Few takers for pricey PG medical NRI seats

Prohibitively expensive NRI quota seats for postgraduate medical courses are not finding many takers across India. Fees being the highest in Maharashtra and Karnataka, just about 3%-5% of such seats have been filled up in the two states.

Data from several states shows that despite setting a flat rate or in some cases, lowering the fee to the same level as for management quota candidates, colleges are finding it difficult to fill their 15% NRI quota. Barring Kerala—where most NRI seats have been snapped up — states have been wooing candidates to join their colleges, sometimes even negotiating tuition rates for NRI seats.

“Most colleges across India, including deemed universities, are finding it difficult to get NRI candidates for their seats,” said head of the Directorate of Medical Education, Dr Praveen Shingare. “So they are looking for Indian candidates who can be sponsored by NRI relatives,” he added.

In most states, private colleges are allowed to follow a three-tier system in which seats are divided into merit, management, and NRI categories. Candidates are charged more for NRI seats in a bid to cross-subsidise education for the meritorious. And until 2016-17, the demand for NRI seats was so high they would be secretly auctioned off in many cases.

Now with the line of claimants thinning, in most states, colleges use their liberty to convert NRI seats to management quota (where fees are less) or surrender them to the agency in charge of regulating admissions, to enrol students at the same rate as merit seats.

In Bihar, not a single NRI seat has seen takers despite the fact that fees are same as those for management quota. Odisha has only one college and it has no NRI quota, merely merit seats and management seats. In Kerala, vacant NRI seats are being converted to merit seats and filled up by the commissioner of entrance exam. And in Karnataka, of 350 NRI seats in PG medical in 2017-18, only130 seats were filled. The rest were later shifted to the management category.

“In Karnataka, the fee structure of PG medical seats has gone up by 15% in 2018-19, compared to the previous year,” said Dr S Sacchidananda, director of Medical Education, government of Karnataka. So, an NRI PG seat in orthopaedics goes for ₹50 lakh, 10 times more compared to the ₹5 lakh charged for a merit seat in private colleges.

HYDERABAD: In a novel method to block medical seats, students are being offered Rs 8 to Rs 10 lakh by agents or middlemen to opt for seats and give them up later. The current medical PG seat aspirants have many such stories to tell.

They told how they and their friends were offered ‘incentives’ for blocking and giving up seats in private medical colleges. But some students rejected the offers and noted down phone numbers and names of the consultancies.

“We did receive calls from people who offered us Rs 8 lakh or more for blocking seats. And usually, it is people below 6000-9000 ranks who are approached with these ‘incentives’. The aspirants are asked to block a seat in first round of counselling and opt out,” said a PG aspirant who requested anonymity.

When some such aspirants asked what they are supposed to do if they opt out of seats, agents asked them not to worry as the rank holders would get a seat based on merit in the second round of counselling.

The agents are on constant look-out for people who have decided to take NEET exam again to get a seat in their chosen specialisation. Such youngsters too are asked to block seats and opt out. “The consultancy employees ask us if we have already opted for a seat. If the answer is no, the second question is if we are interested to opt for a seat in any category.

The candidates who have no plans to join any college this year are ideal for the agents,” said another PG aspirant. The youngsters said that they get to know about people who have rejected such offers but they might never get to know about the people who have accepted the proposals. “Whoever opts for these proposals are effectively killing the dreams of many youngsters who are yearning for a seat,” the aspirant said.

Medical seat aspirants make list of suspected ‘blockers’

Hyderabad: Medical seat aspirants who anticipated that some students will block seats, have been keeping a close watch on all aspirants and red flagged if there is any unusual preference of seat such as a student from Rajasthan whose rank can get a good seat in the State, but opted for management quota seat in Telangana.

In fact, they have made list of some aspirants from Jharkhand, Bihar, Rajasthan, Bihar, West Bengal, their names, ranks they hold, the seats and medical colleges they have opted for. Aspirants from AP and TS have formed groups in social media platforms where they share if they are offered money for blocking seats. “We observe if they will hold on to the seats or will not opt out.

There might be genuine cases where students from other States want to study here because their family has shifted to TS, or they might be some other reason. We know we cannot do anything about the cases. But there will be some obvious unusual choice like a student who will get seat of his choice in home State opts for management quota seat here,” a PG aspirant said.

Agents offering 'incentives' to PG medical seat aspirants for blocking seats

HYDERABAD: Ahead of the second round of counseling for Post Graduate NEET seats is scheduled, aspirants fear that their chances of getting any good seats will be marred by the clandestine attempts to manipulate PG medical seat allotments.

The practice, in common parlance termed as seat-blocking, prevents deserving candidates from gaining admission to good colleges. The seat-blockers opt for seats during the centralised counselling process but relinquish the seat at the last moment.

