No, the SC verdict on Section 497 does not allow you to cheat on your partners

The Supreme Court has merely scrapped a British-era regressive law. It has not said that adultery is right, or legal.

Ever since the Supreme Court scrapped IPC Section 497, which made adultery a criminal offence, on September 27, some people are worried that this will give adulterers a free reign and ‘ruin the sanctity of marriage’. In fact, as the Sabarimala verdict allowing the entry of women of all ages into the temple followed shortly after, jokes such as how a man can now walk into the temple with his neighbour’s wife with no fear have been doing the rounds.

On Monday, a Chennai woman reportedly took her life because her husband, who was allegedly having an affair, told her that having an extramarital affair was no longer a crime. The deceased woman, Akila* had married Peter* in 2016. The police said that the couple has a child, and that Akila was undergoing treatment for tuberculosis.

While the news report about the husband's claim is an unverified one, it is a fact many people are wrong about one thing – while the Supreme Court has scrapped the British-era regressive law, it has not said that adultery is right, or legal. The judgment has only ensured that two consenting adults having sexual relations outside of marriage cannot be deemed criminal.

The law wouldn’t have helped the woman

Women would not have gained from the law even if it existed. The law could only be used by a man against another man who has sexual relations with his wife without his “consent or connivance”, lawyers point out.

“Section 497 did not have any remedy for the wife, and would not have punished the woman her husband was having an affair with either,” senior lawyer Sudha Ramalingam says.

She adds that this is not about the sanctity of marriage at all. The arbitrary law, as even the judgment pointed out, did not preserve the sanctity of marriage – for if a husband consented to his wife’s sexual relationship with another man, it would not be adultery. The judgment contended that it only preserved the ‘propriety rights’ of a man over the woman he was married to.

“The judgment did not extend rights to adulterers. It is just saying that it’s just not a criminal offence. The legislation was only holding men responsible. Its criminality was based on the view of women as property – if you (the man having an affair with someone’s wife) trespass my property (my wife), you can be held criminally liable,” explains Amba Salelkar, a lawyer.

What is considered immoral need not be criminal

Amba argues that what is moral and immoral is different from what is criminal. “There are moral issues around drinking alcohol. However, it is not criminal. The Supreme Court did not say that adultery is legitimate now; the judgment simply means that the state does not have a role in policing sexual relations between two consenting adults,” she says.

This is in line with the right to privacy judgment that came earlier last year from the Supreme Court, deeming it a fundamental right. “Striking down section 497 was then the next logical thing to do,” Amba notes.

Furthermore, Sudha says that extramarital relations are not a new phenomenon. “A woman like Akila is not a victim of the judgment, simply because she couldn’t have sought a remedy under section 497 anyway,” she says.

Further, adultery was a non-cognizable offence and had very few prosecutions in particular cases, Amba points out. “People didn’t even realise it was criminal. The judgment has not commented on the morality of it at all,” she says.

More support for women

While the Supreme Court judgment says that if adultery leads to a person’s suicide, the spouse can be booked for abetting suicide. However, Amba and Sudha say that abetment for suicide can be slapped if one of the partner’s acts are geared towards driving the other person to take their life.

In many cases, including perhaps this one, there are a host of issues already. “This was perhaps the tipping point,” Amba says.

Sudha adds that instead of focusing on the redundant argument that striking down section 497 has destroyed the sanctity of marriage, we should be asking questions about counselling and support services for women if they want to get out of abusive marriages.

Senior citizens list out demands at rally

Elderly men and women on Monday took out a rally here on the occasion of World Senior Citizens day, pressing a charter of demands including 50% fare concession in express trains and domestic air services without gender disparity.

Sub Judge V. Ramalingam, who is secretary of District Legal Services Authority, flagged off the rally.

The senior citizens made their way through the main thoroughfares from Aranmanai holding placards highlighting their demands.

