Deemed or doomed? HC pulls up Centre, UGC on T varsities

Hyderabad: The Telangana high court on Monday issued notices to the central government's higher education department and the University Grants Commission (UGC) asking them to explain their stand within two weeks on the contentions raised by Telangana over the alleged usurping of the state's powers in matters of higher education and in allowing deemed universities to come up in Telangana without the state's approval.

A bench of Acting Chief Justice Sujoy Paul and Justice Renuka Yara was hearing a writ petition filed by the education secretary and also the commissioner of technical education and collegiate education who challenged the 2023 regulations of the UGC that eliminated the role of the state in matters of issuing essentiality certificates for such deemed universities.

Advocate General A Sudarshan Reddy said that some of these colleges "which look like mulgis (small shops)" were emerging as deemed universities on one hand and, as if this were not enough, these deemed varsities were setting up off-campus centres everywhere in an indiscriminate manner.

"The latest regulations allow nondescript colleges to apply for deemed status, and if the essentiality certificate does not arrive within 60 days, these colleges will automatically get deemed university status," he said.

What happens to the students if these deemed universities close shops overnight? It becomes the state's duty to protect the interests of the students. But the state was not allowed to say whether such a university is essential to come up in a particular area, Sudarshan said.

The bench wondered whether the state counsel was describing these deemed universities as doomed universities and sought to know from the authorities what happens if the state rejects the application within 60 days.

Though Section 20 of the Education Act thrusts responsibility on the state to scan before allowing the establishment of such colleges, let alone universities, the UGC says there is no need for an NOC from the state, the AG said.

Citing the case of KL University, which was recently embroiled in allegations of fraud, the AG said the UGC does not take action against such institutions, and that the state was rendered helpless. "Who will monitor the situation in a global city like Hyderabad where the standards of higher education are required to be on a higher pedestal?" the AG asked while urging the court to scrap regulations which he said were inconsistent with the goal of quality education.

These unfair regulations crept into the UGC through amendments in 2010, 2016, 2019 and 2023, he said, requesting the court to stay them as an interim measure to protect the education field and the reputation of Hyderabad.

The bench sought answers from the UGC and the centre within two weeks.The bench also issued notices to KL University, Aurora Deemed University, Malla Reddy deemed university, Symbiosis, Chaitanya and Vignan deemed universities.

கனமழை எச்சரிக்கை: வடமேற்கு திசையிலிருந்து வெப்பக் காற்றும், மேற்கு திசையிலிருந்து குளிா் காற்றும் தமிழக நிலப்பரப்பு வழியாக வங்கக் கடலை சென்றடைகிறது. இதனால் ஏற்படும் காற்றுக் குவிதல் காரணமாக தமிழகம், புதுச்சேரி மற்றும் காரைக்காலில் செவ்வாய்க்கிழமை (மே 13) முதல் மே 18-ஆம் தேதி வரை இடி, மின்னலுடன் கூடிய மழைக்கு வாய்ப்புள்ளது. இதனால், தமிழகத்தில் அடுத்த சில நாள்களுக்கு அதிகபட்ச வெப்பநிலை சற்று குறையும்.

இதில் குறிப்பாக மே 14-இல், நீலகிரி, கோவை, திருப்பூா், திண்டுக்கல், ஈரோடு, தருமபுரி, கிருஷ்ணகிரி, திருப்பத்தூா், சேலம், திருவண்ணாமலை ஆகிய மாவட்டங்களிலும், மே 15-இல் நீலகிரி, கோவை, ஈரோடு, கிருஷ்ணகிரி, தருமபுரி, திருப்பத்தூா் ஆகிய மாவட்டங்களிலும் கனமழைக்கு வாய்ப்புள்ளது எனத் தெரிவிக்கப்பட்டுள்ளது.

குடும்ப உறவுகளில் சுமுகத் தன்மை நிலவ குடும்ப உறுப்பினா்களிடையே விட்டுக் கொடுத்தல், சகிப்புத் தன்மை, உள் ஒன்று வைத்து புறமொன்று பேசாத வெளிப்படைத்தன்மையைக் கடைபிடித்தல் போன்ற குணாதிசயங்கள் அவசியமாகும்.

குடும்பநல நீதிமன்றங்களில் தொடுக்கப்படும் வழக்குகளின் எண்ணிக்கை ஆண்டுதோறும் அதிகரித்துக் கொண்டு போகிறது. உடன் பிறந்தாருக்கே சொத்துரிமையை சற்றே விட்டுக் கொடுக்க மறுக்கும் மனோபாவத்தால் ஒருவரையொருவா் அழிக்கவும் துணிகின்றனா். இவற்றுக்கு அப்பாற்பட்டு குடும்ப உறவுகளிடையே நல்லுறவைப் பராமரிப்பது நன்கு பக்குவப்பட்ட மனநிலை கொண்டவா்களுக்கே சாத்தியமாகும்.

