வரலாறு தந்த வார்த்தை 15: நம்ம ‘கை’ல என்னப்பா இருக்கு?

ஒரு வழியாக, ஆர்.கே.நகர் இடைத்தேர்தல் நடந்து முடிந்துவிட்டது. ஒருவரை ஒருவர் மிஞ்சும் அளவுக்கு, கட்சிகளுக்கிடையே ‘வாரி வாரி’ நடந்த பிரசாரம் என்ன, ‘வாரி வாரி வழங்கிய’ வாக்குறுதிகள் என்ன?

எந்த ஒரு அசம்பாவிதமும் இல்லாமல் சிறப்பான முறையில் தேர்தல் நடந்து முடிந்திருக்கிறது. யார் ஜெயிப்பார் என்பதை விடவும், ஜெயித்தால் அவர் என்ன செய்வார், தொகுதிக்கு ஏதாவது நல்லது செய்யவிடுவார்களா என்பதே அந்தத் தொகுதி மக்களின் எதிர்பார்ப்பாக இருக்கிறது.

அதே எதிர்பார்ப்பு, போட்டியிட்ட வேட்பாளர்களுக்கும் இருக்கவே செய்யும். ‘நாம் நினைத்ததுபோல எல்லாம் நல்லபடியாக நடக்க வேண்டுமே’ என்ற பதற்றம், பரபரப்பு அவர்களை ஓரிடத்தில் நிலைகொள்ள வைக்காது.

ஆங்கிலத்தில் இப்படியான நிலையை வெளிப்படுத்துவதற்கு ‘Keep one’s fingers crossed’ என்று சொல்வார்கள். நாம் நினைப்பது மட்டுமல்லாமல், ‘உன் மனம் போல் எல்லாம் நல்லபடியாக நடக்கட்டும்’ என்று இன்னொருவரை வாழ்த்தவும் இந்தச் சொற்றொடரைப் பயன்படுத்தலாம்.

இப்படியான வாழ்த்து, கடவுளிடமிருந்து வந்ததாக நம்பப்படுகிறது. அன்றைய இஸ்ரேல் தேசத்தில், வழக்கு ஒன்றில் தீர்ப்பு வழங்குவதற்கு முன்னால், தங்களது சுட்டு விரலுக்கு மேலே, நடு விரலை வைத்து, நீதிபதிகள் ‘க்ராஸ்’ செய்வார்கள். அப்படிச் செய்துகொண்டே, ‘உன் மீது இறைவன் கருணை பொழியட்டும்’ என்று சொல்வார்களாம்.

அதாவது, தங்களது தீர்ப்பைவிடவும் இறைவனது தீர்ப்பே மேலானது என்பதை வலியுறுத்தவே இப்படிச் செய்வார்கள். தான் நல்லபடியாகத் தீர்ப்பு எழுதவும், யாருக்குத் தீர்ப்பு எழுதப்படுகிறதோ அவருக்கு நன்மை உண்டாகவும், இறைவனிடமிருந்து வாழ்த்து பெறும் செயலாக இவ்வாறு விரல்களை ‘க்ராஸ்’ செய்து வந்தார்கள். நாளடைவில், அந்தச் செயலைச் சாமானியர்களும் பின்பற்றத் தொடங்கினார்கள். அதிலிருந்து வந்ததுதான் மேற்கண்ட சொற்றொடர்.

நான் திருவாரூரில் பள்ளி இறுதி வகுப்பைப் படித்துக் கொண்டிருந்த காலம். திருவாரூர் நகர தட்டு ரிக்‌ஷா சங்கத் தலைவராக பாபு என்பவர் இருந்தார். திருவாரூர் நகர தலைமை ரஜினி ரசிகர் மன்றத் தலைவர். அவரை 'ரஜினி பாபு' என்றால்தான் தெரியும். ரஜினி பாபுவாக நகரத்தில் நடக்கும் அனைத்து நிகழ்ச்சிகளிலும் இடம் பெற்றிருப்பார். ரஜினிக்கு அரசியல் பிரவேச ஆசை துளிர்விட்ட சமயத்தில், 'தலைவா தரணி ஆள வா' என நகரின் அனைத்து பக்க சுவர்களிலும் நீலமும் வெள்ளையுமாக நிறைத்து விட்டார். நகரில் உள்ள அண்ணாமலை, தளபதி உள்ளிட்ட ரசிகர் மன்றங்களுக்கெல்லாம் நகர தலைமை ரசிகர் மன்றத் தலைவர் என்பதால் ஏக மரியாதை அளிப்பார்கள்.