With the first round of counselling for management quota seats over on May 2, and the second round happening on May 8, aspirants suspect, candidates with high ranks from other states in collusion with agents, block seats under management quota in private medical colleges and post the second round leave them. Often, the seat blocking is a part of undercover financial deals.

As per the rulebook, since there are only two rounds of counselling in the management quota, the seats that are not taken the post the second round of counselling get converted into NRI quota. These seats can be sold to any candidate at a price decided by the private college managements which often runs into crores.

Junior doctors also alleged the role of the private institution in such scams, which eventually stand to make big bucks from the conversion of seats. "In the absence of a mop-up round, all seats that not taken are converted into NRI quota and deserving candidates lose out on seats that they otherwise would have got. On each NRI seat private colleges make three times the money on each seat they otherwise make under management quota," explained Dr K Srinivas, member, Telangana Junior Doctors Joint Action Committee.

A candidate, who wished to remain anonymous said, "Such cartels between agents, students and private colleges not only take a toll on the genuine claims for seats of their choice, in worst cases, force some aspirants have to wait for another year to score a seat."

Another aspirant said that while some seats genuinely are left vacant, the agents and colleges plan it in a way that it is not very visible. "Why would an 8,000 or 9,000 ranker want to take a seat in lower grade college and in not so popular stream when they can get better? Students can often make out which seat are not going taken by genuine candidates but we don't have proof," said the aspirant.

As per rules, a total of 50 per-cent of seats are earmarked for all India quota and the remaining for the State quota.

‘Delhi student blocking seat in TS, AP’

Meanwhile, Dr K. Mahesh Kumar, president, Healthcare Reforms Doctors Associations (HRDA) told Express that a PG aspirant from Delhi who has secured 9,098 rank has been found to be blocking seats in both AP and Telangana. While he submitted his certificates for verification to Dr. NTR University of Health Sciences by 30 April, he also participated in first round counselling by KNRUHS.

"When his name did not feature in the list of candidates who did not report to NTRUHS, it was confirmed. The same person can not submit original certificates at both places. Either college authorities colluded with him or he fooled the universities with fake certificates. In either case, a formal complaint will be sent to KNRUHS and MCI," said Dr Kumar.

If found guilty, as per the MCI rules, the candidates would be barred from counselling for three years and may also be booked for criminal cases amounting to cheating.

SC nod to counselling rule changes for PG medical

NEW DELHI, DHNS: The Supreme Court has approved the changes in the counselling rules introduced by the Medical Council of India this year to check the “blocking” of seats by doctors aspiring to pursue postgraduate courses.

“Devious methods were adopted by certain candidates to block the seats in the all-India quota and resign thereafter from those seats later, which resulted in the reversion of the all-India quota seats to the state quota,” a bench of justices S A Bobde and L Nageswara Rao said.

Notably, admission to postgraduate courses is undertaken on the basis of National Eligibility-cum-Entrance 
Test.

50% of the seats are earmarked for all India quota and the remaining 50% for the state quota. A group of postgraduate courses aspirants, led by Rachit Sinha, contended the changes brought in by the MCI on April 9 stated that even if a candidate is allotted a seat in the first round of counselling in the all-India quota but did not report, he/she would be entitled to participate in the second round. 

A candidate who had reported but resigned was also made eligible to participate in the second round.

The petitioner claimed it would increase competition as candidates who were not eligible to participate in the second round of counselling earlier were permitted to compete for admissions in the second round.

The top court, however, rejected their contention, saying, “the MCI made changes to arrest the blocking of seats by certain candidates which was detrimental to the interest of meritorious candidates in the all-India quota”.

It also noted that the medical counselling committee identified about a thousand candidates who were indulging in such illegal practice and proposed to take action against them after a thorough inquiry. The court said there is no infringement of any legal right of the petitioners.

Reduction of the chances of admission does not entail the violation of any right, it said.

The top court also took exception to the fact that some states and deemed/central institutions completed the second round of counselling without waiting for the reversion of the unfilled seats in the second round of counselling of the all-India quota.

It directed that such states and deemed/central institutions shall conduct the second round of counselling again after reversion of the unfilled seats in the second round of counselling of the all-India quota.

The court said the concerned authority will report the unfilled seats in the second round of the all-India counselling to the respective states by May 5.

The second round of counselling for the state quota shall be conducted and completed by May 10. The mop-up round for the state quota, scheduled to be completed by May 8, is extended to May 15, the court ordered.

Tamil Nadu is likely to miss the May 31 deadline for PG medical admissions after the Madras High Court on Thursday refused to overturn an order by a single bench that had quashed the government orders (G.O.) relating to the award of incentive marks for in-service candidates.