நம்மால் பேசப்படாத வாா்த்தைகளுக்கு நாம் எஜமானா். நம்மால் பேசப்பட்ட வாா்த்தைகள் நமக்கு எஜமானா் என்பதை உணா்ந்தாலே எதையும் பேசுவதற்கு ஒரு முறைக்கு இரு முறை பல முறை யோசிக்கத் தோன்றும். துரதிா்ஷ்டவசமாக, நம்மில் பலா் தெரிந்தே சாத்தியமில்லாத வாக்குறுதிகளை அள்ளிவீசுவதும் பின்னா் அதற்காக பெயரளவில் வருத்தம் தெரிவிப்பதும் மிகச் சாதாரணமாகி விட்டது.

மன மகிழ்ச்சியான குடும்பத்துக்கு, குடும்பத்தில் உள்ள உறுப்பினா்கள் அனைவரின் மனநலனும் இன்றியமையாதது. இன்றைய காலகட்டத்தில் பெரும்பாலான அச்சு, மின்னணு ஊடகங்களில் வெளியாகும் செய்திகளில் குடும்பங்களில் நிலவும் சச்சரவுகள் அதன் காரணமாக நடைபெறும் கொலைச் சம்பவங்களையே பிரதானமாகப் பாா்க்க முடிகிறது. ‘மனத்துக்கண் மாசிலன் ஆதல் ; அனைத்தறன் ஆகுல நீர பிற ’ என்கிற திருக்குறள், மனதில் தீய எண்ணங்கள் இல்லாதிருத்தலே எல்லா அறங்களையும் பெற்றதற்கு நிகா் என்கிறது. ஆனால், மனதை மாசடையச் செய்யும் புறக்காரணிகள் நிறைந்த சூழலில் நாம் வாழும் நிலையில் உள்ளோம். இப்புறக் காரணிகளுள் தொடா் நாடகங்களை ஒளிபரப்பும் சில தனியாா் தொலைக்காட்சி சேனல்களும் இருப்பதுதான் வேதனை.

பெண்களைக் கவரும் வகையில் ஒளிபரப்பப்படும் இத்தொடா் நாடகங்களில், முதன்மை கதபாத்திரமாக வரும் பெண்களைத் தவிர, இதர கதாபாத்திரங்கள் குறிப்பாக பெண்கள் கொடூரமானவா்களாக சித்தரிக்கப்படுகின்றனா். மேலும், குடும்ப உறுப்பினா்களே ஒருவரை ஒருவா் வசை பாடுவது, பழி தீா்க்க திட்டமிடுவது, அடியாள்களை ஏவி ஆள்கடத்தல் செய்வது, போதைப் பொருள் பயன்படுத்துவது போன்ற சமூக விரோதச் செயல்களில் ஈடுபடும் காட்சிகள் இத்தொடா் நாடகங்களில் மிகச் சாதாரணமாக இடம் பெறுகின்றன. பல லட்சம் மக்களின் பொழுதுபோக்கு அம்சமாக சின்னத்திரை தொடா் நாடகங்களின் மூலம் ஒளிபரப்பப்படும் தணிக்கைச் செய்யப்படாத குடும்ப நல்லுறவின் புனிதத்தை தரமிழக்க செய்யும் காட்சிகளால், மக்களின் மனநிலை மாசுபடும் வாய்ப்புகள் உண்டு.

எனவே, சின்னத்திரை தொடா் நாடகங்கள் தணிக்கை செய்யப்பட வேண்டும் என்று கோரி சென்னை உயா்நீதி மன்ற மதுரை கிளையில் பொது நல வழக்கு தொடரப்பட்டுள்ளது. இவ்வழக்கை விசாரணைக்கு ஏற்ற சென்னை உயா்நீதிமன்ற மதுரைக் கிளை, இது தொடா்பாக பதிளிக்குமாறு, மத்திய அரசின் தொலைத் தொடா்பு ஒழுங்குமுறை ஆணையத்துக்கு உத்தரவிட்டுள்ளது.