நான் தங்கிப் படித்த இடத்துக்கு அருகில்தான் அவரது வீடு. காட்சிகள் நினைவுகளில் இருந்து மங்கிக் கொண்டிருக்கிறது. ரஜினி பாபுவுக்கு இரண்டு குழந்தைகள். இப்போது அவர்கள் வளர்ந்துவிட்டனர். பள்ளிக்கூடம் செல்லாத பெரியவன் பஸ் ஸ்டாண்டில் இருக்கும் சாந்தி ஓட்டலில் சப்ளையராக இருக்கிறான். பனிரெண்டாவது படிக்கும் பெண் குழந்தையை அடுத்து படிக்க வைப்பதற்கான வசதியோ, வழியோ இல்லை.

ரஜினி பாபுவை நாங்கள் கொண்டாடிய காலம், நடிகர் ரஜினிகாந்த் தனது திரை வாழ்வின் உச்சத்தில் இருந்த நாட்கள். இப்போது ரஜினி அரசியல் ஆசையின் உச்சத்தில் இருக்கிறார். இடைப்பட்ட காலத்தில் 'பாபா', 'கோச்சடையான்', 'லிங்கா' என அவருக்கே திரை வாழ்வில் பல சறுக்கல்கள். ரஜினி பாபுவுக்கு இருக்காதா என்ன… இந்த இருபது ஆண்டுகளில் இருவரையும் இணைக்கும் புள்ளியில் வந்து நான் நிற்கிறேன்.

யாரை நம்பி ரஜினி அரசியலில் இறங்குகிறார்? அரசியலில் இறங்க வேண்டும் என்கிற அவரது ஆசைக்கு 20 ஆண்டுகளாக ஏன் ஒத்திகை பார்க்க வேண்டும்?

ரஜினிக்கு அரசியல் ஆசை இருப்பதில் தப்பில்லை. யாருக்கும் அரசியல் கதவுகள் அடைக்கப்படுவதில்லை. சாதுர்யமானவர்களுக்கு அரசியல் கதவு தானாக திறக்கிறது. சாமர்த்தியமானவர்கள் கதவை உடைத்துக்கொண்டு உள்ளே நுழைகின்றனர். சாமானியருக்குமான வாய்ப்புகளும் அரசியல் அரங்கில் அருளப்பட்டுள்ளது. ஆனால் 20 ஆண்டுகளாக அதை அடைகாக்கும் மர்மம்தான் என்ன…

எதற்காக இந்தக் காத்திருப்பு?

நினைத்த மாத்திரத்தில் குதித்துவிட அரசியல் என்ன குளியல் தொட்டியா… கடலல்லவா.. ஆழம் பார்த்துதான் இறங்க வேண்டும். அவசரப்படக்கூடாது. தருணத்துக்காக காத்திருக்கிறார் என்பவர்களுக்கு….

1995-ம் வருடத்தில் ஒருநாள், ரஜினியின் கார் போயஸ் தோட்டத்தில் அப்போதைய முதல்வர் ஜெயலலிதாவின் பாதுகாவலர்களால் மறிக்கப்பட்டது. நடந்தே வீட்டுக்குச் சென்றார். அவரது பத்தடி தூர நடை, ஆட்சியை மதிப்பிடுவதற்கான உரை கல்லாக அமைந்துவிட்டது. அப்போது வந்த தேர்தலில், 'ஜெயலலிதா மீண்டும் முதல்வரானால் தமிழ்நாட்டை ஆண்டனாலும் காப்பாற்ற முடியாது' என ரஜினி அறிக்கை விட்டார். அதை கப்பென பிடித்துக் கொண்டது திமுக. மூப்பனார் தலைமையில் தமாகா உருவாகி திமுகவுடன் கூட்டணி வைத்தது. பின்னர் 2004-ம் ஆண்டு நடந்த நாடாளுமன்றத் தேர்தலில் 'பாபா' பட பிரச்சினையில் அவருக்கு தலைவலியை கொடுத்த பாட்டாளி மக்கள் கட்சிக்கு எதிராக 6 தொகுதிகளுக்கு மட்டும் அறிக்கை விட்டார். அப்போது பாஜகவுடன் அதிமுக கூட்டணி வைத்திருந்தது. அப்போது வெளியிட்ட அறிக்கையில் தமிழ்நாட்டின் தண்ணீர் பிரச்சினை குறித்தெல்லாம் தொட்டிருந்தார். ரஜினிக்குத் தெரியாததல்ல… அதற்கு முன்னரும், பின்னரும் எந்த அரசியல் கருத்து குத்துகளையும் தமிழக மக்கள் மூஞ்சியில் குத்தியதில்லை. ஆக காத்திருக்கும் காலத்திலும் அவர் அரசியல் பேசியதில்லை…