The vacation bench of Justice V. Bharathidasan and Justice N. Seshasayee asked the State government to approach the Supreme Court for clarifications.

“We are not inclined to interfere in the single judge’s order. When the Supreme Court has clearly set out the guidelines to identify such areas for the purpose of PG medical admissions, how can the High Court interfere?”

The April 18 order had declared as illegal two G.O.s passed on March 9 and 23.

The G.O.s had classified the workplaces of government doctors as remote, difficult or rural in order to award incentive marks for PG admissions.

Justice S. Vaidhyanathan, in his order, found the government’s method of identifying these areas “flawed”.

The petitioners before him had pointed out that despite serving in rural locations, they were not eligible for incentive marks; some who work at district headquarters, on the other hand, were eligible for such marks.

On Thursday, the court agreed with the counsel for the original petitioners, G. Shankaran, that the government had not complied with the Supreme Court guidelines.

“Incentive marks should be given to in-service candidates who sacrificed the comfort of living in a city and served in remote and difficult areas. Not based on number of vacancies or work load,” said the court.

Richardson Wilson, appearing for the candidates who wanted the G.O.s reinstated, argued that government doctors in city limits work 12-18 hours while those in rural areas, sometimes, need to work for only about a couple of hours a day.

He said that such factors were considered by the government.

In a setback to the state’s incentive marks scheme for government doctors aspiring for post-graduate medical admissions, the Madras high court upheld a single order quashing the list of remote and difficult areas eligible for incentive marks.

“When the Supreme Court has clearly set out guidelines to identify such areas for the purpose of PG medical admission, how can the high court interfere,” asked a vacation bench of Justice V Bharathidasan and Justice N Seshasayee on Thursday.

On April 18, a single judge quashed the Tamil Nadu government orders dated March 9 and 23 identifying remote and difficult areas while allowing a batch of petitions filed by MBBS doctors, alleging that the classification had not been made considering geographical parameters. Other contingencies like number of vacancies and work load alone had been considered, they said.

When the appeal came up for hearing on Thursday, the state argued that a committee of experts was constituted for classifying the areas. The committee, after considering all the parameters, identified certain areas as remotefor awarding incentive marks. But, the single judge had failed to consider facts and hence the order must be interfered with, said additional advocate general Manishankar.

Opposing the submissions, G Shankaran, counsel for the original petitioner, said the committee had in fact, failed to follow the guidelines set by the apex court and had not considered the geographical parameters. The bench also observed that the committee had categorised the areas in the perspective of the doctors and not as directed by the apex court.

“Incentive marks should be given to in-service candidates who sacrificed the comfort of living in a city and served in remote and difficult areas. Not based on number of vacancies or work load,” the bench said.

Representing candidates who support the government’s stand, advocate Richardson Wilson submitted that in some places which were in city limits, government doctors worked for more than 12 to 18 hours, but in some rural areas they worked only for a couple of hours. In such cases, the workload of doctors in urban areas must also be considered, he argued. However, the bench said the state must approach the SC for any clarification, since the admission process could not be stalled, as per apex court directive.

Govt calls for applications for PG med courses

After the National Boardof Examination (NBE) announced a revised cutoff for admission to PG courses, thestateselection committee secretary Dr G Selvarajan has called for eligible students, who have not yet applied, to submit their applications by May 3.

The revised percentile eligible candidates must have scored for admission to government medical colleges, state quota of self-financing colleges and Annamalai university general category is between 262 and 320, between 223 and 280 for SC/ST and OBC and between 244 and 299 for the physically challenged. For candidates seeking admission under management quota of self-financing colleges, the cutoff is between 262 and 320 for general category, 225 and 280 for SC/ST and OBC and 244 and 299 for the physically challenged.

For candidates seeking admission to PG dental courses in state-run dental college and Annamalai University, the revised percentile issued by the NBE is between 149 and 233 for the general category, between 115 and 203 for SC/ST/OBC and between 133 and 218 for the physically handicapped.

The revised percentilecutoff for MDS courses under management quota of self-financing dental colleges has been revised as between149 and 233 for general category, 155 and 203 for SC/ST/OBC and between 133 and 218 for the physically handicapped.

Candidates who are yet to apply can submit their downloaded applications with a demand draft for ₹5,000 drawn in favour or the secretary, selection committee, Kilpauk and hand it over in person to the secretary, selection committee, Chennai on or before 5pm on May 3.