கேரள மாநிலத்தில் கோட்டயம், திருவனந்தபுரம், மலப்புரம் ஆகிய மாவட்டங்களில் அம்மாநில மகளிா் ஆணையம் சின்னத்திரையில் ஒளிபரப்பாகும் தொடா் நாடகங்கள் பற்றிய நடத்திய ஆய்வில், தற்போது ஒளிபரப்பாகும் சின்னத்திரை தொடா் நாடகங்கள் ஒளிபரப்பில் சமூகத்தில் எதிா்மறையான விளைவுகளை ஏற்படுத்தும் காட்சிகள் இல்லாத வகையில் உரிய மாற்றங்களைக் கொண்டு வர வேண்டும் என 57 சதவீதம் போ் தெரிவித்துள்ளனா். 43 சதவீதம் போ் சின்னத்திரை தொடா் நாடகங்கள் மக்களிடையே தவறான கருத்துகளையே பரப்புவதாகத் தெரிவித்துள்ளனா். இதனடிப்படையில் சின்னதிரையில் ஒளிபரப்பப்படும் தொடா் நாடகங்களின் எண்ணிக்கையை கட்டுப்படுத்த வேண்டும் என்றும், திரைப்பட குழுவோ அல்லது தனியாக ஓா் தணிக்கைக் குழு அமைத்தோ சின்னத்திரை தொடா் நாடகங்கள் தணிக்கை செய்யப்பட வேண்டும் என மாநில அரசுக்கு அம்மாநில மகளிா் ஆணையம் சிபாரிசு செய்துள்ளது.

தேசிய மனநல ஆய்வு வெளியிட்டுள்ள அறிக்கையில் - லண்டன் கிங்ஸ் கல்லூரியை சோ்ந்த ஆராய்ச்சியாளா் டாக்டா் நாக்மே நிக்கெஸ்லட் வெளியிட்டுள்ள அறிக்கையில், இந்தியாவில் 20 நபரில் ஒருவா் மன அழுத்தத்துக்கு உள்ளாகி இருப்பதாகத் தெரிய வருகிறது. உலக அளவில் சுமாா் 26.4 கோடி மக்கள் மன அழுத்தத்தால் பாதிக்கப்பட்டுள்ளனா் எனத் தெரிவித்துள்ளாா்.

சக உறவுகள் உச்சரிக்கும் பண்படாத, மனதைப் புண்படுத்தும் வாா்த்தைகள், வரவுக்கு மிஞ்சிய ஆடம்பரச் செலவுகளால் குடும்பத்தில் ஏற்படும் நிதி நெருக்கடி, பணியிடங்களில் உள்ள அதிகப்படியான வேலைப்பளு, உடல் நலச் சீா்கேடு ஆகியன மன அழுத்தத்தை ஏற்படுத்தும் சில காரணிகளாகும். மனஅழுத்தத்தால் பாதிக்கப்பட்டவா்களில் பலா், தமது மன அழுத்தம் குறித்தான விழிப்புணா்வு இல்லாதிருக்கின்றனா். சிலா் நடைபயிற்சி, உடற்பயிற்சி கூடங்களுக்குச் செல்லுதல் ஆகியவற்றின் மூலம் தம் உடல் நலத்துக்கு அளிக்கும் முக்கியத்துவத்தை மனநலத்துக்கு அளிப்பதில்லை.

The Supreme Court on Friday dismissed a Public Interest Litigation filed by a person seeking to direct the State of Tamil Nadu to implement the National Education Policy (2020) including its 'three-language formula'.

A bench comprising Justice JB Pardiwala and Justice R Mahadevan observed that the Court cannot issue any direction under Article 32 of the Constitution to compel any State to adopt the NEP.

Dismissing the petition filed by one GS Mani, the Court said : "Whether the States should adopt the National Education Policy 2020 or not is a vexed issue. The Supreme Court, through Article 32 of the Constitution, can issue directives to ensure that the rights of the citizens are protected. It cannot directly compel a State to adopt a policy like the National Education Policy 2020.

The Court may, however, intervene if a State's action or inaction related to the National Education Policy violates any fundamental rights. We do not propose to examine this issue in this writ petition. We believe that the petitioner has nothing to do with the cause he proposes to espouse. Although he may be from the State of Tamil Nadu, yet on his own admission, he is residing in New Delhi. In such circumstances, this petition stands dismissed."

The bench also added that the "main issue may be examined by the Court in an appropriate proceeding." As soon as the matter was taken, the bench asked the petitioner, who was appearing in person, "Who are you? How are you concerned with the National Education Policy?".

The petitioner, saying that he is from Tamil Nadu and is now settled in Delhi, said that because of "this kind of policy" (Tamil Nadu schools not teaching Hindi), he could not learn Hindi easily.

"Then learn Hindi now in Delhi, na?" Justice Pardiwala told the petitioner. Tamil Nadu Chief Minister MK Stalin recently said that the NEP 2020 will not be implemented in the State, saying that its three-language formula was an attempt to impose Hindi.

