The government has made Aadhaar authentication of taxpayers mandatory for claiming Goods and Services Tax (GST) refund.

The Central Board of Indirect Taxes and Customs (CBIC) has amended GST rules bringing in various anti-evasion measures, including disbursal of refunds only in the bank account which is linked with the same PAN on which GST registration has been obtained.

The notification also states that from January 1, 2022 businesses that have defaulted in filing summary return and paying monthly GST will not be able to file GSTR-1 sales return of the succeeding month.

The notification follows the decisions taken at the GST Council meeting on September 17. PTI

இந்திய தபால் மற்றும் பரிவர்த்தனை வங்கியின் நிர்வாக இயக்குனரும், தலைமை செயல் அதிகாரியுமான வெங்கட்ராமு வெளியிட்டு உள்ள அறிக்கை: இந்திய தனித்துவ அடையாள ஆணையம் சார்பில் அனைவருக்கும் தனிப்பட்ட எண் உடைய ஆதார் அடையாள அட்டை வழங்கப்பட்டு உள்ளது.இதற்காக மக்கள் தங்கள் 'மொபைல் போன்' எண்ணை, ஆணையத்தில் பதிவு செய்துள்ளனர்.

இந்த எண்ணை எளிதாக புதுப்பிக்க, இந்திய தனித்துவ அடையாள ஆணையத்துடன் இணைந்து, இந்திய தபால் மற்றும் பரிவர்த்தனை வங்கி ஏற்பாடு செய்துள்ளது.இதன்படி ஆதார் அட்டைக்கான மொபைல் எண்ணை, மக்கள் வீடுகளில் இருந்தபடி தபால்காரர் வாயிலாக புதுப்பித்துக்கொள்ளலாம்.

நாட்டில் 650 இந்திய தபால் பரிவர்த்தனை வங்கிகள் வாயிலாக 1.46 லட்சம் தபால்காரர்கள் மற்றும் கிராம தபால் சேவகர்கள் இந்த சேவையை பொதுமக்களுக்கு வழங்குவர்.இவ்வாறு அதில் கூறப்பட்டு உள்ளது.

Driving licence holders and vehicle owners would need to get Aadhaar authentication to avail 16 types of online and contactless services and avoid the hassles of visiting offices of transport departments. These include obtaining learner's licence, renewal of DL, changes of address and certificate of registration, issue of international driving licence, notice of transfer and application for transfer of ownership of vehicle. According to a draft “order” by the road transport ministry, “Any individual desirous of availing various contactless services through the portal is required to undergo Aadhaar authentication. ”

This voluntary Aadhaar authentication will help the government to weed out fake documents and more than one driving licences held by individuals, which are big deterrents to road safety in India.

Another official said considering that people are opting more for contactless or online services they are hopeful of this becoming popular. The state government would be asked to make this initiative popular among people. TNN

CHENNAI: With the Centre making FASTag, an electronic toll collection system, mandatory for all four-wheelers running on National Highways (NH) toll plazas from January 1, motorists who are yet to get Aadhaar, which is a prerequisite for getting the FASTag, are expected to be penalised heavily. Although the Supreme Court ordered that Aadhaar should be made compulsory only for availing benefits from the government, union government has made it mandatory for purchasing the FASTag ID. 

Activists rued that motorists who did not have Aadhaar or not willing to share their Aadhaar will be put through hardship for using national highways. To this effect, the Ministry of Road Transport and Highways issued a notification in November, amending the Central Motor Vehicles Rules, 1989. To get FASTag, motorists had to submit a copy of Aadhaar, vehicle registration certification, bank account, and mobile number. 

Representatives of FASTag suppliers said, “For filling the electronic KYC (Know Your Customer) form in ‘myfastag’ application, Aadhaar is mandatory. Without getting validated through Aadhaar, the FASTag account will not get linked with bank account, which will allow the user to recharge the amount.”Retired IAS officer MG Devasagayam, who was one of the petitioners of the case in Supreme Court against linking Aadhaar with bank accounts said making it compulsory was illegal, unconstitutional, and amounted to contempt of court.

“The apex court clearly said Aadhaar should always be optional unless the person was a beneficiary of the government scheme. The High Courts and Supreme Court should exercise their powers when the judicial orders are disobeyed blatantly.” Aimed at reducing cash handling at the toll gate, the e-payment system was introduced in tollgates maintained by National Highway Authority of India (NHAI) since December 15 last year. The NHAI said non-FASTag vehicles would be charged double the user fee.

Following a stiff resistance from a section of truck owners, NHAI converted 25 per cent of the lands into hybrid lanes, enabling user fee payment through cash, and FASTag in 13 out of 48 tollgates in the State. In May, the hybrid lanes in 13 tollgates were made FASTag lanes. However, one lane on the extreme left in each toll was allowed for making cash. Chennai-based consumer activist T Sadagopan wondered why one’s private credentials are required for using toll roads. “The personal data captured in Aadhaar are sensitive in nature. Senior citizens are vulnerable as their data could be misused. People have the right to say ‘no’ to sharing their personal details. There is no transparency and NHAI is following unfair trade practices in selling FASTags.

The Ministry’s notification said transports will not be able to renew fitness certificates without installing FASTags. The notification also stated that, to acquire third-party insurance for a vehicle, FASTag will become a requirement from April 1, 2021. Despite repeated attempts, NHAI officials could not be reached for comments.