 முதுநிலை மருத்துவ மாணவர் சேர்க்கை தொடர்பாக இந்திய மருத்துவக் கவுன்சில் விதிமுறை 9(4), அரசு மருத்துவர்களுக்கு இடஒதுக்கீடு அளிக்கவில்லை. ஊக்க மதிப்பெண் அளிக்கலாம் என்றுதான் தெரிவிக்கிறது. அதுவும் கூட விரைவில் அணுக முடியாத மலைப்பிரதேசங்கள், ஆதிவாசி வாழும் இடங்கள் ஆகியவற்றுக்குத்தான்.
 அரசு மருத்துவர்களுக்கு முதுநிலை மருத்துவ மாணவர் சேர்க்கையில் மாநில அரசுகள் இட ஒதுக்கீடு அளிக்க அனுமதித்தால், மருத்துவர்களின் தரத்தில் சமரசம் செய்ய நேரிடும் என்றும், இந்திய மருத்துவக் கவுன்சிலின் ஒழுங்குமுறை அதிகாரங்களில் அத்துமீறித் தலையிடுவது போல ஆகிவிடும் என்றும் கூறி உச்சநீதிமன்ற அமர்வு தமிழக அரசின் இட ஒதுக்கீடு முடிவை நிராகரித்திருக்கிறது.
 இந்தியாவில் 10,189 பேருக்கு ஓர் அரசு மருத்துவர் என்கிற நிலைதான் காணப்படுகிறது. அதேபோல 90,343 பேருக்கு ஓர் அரசு மருத்துவமனை என்கிற விகிதம்தான் காணப்படுகிறது. இந்தியாவில் 70 கோடி மக்கள் வாழும் கிராமங்களில் 11,054 மருத்துவமனைகள்தான் இருக்கின்றன. இந்தியாவில் நோயாளிகளின் எண்ணிக்கைக்கும், மருத்துவர்களுக்கும் இடையேயான விகிதம் என்பது வியத்நாம், அல்ஜீரியா, பாகிஸ்தான் ஆகிய நாடுகளில் இருப்பதைவிடக் குறைவாகக் காணப்படுகிறது. மருத்துவர்கள் பற்றாக்குறைதான் நாட்டின்சுகாதார நிர்வாகம் எதிர்கொள்ளும் மிகப்பெரிய சவால்.
 130 கோடி மக்கள் தொகை உள்ள இந்தியாவில் 60% மக்கள் ஊரகப் புறங்களில்தான் வாழ்கிறார்கள். அங்கே நோய்வாய்ப்பட்டவர்களுக்கு மருத்துவம் பார்ப்பதற்குப் போதிய மருத்துவர்கள் இல்லாத அவலம் நீண்ட காலமாகவே தொடர்கிறது. தமிழகத்தில் மட்டுமல்ல இந்தியாவின் எல்லா மாநிலங்களிலும் ஊரகப்புறங்களில் குறிப்பாக, வசதி இல்லாத பின்தங்கிய கிராமங்களில் பணிபுரிய மருத்துவர்கள் தயாராக இல்லை.
 மருத்துவ பட்டப்படிப்பை முடித்த பிறகு இளம் மருத்துவர்கள் அரசு மருத்துவமனைகளில் பணிபுரிய ஆர்வம் காட்டுவதற்கான காரணம், அவர்கள் தங்களது அனுபவத்தை அதிகரித்துக் கொள்வதற்காக அல்ல. மருத்துவ மேல்படிப்பு சேர்க்கைக்கு அது கூடுதல் வாய்ப்பை ஏற்படுத்தித் தருகிறது என்பதால்தான்.
 ஏற்கெனவே நடுத்தர வர்க்கத்தினரும், விளிம்பு நிலை மக்களும், அதிகரித்துவிட்ட மருத்துவ செலவினங்களால் பாதிக்கப்பட்டிருக்கும் நிலையில், அரசு மருத்துவமனைகளில் மருத்துவர்கள் இல்லாத நிலைமை ஏற்படுவது மிகப்பெரிய சமூக அநீதி. இதை அரசியல் தலைமை புரிந்து கொண்டிருக்கிறது. மருத்துவக் கவுன்சிலும், நீதிமன்றமும் இதை கணக்கில் எடுத்துக் கொள்ளவில்லை என்பதைத்தான் அரசு மருத்துவர்களுக்கு இட ஒதுக்கீட்டில் மருத்துவ மேல்படிப்புக்கான நுழைவு முறை அகற்றப்படுவது தெரிவிக்கிறது.
 இன்றைய மருத்துவக் கல்வியில் காணப்படும் மிகப்பெரிய குறை மருத்துவ பட்டப்படிப்பு முடிந்த பிறகு பெரும்பாலான மருத்துவர்கள், மருத்துவமனைகளில் பணிபுரியவோ, நோயாளிகளைப் பரிசோதித்து அனுபவம் பெறவோ முற்படுவதில்லை. மருத்துவ மேல்படிப்புக்கான தகுதிகாண் தேர்வுக்குத் தங்களைத் தயார்படுத்திக் கொள்வதில்தான் முனைப்புக் காட்டுகிறார்கள். தகுதிகாண் தேர்வு எழுதி மருத்துவத்தில் முதுநிலை பட்டம் பெற்றாலும் கூட, மருத்துவப் பணிக்குத் தயாராவதில்லை. அடுத்து, சிறப்பு மருத்துவர் ஆவதற்கான படிப்புக்குத் தயாராகிறார்கள். பெரும்பாலான சிறப்பு மருத்துவர்கள் அடிப்படை நோயாளிகள் பரிசோதனை அனுபவம் இல்லாதவர்களாக மருத்துவத் தொழிலில் இருக்கும் நிலைமை நாளுக்கு நாள் அதிகரித்து வருகிறது.
 இப்படிப்பட்ட சூழலில் மருத்துவப் பட்டப்படிப்பு முடித்த மருத்துவர்கள் குறைந்தது மூன்று ஆண்டுகளாவது அரசு மருத்துவமனைகளில், அதிலும் ஊரகப் புறங்களில் பணிபுரிந்தால் மட்டுமே மேற்படிப்புக்குத் தகுதி பெறுவார்கள் என்கிற நிலைமை ஏற்பட்டால்தான் மருத்துவர்களின் தரமும் அதிகரிக்கும், ஊரகப் புற மருத்துவமனைகளில் மருத்துவர்கள் பணிபுரியவும் முற்படுவார்கள். அதை விட்டுவிட்டு தகுதிகாண் தேர்வு மட்டுமே மருத்துவ மேல்படிப்புக்கு அளவுகோல் என்கிற இந்திய மருத்துவ கவுன்சில், உச்சநீதிமன்றத்தின் கருத்து நடைமுறைப்படுத்தப்படுமானால், அடிப்படை நோயாளிகள் பரிசோதனை அனுபவம் இல்லாத வெறும் புத்தகப் புழுக்கள் மட்டும்தான் மருத்துவ மேல்படிப்புக்கும் சிறப்பு மருத்துவத்துக்கும் செல்ல முடியும் என்கிற அபாயத்தை மருத்துவக் கல்வி எதிர்கொள்ளும்.