S. Jesuraj, president, District Senior Citizens Federation, who led the rally, urged the railways to make available 50% concession in express trains to them. At present, women were given 50% concession and men 40%, he said.

He also urged the railways to allot 25% of the lower berths in each coach to senior citizens. Airline companies had announced 50% fare concession to women who had completed 63 years and men 65 years, but the concession had not materialised.

Further, the Centre should fix Rs. 6 lakh income tax ceiling for senior citizens and exempt pensioners (Centre and State governments) from the IT bracket. The State government should double the old age pension (OAP) from the present Rs. 1,000 and restore OAP to many deserving senior citizens from whom it had been taken away.

As announced in the AIADMK election manifesto, the government should provide free bus passes to senior citizens throughout the State. Despite repeated pleas, and repeated assurances by authorities, a geriatric ward for senior citizens remained a distant dream, he said.

Mr. Ramalingam said a counselling centre would be set up for senior citizens and he also promised to look into their other demands.

Federation secretary N. Ramakrishnan and treasurer P. Ravindran were present on the occasion.

Eight persons submitted petitions to SP seeking action

Petitions were submitted to the Superintendent of Police, Dindigul, against the manager of a nationalised bank here on Monday.

The complaint was that the manager, who was identified as Sorna Priya, was working in Allahabad Bank branch in RM Colony. According to the complainants, the manager’s modus operandi was whenever customers approached her seeking loans, she would direct them to furnish the documents they intended to give as collateral security. After some time, she would return the documents stating that the higher-ups had rejected the loan proposal.

The crime came to light when one of the customers, Chokkalingam, received a notice from the bank branch asking him to pay the EMI, which was overdue. The shocked customer approached the bank branch, where he found out that a loan was indeed sanctioned in his name.

Investigation revealed that like Mr. Chokkalingam many others had received such a demand notice directing them to pay the EMI without any delay.

The eight petitioners stated in their complaints submitted individually to the SP that the bank manager had taken close to Rs. 3.5 crore in their names. They maintained that they had never built a home as claimed by the bank nor had they taken other loans.

Based on the petitions, a police officer said inquiries with the bank suggested that it had transferred Sorna Priya a few months ago and posted a new officer in her place.

Further investigation is on. When The Hindu contacted the bank for its comments, the officials did not wish to speak saying that they were not authorised to share information with the media.

Nursing college alumni demand completion certificates

A few alumni of a private nursing college near Pollachi on Monday approached the district administration seeking help in getting their course completion certificates.

The alumni led by M. Sangeetha told the administration at the grievances redress meeting that 18 alumni, who had completed the course during 2013-16 and five more from their senior batch, were yet to get the registered nurses and registered midwives (RN, RM) certificates from their alma mater. The failure to get the certificates had prevented them from either pursuing higher studies or taking up jobs. Their pleas to the college administration had not yielded any result.

As they approached the Pollachi Sub Collector on August 28 and didn’t get any solution, they approached the district administration, the alumni said.

‘Withdraw move to

hike property tax’

Welfare Party of India cadre petitioned the district administration seeking withdrawal of the move by the Corporation to hike property tax by 50 % – 100%. In their petition, the cadre said the civic body was trying to overcome the financial stress it was reeling under by trying to hike property tax.

The cadre claimed that the move was illegal because the Corporation was taking the decision in the absence of an elected Council.

To condemn the move, they were presenting the petitions armed with begging bowls, the cadre said.

They urged the district administration to prevail upon the Corporation to give up the tax revision move.

Plea to stop illegal

All India Youth Federation has urged the district administration to stop the illegal sale of liquor and drugs.

In a petition, Federation’s district secretary V. Vasanthakumar alleged the sale of drugs was widely prevalent in schools, colleges and liquor sale was going on unchecked in roadside eateries.

This posed a serious threat to students’ future, the petition said and sought stringent action against those who indulged in the illegality.

