HC grants relief to NRI student

Mumbai: The Bombay High Court on Wednesday directed the Directorate General of Health Services (DGHS) to open its web portal and issue an admission letter to an NRI medical student.

Dr. Faaria Asif Ali, 25, a Juhu resident, had sought admission to the post-graduate course in dermatology at DY Patil Medical college under the NRI category. Despite the letter from the DGHS dated May 19 that deemed her eligible for the course, the college had refused admission unless she paid ₹50 lakh for admission.

On Wednesday, the college consented to grant admission. Advocate Anukul B. Seth, representing Dr. Ali, said the college has permitted her to begin attending lectures. However, since the DGHS has not included her in an official capacity, a Division Bench comprising Justices Nitin Sambre and PD Naik directed it to open the admission portal and grant admission to Dr. Ali.

The court ordered that they must complete all formalities, ensure her admission to the post-graduate medical course and not block her admission. The matter will now be heard on June 11 for compliance by the DGHS.

Discharge 11 medical students: MCI to deemed university

PUDUCHERRY: The Medical Council of India (MCI) has directed a deemed university in the Union territory to discharge (remove from the rolls of the institution) eight postgraduate medical students and three diploma students admitted last academic year with immediate effect and submit a compliance report within a week.

MCI joint secretary Rajendra Wabale in a notice addressed to the principal of Mahatma Gandhi medical college and research institute, a constituent college of Sri Balaji Vidyapeeth, a deemed university, asked him to comply with the notice issued by the council on July 24 last year and discharge 11 students (eight PG medical students and three diploma students).

He said the council will take necessary action if the college failed to comply with the order.

The council will take a final call on the future of six students (four PG medical students and two diploma students), who were given different specialities by the college against the ones allotted to them by the centralised admission committee, after receiving the opinion of the additional solicitor general of India.

The council, however, withdrew its order discharging four students (a PG student and three diploma students).

Student accuses College of demanding 50 lakh for admission, moves HC —

 Dr Faaria, resident of Juhu, has moved the vacation bench seeking stay on the admission process to the Post Graduate (PG) Dermatology course. She claims that the college has asked her to pay Rs 50 lakh as donation for her admission to the course in DY Patil Medical College.

Mumbai : The Bombay High Court on Saturday issued notice to the management of DY Patil Medical College and has sought its response to a plea field by a student accusing the institution of denying admission and demanding a hefty amount as ‘donation.’

A vacation bench presided over by Justice Shahrukh Kathawalla and Justice Ajay Gadkari issued the notice after admitting a writ petition filed by Dr. Faaria Asif Ali.

Dr. Faaria, resident of Juhu, Mumbai has moved the bench seeking stay on the admission process to the Post Graduate (PG) Dermatology course. She claims that the college has asked her to pay Rs. 50 lakh as donation for her admission to the said course in DY Patil Medical College.

According to advocate Anukul Seth, his client Faaria was allotted a seat in the course by the Directorate General of Health Services, Ministry of Health and Family Welfare, Government of India.

“The ministry had made a provisional allotment to my client by issuing a letter on May 19. She was given the allotment under the NRI quota since her uncle is an NRI,” Seth told Free Press Journal.

“Soon after receiving the letter from the ministry, we approached the college to confirm our seat by paying the fees. But there we were asked to pay an additional amount of Rs. 50 lakh, which did not include the course fees. We haven’t paid the amount yet since our admission has not been confirmed,” Seth added.

Dr. Faaria has now moved the court seeking a stay on the admission process since the Saturday was the last date for admissions to the course. She has claimed that if the college now refuses to grant her admission then it would cause great harm to her career.

Having heard the contentions, the bench said, “Since the College is not served and therefor not represented before us, we are not able to verify the allegations made by the Petitioner (Faaria) against the management of the College.”

“However, we adjourn the matter till Monday, with a clarification that all steps taken by the College for granting of admissions to students in M.D. (Dermatology) between today and Monday, shall be subject to the Orders which would be passed on the next date,” the judges added.

