The Delhi high court has held that an RTI applicant seeking information should disclose his/her interest in it to prevent a “roving and fishing enquiry”.

Justice Pratibha M Singh, in a recent order, upheld the order of the Central Information Commission to deny material sought by an applicant under the Right to Information Act about appointments to a particular position at President’s Estate in Rashtrapati Bhavan.

“This court is of the opinion that whenever information is sought under the RTI Act, disclosure of an interest in the information sought would be necessary to establish the bonafides of the applicant. Non-disclosure of the same could result in injustice to several other affected persons whose information is sought,” the court noted, while also slapping a cost of ₹25,000 on the applicant, Har Kishan. In his plea, Har Kishan had sought information that included, among others, the complete residential address and father’s name of all selected candidates who had been appointed to the post of multitasking staff, alleging irregularities.

‘Petitioner didn’t disclose his kin had sought job’

Later a probe was carried out that showed 10 candidates obtained jobs on the basis of fake certificates, and their appointments were terminated, but President’s Estate refused to furnish the details sought in the RTI.

During the hearing of Har Kishan’s appeal against the CIC order, the HC found that his daughter had also applied for appointment, which he didn’t mention. He also hid the fact that he had himself worked at President’s Estate on an ad-hoc basis.

“The seeking of the above information, especially after the petitioner’s daughter did not obtain employment, clearly points to some ulterior motives,” the court observed.

It pointed out that even otherwise “the information sought in respect of the names of the fathers and residential addresses of the candidates is completely invasive”.

சென்னையில் கல்லூரிப் பேராசிரியராகப் பணிபுரிகிறார் ஜே.டி. (விஜய்). மாணவர்கள் மத்தியில் அவருக்கு ஏகப்பட்ட மாஸ். ஆனால், பேராசிரியர்கள், முதல்வர் உள்ளிட்ட கல்லூரி நிர்வாகத் தரப்பில் நல்ல இமேஜ் இல்லை. இச்சூழலில் மாணவர் தேர்தலை நடத்த வேண்டாம் என்று கல்லூரி நிர்வாகம் முடிவெடுக்கிறது. தேர்தல் வேண்டும் என்று விஜய் சொல்கிறார். தேர்தலை நடத்தும் பொறுப்பு அவரிடம் ஒப்படைக்கப்படுகிறது. அதில் அசம்பாவிதம் நடந்தால் பணியிலிருந்து விலக வேண்டும் என்ற நிபந்தனையும் விதிக்கப்படுகிறது. துரதிர்ஷடவசமாக தேர்தல் முடிந்த பிறகு கலவரம் வெடிக்கிறது. இதனால் விஜய் அதே பணியில் தொடர்வதை நிர்வாகம் விரும்பவில்லை.

3 மாதம் பிரேக் எடுத்துக்கொள்ள வேண்டிய சூழல் நேரிடுகிறது. நாகர்கோவிலில் உள்ள அரசினர் கூர்நோக்கு இல்லத்தில் அடைக்கப்பட்ட சிறுவர்களை நல்வழித்தப்படுத்தும் ஆசிரியராகச் செல்கிறார். 90 நாட்கள் கழித்து மீண்டும் கல்லூரிக்கே செல்ல நினைக்கிறார். ஆனால், அங்கு நடக்கும் வித்தியாசமான செயல்கள், விபரீதங்கள், ஆபத்தை அறிந்து அதிர்ச்சி அடைகிறார். அவர் குற்ற உணர்ச்சி அடையும் அளவுக்கு அசம்பாவிதங்கள் நடக்கின்றன. பிரச்சினையின் ஆணிவேரைக் கண்டறிய முயல்கிறார்.

உண்மையில் அரசினர் கூர்நோக்கு இல்லத்தில் நடப்பது என்ன, அது யார் கட்டுப்பாட்டில் இருக்கிறது, அதற்கான பின்புலம் என்ன, விஜய்யால் பிரச்சினைகளைத் தீர்க்க முடிந்ததா போன்ற கேள்விகளுக்குப் பதில் சொல்கிறது திரைக்கதை.

ஒரே படத்தில் ஓஹோ என்று பெயர் எடுத்தவர் லோகேஷ் கனகராஜ். 'மாநகரம்' படத்தின் மூலம் நம்பிக்கையூட்டும் நல்வரவானவர், 'கைதி' மூலம் கச்சிதமான கமர்ஷியல் படத்தைக் கொடுத்தவர் இந்த முறை திசை மாறிய திரைக்கதையால் திணறி இருக்கிறார். விஜய் படமாகவும் இல்லாமல், லோகேஷ் கனகராஜ் படமாகவும் இல்லாமல் இரண்டும் கலந்த கலவையாகவே இருக்கிறது. ஆங்காங்கே விஜய்க்குரிய காட்சிகளும், சில இடங்களில் லோகேஷின் டைரக்டர் டச் மட்டும் தெரிகின்றன.

