HC raps Vijayakanth for wasting its time with frivolous pleas

Chennai: Censuring DMDK founder Vijayakanth for wasting the court’s time by filing unnecessary appeals seven years ago, the Madras high court dismissed as withdrawn one such appeal moved by him challenging refusal to quash criminal defamation complaints made by AIADMK government in 2011.

“Filing of such petitions and appeals unnecessarily consumes the time of the court and care should be taken in the preparation, drafting and presentation of such petitions and should not be brought forth unless there is any constitutional question, keeping in view of the nature of allegations that have been made. We hope and trust that such care shall be taken in future,” the first bench of Chief Justice A P Sahi and Justice Subramonium Prasad said on Monday.

The bench also informed the counsel for Vijayakanth that they are refraining from imposing cost as he had volunteered to withdraw the appeal. The criminal defamations were filed by the then AIADMK government led by former chief minister J Jayalalithaa against Vijayakanth when he was the opposition leader of the Tamil Nadu state assembly.

Vijayakanth moved the high court in 2012 seeking to quash all such proceedings pending before the subordinate court. However, the same was dismissed by a single judge in the admission stage itself. Aggrieved, the petitioner moved the present appeal. In his affidavit, Vijayakanth submitted that his plea challenging the validity of Sections 500 and 501 (criminal defamation) was pending before a constitutional bench of the Supreme Court.

Pallavaram municipality dumps waste in lake chosen for biomining

CHENNAI: What happens when a civic body is unable to dump garbage at a designated spot? It empties trucks in a legacy dump yard created on a large water body.

This is the state of affairs in Pallavaram. Garbage collected from houses in Pallavaram municipality is being sent to a dump yard south of the Pallavaram Periya Eri (lake).

David Manohar, a social activist and local resident, took photographs of vehicles ferrying garbage and emptying it in the dump yard. “This has been happening for the past few days. Garbage collection from houses has also become erratic,” he said.

The legacy waste in this dump yard is supposed to be biomined to help restore the water body. (See graphic)

Sources in the municipality said problems began after National Green Tribunal (NGT) pulled up Tambaram and Pallavaram municipalities for dumping waste in the Vengadamangalam yard located on the Vandalur-Kelambakkam Road.

In 2015, it was decided that waste from these two civic bodies would be sent to the waste-to-energy plant in Vengadamangalam. The waste collected from houses would be taken to a transfer station, where it would be compressed and then sent to the Vengadamangalam yard. However, the state government found several lapses in the working of the private contractor and work stopped.

Also, reports by the Tamil Nadu Pollution Control Board showed that frequent fires broke out in the yard leading to pollution over which nearby residents protested.

Advocates appearing for the municipalities before NGT said that there would be no fresh dumping of garbage from September 2019 in Vengadamangalam. But then where was this garbage going? Residents of Pallavaram found this answer — into the lake.

An official from Pallavaram municipality told TOI they were in talks to transfer the garbage to Perungudi dump yard which is under the control of Greater Chennai Corporation.

S Narasimhan, a resident and former councillor of Pallavaram municipality, said there was major mismanagement at the Vengadamangalam yard as well as in the biomining project in Pallavaram.

“A work order was given a year ago, but there appears to be no change in the size of the garbage mounds. Frequent fires cause pollution while the water in the lake, used by local residents, is polluted,” Narasimhan said. “How can the government itself contribute to polluting a water body,” Narasimhan asked.

Manohar has documented how raw sewage is being pumped out from a collection well into a channel connecting Pallavaram lake and Kilkattalai lake. Sewage is being let out

into the Periya Eri through an inlet channel.

Despite repeated calls, the Pallavaram municipality commissioner could not be reached for comments.

Parking at Chennai Central railway station may get costlier

CHENNAI: Car and bike parking rates at Dr MGR Central (Chennai Central) railway station may be increased, sources in Southern Railway told TOI.

Railway officials initiated a discussion in this regard after Chennai Metro Rail Limited opened its parking facility at the station recently. CMRL charges Rs 10/hour for bikes and Rs 25/hour for four-wheelers, at least twice what Southern Railway charges for parking at the station. The normal car parking rate at Central is Rs 25 for the first two hours, Rs 35 for the next two and Rs 70 for the subsequent two. Bike parking charges are Rs 5 for the first four hours and Rs 10 for up to eight hours.

A slot at the premium car park facility available opposite the Moore Market Complex (MMC) suburban station costs Rs 50 per hour.

Senior officials in Chennai division took up the issue of increasing the rate after CMRL opened its facility last week. One of the proposals is to increase rates for those who park vehicles for a long time, say a week or more. However, nothing has been finalised, sources said.

Chennai divisional railway manager P Mahesh did not respond to a call seeking clarification.

Meanwhile, opinions are divided over the issue. Some officials feel that CMRL offers a covered parking space which would keep bikes and cars safe during rain or during summer.

The parking spots also have proper pavements.