‘Penal action should be taken against those responsible for losses’

The Madras High Court on Monday termed as a “national waste,” the Rs. 1,200 crore spent on construction of a new Secretariat complex in Chennai during the 2006-11 DMK regime, the additional funds spent by the AIADMK government to convert the complex into a hospital and another Rs. 4.5 crore sanctioned by it for a Commission of Inquiry constituted to probe into alleged irregularities in the construction.

Justice S.M. Subramaniam said: “Such a situation is not only painful but also a matter of national concern because tax payers’ money had been spent detrimental to the interest of the public at large. This court is of the considered opinion that once an elected government starts functioning, its policy decisions and expenditures must be beyond political ideologies. All expenditures must be only in accordance with the constitutional principles.”

He went on to elaborate that the Constitution expected the administrators to protect tax payers’ money and spend it judiciously only for people’s welfare. “The government should not only be responsible but also accountable. Any unlawful loss caused in respect of the tax payers’ money should not only be questioned by the appropriate authorities but also acted upon by prosecuting persons responsible for the loss under the penal laws,” the judge observed.

Files with DVAC

The observations were made while dismissing as withdrawn cases filed by DMK president M.K. Stalin and treasurer Duraimurugan in 2015 challenging the constitution of the commission headed by former High Court judge R. Regupathi. Mr. Justice Subramaniam had on August 3 directed the government to suspend the commission because it had not made any headway since 2011 despite more than Rs. 4.5 crore having been spent on its functioning.

Subsequently, Advocate General Vijay Narayan reported to the court that former judge Regupathi himself had demitted office on August 24 and the government had decided not to continue the commission by appointing any other retired judge. He also said that all files related to the alleged irregularities in the construction of the Secretariat complex had been forwarded to the Directorate of Vigilance and Anti-Corruption (DVAC) for necessary action.

After recording his submissions, the judge said: “Any further action must be taken without any undue delay on the part of the authorities concerned... In one way or the other, the issues are prolonged and protracted against the common interest.”

 |அக்டோபர் 2, 1947. அன்றுதான் அண்ணல் காந்தி, தனது 78 வயதை நிறைவு செய்து, 79-ஆவது வயதில் அடி எடுத்து வைக்கிறார். தனது பிறந்த நாள் ஆரவாரமின்றிக் கொண்டாடப்பட வேண்டும் என்று ஏற்கெனவே அறிவித்திருந்தார். ஆனாலும் அண்மையில் விடுதலை பெற்ற இந்திய மக்களும், வெளிநாட்டின் பல அமைப்புகளும், அந்நாளை விமரிசையாக கொண்டாட விரிவான ஏற்பாடுகள் செய்திருந்தார்கள்.

அதற்கு முந்தைய நாளான அக்டோபர் 1 அன்றே பலரும் ஆசி வேண்டி அண்ணலைச் சந்தித்தனர். அவர் அனைவரையும் சந்தித்தார். ஆனால், தனக்கு சிகிச்சை அளிக்க முன்வந்த மருத்துவர்களை திருப்பி அனுப்பி விட்டார். பென்சிலின் மருந்து செலுத்தினால் காய்ச்சல் விரைவில் குணமாகும் என்று மருத்துவர்கள் கூற, ராம நாமத்தை ஜெபிப்பதுதான் எனது பென்சிலின், பிரார்த்தனையால் சாதிக்க முடியாததை பென்சிலின் மருந்து சாதிக்கும் என்று என்னால் ஏற்க முடியவில்லை எனப் பதில் உரைத்தார்.
அன்று மாலை நடந்த பிரார்த்தனைக் கூட்டத்தில் பேசும்போது, வகுப்புவாத வன்முறையால் நம்மை நாமே அழித்துக் கொள்ளுகிறோம். இந்தப் பைத்தியக்காரத்தனத்திலிருந்து நாம் விழித்தெழ வேண்டும். மிகுந்த வருத்தத்தைத் தருகிற இத்தகைய நிகழ்வுகளைக் காணும் ஒரு பார்வையாளனாக நான் இவ்வுலகில் இருக்க விரும்பவில்லை என்று கூறினார்.