தமிழ் சினிமா ஏகப்பட்ட வாத்தியார்களைப் பார்த்திருக்கிறது. அந்தப் பட்டியலில் ஸ்லிம்மாக, கெத்தாக, தத்துவம் பாடி, அறிவுரை கூறி, அழுது, ஆர்ப்பாட்டம் செய்யாமல் அரவணைக்கும் ஆசானாக விஜய் இணைந்துள்ளார். வழக்கமான பில்டப் காட்சிகள், பன்ச் வசனங்கள் விஜய்க்கு இல்லாதது ஆறுதல். அதே சமயத்தில் விஜய்யின் எனர்ஜி லெவலும், எமோஷனல் லெவலும் அதிகம் உள்ளன. எல்லாக் காட்சிகளையும் ஆக்கிரமிக்கும் நாயக பிம்பத்தையும் நிறையவே இறக்கி வைத்திருக்கிறார். தான் இருக்கும் காட்சிகளில் சிறுவர்கள் ஸ்கோர் செய்ய இடம் கொடுத்திருக்கும் அந்த தாராளம் பாராட்டுக்குரியது. தொடர்ந்து பின்பற்ற வேண்டியதும் கூட. தன் பெர்சனல் பிரச்சினைகள் என்று ஒவ்வொரு கதையாய் அளந்து விடுவதும் ரசிக்க வைக்கிறது.

ஆனால், விஜய் கதாபாத்திரப் படைப்பில் விட்ட குறை, தொட்ட குறை படம் முழுக்கத் தொடர்கிறது. அவரது கேரக்டர் ஸ்கெட்ச் முழுமையடையவில்லை. மாஸ்டர் என்று பெருமைப்படும் அளவுக்கு, அவர் புத்திசாலி என்பதை மருந்துக்கும் பயன்படுத்தவில்லை. அது பெருங்குறை.

நல்லவன், கெட்டவன் லாஜிக்கைத் தாண்டிப் பார்த்தால் விஜய் சேதுபதியை எதிர் நாயகன் என்றுதான் சொல்ல வேண்டும். பெரும்பாலான கமர்ஷியல் படங்களில் மாஸ் நடிகரின் படத்தில் வில்லனுக்கான கதாபாத்திரம் சிறப்பாக எழுதப்படுவதில்லை. அப்படி எழுதப்பட்டால் அந்தக் கதாபாத்திரத்தில் நடிப்பவர்களின் தேர்வு சரியாக அமையாது. லோகேஷ் கனகராஜ் அந்த விதத்தில் எந்தக் குறையும் வைக்கவில்லை. விஜய் சேதுபதியின் பாத்திரத்தை மிகக் கச்சிதமாகக் கையாண்டுள்ளார்.

விஜய் சேதுபதியும் அதன் நுட்பம் உணர்ந்து, நோக்கம் அறிந்து மிகச் சிறப்பான திரையைத் தன்வசப்படுத்துகிறார். படத்தின் பல இடங்களில் விஜய் சேதுபதியின் எதிர் நாயகத் தன்மை சிந்தாமல் சிதறாமல் எடுபடுகிறது. அவர் மட்டும் இன்னும் கொஞ்சம் மாடுலேஷன் மாற்றி நடிப்பில் மெனக்கிடல் செய்திருக்கலாம். இனியும் இதே பாணியைத் தொடர்ந்தால் ஒரே மாதிரியான நடிப்புக்குள் சிக்கிக் கொள்வார்.

கமர்ஷியல் படத்தில் நாயகிக்குக் கிடைக்கும் சிற்சில காட்சிகளே மாளவிகா மோகனனுக்கும் கிடைத்துள்ளன. அதிலும் கதைக்குத் தேவைப்படவில்லை என்று சொல்லிவிடக்கூடாது என்பதையே மனதில் வைத்து நாயகன் சாகசம் புரியும் சண்டைக்காட்சிகளினூடே ஹோட்டல், டாஸ்மாக், மெடிக்கல் ஷாப் என்று இஷ்டத்துக்கும் கூடவே இழுத்து வைத்திருக்கிறார்கள். அதற்கான ஒரு காரணத்தையும் சொல்லி வைத்திருக்கிறார்கள். அதை மட்டும் ஏற்றுக்கொள்ள முடிகிறது. மாளவிகா தன் பங்கைக் குறையில்லாமல் நிறைவேற்றியுள்ளார்.