Compared to this, the railway parking lot for bikes and cars is either open or covered with a flimsy tin roof. The security at these lots is also suspect while the lanes inside are not paved. “Those who can afford to pay a higher fee will surely prefer the metro parking,” said a senior official. This will eat into the railway’s revenue, the official said.

Nirbhaya Case : SC Dismisses Plea Of Juvenility Raised By Death Row Convict Pawan Gupta

The Supreme Court on Monday rejected the plea of juvenility raised by Pawan Kumar Gupta, one of the four death row convicts in the 2012 Delhi gangrape-murder case.

A bench comprising Justices R Banumathi, Ashok Bushan and AS Bopanna held that the same claim was earlier rejected by the Court after due consideration.

The bench held that Delhi High Court had rightly rejected the plea.

Advocate A P Singh, lawyer of Pawan Gupta, claimed that his school records show that he was a juvenile at the time of the crime. He argued that the school leaving certificate showed his date of birth as October 8, 1996.

He was held to be a major by an order of Magistrate passed in 2013. The death row convict now stated that the order was passed without hearing him. He alleged that the police had not produced the school records in the case. No opportunity was given to his counsel to examine the papers submitted by police on the plea of juvenility, Pawan states in the application.

He submitted that the school certificate came to light only after 2017, when his lawyers were collecting materials for preparing an affidavit detailing his mitigating circumstances, following the directions of the Supreme Court on February 3, 2017.

Referring to proviso Section 9(2) of the JJ Act and the SC decision in Upendra Pradhan v State of Orissa (2015), he stated that the claim of juvenility can be raised at any stage, even after the final disposal of the proceedings.

Opposing the plea, Solicitor General Tushar Mehta submitted that these contentions were earlier raised and rejected by the Court. In 2018, the SC had specifically adverted to his claim based on school certificate and rejected the claim.

"It will be a travesty of justice if this ground at this stage is raised again, after all forums have rejected it", SG said.

On December 19, the Delhi HC had dismissed the plea.

Justice Suresh Kumar Kait also imposed cost of Rs 25000 on the convict's advocate A P Singh, who did not appear in the court despite several communications sent to him on behalf of the court, for playing "hide and seek".

The execution of four convicts is scheduled on February 1.

இது போன்ற அப்பாவி மனிதன் கதாபாத்திரங்களை நடிகர் திலகம் ஏற்பது ஒன்றும் புதிதல்ல. ‘படிக்காத மேதை’, ‘பழநி’, ‘காளிதாஸ்’, ‘ராமன் எத்தனை ராமனடி’ என்று நீளும் அந்தப் பட்டியலில் பழநி கிராமிய வாழ்வியலின் அழகுடன் வியர்வையின் வாசனையும் வீசச் செய்த உழவுத் தொழிலாளியின் உன்னதம் பேசியது. பழநி அப்பாவி, மனம் முழுவதும் நன்மை நிறைந்த மனிதன். தனக்கு இழைக்கப்பட்ட தீங்குகளைக்கூடப் பெரிதுபடுத்தாதவன். பழநிக்கு விவசாயம் ஒரு கண், தன் தம்பிமார்கள் மற்றொரு கண்.




அள்ளி முடிந்த தலைமுடி, கசங்கிய வேட்டி, சட்டை என்ற ஒரே உடையில் படம் முழுக்க வரும் சிவாஜி, பண்ணையார் மீது கண்மூடித்தனமான நம்பிக்கையை வைத்திருப்பார். அதைப் பார்வையாளர்கள் எந்தக் கேள்வியுமின்றி ஏற்றுக்கொள்ள வைத்திருப்பதில்தான் அவர் திறமை அடங்கியிருக்கிறது. நிலத்தை உழும்போது கிடைத்த புதையலை ‘அது உங்க நிலம் எனவே அது உங்களுக்குத்தான் சொந்தம்’ என்று கொண்டுபோய்க் கொடுப்பார். தானமாகத் தருகிறேன் என்று சொல்லி, பாறை நிலத்தைப் பண்ணையார் தரும்போது கோபப்படும் தம்பிகளை அடக்கி, ‘இந்த நிலத்தையும் நம்மால் விளை நிலமாக மாற்ற முடியும் என்றுதான் பண்ணையார் இதைக் கொடுத்திருக்கிறார்’என்று கூறும்போது ‘அட அப்பாவியே!’ என்று பார்வையாளர்களை பரிதாபப்பட வைத்திருப்பார்.

நிலவுடமைச் சமூகத்தின் கண்ணாடி

வெற்றுக் காகிதத்தில் கைநாட்டு வாங்கிக்கொண்டு, வெறும் இரண்டாயிரம் ரூபாயை மட்டும் கொடுத்துவிட்டு அறுவடை நேரத்தில் அதைப் பன்னிரண்டாயிரமாக மாற்றி எழுதி நிலத்தை ஜப்தி செய்யும் பண்ணையாரிடம் ‘நான் பன்னிரண்டாயிரமா வாங்கினேன்?’ என்று கேட்டுக் கதறி அழும்போது அந்த அப்பாவிக்காக நாமும் கண் கலங்குவோம். அந்தக் காட்சி அன்றைய நிலவுடமைச் சமூகத்தின் கண்ணாடியாக இன்றைய தலைமுறைக்கு கிடைக்கும் ஆவணம்.

