The Court appointed Senior Advocate Aman Sinha as amicus curie in a plea challenging the mandatory requirement of class XI certificate to be eligible for participating in NEET-UG counselling.

The Supreme Court on Tuesday appointed Senior Advocate Aman Sinha as amicus curiae in a plea challenging the mandatory requirement of class XI certificate for eligibility in the counselling process for undergraduate courses of National Eligibility cum Test (NEET UG) [Srishti Nayak and ors. v. Union of India and ors.]

A Bench of Justices L Nageswara Rao and BR Gavai allowed the intervention application filed by a class XII student who contended that the Director of Medical Education, Bhopal made it mandatory to upload class 11 mark sheet, failing which, the students will not be eligible to participate in the counselling.

"Mr. Aman Sinha, learned senior counsel, is requested to appear as Amicus Curiae in this case," the Bench ordered.

The plea contended that the mandatory requirement of Class XI certificates will make private candidates who have passed 10+2 exams ineligible for counselling.

Earlier, the Delhi High Court had held that this requirement is unconstitutional and it was struck down in the case of Anshul Aggarwal v. Union of India.

The applicant submitted that the requirement is arbitrary and violative of Article 14, 19(1)(g) and 21 of the Constitution, because many students have become ineligible to participate in counselling, which amounts to denial for admission in MBBS course, although, they have cleared the NEET examination.

A private candidate from the State of Maharasthra is not eligible as per this rule as there are no class XI examinations in the State, it was pointed out.

The plea further said that the applicant was not categorised as 'ineligible' even for securing admissions in a foreign university, but was not granted an eligibility certificate for NEET as the Class XI marksheet was not annexed.

The matter will be heard by the Supreme Court after the summer vacations.

Senior Advocates Nidesh Gupta and SK Gangale and advocates Avijit Mani Tripathi, Akshat Srivastava and Gaurav Sharma appeared for the petitioners.

Additional Solicitor General of India Aishwarya Bhati and Senior Advocate Vikas Singh appeared for respondents.

Chennai: Nearly 77% of the undergraduate medical seats under the NRI quota have remained vacant after the first round of online medical counselling for 2021 admissions. The state selection committee, which has extended counselling for the category, has announced that if these seats continue to remain vacant until Monday, they will be considered as “lapsed seats” and moved to the general pool.

When the counselling opened, 17 self-financing colleges asked for 15% of the seats to be set aside for NRI admissions, for which the fee committee has permitted college managements to charge ₹23.50 lakh as an annual fee. “But even when we opened the counselling there were just 250 applications for the 398 seats. When the process began, 106 candidates locked choices and 92 took the seats,” said selection committee secretary Dr P Vasanthamani.

The committee then decided to extend the first round of counselling for the category and the deadline for registration ended by noon on Friday. Candidates have been asked to lock choices by 10pm on Saturday. “We will be putting out the results by Saturday and students will be given time to join colleges until Monday,” she said.

Seats that continue to remain vacant after Monday will be considered ‘lapsed NRI seats’ and added back into the management quota matrix. Students from the general category in the management rank list can apply for the seats. The fee for lapsed seats will be ₹20.3 lakh. The fee committee has allowed colleges to charge to take ₹12.5 lakh for students allotted under management quota and ₹3.8 to ₹4 lakh for students allotted under government quota.

Students say they will be happy to have at least 300 more seats on the seat matrix. “These seats will cost us more than management quota seats, but it is still lesser than deemed universities, which is the only other option we are left with,” he said.

The admissions to deemed universities, which charge around ₹25lakh a year, are done by the medical counselling committee of the Directorate General of Health Services.

NO RESGIANTION IS ACCEPTED IN/AFTER ROUND-2 OF COUNSELLING.

Kind Attention of Candidates & institutes: It is for the information of all the candidates & institutes participating in UG /PG Counselling 2021-22. MCC is receiving several requests from the candidates regarding resignation of seat from allotted College/ institutes from their joined seats in 2nd round. 

The timeline that has been published by MCC on official website of resignation of Round seats as on intramcc portal was as follows: 

UG Course: 04:00 PM of 15th February 2022 (as per notice dated 05.02.2022)

 PG Course: 04:00 P.M of 3rd February, 2022 (as per notice dated 19.01.2022) 

However, it is re-iterated to all the participating candidates that as per the directions mentioned in the matter of Dar-u-slam Educational trust & ors. vs. MCI & ors. (W.P. no. 267 of 2017) & Snigda Leo vs. MCC & ORs (W.P.no. 820 of 2021) no resignation are allowed once the candidate is a part of round 2 of Counselling conducted by MCC. The Colleges taking resignation offline are advised to abstain from doing so as such vacant seats allowing through offline resignation will not be included in further rounds of Counselling.

 NOTICE 

It is for the information to all the candidates that the Final Result of Round-2 of NEET PG Counselling 2021 for MD/MS/Diploma/ PG DNB seats is now available. The Allotment Letters can be downloaded from MCC website. Candidates are requested to proceed for Reporting to the allotted college as per schedule after downloading their Allotment Letters. 

The candidates can contact their allotted college directly for queries related to documents/ Fee to be submitted at the time of Reporting. Also, candidates should confirm Admission Schedule from the allotted college before proceeding for Reporting along with all required original documents.