படம் முழுக்க ஏகப்பட்ட துணைப் பாத்திரங்கள். நாசர், அழகம்பெருமாள், ஸ்ரீமன், சஞ்சீவ், பிரேம், நாகேந்திர பிரசாத், ஸ்ரீநாத், ரம்யா, சாய் தீனா, ரமேஷ் திலக், சேத்தன், கல்யாணி நடராஜன், லல்லு, தீனா, சுனில் ரெட்டி, அருண் அலெக்ஸாண்டர், விஜய் முருகன் என்று படம் முழுக்கத் தெரிந்த முகங்களே தென்படுகிறார்கள். ஆனால், இவர்கள் யாருக்கும் முக்கியத்துவம் தரப்படவில்லை. சாந்தனு, ஆண்ட்ரியா, கௌரி கிஷண் ஆகியோரும் வீணடிக்கப்பட்டிருக்கிறார்கள்.

இதையெல்லாம் மீறி (மாஸ்டர்) மகேந்திரன், சிபி புவன சந்திரன், பூவையார், அர்ஜுன் தாஸ் ஆகியோர் மட்டும் சில காட்சிகளில் தங்கள் இருப்பைப் பதிவு செய்கிறார்கள்.

சென்னை, நாகர்கோவில் என இருவித நிலப்பரப்புகளின் தன்மையைத் துல்லியத்துடன் அப்படியே கேமராவில் அள்ளி வந்திருக்கிறார் சத்யன் சூரியன். அரசினர் கூர்நோக்கு இல்லத்தின் அவல நிலையைப் படம் பிடித்த விதத்தில் அவரின் உழைப்பு பளிச்சிடுகிறது. அனிருத் இசையில் வாத்தி கமிங், வாத்தி ரெய்டு, குட்டி ஸ்டோரி பாடல்கள், மாஸ்டர் பீட் ரிப்பீட் ரகம். பின்னணி இசையும் கதைக்குப் பலம் சேர்த்துள்ளது.

பிலோமின் ராஜ், இயக்குநருடன் இணைந்து பேசி கல்லூரிக் காட்சிகளைக் கொஞ்சம் கத்தரித்திருக்கலாம். அது நீளத்தைக் குறைக்கப் பயன்பட்டிருக்கும்.

இயக்குநராக லோகேஷ் கனகராஜ் கதாபாத்திரத் தேர்வில் அப்ளாஸ் அள்ளுகிறார். நடிகர்களிடம் நடிப்பை வாங்கியதிலும் அவரின் திறமை தெரிகிறது. விஜய்யின் ஃபிளாஷ்பேக் இதுவென்று ஒரு சோகக் கதையை, குடும்பத்தைப் பலி கொடுத்த கதையைச் சொல்லாமல், 'காதல் கோட்டை', 'வாரணம் ஆயிரம்', 'பிரேமம்', 'புன்னகை மன்னன்',' டைட்டானிக்' ஆகிய படங்களின் கதைகளைத் தன் காதல் கதைகளாச் சொன்ன விதத்தில் லோகேஷின் டைரக்டர் டச் பிரகாசம்.

லோகேஷ் கனகராஜ், ரத்னகுமார், பொன்.பார்த்திபன் ஆகிய மூவரும் இணைந்து திரைக்கதையை எழுதியுள்ளனர். வழக்கமாக பலம் பொருந்திய வலிமையான, புத்திசாலித்தனமான நாயகன்தான் இப்படத்துக்குத் தேவை. ஆனால், விஜய் அப்படி எந்த புத்திசாலித்தனமான செயலையும் இப்படத்தில் செய்யவில்லை. குற்றத்தின் பின்னணி அறிய அவர் தேடல் பயணத்தையும் நிறையப் பேரை புரட்டி எடுக்கிறார். ஆனால், அதனால் என்ன பயன்? அதன் விளைவு என்ன? அதனால் அவர் என்ன கண்டுபிடித்தார் என்பதற்கு பதில் இல்லை. அந்தத் தேடல் வலுவிழந்து பயனில்லாமல் போகிறது.

மது அருந்துவதற்கான காரணத்தைச் சொன்னால் அதையே காரணமாகக் கொண்டவர்கள் தொடர்ந்து அதை அருந்துவார்கள் என்று விஜய்யின் மூலம் சொல்ல வைத்த லோகேஷ், தேவைக்கும் அதிகமான காட்சிகளில் விஜய் மது அருந்தும் காட்சிகளைக் குறைத்திருக்க வேண்டும்.

