 HC quashes FIR against students

Warns them that complaint will stand restored if they indulged in violence again

Even as it quashed a First Information Report (FIR) registered against four students of a private engineering college here, the Madras High Court has directed them to submit an affidavit to the police and college authorities that they would not indulge in any illegal activity till the time they complete college.

While hearing the criminal original petition filed by the students against whom an FIR was registered under Sections 341, 324 and 506 (ii) of the IPC on the basis of a complaint by another student, Justice R. Mahadevan said the violent acts of the petitioners on the college campus cannot be countenanced.
According to the police, Vijay Chowdhri alias Gullapallai Yugasai Vijay Kumar, Shiva Vardhan alias Naga Mega Shiva Vardhan Reddy, Kumaresh alias Kumara Venkatesh and Sirish alias Baratam Sirish Mohan — all second year students in Sathyabama University — were involved in violence and the FIR was based on a complaint by another student Akkash Reddy.


While Kumar was from Maharashtra, Vardhan Reddy and Kumara Venkatesh were from Andhra Pradesh and Sirish Mohan was a native of Odisha.

The judge quashed the FIR on the condition that each of the petitioners file individual affidavits countersigned by their parents that they would not indulge in any such illegal activity in the remaining period of their study in question.

“Failing compliance of the condition, the FIR shall stand restored against them. Such affidavits have to be submitted within two weeks from the date of receipt of a copy of this order,” Justice Mahadevan said.