Few takers for PG medical seats under management quota in Tamil Nadu

CHENNAI: Over one-third of the unfilled PG medical seats under management quota in the deemed medical universities are in Tamil Nadu. The Medical Council Committee, functioning under the Union Health Ministry’s Directorate General of Health Services, has surrendered over 150 PG medical degree and diploma seats to various private medical universities in Tamil Nadu. The committee usually conducts the single-window admission counselling for all management seats of PG medical courses in deemed universities across the country.

Even after a mop-up round of counselling, over 450 seats across the country remained unfilled and over 150 were in Tamil Nadu. The private universities are now free to admit students on their own, before the deadline of May 31.

“Non-clinical PG seats were not filled even after the mop-up round (of the counselling). Because there is no scope in these courses,” a Directorate General of Health Services official told Express.“Also across India, over 200 non-resident Indian (NRI) seats were not filled. This is because of the huge fee that the private medical colleges charge. Per annum, Rs 40 lakh fee is collected for each NRI seat and many cannot afford it. These colleges should reduce the fee,” the official added. The official said that the percentile was further reduced, but still, there were no takers for many of the courses.

PG medical aspirants told to surrender ‘State’ seats by today

Failure to do so will attract a hefty continuation fees

The Selection Committee of the Directorate of Medical Education has instructed candidates wishing to discontinue the course they joined through allotment made by the committee between May 19 and 23 that they can do so before May 25.

Such candidates will not be permitted to attend the subsequent phase of counselling for admission to PG degree/diploma courses in government colleges and government quota seats in self-financing medical colleges.

Candidates who discontinue the course allotted under the State quota after May 25 will have to pay the discontinuation fees of Rs. 15 lakh for PG degree courses and Rs. 10 lakh for PG diploma courses.

Changing quota

If a candidate who has joined the course under the State quota takes a seat under the management quota in a self-financing medical college then the seat held by the candidate will be automatically surrendered to the State quota, selection secretary G. Selvarajan has said.

Of the 1,376 candidates called for counselling on Thursday, including 593 for management quota seats in MDS, 23 were allotted seats in government colleges and 224 candidates were allotted seats in self-financing colleges. Of the 738 candidates who attended the counselling, 490 have been waitlisted.

மாநில ஒதுக்கீட்டில் இடம் பெற்று, கல்லுாரியில் சேர்ந்தோர், தனியார் கல்லுாரிகளின் நிர்வாக ஒதுக்கீட்டு இடங்களுக்கான கவுன்சிலிங்கில் பங்கேற்று இடங்களை தேர்வு செய்தால், அவர்கள் ஏற்கனவே பெற்ற, அரசு ஒதுக்கீட்டு இடங்கள் தானாகவே ரத்தாகி விடும். அந்த இடம், மீண்டும் கவுன்சிலிங்கில் சேர்க்கப்படும். இவ்வாறு அறிவிப்பில் கூறப்பட்டுள்ளது.

முதுநிலை மருத்துவம்; முதல்கட்ட கவுன்சிலிங் இன்று நிறைவு

சென்னை : முதுநிலை மருத்துவ படிப்புக்கான முதல்கட்ட கவுன்சிலிங் இன்று(மே 24) நிறைவடைகிறது.

அரசு மருத்துவ கல்லுாரிகளில் உள்ள, முதுநிலை மருத்துவப் படிப்பில், 981 இடங்கள் உள்ளன. இந்த இடங்களுக்கான மாணவர் சேர்க்கை, கவுன்சிலிங், சென்னை, ஓமந்துாரார் மருத்துவமனையில் நடக்கிறது. இதை, தமிழக மருத்துவ கல்வி இயக்கம் நடத்துகிறது. இந்நிலையில் முதல்கட்ட கவுன்சிலிங் இன்றுடன் நிறைவடைகிறது. மே 25ல் நிர்வாக ஒதுக்கீட்டு இடங்களுக்கான கவுன்சிலிங் நடைபெறும் என அறிவிக்கப்பட்டுள்ளது.

First round of PG medical counselling completed

The first round of counselling for postgraduate medical courses ended on Tuesday with 179 of the 753 candidates who attended the counselling being allotted seats in government medical colleges. As many as 50 candidates were allotted seats in self-financing medical colleges. A total of 524 candidates have opted to be wait-listed.