மக்கள் வன்முறையைக் கைவிடுவதற்கும் நீண்ட உண்ணா நோன்பு மேற்கொள்ளலாமா என எண்ணினார். அதற்கு அது ஏற்ற தருணம் அல்ல என்பதால் 24 மணி நேர உண்ணா நோன்பை, 1-ஆம் தேதி மாலையிலிருந்து தொடங்கினார்.

மறுநாள், அதாவது அவரது பிறந்த நாளான அக்டோபர் 2-ஆம் தேதியன்று வழக்கம் போல அதிகாலையில் துயிலெழுந்தார். காலைக் கடன்களை முடித்தார். கைராட்டையில் நூல் நூற்றார். கீதை சுலோகங்களைக் கேட்டார். பிரார்த்தனையில் ஈடுபட்டார்.

இறைவா! இதனைக் காண்பதற்கா என்னை இன்னும் விட்டு வைத்திருக்கிறாய்? ஆனாலும் நான் கலங்கவில்லை. நம்பிக்கையைக் கைவிடவில்லை. உன் கருணை இருக்கும் வரை நான் போராடுவேன். என் மக்களின் மனதை மாற்றுவேன். என் முயற்சியில் வெற்றி பெறுவேன், அல்லது மரணத்தைத் தழுவி உன் காலடியில் சரணடைவேன் இதுவே என் சபதம் என அண்ணல் உறுதி ஏற்றார்.




காலை மலர்ந்தது. பார்வையாளர்களைச் சந்திக்க பாபுஜி தன் இருக்கையில் அமர்ந்தார். இருமல் விடாது தொடர்ந்தது. அவரது உடலும் அதிர்ந்தது. அதனால் அவர் சிரமப்பட்டார். அருகிலிருந்த தேவதாஸ் காந்தி சிரமப்படாதீர்கள்... சிரமப்படாதீர்கள் என்றார். ஆனால், அண்ணலோ எதுவும் பதில் பேசவில்லை.

வந்தவர்கள் அனைவரும் சுதந்திர இந்தியாவின் தந்தை எனப் புகழ்ந்துரைத்தனர். கவர்னர் ஜெனரல் மவுன்ட் பேட்டன் தனது மனைவி எட்வினா மவுன்ட் பேட்டனோடு வந்து காந்திஜிக்கு பிறந்த நாள் வாழ்த்து கூறினார். அன்று காலையிலேயே மகாத்மாவை தரிசித்தவர்களில் முக்கியமானவர் அன்றைய துணைப்பிரதமர் சர்தார் வல்லபபாய் படேல். பிரதமர் பண்டித ஜவாஹர்லால் நேரு, ஜி.டி.பிர்லா இருவரும் அண்ணலைச் சந்தித்து ஆசி பெற்றனர். ராஜகுமாரி அமிர்த கவுர், அமைச்சர்கள், சீக்கிய மற்றும் முஸ்லிம் சமுதாயத்தின் முக்கிய பிரதிநிதிகள், அரசு அதிகாரிகள், பொது மக்கள் என அனைத்துப் பிரிவினரும் சந்தித்தனர்.