ரஜினிக்கு அரசியல் ஆசை துளிர்க்கத் தொடங்கிய காலத்தில் நெறியாள்கை செய்வதற்கு ஜி.கே.மூப்பனார் இருந்தார். தவிர அவரது ஆஸ்தான நண்பர் சோ இருந்தார். சொந்த முடிவுகளுக்கே பழக்கப்பட்ட ஜெயலலிதாவுக்கே ஆலோசகராக இருந்தவர் மறைந்த சோ. அவர் இருந்த காலத்தில் ஏன் ரஜினிக்கு ஒரு நல்ல வழியைக் காட்டவில்லை. அல்லது எவ்வளவு காலம் வரை அவரைக் காத்திருக்கச் சொன்னார். அல்லது தமிழருவி மணியனை ரஜினியின் அடுத்த ஆலோசகராக கை காட்டிவிட்டுச் சென்றாரா… தேவைக்கேற்ற நெளிவு சுளிவுகளோடு இயங்கும் தமிழருவி மணியன்தான் ரஜினியின் அரசியல் ஆலோசகர் என்றால், நிச்சயம் தமிழருவி வந்தடைந்த இடம் சரியானது. அல்லது ரஜினியின் தேர்வும் மிகச் சரி.

உங்களில் ஒழுக்க சீலர்கள் யாரோ அவர்மீது கல்லெறியுங்கள் என்கிறார் இயேசு. ஒருவரும் கல்லெறியவில்லை. ஏனென்றால் யாரும் ஒழுக்க சீலர்கள் இல்லை. இதை வேதம் சொல்கிறது. ஆனால் அவர்களில் ஒருவரும் தங்கள் மீது தாங்களே ஏன் கல்லெறிந்து கொள்ளவில்லை. இது வாதம்.

ரஜினி மீது முன் வைக்கப்படும் கேள்வியும் இதுதான். பொது வாழ்வுக்கு வந்து ரஜினி செய்யப்போவது என்ன… சுத்தமான அரசியல், சுகாதாரமான அரசியல், நேர்மையான அரசியல் என்றால் இத்தனை ஆண்டுகாலம் தமிழகத்தின் தலைநகரில் இருந்து கொண்டு கண்ணெதிரே நடக்கும் அவலங்களைக் காணாமல் கண்ணை மூடிக் கொண்டு இருக்கிறாரா?. ஈழத் தமிழர் கொத்து கொத்தாக செத்து மடிந்த போது ஏன் குரல் கொடுக்கவில்லை? பரபரப்பு மிக்க ரயில் நிலையில் சுவாதி துடிக்கத் துடிக்க செத்தபோது ஏன் ரஜினியின் கண்கள் திறக்கவில்லை?

சாதி ஆணவ வெறியர்கள் , கட்டியவள் முன்னே கணவனை வெட்டிக் கொன்றார்களே? சட்டம் ஒழுங்கு சந்தியில் நிற்பது குறித்து உடுமலை சங்கருக்காக ரஜினியின் தொண்டைக் குழியிலிருந்து ஒரு சொல் வெளியேறவில்லையே ஏன்?.

இவையெல்லாம் ரஜினியின் அரசியல் அஜெண்டாவில் இல்லையா. இல்லை இவை தமிழ்நாட்டு அரசியல் இல்லையா... உண்மையில் ரஜினி களமாடப்போகும் களம் எது..?

நேரடியாக முதல்வர்தான் என்றாலும் எல்லாவற்றுக்கும் கருத்து சொல்ல வேண்டுமே. ரஜினி என்ன சொல்லப் போகிறார். ஆற்றில் இறங்கினால்தான் நீந்த முடியும்… அரசியலில் குதித்தால்தான் அதிரடி காட்ட முடியும் என்றால் அவரின் ஸ்கிரிப்டுக்கு வேலை செய்யப் போவது யார்..?



சொந்த வாழ்வில் நேர்மையா?

