The Madurai Bench of Madras High Court has directed a father of two daughters to pay monthly maintenance to his family as directed by a lower court.

Justice S.Vimala directed the petitioner, who had filed a revision petition, to pay a monthly maintenance of Rs. 7,000 to his wife and Rs. 5,000 each to his two daughters, one of whom is suffering from cancer. The court took cognisance of the fact that the petitioner’s mother had also sought maintenance from her son and a lower court had directed him to pay Rs. 3,000.

The court directed the Managing Director of TNSTC (Coimbatore), where the petitioner, M.Velusamy, is employed, to deduct Rs. 17,000 from his salary and deposit Rs. 7,000 to his wife and Rs. 5,000 each to his daughters in their respective savings bank accounts.

If he was to seek a voluntary retirement, then a notice be sent to his family before his retirement benefits were disbursed.

The petitioner should not decline the maintenance to be paid towards his wife and daughters on the ground that he had to look after his mother also.

The court observed that the petitioner had produced a made-up salary slip to evade payment of maintenance to his family.