Of the 1,262 candidates called for counselling, 138 had been allotted seats under the all-India quota. Only 753 attended, according to the Tamil Nadu Medical Education Selection Committee.

Counselling for PG dental programmes will be held on Thursday. The first session will be held at 2 p.m. and the second session at 4 p.m.

Says All India PG quota allottees have no right to seek admission under State quota too

Doctors who had been allotted postgraduate degree or diploma seats under the all India quota cannot claim a right to participate in the counselling held for State quota seats too in an attempt to gain admission into a better course and a better institution in their home State, the Madras High Court has held.

Justice S.M. Subramaniam passed the ruling while dismissing a batch of 17 writ petitions filed by candidates who were aggrieved against non-inclusion of their names in the State merit list for the academic year 2018-19 since they had already been allotted seats in other States under the all India quota.

After finding that regulations governing the subject do not confer any right on candidates to select a course or institute of their choice, the judge said: “Choice/option can neither be claimed as a matter of right nor such a choice granted to the students be construed as a legal right so as to claim a PG medical seat based on such a choice before the court of law.”

Extracting the dictionary meaning of the term ‘choice,’ the judge said: “Thus, choice is a chance and can never be a legal right. Choice of a branch or choice of a medical institution is subject to the availability of seats in a particular branch and subject to the availability of such a branch in a particular medical institution. “It is not as if admission to PG medical courses has been denied to these batch of writ petitioners... Simply because they have been admitted in other States, they cannot say that once again they must be considered for the admission under the State quota in courses and institutions of their own choice and as per their wishes.”

‘Open more colleges’

Though counselling for the all India quota as well as the State quota seats ought to have taken place contiguously, the judge accepted the explanation offered by government advocate K. Karthikeyan that this year there was a delay in releasing the State list due to the interim orders passed by the court in another batch of cases related to grant of incentive marks to government doctors.

At the same breath, observing that meritorious students should not get disillusioned due to their inability to gain admission into a better course and institute, Mr. Justice Subramanian reminded the Centre as well as the State government of their duty to establish adequate number of medical colleges. “The intellectual calibre of the young minds of our great nation are undoubtedly vibrant, and numerous students are now aspiring to secure seats to undergo medical courses in distinct branches... This court is of an opinion that starting more medical institutions is imminent on account of the current needs of our nation,” he concluded.

Batting for establishing more medical education institutions, both at the state and central level Madras high court has said, “It is imminent on account of the current needs of the nation and that the governments are expected to do so by performing their duties as expectedunder theDirectivePrinciples of State Policy enumerated in the Constitution.”

Justice S M Subramaniam made the observation while dismissing a batch of pleas moved by MBBS doctors seeking to include their names in the merit list for admission to PG medical courses under state quota. Their plea was dismissed since they have already allotted seats under All-India quota.

“Right to participate in the process of admission is a fundamental right. Equal opportunity to participate in the admission process is a constitutional mandate. However, such an opportunity providedto participate in the process of admission or selection will not confer any legal right for choosing a place of their choice or a branch, which is not contemplated either under the statute or under the prospectus issued to these students.They had acceptedthe prospectus and the terms and conditions stipulated therein. In the event of any violation of terms and conditions stipulated in the prospectus, then alone the petitioners can move a petition for redressal of their grievances. Contrarily, they cannot come out with a writ petition by stating that more chances are to be given to them for purpose of choosing the branch of study or choice of their place,” Justice Subramaniam said.

According to the petitioners, they had not been given an opportunity to avail the state quota as per the scheme of admission provided for PG degree/diploma courses, since the process was delayed by the state government.

Refusing to accept the contentions, the judge pointed out that the state is not responsible for non-publication of state merit rank list to fill up its quota. The delay was actually because of pendency of litigations before this court.

This being the factum of the case, this court is of an undoubted opinion that the writ petitionershave notestablished any legal right, to consider the reliefs, as such, sought for in these batch of writ petitions. The grounds raisedin respectof the choice of the students are also untenable, the court concluded.