லாரி உரிமையாளர்கள் சங்கத் தலைவர் தேர்தலில் நிற்போம் என்று முறுக்கிக்கொண்டு நின்ற மூன்று பேரில் இருவருக்கு நேர்ந்த கதியைத் தெரிந்துகொண்ட பிறகு மூன்றாவது நபரும் எப்படித் தானாக வந்து சிக்குவார்? மாளவிகா மோகனன் ரவுடிகளிடமிருந்து தப்பிக்க சென்னை, திருவல்லிக்கேணியில் ஓடுகிறார். அடுத்த காட்சியில் நாகர்கோவிலில் இருக்கிறார். கதை எந்த இடத்தில் நிகழ்கிறது என்பதில் லாஜிக் இல்லை.

மிகப்பெரிய எதிரிக்குச் சவால் விடும் நாயகன், தன் நட்பு சூழ் உலகை எப்படி எச்சரிக்கை செய்யாமல் இருப்பான்? படத்தில் நாயகனை விட எதிர் நாயகன் புத்திசாலித்தனமாக இருப்பதுதான் திரைக்கதையின் சறுக்கல். திரைக்கதை தொய்வடையும் ஒவ்வொரு கட்டத்திலும் விஜய்யின் எமோஷனல் காட்சிகள் மூலம் சரிவைச் சரிசெய்யப் பார்த்திருக்கிறார்கள். அது தனியாகத் துருத்திக்கொண்டு நிற்கிறது. சில இடங்களில் வெறுமனே எமோஷனல் வசனங்கள் பேசுவது நம்பம்படியாக இல்லை. இப்படி திரைக்கதையின் ஓட்டைகள் அடைக்க முடியாத அளவுக்கு உள்ளன.

அரசினர் கூர்நோக்கு இல்லத்தில் அடைக்கப்பட்ட சிறுவர்கள் செய்யும் முதல் குற்றம் மட்டுமே எமோஷனல் அடிப்படையிலானது. அடுத்தடுத்து செய்யும் குற்றங்கள் ஏன் நடக்கின்றன? யாரால் நடக்கின்றன? என்பதன் பின்னணியையும், வழிதவறிப் போகும் சிறுவர்களை வாழவைக்கப் போராடுவதன் அவசியத்தையும் சமூக அக்கறையோடு பதிவு செய்த விதத்தில் மட்டும் 'மாஸ்டர்' கண்ணியமான பெயரைச் சம்பாதித்துள்ளது.

MADURAI: Calling the denial of medical admission to an eligible differently-abled aspirant as ‘arbitrary’ and ‘unfair’, the Madurai Bench of the Madras High Court recently directed the State Health Department to pay Rs 2-lakh cost to the aspirant.

Justice G R Swaminathan noted that the petitioner G Arun Kumar had applied for admission to MBBS course under the differently-abled category for the year 2018-2019. But he was not granted admission as the selection committee disputed his disability certificate.

Kumar filed a petition before the court in that regard in 2018, and pursuant to the court’s direction in 2019, a fresh board was constituted and the board confirmed that Kumar was a differently-abled person. Since the academic year, for which admission was sought, had expired, the court had directed the authorities to consider granting admission to Kumar in the next year. 

But Kumar’s application was not considered next year as well and he filed a contempt petition to which the authorities answered that NEET marks obtained in previous year cannot be used to seek admission in the subsequent year. Hence he filed a separate petition in August 2019 but the same could not be taken for disposal till January 6, 2021.

Justice Swaminathan observed that Kumar had been ‘unfairly’ denied seat and had to move the court thrice. Though Kumar is found to be meritorious, the Supreme Court authorises the court for direct admission of a candidate only in the succeeding year (next academic year) which would be 2019-2020 in the petitioner’s case. Hence the court cannot give any direction for admission at this stage, the judge pointed out. But he directed the authorities to pay `2-lakh cost to Kumar for arbitrarily denying seat to him and wished him good luck in achieving his dream in the next academic year.

PUDUKKOTTAI: Some of the leading doctors in the State will take the coronavirus vaccine on Saturday, to instil confidence among people, Health Minister C Vijayabaskar has said.

After inspecting the vaccine centre at Pudukkottai Medical College Hospital on Friday, he said, “Ten leading doctors will take the shot on day 1 .

These include national IMA president Dr JA Jayalal, State IMA president CN Raja, Dr Sudha Seshayyan, Dr Mohan Kameswaran, Dr Mohamed Rela and Deans of Omandurar and Pudukkottai Medical College... There is no need to worry about the safety of the vaccine.