The Ministry of Health and Family Welfare has reduced the NEET PG and NEET SS cut off percentile by 15%. The decision is likely to benefit about 18000 students as this will improve the chances of filling up PG seats and minimizing wastage of seats. 

Referring to the decision, Shri J P Nadda, Union Minister of Health and Family Welfare stated that all efforts are being made to fill up the PG seats. “This is a significant step towards strengthening medical sector and indicates the priority given by the government to the health sector. We are making sure that there is adequate manpower for providing quality health services,” Shri Nadda added.

நாடு முழுவதும் எம்.டி., எம்.எஸ்., டி.என்.பி., ஆகிய மருத்துவ மேற்படிப்பு, டி.எம்., எம்.சி.எச்., ஆகிய சிறப்பு உயர் மருத்துவ படிப்பு மாணவர் சேர்க்கை ‘நீட்’ தேர்வு மதிப்பெண்கள் அடிப்படையில் நடைபெறுகிறது.இந்த நிலையில், இப்படிப்புகளில் மாணவர் சேர்க்கைக்கான ‘கட்-ஆப்’ மதிப்பெண்களை 15 சதவீதம் குறைத்து மத்திய அரசு சுகாதாரம், குடும்ப நல அமைச்சகம் முடிவு எடுத்து உள்ளது.இது தொடர்பாக வெளியிடப்பட்டு உள்ள அறிக்கையில், “இதன்மூலம் காலி இடங்களை நிரப்புவதில் முன்னேற்றம் ஏற்படும். இடங்கள் வீணாகாமல் தடுக்கப்படும்” என சுட்டிக்காட்டப்பட்டு உள்ளது.

இது குறித்து மத்திய சுகாதார மந்திரி ஜே.பி. நட்டா கூறுகையில், “மருத்துவ துறையை வலுப்படுத்துவதில் இது குறிப்பிடத்தகுந்த ஒரு நடவடிக்கை ஆகும். சுகாதார துறைக்கு அரசு முக்கியத்துவம் அளிப்பதை இது எடுத்துக்காட்டுகிறது. தரமான மருத்துவ சேவைகளை வழங்குவதில் போதுமான மனித சக்தி இருப்பதை நாங்கள் உறுதிப்படுத்துகிறோம்” என குறிப்பிட்டார்.மருத்துவ மேற்படிப்பிலும், சிறப்பு உயர் மருத்துவ படிப்பிலும் ‘கட்-ஆப்’ மதிப்பெண்களில் 15 சதவீதம் குறைத்து இருப்பதின் மூலம் 18 ஆயிரம் பேர் பலன் அடைவர் என தகவல்கள் கூறுகின்றன.

