்றோ பெயர் எடுத்தவனாக இருக்கக் கூடாது. கடவுள் நம்பிக்கை உள்ளவனாகவும், அத்தகைய பிள்ளைகளை பெற்றெடுத்தவனாகவும் இருக்க வேண்டும். தன் விருப்பப்படி செயல்படுபவனாக இருக்கக் கூடாது. முன்கோபம் கூடாது. மதுபானப் பிரியனாக இருக்கக் கூடாது. இழிவான ஆதாயத்தை நாடாதவனாகவும் இருக்க வேண்டும். தெளிந்த புத்தியை உடையவனாகவும், நீதிமானாகவும், இச்சை அடக்கம் உள்ளவனாகவும் இருக்க வேண்டும்.

ஆரோக்கியமானவனாக, நல்ல ஆலோசனை மூலம் புத்தி சொல்பவனாக, எதிர்த்து பேசுபவர்களை கண்டனம் செய்து பதில் அளிப்பதில் வல்லவனாக, தான் கற்றுக் கொண்டதற்கேற்ப உண்மையை பின்பற்றுபவனாக, அதையே பேசுபவனாக, காரிய சமர்த்தனாக இருத்தல் அவசியம் என தலைவனுக்குரிய தகுதிகளாக நீதி நூல்கள் வரையறுக்கின்றன.

இந்தத் தகுதிகள் முழுமையாக இல்லாவிட்டாலும், நிரம்பப் பெற்றவர்கள் நாட்டின் தலைவர்களாக இருந்த காலம் இல்லாமல் இல்லை. ஆனால் இன்று நிலைமை தலைகீழாகி விட்டதை எவரும் மறுக்க முடியாது. தலைமைக்கான தகுதி முழுமையாக பெற்றவர்கள்தான் தலைவர்களாக வேண்டும் என்றால் நாட்டில் தலைமைப் பஞ்சம் தலைவிரித்துதான் ஆடும். அந்தக் கால கணக்குப்படி "ஐந்துக்கு இரண்டாவது' (அது இந்தக் கால கணக்குபடி 40 சதவீதம்-35 சதவீதமே தேர்ச்சிதானே) இருந்தால்கூட தலைவராக ஏற்கலாம்.
ஆனால் அதற்கும் தகுதி இல்லை என்பதுதான் இன்றைய நிலை. அதனால்தான் இப்போது சில தலைவர்கள் நாள்தோறும் தங்களது சொல் மற்றும் செயல்களால் மீம்ஸ்ளுக்கு தீனி போட்டுக் கொண்டிருக்கிறார்கள்.

ஒரு அமைச்சர் வைகை அணை நீர் ஆவியாகாமல் இருக்க தெர்மகோல் (பாலிஸ்டிரீன்) கொண்டு மூடுகிறார். மற்றொருவர் நொய்யல் ஆற்றுநீர் மாசுபடுவதற்கு மக்கள் சோப்பை பயன்படுத்துவதுதான் காரணம் என கண்டறிந்து கூறுகிறார். தமிழக முதல்வர் புதுதில்லி சென்று பிரதமர் மன்மோகன் சிங்கை சந்தித்து பேசியுள்ளார் என்கிறார் மற்றொரு அமைச்சர்.
தமிழகத்தின் துணை குடியரசு தலைவர் வெங்கய்ய நாயுடு என்கிறார் இன்னொருவர். இவற்றுக்கெல்லாம் சிகரம் வைத்தாற்போன்று, கம்ப ராமாயணத்தை எழுதியவர் சேக்கிழார் என்று கூறி அரங்கை அதிர வைக்கிறார் ஒருவர்.

சரி, நாட்டை ஆளும் தலைவர்கள்தான் இப்படி இருக்கிறார்கள் என்றால், ஆளத் துடிக்கும் தலைவர்கள் எப்படி இருக்கிறார்கள்? மீத்தேன் திட்டத்துக்கு, தெரியாமல் கையெழுத்திட்டேன் என்கிறார் ஒருவர்.