அங்கு குழுமியிருந்தோர் காந்திஜிக்கு நீண்ட ஆயுளை அருளுமாறு பிரார்த்தனை செய்தனர். அதனைக் கண்ணுற்ற காந்திஜி பலவீனமான முறையில் புன்னகை செய்து, தலையை ஆட்டினார். அவர்களுடைய வாழ்த்துகளை முழுமனதின்றி ஏற்றுக் கொண்டார்.
அன்று காலையில், அண்ணல் விரும்பியபடி, ஒரு சிறப்பு பிரார்த்தனைக் கூட்டம் நடத்தப்பட்டது. அதில் பண்டித நேரு, கே.எம்.முன்ஷி மற்றும் பலர் கலந்து கொண்டார்கள். பல மதங்களின் புனித நூல்களிலிருந்து தேர்ந்தெடுக்கப்பட்ட வாசகங்கள் அங்கே படிக்கப்பட்டன.
சுதந்திர நாடான இந்தியா, அதன் சகோதர நாடான பாகிஸ்தான் மற்றும் உலக நாடுகளின் அனைத்து மக்களுக்கும் நிறைந்த அமைதியையும் நீண்ட வாழ்வையும் இறைவன் அருள வேண்டும் என்பதே அண்ணலின் பிறந்தநாள் பிரார்த்தனை என்று அப்போது அறிவிக்கப்பட்டது.

அன்று பேசிய பிரதமர் நேரு, வல்லமை மிகுந்த பிரிட்டிஷாரிடமிருந்து அஹிம்சை வழியில் நமக்கு விடுதலை பெற வழிகாட்டியவர் அண்ணல் காந்தி. ஆனால் இன்று மக்கள் அராஜக வழியில் அடியெடுத்து வைக்கின்றனர். இத்தகைய செயல் தேசத்துக்கும் தேசப் பிதாவுக்கும் செய்யும் துரோகம் என முழங்கினார். சர்தார் படேல், காந்திஜியின் விருப்பத்திற்கு ஏற்ப நாம் நடக்கவில்லையென்றால் காந்திஜியின் பிறந்த நாளைக் கொண்டாடுவதில் பொருளே இல்லை. கடந்த சில நாட்களின் நிகழ்வுகள் நமது நாட்டின் கௌரவத்தின் மீது விழுந்த பலத்த அடி ஆகும். தாக்குதலுக்கு பதில் தாக்குதல் என்ற மடத்தனத்தை மகாத்மா என்றும் ஏற்கமாட்டார் என்றார்.
மூதறிஞர் ராஜாஜி, பயங்கரமான வீழ்ச்சி ஏற்பட்டுள்ள இந்நாட்களில் ஒளிவீசும் ஒரே விளக்காக காந்திஜி திகழ்கிறார். இந்தியாவின் அமைதியைச் சுமந்து நிற்கும் ஒரு தூணைப் போல அவர் விளங்குகிறார் எனப் புகழ்ந்தார்.
காந்திஜியின் ஆக்கபூர்வமான திட்டங்களை நிறைவேற்றுவதன் மூலம்தான் பொருளாதார விடுதலையைக் கொண்டுவர முடியும். அதுதான் கஷ்டப்பட்டு பெற்ற விடுதலையை பாதுகாக்கும் என்றார் சென்னை பொதுக்கூட்டத்தில் அன்று பேசிய காமராஜர்.

ஒரு எளிய மனிதன், மெலிந்த தேகமுடைய மனிதன், இந்த பூமியில் சொத்து எதுவுமில்லாத மனிதன், எந்த பதவியையும் வகிக்காத மனிதன், சாதுவாக துறவியாக வாழும் ஒரு மனிதன் சாம்ராஜ்யங்களைத் தோற்கடிக்கிறான். மனித மனங்களில் வாழ்கிறான். கடவுளைப் போல் அவர்கள் மீது ஆதிக்கம் செலுத்துகிறான். இத்தகைய மாமனிதருக்கு, எனது தலைவருக்கு, எனது நண்பருக்கு, எனது தந்தைக்கு, மகாத்மாவுக்கு என் வணக்கங்களை செலுத்துகிறேன் என்று புகழ்ந்தார் கவிக்குயில் சரோஜினி நாயுடு.
தத்துவ ஞானி டாக்டர் ராதாகிருஷ்ணன், சாமானியர்களான ஆண்களையும், பெண்களையும் அவர் அணி திரட்டினார். அசுர பலம் கொண்ட பிரிட்டிஷ் ஆட்சிக்கு எதிராக ஆயுதம் ஏந்தாப் புரட்சிக்கு தலைமை தாங்கினார். அவர் விரும்பிய விடுதலை வந்தது. விரும்பாத பிரிவினையும் வந்தது. வேண்டாத வெறுப்பும், பகைமையும் பரவியது. சகோதரர்கள் விரோதிகளாக மாறுகிறார்கள். விளைவு?அராஜகம், உயிரிழப்பு, அழிவு! இதுவே அண்ணலின் நெஞ்சத்தை வருத்துகிறது. இந்துக்களும், முஸ்லிம்களும் அமைதியாக வாழ அவர் முயற்சிக்கிறார். அதில் நிச்சயம் வெற்றி பெறுவார். அவர் என்றும் தோற்றதில்லை. தோல்வி வருமென்றால் அதனைக் காண அவர் இருக்கமாட்டார் என்று உணர்ச்சிகரமாகப் பேசினார்.