Doctors and nurses have been asked to state their willingness to take the shot.” Each vial of Covishield vaccine is 5 ml, and can be used for 10 people, the minister explained. The vaccine will be administered using an auto-disable syringe, which can be used only once, he added.

“People who tested positive and recovered can get vaccinated. If you have just tested positive, you cannot receive take the shot for 14 days,” he said.

CHENNAI: The DMK has to be defeated in the upcoming Assembly elections to prevent the misuse of official machinery and increase in rowdyism, Thuglak editor S Gurumurthy said on Thursday. He was speaking at the anniversary celebrations of the magazine. “In the upcoming elections too, the contest is between the AIADMK and the DMK,” he said. 

“Of the two, AIADMK-BJP combine would be the better option on several counts. If the DMK comes to power, there won’t be any limit for misuse of official machinery. Besides, rowdyism and atrocities will go up. So, it is our duty to defeat the DMK.” He then lauded the AIADMK government for tackling the Covid threat efficiently, and praised Chief Minister Edappadi K Palaniswami for working overtime to keep the pandemic at bay.

He said there was a need for national parties to grow in Tamil Nadu, and expressed confidence that the BJP would become a major force in the State in the next 3-4 years. Responding to questions from readers of the magazine, one of whom asked if it would be correct to assume that the BJP, Sasikala, and AMMK would come together in support of the AIADMK to defeat the DMK.

In response, Gurumurthy referred to an analogy quoted by veteran journalist Arun Shourie way back, and said: “When the house is on fire, we cannot wait for Ganga water to douse the flames. We may have to pour even sewer water to douse it. Similarly, when an alliance if formed to defeat the DMK, we cannot expect merely the pure forces to join hands. We may need to engage some other elements too.” The remark, seen by certain sections as extension of support for Sasikala and her family, was met with objection from the AIADMK. Responding to it, minister D Jayakumar said, “Gurumurthy thinks that he is a king maker and a Chanakya... maybe he can advise Donald Trump.” 

Later, on Twitter, Gurumurthy said his comments were being misinterpreted. “We at Thuglak will continue to regard the Mannargudi family as Mafia. Our opinion on them will not change. How is it amounting to supporting AMMK which I regarded as Mafia I can’t understand. I still regard AMMK as Mannargudi Mafia as someone had said. Even if they become part of BJP-AIADMK alliance I will regard them as only Mafia like we regarded Chandraswamy as sewer,” Gurumurthy said.

Gurumurthy referring to the questions faced by the Indian Express in 1987 when it took Chandraswamy’s help to probe the Bofors case which involved Rajiv Gandhi, and what Arun Shourie had said about it at that time. The Thuglak editor also said in the Thuglak meet he had cited the Chandraswamy incident when a reader asked whether the BJP would ally with the AMMK and Azhagiri to fight the DMK. 

“I don’t know what the BJP would do. But Thuglak had decided to tell the readers they should support AIADMK-BJP alliance,” Gurumurthy added. At the Thuglak meet, BJP national president JP Nadda hailed the contribution of Thuglak to courageous journalism and a video message from Union Home Minister Amit Shah was shown.

CHENNAI: Censuring the Dharmapuri and Perambalur district administration for a 20-year delay in providing land records awaiting mutation, the Madras High Court observed that the judiciary is not Jesus Christ to carry the cross for the sins committed by the authorities. The court also ordered Rs 1 lakh and Rs 50,000 as compensation for the two petitioners, respectively, who were made to run from pillar to post for the past 20 years.

Taking a serious view of the delay, Justice N Seshasayee observed that only because of such unjustifiable delays caused by authorities, courts are burdened with lakhs of litigations. The issue pertains to the petitions moved by Rathinam and Jayalakshmi seeking direction to the district administration to re-mutate records of the land owned by them.

According to Rathinam, she owned about four acres of land at Virappanayakkampatti, Harur village, Dharmapuri. The land was notified for acquisition under the Land Acquisition Act, 1984, by the Tamil Nadu government in 1987. In 1988, a GO was issued for acquisition of the land. The same was challenged by the petitioner in the high court.

The judge, recording the submissions made by the counsel for the petitioners, ordered SP Karthikaa, Dharmapuri collector and P Sri Venkada Priya, Perambalur collector, who were summoned during the hearing, to come up with a viable solution for such issues which are rampant across the State. It was also noted that no appeal was made by the State against the HC order, or fresh acquisition notification was issued.

The court, ordering compensation for each of the petitioners, observed that such lack of professionalism at one level affects the judiciary by adding up to the pending cases. Also, an out-of-the-box solution is found to handle such issues, the court emphasised.
