Ukraine returned medical students have filed a plea in the Supreme Court seeking migration to Indian medical colleges as a one-time measure.

Supreme Court has already asked the National Medical Commission (NMC) to come up with a scheme to accommodate students pursuing medical courses from Ukraine and China in wake of the ongoing Ukraine and Russia war and Covid-19 pandemic. Now, many Indian medical students evacuated from Ukraine have approached the top court with a plea seeking migration to medical colleges in India as a one-time measure.

The petition filed through Advocate Ashwarya Sinha stated that the education of nearly 14000 such students has come to a complete halt due to the ongoing war and through the plea, the medical students have sought migration in the equivalent academic year.

The petition also seeks direction for the Centre to issue necessary directions under the National Medical Commission Act to the Commission to frame guidelines and SOPs in this regard, as reported by India Today.

Other demands of these students

The students urged the top court to formulate guidelines by exercising its jurisdiction under Article 142 of the Constitution of India in light of the extraordinary situation and also provide adequate infrastructural, academic, and financial support for the continuation of medical education of the evacuated Indian students.

Students cited that countries like Pakistan, Nigeria, Ghana, and Egypt have already accommodated their medical students who returned from Ukraine.

The Chennai health department has initiated legal action — including closure — on four private hospitals involved in the illegal harvesting of eggs from a minor girl, minister Ma Subramanian said on Thursday. Sudha Hospitals’ branches in Erode and Salem, Ram Prasad Hospital in Perundurai, and Vijay Srishti Fertility Centre in Hosur have been directed to discharge all patients within 15 days, after which measures would be initiated to shut them down.

“The scan centres will be closed with immediate effect. Two of these hospitals, which are empanelled under the state health insurance scheme, will be removed from the list,” said Subramanian, adding that the harvesting was done in violation of laws, ethics, and ICMR guidelines. Joint directors have been asked to file cases against these hospitals in court for violations under Assisted Reproductive Technology (Regulation) Act, Pre-Conception and Pre-Natal Diagnostic Techniques Act besides ICMR guidelines. Complaints will be lodged with the state medical council against doctors in these hospitals. In June, the state received a report that a minor girl was forced to donate her eggs to hospitals for commercial reason

The Delhi High Court on Thursday dismissed a writ petition filed by 15 students seeking to postpone the NEET-UG 2022 exam to be held on July 17.

"This is totally a misconceived petition. It's just because these are students, the court will not be harsh. Had it been anyone else, this would have been dismissed with costs", a single bench of Justice Sanjeev Narula orally said while concluding the hearing.

"The pressure can only be eased by self study, not by the manner you are doing this. I wish the students all the best", Justice Narula said.

At the outset, the bench asked the petitioners why they are approaching the Court now, when the schedule of the exam was known in April 2022.

The petitioners' counsel submitted that the admit cards were only issued recently and that the petitioners had been pursuing representations before various authorities.

"How can 15 students ask for rescheduling of the exam? Such petitions should be discouraged", Justice Narula said.

When the counsel submitted that 218 people died in floods across the country, the bench said that being the Monsoon season, such things happen, and that cannot be the basis for relief.

The counsel then submitted that there was only a short gap between major exams like CUET, JEET and NEET and this was putting the students under immense pressure.

The bench asked if there are common subjects in these exams. When the counsel replied in the affirmative, the bench said "then that is good for you- having common subjects will be good for preparation, everything will be fresh in your mind".

The counsel also submitted that 17 students have committed suicide due to exam pressure. "These are vague statements. How can you say that the students have committed suicide because of the exam? I will not go by newspaper reports", Justice Narula replied.

As regards the counsel's submission regarding travel difficulties of the students, the bench said that vague statements were made.

"You have to make out which petitioner is giving what exam and from where he has to travel", the bench said.

"I'm sorry, petitioners didn't give details because they were scared that authorities will take adverse action", the counsel replied.

"No students should be scared. This court is here to help them. But you have to be specific. They're approaching the court through a counsel", the Court said.

The counsel for the National Testing Agency told the bench that more than 90% students have downloaded the admit cards. Delay in holding the exam will have a spill over effect on future academic sessions, the NTA counsel said. The counsel added that in 2020 and 2021 also similar demands were raised, which the Courts refused to entertain.

"I don't want to give any anxiety to other students so I will just give the operative portion of the order.These are students so I am not being harsh but in other matters of this nature, I would not shy from imposing costs. Dismissed", Justice Narula said as the hearing concluded.

NEET 2022 has not been postponed. Delhi High Court today dismissed the plea to postpone the examination. The court pointed out that there was no actual overlap of the examination and that the examination schedule cannot be disrupted continuously.

National Eligibility cum Entrance Test, NEET 2022 has not been postponed. Delhi High Court bench today dismissed the plea to postpone the medical and dental admission test scheduled for July 17. The court pointed out that it was too late and the petition was misconceived. Clearly not amused, the court also said that it is not going to levy costs because these are students.

"I was quite inclined to pass order against the petitioner but only becase these are students we are not going. If such petitions are filed then the court wll not shy away from imposing costs," Justice Narula noted as he dismissed the plea. He further added that there was no merit in the petition.

The court was not convinced by the petitioners’ statements, questioning the rationale of seeking deferment of the exam at the last minute. It also asked as to how could 15 students ask for the postponement of the examination at the last minute.

On the concerns regarding flood situation, the court pointed out that it is the Monsoon season. We are in monsoon season. That cannot be the basis that there are floods in some districts. Something or the other keeps happening in our country,” Justice pointed out.

As for the clustered examinations, Court quizzed if any of the examinations were overlapping. When refused, the court said that this was actually in favor of the students With subjects being similar, the court suggested that students would actually be freshly prepared for all the examinations. The court also quickly dismissed the possibility of Phase II as there was no precedent.

Students had filed a petition in the Delhi HC, seeking postponement of NEET UG 2022 examination by 4 to 6 weeks. The main point raised by the students was that many national level competitive exams were nestled together with a gap of only about 1 to 2 days.

Talking about NTA, which would be conducting CUET, NEET and JEE Main almost next to each other, the students have asked the court to offer respite. “Respondents scheduled National Level Examinaitons CUET, NEET UG and JEE in the month of July 2022 having a time gap of 1-2 days, wherein the syllabus of all three examinations is completely different,” the plea read.

NTA maintained its stand that the examination would not be postponed. Citing disruption of academic calendar over the past two years, NTA Counsel urged the court not to defer as delay of even a single day would create havoc. NTA also said that the time schedule has to be compressed this year in order to bring back the academic calendar on track.

NTA Counsel shared that 90 per cent of the students registered for the NEET examinaiton have downloaded their admit cards. They have also shared that all possible arrangements would be made and that agency has already written to states for support.