இந்திய மருத்துவ கவுன்சில் விதிமுறைகளின்படியே முதுநிலை மருத்துவ மாணவர் சேர்க்கையை நடத்த வேண்டும் என உச்ச நீதிமன்றம் தீர்ப்பளித்துள்ளது. 

மேலும், முதுநிலை மருத்துவ மாணவர் சேர்க்கையில் அரசு மருத்துவர்களுக்கு 50 சதவீத இட ஒதுக்கீடு அளிக்க தமிழக அரசை அனுமதிக்க வேண்டும் என்ற கோரிக்கையையும் உச்ச நீதிமன்றம் நிராகரித்துள்ளது. 

இந்திய மருத்துவ கவுன்சில் விதிமுறைகளின்படி, அரசு மருத்துவர்களுக்கு முதுநிலை பட்டயப் படிப்புக்கு மட்டும் இட ஒதுக்கீடு அளிக்கப்படுகிறது. பட்டப் படிப்புக்கு இட ஒதுக்கீடு அளிக்கப்படவில்லை. இதையடுத்து, இந்திய மருத்துவ கவுன்சில் விதிமுறைகளை எதிர்த்தும், முதுநிலை மருத்துவ மாணவர் சேர்க்கையில் அரசு மருத்துவர்களுக்கு 50 சதவீத இட ஒதுக்கீடு அளிக்க தமிழக அரசை அனுமதிக்கவும் கோரி தமிழ்நாடு மருத்துவர் அலுவலர் சங்கம் சார்பில் உச்ச நீதிமன்றத்தில் மனு தாக்கல் செய்யப்பட்டது.
இந்த வழக்கின் முக்கியத்துவம் கருதி, அது அரசியல் சாசன அமர்வுக்கு மாற்றப்பட்டது. இதைத் தொடர்ந்து, உச்ச நீதிமன்ற தலைமை நீதிபதி தீபக் மிஸ்ரா, நீதிபதிகள் ஏ.கே. சிக்ரி, ஏ.எம். கான்வில்கர், டி.ஒய். சந்திரசூட், அசோக் பூஷண் ஆகியோர் கொண்ட அரசியல் சாசன அமர்வு முன் கடந்த 18-ஆம் தேதி விசாரணை நடைபெற்றது.

அப்போது, மனுதாரர்கள் சார்பில் முன் வைக்கப்பட்ட வாதத்தில், 'நீட் ' மதிப்பெண் அடிப்படையில் பூர்த்தி செய்யப்படும் அகில இந்திய ஒதுக்கீட்டில் 50 சதவீதமான இடங்களை அரசு, தனியார் மருத்துவமனைகளில் பணிபுரியும் மருத்துவர்களுக்கு மாநிலங்கள் ஒதுக்கீடு செய்து வருகின்றன. ஆனால், இந்திய மருத்துவ கவுன்சில் விதிமுறைகள் மாநிலங்களின் உரிமைகளைப் பறிக்கும் வகையில் உள்ளன. கிராமப்புறங்களில் உள்ள மருத்துவமனைகளில் சிறப்பு மருத்துவர்களின் பற்றாக்குறையைக் கருத்தில் கொண்டு, மாநிலங்கள் அளித்து வரும் இதுபோன்ற இட ஒதுக்கீடு முறையை அனுமதிக்க வேண்டும் எனத் தெரிவிக்கப்பட்டது.

ஆனால், 'முதுநிலை மருத்துவ மாணவர் சேர்க்கையில் அரசு மருத்துவர்களுக்கு ஒதுக்கீடு செய்யும் அதிகாரம் மாநிலங்களுக்கு இருந்தால் அது தரத்தை நீர்த்துப் போகச் செய்யும்' என்று இந்திய மருத்துவ கவுன்சில் தரப்பில் தெரிவிக்கப்பட்டது. இதைத் தொடர்ந்து, மேற்கண்ட மனுக்கள் மீதான தீர்ப்பை தேதி குறிப்பிடாமல் நீதிபதிகள் ஒத்திவைத்தனர்.
தீர்ப்பு: இந்நிலையில், உச்ச நீதிமன்ற தலைமை நீதிபதி தீபக் மிஸ்ரா தலைமையிலான அரசியல் சாசன அமர்வு செவ்வாய்க்கிழமை அளித்த தீர்ப்பு வருமாறு: 