சொந்த வாழ்வில் நேர்மையா என்று கேட்பது அரசியல் வாழ்க்கைக்கு ஏற்புடைய கேள்வியல்ல… ஆனால் ஊழலற்ற அரசியல் வேண்டும் என்று களமிறங்கும்போது ரஜினி எத்தனை சதவீதம் அதில் சரியாக இருக்கிறார் என்பதை வாக்காளர்கள் தெரிந்து கொள்ள விரும்புவதில் தப்பில்லை. ஒட்டுமொத்த தமிழகமும் ரஜினியின் கை வித்தைக்கு மயங்கும் ரசிகர்கள் இல்லை என்பதால் அவரின் சொந்த வாழ்க்கையின் நேர்மையை சோதனைக்கு உட்படுத்துவதுதான் அரசியல் வாழ்க்கையின் அஸ்திவாரமாக இருக்கும்.

'படையப்பா' திரைப்படம் வந்தபோதே ஏரியா ரைட்ஸ் வாங்கியவர் ரஜினி. 'காலா' படத்துக்கான வரவு செலவு என்ன என்பதையோ, அப்படத்துக்காக பெறும் சம்பளத்தையோ ரஜினி பகிரங்கமாக வெளியிட முடியுமா… அனைத்தும் வெள்ளையாக இருந்தால் ரஜினியின் அரசியல் தூய்மையில் சந்தேகமேயில்லை.

பெருமைப்படுவதா? வருத்தப்படுவதா?

நாடாளுபவர்களே நடிகர்களாக இருக்கையில் நடிகர்கள் நாடாள ஆசைப்படலாமா என்று கேட்கவில்லை. ரஜினியின் ஓய்வு கால அரசியல்தான் கேள்வியாகிறது. ரஜினி தன் பரிசோதனை காலத்தை 40 வயதில் தொடங்கி இருக்கலாம். அல்லது 50 வயது, அல்லது குறைந்தபட்சம் 60 வயதிலாவது தொடங்கி இருக்கலாம். அடுத்த பட புராஜெக்ட் முடிக்கையில் அவர் 70 வயதை நெருங்கிவிடுவார். இந்த வயதில் ரஜினி தமிழகத்தின் தலையெழுத்தை தூக்கி சுமக்க நினைப்பதற்கு பெருமைப்படுவதா? அல்லது ஓய்வு காலத்தில் முதல்வராக ஆசைப்படுகிறார் என வருத்தப்படுவதா?

ரஜினி அடையாளப்படுத்தப்போவது எதை அல்லது யாரை?

அரசியலுக்கு வயது வரம்பு தடையில்லைதான். ஆனால் ஒரு பரந்த மாநில மக்களின் நல்லது கெட்டதுகளை தெரிந்து கொள்ள ஒரு காலம் வேண்டாமா.. தமிழ்நாட்டின் 50 ஆண்டுகால அரசியலை தீர்மானித்தவர்கள் தமிழ் சினிமாவிலிருந்து வந்தவர்கள்தான். ஆனால் அவர்கள் அரசியலுக்கு தங்களை ஒப்படைத்த வயதும் காலமும் முக்கியமானது. கருணாநிதியின் அரசியல் வாழ்க்கை திருவாரூரில் தொடங்கி இருக்கலாம். திரையில் கோலோச்சிய காலத்தில்தான் தேர்தல் அரசியலிலும் தீவிரமாக இருந்தார்.

மூன்று முறை தமிழக முதல்வராக இருந்த எம்.ஜி.ஆர் 30 வயதுகளிலேயே அரசியல் கருத்துகளோடு இருந்தவர். 50 வயதில் தனிக்கட்சி தொடங்கினார். முன்னாள் முதல்வர் ஜெயலலிதா 1948ல் பிறந்து 1981ல் அரசியல் வாழ்க்கையைத் தொடங்கினார். இவர்கள் யாவரும் நேரடியாக முதல்வர் ஆனவர்கள் இல்லை. எம்.எல்.ஏ, எம்.பி. என படிப்படியாக உயர்ந்தவர்களே.

ஆந்திராவின் அரசியல் போக்கை தீர்மானித்த என்.டி.ஆரை எடுத்துக் கொள்ளுங்கள. 60 வயதில் அரசியலுக்கு தன்னை ஒப்படைத்தார். இவையெல்லாம் வரலாற்றில் உள்ளவை. தங்களுக்குப் பிறகான அரசியலை தொடர இவர்களின் கொள்கை இருந்தது. அல்லது குறைந்தபட்சம் வாரிசுகளாகவது இருந்தனர். ரஜினி அடையாளப்படுத்தப்போவது எதை அல்லது யாரை?