பக்கத்துக் குடிசையில் வசிக்கும் தம்பிக்கும் அவன் மனைவிக்கும் பொங்கலுக்குத் துணி வாங்கிக் கொடுத்துவிட்டு, அங்கே இலைக்கு முன் சாப்பிடாமல் உட்கார்ந்திருக்கும் தம்பிக்கு கேட்கும்படியாக, ‘நல்ல நாளன்னிக்கு அழக் கூடாது சாப்பிடு’ என்று சத்தமாகச் சொல்லும்போது, சிவாஜியின் முகம் காட்டும் உணர்வுகள், பாசாங்கில்லாத அண்ணன் தம்பி பாசத்தை உணர்த்தும்.

தன் அக்காள் மகளை, தம்பி மனைவியே தவறாகப் பேசுவதைக் கேட்டுவிட்டு கோவத்தில் கண் துடிக்க ‘காவேரி..’ என்று அழைத்துக் கொண்டே வீட்டுக்குள் வருவார் சிவாஜி. கள்ளங்கபடமில்லாத வெள்ளைச் சிரிப்புடன் ‘என்ன மாமா?’ என்று கேட்டபடியே வரும் அக்காளின் மகளைப் பார்த்தவுடன் கண்ணீர் கட்டி நிற்கும் பார்வையுடன் ‘ஒண்ணுமில்லமா..’ என்று முகமசைப்பாரே! அந்த உயர்ந்த நடிப்பாற்றல் சிவாஜிக்கு மட்டுமே சாத்தியம்.



உயிர்ப்புமிக்க காவியம்

தம்பிகள் பட்டணத்தில் மோசம் போய்விட்டார்கள் என்றவுடன் மனம் உடைந்து, ‘மனித ஜாதியில் துயரம் யாவுமே மனதினால் வந்த நோயடா’ என்றும், ‘பதைக்கும் நெஞ்சினை அணைக்கும் யாவரும் அண்ணன் தம்பிகள்தானடா’ என்ற கவியரசரின் காவிய வரிகளுக்கு சிவாஜி வாயசைப்பால் உயிரூட்டும்போதும் இன்றும் அவை உண்மை என்பதாகவே ரசிகர்கள் உணர்வார்கள்.

விவசாயத்தை நேசிக்கும் எந்த விவசாயியும் அதை விட்டு விட்டு செல்ல மாட்டான் என்பதை, ‘நம்முடைய உணவு தானியம் பட்டணம் போகலாமே தவிர நாம போகக் கூடாது’ என்ற ஒரு வரி வசனத்தில் உணர்த்திவிடுவார். சிவாஜி படத்தின் முகமும் தலையும் என்றால், எஸ்.எஸ்.ஆர், முத்துராமன், பாலையா, நாகேஷ், எம்.ஆர்.ராதா, தேவிகா, புஷ்பலதா ராம், சிவகாமி எனப் பெரும் நட்சத்திரப் பட்டாளத்தின் கச்சிதமான பங்களிப்பு படத்துக்கு முதுகெலும்பு.

முதல் காட்சியில் ‘ஆறோடும் மண்ணில் எங்கும் நீரோடும்’ என்ற அற்புதமான பாடலில் தொடங்கி இறுதிக் காட்சி வரை ஒரு இடத்தில்கூட சிவாஜி கணேசன் எனத் தெரியாமல் மதுரை மாவட்டம் புளியரை கிராமத்துக் குடியானவன் பழநி மட்டுமே கண்ணுக்குத் தெரியும் அற்புதம்தான், படம் வெளியான இந்த 55-ம் உழவர் திருநாளிலும் ‘பழநி’ திரைப்படத்தை உயிர்ப்போடு வைத்திருக்கிறது.

அப்போது, பல்வேறு உடல்நலக் குறைபாடுகளால் பாதிக்கப்பட்டோம். ரசாயன உரங்கள் மூலம் உற்பத்தியாகும் உணவுப் பொருட்களை சாப்பிடுவதே இதற்கு காரணம் என்பதை உணர்ந்தோம். ஆகவே, நாங்கள் இயற்கை விவசாயத்தில் ஈடுபட்டு, இயற்கையோடு இணைந்து வாழ முடிவு செய்தோம். அதன்படி, மாதம் ஒன்றரை லட்சம் ரூபாய் ஊதியம் பெற்றுவந்த என் கணவரும், மாதம் ஒரு லட்சம் ரூபாய் ஊதியம் ஈட்டிவந்த நானும் எங்கள் பணிகளை உதறிவிட்டு, கடந்த 5 ஆண்டுகளாக இயற்கை விவசாயத்தில் ஈடுபட்டு வருகிறோம்.