முதுநிலை மருத்துவ மாணவர் சேர்க்கையில் இட ஒதுக்கீடு அளிப்பது தொடர்பான இந்திய மருத்துவ கவுன்சில் விதிமுறைகள் 9(4), (8) ஆகியவற்றுக்கு எதிராக இடைக்கால நிவாரணம் கோரும் மனு தள்ளுபடி செய்யப்படுகிறது. 2007-ஆம் ஆண்டு தொடங்கி அரசு மருத்துவர்களுக்கு முதுநிலை மருத்துவ மாணவர் சேர்க்கையில் 50 சதவீத இடஒதுக்கீட்டை தமிழகம் அளித்து வருகிறது. இதற்கு தடை ஏற்படுத்தக் கூடாது என்ற வாதமும் நிராகரிக்கப்படுகிறது.
முதுநிலை மருத்துவ மாணவர் சேர்க்கை தொடர்பாக இந்திய மருத்துவ கவுன்சிலின் விதிமுறை 9(4) அரசு மருத்துவர்களுக்கு இட ஒதுக்கீடு அளிக்க கூறவில்லை. ஊக்க மதிப்பெண் அளிக்க வேண்டும் என்றே தெரிவிக்கிறது. அரசு மருத்துவர்களுக்கு முதுநிலை மருத்துவக் கல்வியில் சேர்வதற்கு தனியொரு ஏற்பாட்டை பரிந்துரைப்பது மருத்துவக் கல்வியின் தரத்தைப் பாதிக்கும். 

அரசு மருத்துவர்களுக்கு முதுநிலை மருத்துவ மாணவர் சேர்க்கையில் இட ஒதுக்கீடு அளிக்க மாநிலங்களுக்கு அனுமதித்தால் தரத்தில் சமரசம் செய்ய நேரிடும். தற்போதைய நிலையில் விதிமுறை 9(4) -இல் கூடுதல் அர்த்தத்தை தேடினால், இந்திய மருத்துவ கவுன்சிலின் ஒழுங்குமுறை அதிகாரங்களில் அத்துமீறி தலையிடுவது போலாகி விடும். இந்திய மருத்துவ கவுன்சில் விதிமுறைகளில் தெரிவிக்கப்பட்டுள்ள 'இடஒதுக்கீடுகள்' என்ற சொல் தாழ்த்தப்பட்டோர், பழங்குடியினர், சமூக, கல்வியில் பின்தங்கியோருக்கு அளிக்கப்பட்டுள்ள அரசியலமைப்பு இடஒதுக்கீட்டையே குறிக்கிறதே தவிர, அரசு மருத்துவர்களுக்கானது அல்ல. தற்போதைய நிலையில் அளிக்கப்பட்டுள்ள எவ்விதமான இடைக்கால நிவாரணமும், மாணவர் சேர்க்கைக்கான கலந்தாய்வும் இறுதி உத்தரவுக்கு கட்டுப்பட்டதாகும் எனத் தீர்ப்பில் தெரிவிக்கப்பட்டுள்ளது.

திண்டுக்கல்: 'நீட்' தேர்வில் முன்னிலை பெற்றும் மாநில அரசின் கவுன்சிலிங் தாமதத்தால் மருத்துவ மேற்படிப்பு மாணவர்கள் தவிப்பில் உள்ளனர்.முதுநிலை பட்ட மேற்படிப்பில் கிராமப்புறத்தில் பணியாற்றிய டாக்டர்களுக்கான ஒதுக்கீடு வழக்கில் உச்சநீதிமன்றம் அண்மையில், மருத்துவ கவுன்சில் விதிமுறையின்படியே நடத்த வேண்டும்' என தீர்ப்பளித்துள்ளது. இதே போன்று தொலைதுாரத்தில் பணியாற்றும் டாக்டர்களுக்கு' தனி ஒதுக்கீடு வழங்கிய தமிழக அரசின் உத்தரவை சென்னை உயர்நீதிமன்றம் ஏற்க மறுத்து உத்தரவிட்டது. இது அரசுக்கு பின்னடைவாக அமைந்தது. இதில் மேல் முறையீடு செய்ய தமிழக சுகாதாரத்துறை உயரதிகாரிகள் முதன்மை செயலர் ராதாகிருஷ்ணன் தலைமையில் ஆலோசித்து வருகின்றனர். இதனால் மாநில பட்ட மேற்படிப்பு கவுன்சிலிங் தாமதமாகி வருகிறது.இதற்கிடையே 'நீட்' தேர்வில் பங்கேற்று, தரவரிசையில் முன்னிலை பெற்ற தமிழக டாக்டர்கள், பட்ட மேற்படிப்புக்கு அகில இந்திய கவுன்சிலிங் மூலம் வேறு மாநிலங்களில் கிடைத்த படிப்புகளில் அனுமதி பெற்றுள்ளனர். மாநில அரசு கவுன்சிலிங் நடத்தினால் இங்கு, விரும்பிய பிரிவில் 'சீட்' பெற வாய்ப்புள்ளது. அதற்காக கிடைத்த இடங்களில் சேராமல் காத்திருக்கின்றனர். ஆனால் மேல்முறையீடு சிந்தனையால் கவுன்சிலிங் நடத்தாமல் தமிழக அரசு காலம் கடத்தி வருகிறது என அவர்கள் குற்றம்சாட்டுகின்றனர்.