பிரெஞ்சு தேசத்து தத்துவ ஞானி ரோமன் ரோலந்து, காந்திஜியின் வாழ்வு அனைவருக்கும் அபயமளிக்கும் மாளிகை. வருந்துவோருக்கெல்லாம் வழிகாட்டி வரமளிக்கும் ஒரு கிறித்துவக் கோயில் எனப் போற்றிப் புகழ்ந்தார்.
இத்துணை வாழ்த்துச் செய்திகளும் அண்ணலின் நெஞ்சத்தில் ஒட்டவே இல்லை என்பதே உண்மை.

ஆனால் அவருக்கு மகிழ்ச்சியையும், ஆறுதலையும் தரும் செய்தி ஒன்று அப்போது வந்தது. அது, அக்டோபர் 2-ஆம் தேதி முதல் மதராஸ் மாகாணத்தில் முழுமையான மதுவிலக்கு அமலுக்கு வரும் என்ற அறிவிப்பு.
அதனைக் கேட்டவுடன், மதுபானம் மூலம் கிடைக்கும் வரி மட்டமான வரி. அது மனிதன் தன் ஒழுக்கக்கேடான செயலுக்கு செலுத்தும் வரி. மதுவிலக்கால் வருவாய் இழப்பு ஏற்படும் என்பது ஓர் பொய்த்தோற்றம். மதுவிலக்கால், குடிப்பவனை மீட்டெடுக்கிறோம். குடிப்பதை நிறுத்துகிறோம். அதன்பின் அவன் உழைக்கிறான், அதிக வருவாய் ஈட்டுகிறான், வரியும் செலுத்துகிறான். அதன் மூலம் அரசு வருவாய் உயருமல்லவா? மதராஸ் மாகாணம் தேசத்துக்கு வழிகாட்டுகிறது. மதராஸ் மாகாண அரசுக்கும் மக்களுக்கும் என் வாழ்த்துகள் என்று கூறினார்.

அண்ணல் தனது உறுதியை புதுப்பித்துக் கொண்டார். எழுந்து நின்றார். கையில் தடியை ஏந்தினார். கடிகாரத்தை தன் இடுப்பில் தொங்கவிட்டார். தனது லட்சியம் மட்டுமே தேசப்பிதாவின் கண்ணுக்குத் தெரிந்தது. அசைக்கமுடியாத உறுதியோடும், இறை நம்பிக்கையோடும் மீண்டும் தன் பயணத்தைத் தொடர்ந்தார்.

அதுவே சுதந்திர இந்தியாவில் காந்திஜி கொண்டாடிய முதல் பிறந்த நாள். துரதிருஷ்டவசமாக அதுவே அண்ணல் கொண்டாடிய கடைசி பிறந்தநாளாகவும் அமைந்து விட்டது!

இன்று மகாத்மா காந்தியின் 150-ஆவது பிறந்தநாள்.