Rail passenger suffers head injury as middle berth collapses on her

A woman passenger suffered a head injury after the middle berth of a sleeper class coach fell while she was asleep. The incident happened on Train No. 22651 Chennai-Palakkad Express shortly after it crossed Jolarpet early on Monday. The victim’s husband alleged that first aid was not provided by the railway authorities for more than an hour until the train reached Salem where an ambulance was arranged.

According to railway sources, Suria Murugan, 39, of Chennai, was sleeping on berth no. 1 (lower berth) when the unoccupied middle berth suddenly fell on her around 1.15 a.m. Other passengers alerted her husband Jyothi Jayashankar who was sleeping in another coach. On seeing Ms. Suria bleeding with a head injury, he sought medical assistance from the Travelling Ticket Examiner (TTE) and other railway employees on the train. “There was no first aid kit in the train. They did not even provide a cotton roll. The TTE said we could get down at the next stop [Morappur] and seek help there. But what can we do at an unknown place in the middle of the night? My wife managed to control the bleeding with a piece of cloth and we travelled for almost an hour-and-a-half so far as Salem,” Mr. Jayashankar told The Hindu.

Taken to hospital

On arrival at Salem around 2.40 a.m., the ambulance paramedics did basic dressing and shifted Ms. Suria to the Government Hospital. “We later took an autorickshaw and went to a private hospital. My wife had a deep cut on the forehead and underwent sutures. There was no assistance from the Railways. It is shocking that a train with about 1,000 passengers does not have even paramedics or a first aid box,” he said.

Railway sources said the chain and locking mechanism of the middle berth was found to be normal when inspected at Dindigul Junction. The coach was allowed to run through the service without any change.

Southern Railway spokesperson M. Senthamil Selvan said the “berth may have fallen owing to improper locking of the berth hook by the passenger”. The coach was 19 years old and fit for operation. A total of 154 ICF-designed rakes were operational in the zone, and a complete migration to LHB rakes would happen in three years, he said.

On Monday evening, the Chief Public Relations Officer said medical assistance was promptly arranged by the commercial and medical control staff, but the passenger refused to disembark at Morappur. “The unfortunate incident appears to have occurred owing to the passenger’s improper handling of the chain link, which is the designated locking mechanism for the middle berth,” the CPRO said.

Show cause notices to 34 med colleges over faculty shortage, data deficiencies Docs: Will Be Impossibe To Fill Vacancies

Chennai : National Medical Council has issued showcause notices to 34 of Tamil Nadu’s 36 govt medical colleges, excluding Madras Medical College and Govt Coimbatore Medical College and Hospital, asking them to explain deficiencies in faculty and services, labs and surgeries. Shortage of staff in up to 95% of the departments, including general medicine, general surgery, orthopaedics, and dermatology, due to existing vacancies, was among the most common deficiencies quoted in the notice.

For instance, 19 of 20 departments in Govt Chengalpet Medical College were found deficient in faculty/resident/tutor as per AEBAS record data in departments from anatomy to radiodiagnosis.

At Govt Kilpauk Medical College and Hospital, 8 of 20 departments reported inadequacy in faculty members. While both these colleges had inadequate data in pathology reports, the first didn’t conduct any “emergency surgery” as per data uploaded on NMC portal.

The May 7 showcause notices, from undergraduate medical education board director Sukh Lal Meena, seek written clarification within a week from each of the deans . “In case the opportunity provided is not availed, it will be presumed the college doesn’t have any clarification to furnish, and no further opportunity will be given, and a decision as deemed fit shall be taken by the UGMEB.”

Provision of Maintenance of Standard of Medical Education Regulation, 2023 chapter III-clause 8 allows the board to impose a penalty of up to ₹1 crore on medical institutions, it said. As per the regulation notified on Sept 19, 2023, institutions must submit annual disclosure reports in the prescribed mode. On Nov 1, 2024, and April 25, all colleges permitted to admit MBBS students were directed to fill in details/ data on the NMC portal for annual declaration, including total faculty, inpatient and outpatient details, and number of surgeries.

The show cause notices were sent based on reports from experts nominated. Director of medical education Dr J Sangumani said vacancies in assistant professor, associate professor, and professor posts are being filled through counselling. “Most will join in a couple of days. We are hoping to send a letter to NMC stating we have filled all vacancies.”

Doctors’ bodies said it will be impossible to fill vacancies which arose in the last three years due to a lack of timely counselling and promotions. In 2024, TN govt doctors association said there were at least 30% vacancies in doctors’ positions across govt hospitals. On Monday, Service Doctors and Post Graduates Association said counselling for 2023 batch was just over. “We still have counselling for two more years. Vacancies will exist until counselling is over. Also, govt has failed to increase staff strength as per the requirement of NMC,” said state organising secretary Dr A Ramalingam.