திரைக்கலைஞராக ரஜினியின் மீது கொண்டுள்ள அன்பையும், ரசிக தன்மையும் மட்டுமே அரசியலுக்குக்கான முதலீடாகிவிட முடியுமா… அவரின் சொந்தப் பிரச்சினைகளுக்கான அறிக்கைகளே அரசியல் செல்வாக்கை உரசும் உரை கல்லாக அமைந்துவிடுமா… உச்சநட்சத்திரமாக உருமாறிய காலத்தில் பின் தொடர்ந்த ரசிகர்களின் ரகம் வேறு. போஸ்டர்களுக்கு பசையை காய்ச்சித் தடவிய காலம். நாயக பிம்பங்களும் அதிகம் இல்லாத நாட்கள். இப்போதோ நேற்று வந்த நட்சத்திரங்களுக்கும் ஓப்பனின் சாங் வைக்கப்படுகிறது என்பதை ரஜினி புரிந்துகொள்ள வேண்டும். லட்சம் கோடியை எண்ணால் எழுதினால், அதில் அதிகம் சைபர்கள்தான் என்கிற நவயுக தமிழன் காலம் இது. சறுக்கினால் ரஜினியும் ஒரு மீம்ஸ் கிளிப்பிங்ஸ்தான். வாட்ஸ் அப்- வறுவல்தான். யாரும் விதிவிலக்கில்லை.

இறுதியாக உறுதியாக ரஜினிக்கு சொல்லிக் கொள்ள விரும்புவது என்னவென்றால்... உங்களுக்கு நீங்களே எதிரியாகப் போகிறீர்களா? திரைவாழ்வில் சம்பாதித்த சுகமான நாட்களை அரசியல் நாட்களில் தொலைத்து விடாதீர்கள் ரஜினி.

குரோம்பேட்டை வெற்றி திரையரங்கின் 2010-17 டாப் 10 படங்கள்: ஆச்சர்ய தகவல்கள்!

சென்னை குரோம்பேட்டையில் உள்ள புகழ்பெற்ற வெற்றி திரையரங்கில், கடந்த வருடம் வரை டாப் 10 பட்டியலில் முதலிடத்தில் இருந்த எந்திரன் படம் இந்த வருடம் கீழே இறங்கிவிட்டது.

வெற்றி திரையரங்கில் அதிகம் பேர் பார்த்த படம் என்கிற பெருமையை இந்த வருட ஏப்ரலில் வெளியான பாகுபலி 2 படம் தட்டிச்சென்றுள்ளது. 2010-ல் வெளியான எந்திரன் கடந்த ஏழு வருடங்கள் வரை முதலிடத்தில் இருந்த நிலையில் இந்த வருடம் பாகுபலி 2 படத்தினால் அது இரண்டாம் இடத்துக்குச் சென்றுவிட்டது.

Stop inflating marks for Class XII: Central govt advised, 17 states agree

AS many as 17 states have responded positively to the Centre’s appeal to end the practice of inflating Class XII Board marks in the garb of “moderation,” The Indian Express has learnt. On October 6, school education secretary Anil Swarup wrote to the heads of all state education boards advising them to completely avoid “bunching of marks” and “their spiking.” The inflation of results have led to unrealistic cut-off marks for admission to Delhi University in the past.

Sources said education boards of Gujarat, Haryana, Himachal Pradesh, Kerala, Madhya Pradesh, Punjab, Uttarakhand, Andhra Pradesh, Rajasthan, Assam, Jammu and Kashmir, Jharkhand, Manipur, Mizoram, Nagaland, Telangana and Goa have replied in agreement to the Centre’s advice.

“They have either clarified that they don’t resort to inflation or are willing to reconsider their moderation policy in light of our letter,” said a senior official who did not wish to be identified.

Uttar Pradesh, West Bengal, Bihar, Maharashtra, Tamil Nadu and Odisha are among states that are yet to respond.

This meant that marks were inflated even this year.
“Moderation” policy refers to a practice in which students get extra marks in subjects regarded “unusually difficult,” or if there have been differences in the sets of question papers.

So, in theory, moderation is meant to level the playing field but the suspicion is that some school boards are allegedly misusing it to inflate Class XII results to give their students a competitive edge in admission to higher education institutions.

Swarup’s fresh plea, dated October 6, advised states that the practice of giving grace marks can continue provided the policy is publicly declared and that weight to extra-curricular activities should be the same across all boards.

An online shopper who received a faulty phone through Flipkart will get a refund, thanks to the Consumer Grievances Redressal Forum here.