வெள்ளித்திரையில் வெகுண்டெழச் செய்யும் வீர வசனங்கள் பேசுவோர், அரசியல் கருத்தைச் சொல்லும்போது தெளிவின்றித் தடுமாறுகின்றனர். ஆர்.கே. நகர் இடைத்தேர்தல் முறைகேடு குறித்து மாநில தேர்தல் ஆணைய முகவரிக்குப் புகார் கடிதம் எழுதுகிறார் மற்றொருவர்.
சுதந்திர இந்தியாவின் சிற்பி பண்டித நேரு, இந்தியாவின் இரும்புப் பெண்மணி இந்திரா காந்தி, கர்மவீரர் காமராஜர், ஏன் எம்.ஜி.ஆர்., ஜெயலலிதா ஆகியோர் மீது கூட பொதுவெளியில் கடுமையான விமர்சனங்கள் இருக்கலாம். ஆனால் அவர்களது ஆளுமைகள் குறித்து இன்றும் சிலாகித்துப் பேசப்படுகிறது. அவர்களது காலத்திலும் இப்படிப்பட்ட கேலி, கிண்டல்கள் தனிவெளியில் பரவி இருக்கலாம். இன்றைய சமூக ஊடகங்களின் இருப்பு அன்று இல்லாமல் இருந்திருக்கலாம். 

ஆனாலும்கூட அவர்கள் இத்தனை தூரம் தரம் தாழ்ந்து போனதில்லை. அதற்கான வாய்ப்புகள் இன்றுபோலவே அன்றும் இருந்திருக்கவே கூடும். ஆனால் தலைமைப் பண்பு அவர்களைத் தற்காத்தது. அதனால்தான் அவர்கள் இன்றும் தலைவர்களாக மக்கள் மனங்களில் தலைநிமிர்ந்து நிற்கிறார்கள்.

தலைநிமிர்ந்து நின்ற தலைவர்கள் ஆட்சி செய்த இந்த நாட்டை இன்று ஆளும் தலைவர்கள் கேலிக்கும், கிண்டலுக்கும் ஆளாகி வருவது வேதனை அளிக்கிறது. தலைவர்களுக்கான அந்த பிம்பம் உடைந்து வேடிக்கை மனிதர்களாக வலம் வரத் தொடங்கி இருப்பது நாட்டுக்கு நல்ல அறிகுறி அல்ல.

தலைவர்கள் கேலிப் பொருளாகும்போது அவர்களது தலைமைப் பண்பு கேள்விக்குறியாகிறது. தலைமைப் பண்பு கேள்விக்குறியாகும்போது அவர்களது ஆளுமையும் ஆட்டம் காணுகிறது. ஆளுமை ஆட்டம் கண்டால் அவர்களது அதிகாரத்துக்கு என்ன சக்தி இருக்கும்? ஜனநாயகத்தில் சக்தி இல்லாத அதிகாரம் கொண்ட தலைவர்களால் யாருக்கு என்ன பயன்? தலைவர்களும், தலைவர்களாகத் துடிப்பவர்களும் சிந்திக்க வேண்டிய தருணம் இது.

பத்திர பதிவு அலுவலகங்களில் 'விஜிலென்ஸ்' சோதனை

சென்னையில் சார் பதிவாளர் அலுவலகங்களில், 'விஜிலென்ஸ்' அதிகாரிகள், திடீர் சோதனை நடத்தினர். தமிழகத்தில், 578 சார் பதிவாளர் அலுவலகங்கள் உள்ளன. இவற்றில், தரகர்கள் ஆதிக்கம் அதிகமாக உள்ளதாக புகார் கூறப்படுகிறது. இதை கட்டுப்படுத்த, பதிவுத்துறை தலைவர் பல்வேறு கிடுக்கிப்பிடி உத்தரவுகளை பிறப்பித்துள்ளார்; ஆனாலும், முறைகேடுகள் தொடர்கின்றன. இந்நிலையில், பதிவுத்துறை விஜிலென்ஸ் பிரிவு, உதவி ஐ.ஜி., ஸ்ரீசித்ரா தலைமையிலான தனி படையினர், சென்னை சார் பதிவாளர் அலவலகங்களில், திடீர் சோதனை நடத்தினர்.