குறிப்பிட்ட காலத்திற்குள் மாநில கவுன்சிலிங் நடத்தாவிட்டால், கிடைத்த வேறு மாநில வாய்ப்பையும் இழக்க நேரிடும் என அந்த மாணவர்கள் குமுறுகின்றனர்.

Supreme Court declines plea for in-service doctors’ quota

Chennai: The state health department won’t be able to hold on to a 50% quota for in-service doctors, with the Supreme Court on Tuesday declined any interim relief to government doctors’ association. The court said admission to postgraduate medical courses should be as per Medical Council of India rules.

However, the state will not be able start the counselling process for at least a week. The selection committee will not release the merit list at least until Thursday, director of medical education Dr A Edwin Joe said.

Justice S Vaidyanathan of the Madras high court had quashed government orders of March 9 and March 23 which notified the department to award incentive marks for in-service candidates from remote or difficult areas. “A detailed order is expected on Thursday. Legal experts have told us that they will be able to offer their opinion on whether we should go on an appeal. If not we may have to issue a fresh order after reclassifying areas,” said Edwin Joe Either of these will take at least a week. Reclassification has to be worked out with data from the Directorate of Medical Education and the Directorate of Medical Services.

Meanwhile, on Tuesday, the Tamil Nadu Medical Officers Association submitted that instead of granting incentive marks to government doctors, serving in remote and difficult rural areas, in PG admissions, the state government should be allowed to continue with its own quota policy. After giving away 50% of its seats to the all India quota, the state reserved 50% of the remaining seats for in-service doctors. “We are unable to accede to the request,” a five-judge constitution bench headed by Chief Justice Dipak Misra said.

The bench, also comprising Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan, said the counselling process for admissions in PG courses would go on as per the MCI regulations and its final verdict will decide the fate of admissions.

Include maternity leave period for award of incentive marks, says Madras High Court

CHENNAI: A Division Bench of the Madras High Court has ruled that the maternity leave period availed of by woman government doctors also should be included as in-service and incentive marks should be extended to them in admission in PG medical courses. “The intention of the government to grant maternity leave and other benefits to protect the interest of the women and the foetus should not be lightly ignored. When the intention is to give the benefits to the women, the same intention should not take away the consequential benefits given to in-service women candidates by way of incentive marks.

Moreover, the object of giving incentive marks is to encourage the doctors who render service in the remote area or hilly area or difficult areas,” a Bench of Justices Huluvadi G Ramesh and M Dhandapani said.The Bench was disposing of a batch of writ petitions from P Sowmya and 25 others seeking to declare clause 9(a)(i) of the prospectus issued by the authorities concerned for selection of candidates for postgraduate degree and diploma courses for 2018-19 session in government medical colleges, government seats in self-financing medical colleges and seats in Rajah Muthiah Medical College (Annamalai University) in Chidambaram as unconstitutional and violative of the fundamental right enshrined under Articles 14, 19 and 21 of the Constitution and consequently, direct them to accept their applications and scrutinise them along with other applications.

Accepting the arguments of senior advocate P Wilson and advocate V Subramanian, the Bench on April 11 said any service rule or clause should satisfy not only the public policy, but also the fundamental right guaranteed under Articles 14, 15 and 21 of the Constitution, as held by the Constitution Bench of Supreme Court in Central Inland Water Transport vs Brojo Nath Ganguly case.“We are, therefore, of the view that the petitioners are entitled to incentive marks and the respondents are directed to take into consideration the period of maternity leave as the service period for the purpose of awarding incentive marks.

“However, the incentive marks shall be calculated for the period of maternity leave, on the basis of the performance of the in-service candidates during their service in the rest of the period,” the Bench said.

The Bench also added that admittedly, the intention of the government to give incentive marks to in-service candidates for their services rendered in remote areas, is a noble one.

NEET PG counseling resumed. High court vacated stay orders

In a high voltage drama, Madras High court vacated its stay orders on NEET PG counseling conducted by MCC in less than 24 hours. Earlier Madras high court issued stay orders on NEET PG counseling while listening to the plea of Inservice candidates of Tamil Nadu state government, Later the stay orders are vacated on 18th April while listening to the plea of Non-government doctors of Tamil Nadu.

MCC further issued the notification to resume the counseling process from where it was left. The notification reads as; Subsequent to the dismissal of Writ Petition 6169 of 2018 of Hon’ble High Court of Madras, the second round Counseling is now resumed. Candidates are now advised to report to the allotted centres for admission procedure.