Headed by P V Singri, the forum directed the e-commerce giant to pay Vijay Jain (26) the full cost of the phone with interest.

Jain bought a Lenovo Sisley S90 on April 4, 2015 for Rs 17,680. After about four months of use, it stopped working.

He took it to the Lenovo authorised service centre, but was denied service on the grounds that the invoice issued by Flipkart made no mention of the phone's IMEI (international mobile equipment identity) number.

He emailed and sought help from the online store, but it did not address his concerns for three years and a half, according to his petition. He then approached the consumer forum.

Defence argument

Bharath Babu, advocate for Flipkart, contended it only provides a platform for sellers and buyers, and was not liable for defective products.

Flipkart's services are similar to those offered by a shopping mall. In case a product is defective, the shop owner and seller are held liable and not the owner of the mall, he argued.

The consumer forum, however, ruled that the defective product was delivered by Flipkart, which had also given, by its own admission, a replacement guarantee.

"The act of Flipkart in selling the mobile handset without an IMEI number in the invoice… amounts to deficiency of service and unfair trade practice," the forum observed in its order.

Since Jain has already bought a new phone, the forum asked Flipkart to reimburse the price of the Lenovo phone with 6% interest since February 2016.

It will also have to pay Jain Rs 4,000 towards litigation costs.

Decision expected in next few days

The vice-chancellor search committee for the Bharathidasan University (BDU) has narrowed down on three candidates – P. Manishankar, Professor and Head, Department of Chemistry, Alagappa University; S. Ponnusamy, retired Professor of Mathematics, IIT Madras; and M. Thenmozhi, Professor of Management, IIT Madras – and submitted the list to the Governor and Chancellor, informed sources said.

The three candidates were among the 10 candidates interviewed by the three-member search committee chaired by retired IAS officer Shantha Sheela Nair last week.

The Governor, sources said, will make an announcement over the next few days after ascertaining whether the identified candidates fulfil all the norms.

‘Process unclear’

Incidentally, Prof. Manishankar had completed his doctorate under Prof. Sivasubramanian during the latter’s stint as a professor in the Department of Chemistry, Madurai Kamaraj University. Prof. Manishankar and nine other candidates were identified from among 40 of the 246 aspirants.

There is no clarity, however, on whether the search committee had narrowed down on the final three candidates strictly based on the marks, on the basis of the 14-point criteria, or had deemed it necessary to give representation to candidates from different streams.

Unlike Anna University, where the applicant has to necessarily belong to science or engineering backgrounds, in the case of BDU, anybody with a minimum qualification of Ph.D. and the requisite administrative exposure is eligible to apply.

Academics are learnt to have written to the Chancellor and the Governor to determine if the candidates deemed eligible by the BDU search committee had been rejected by the search committee for the Periyar University, Salem, or vice-versa.

The interview processes of the two universities differ from each other, according to aspirants. For instance, in the Periyar University’s case, the candidates had been informed that they would be asked to make a 10-minute oral presentation about their achievements and vision. However, irrespective of ranking, those considered most qualified among the aspirants for BDU vice-chancellorship did not get that opportunity.

Reinstatement of TNSTC staff set aside

The Madurai Bench of the Madras High Court on Tuesday set aside a single bench order for reinstatement of employees of Tamil Nadu State Transport Corporation (Kumbakonam), who were terminated from service for allegedly producing bogus certificates at the time of appointment.

Hearing a batch of appeals by the employees, a division bench of Justices M. Venugopal and R. Tharani, however, upheld the single bench order with regard to violation of principles of natural justice which resulted in termination and directed the employees to furnish their individual replies to the enquiry officer within two weeks. It asked the enquiry officer to examine the replies and pass appropriate orders within six weeks.

The single bench had earlier ordered the reinstatement of terminated employees as a stop gap arrangement and simultaneous enquiry proceedings.

The court observed that the employees should extend cooperation to the TNSTC enquiry and they should be allowed to raise factual and legal pleas before the enquiry officer.

Counsel for the employees argued that charge memos were issued to them after a lapse of time. The termination orders were issued after 10 years, by which time the services of drivers had been regularised. Their certificates were also verified.

Counsel for the TNSTC argued that at the time of enquiry the employees did not raise a plea for supply of documents relied on by the management. However, it was only after a second show cause notice was sent that they sought the copies. The employees were terminated from service in accordance with law and the direction to reinstate them as a stop gap arrangement ought not to have been passed, the counsel said.