'ஆதார்' அட்டையில் திருத்தம் மற்றும் புதிய தகவல்களைச் சேர்க்க இந்த மையங்களைப் பயன்படுத்த, அனுமதி வழங்கப்பட்டு உள்ளது. பொதுமக்கள் கூறுகையில், 'ஊரடங்கையொட்டி, மத்திய அரசு,விவசாயிகளுக்கு இந்த நிதியாண்டுக்கான முதல் கட்ட ஊக்கத்தொகையான, 2,000 ரூபாயை முன்கூட்டியே வழங்கியுள்ளது. விவசாயிகளின்'ஆதார்' தகவல்களுடன், நிலம் உள்ளிட்ட ஆவணத் தகவல்கள் முரண்பட்டிருந்தால், இத்தொகை கிடைப்பதில்லை. இதற்கு 'ஆதார்' அட்டையில் திருத்தம் அவசியமாகிறது.

ஆதார் எண்ணுடன் பான் கார்டை இணைக்க வேண்டியது கட்டாயம் ஆக்கப்பட்டிருக்கிறது. வருமானவரி தாக்கல் செய்வது, வருமானவரி பிடித்தம் திரும்பப் பெறுவது போன்றவற்றுக்கு இது இன்றியமையாத தேவையாக உள்ளது. ஆதார் எண் இணைக்கப்படாத பான் கார்டு ரத்து செய்யப்படும்.

இந்நிலையில், தேவையில்லாத சிக்கல்களைத் தவிர்க்க ஆதார் எண்ணுடன் பான் கார்டு வைத்திருக்கும் அனைவரும் இணைப்பது கட்டாயம் என தெரிவிக்கப்பட்டுள்ளது.

இதுதொடர்பாக வருமான வரித்துறை வெளியிட்டுள்ள அறிவிப்பில், மார்ச் 31 ஆம் தேதிக்குள் ஆதார் எண்ணுடன் இணைக்கப்படாத வருமான வரித்துறையின் பான் கார்டுகள் செல்லாது.

இந்தியாவில் சுமார் 31 கோடி பான் கார்டுகள் ஏற்கெனவே ஆதார் எண்ணுடன் இணைக்கப்பட்டுள்ளன. மேலும் 18 கோடி பான் கார்டுகள் இணைக்கப்பட உள்ளன என தெரிவித்துள்ளது.

ஆதாருடன் பான் கார்டை இணைப்பதற்கான காலக்கெடு பலமுறை நீட்டிக்கப்பட்டு தற்போது மார்ச் 31 ஆம் தேதி கடைசி நாளாக அறிவித்துள்ளது. மார்ச் 31-க்குள் இணைக்கப்படவில்லை என்றால், பான் எண் முடங்கும் வாய்ப்புகள் உள்ளன.

CHENNAI: Aadhaar may no longer be used a proof of relationships and hence not useful for crucial purposes like obtaining legal heir certificates.

The Unique Identification Authority of India (UIDAI), the overarching body for Aadhaar, has modified the fields like 'S/O' or 'W/O' in the Aadhaar ID cards and made it as 'C/O'. This means that the other  person is merely treated as part of the address, not of the relationship.

The changes have come to light after a few people applied recently for corrections in Aadhaar found that the column to have changed in the Aadhaar card as 'C/O'.

T Sadagopan, a resident of Pattabiram, found that in the card issued after an address correction, his father was mentioned merely as 'C/O', though his father is living in a different address.

When he filed an RTI application to UIDAI seeking clarification, the reply given by the authority was, "The Aadhaar is issued on the basis of bio-metric and demographic information of the individual and no relationship is ascertained in r/o S/O, D/O, W/O etc., the relationship filed have been modified to C/O for enrollment as well for update in Aadhaar."

The decision will affect those who lack other documents and depend on the Aadhaar for important purposes like obtaining legal heir certificates and birth/death certificates.

Poor migrants, especially, will be at a disadvantage since many of them do not have other documents and enrolled for Aadhaar with the hope of using it for multiple purposes. The central government had publicised Aadhaar as an identity which any common man can use.

In fact, in September, the Tamil Nadu revenue department issued a circular listing Aadhaar as one of the acceptable proofs for issuing legal heir certificates. Legal heir certificate is required for the inheritance of property and other important statutory matters.

Since the state government has still not changed its circular, those having old Aadhaar card with the relationship status mentioned can use it for the purposes.

But those getting Aadhaar card hereafter or making changes in details will not be able to use it for such purposes since the relationship will no longer be mentioned.

“While all the other documents including driving licence have got the fathers/husband’s name, why UIDAI alone removing the relationship title? Do the government has any plans of demanding medical tests to include parent relationship?” asked Sadagopan, who is also president of the Tamil Nadu Progressive Consumers' Centre.

When asked for her comments, legal researcher and activist Usha Ramanathan, said, it was interesting that the UIDAI has explained that the relationships were not verified.

"Yet, the form has columns for the father's name and mother's name, and that is not verified either. Truth is, nothing in the UID system is verified. So this effort seems to be to provide standardisation while taking as little responsibility for the information in the database as possible. They are constantly making changes in the process and the diluting any merit that the document may have had," she said.

She highlighted how Aadhaar was not considered as a proof of citizenship in the National Register of Citizens.

A recent amendment in the Prevention of Money Laundering (Maintenance of Records) Rules
also allowed people to use an address different from that in UID system by just submitting a self-declaration.

"So, the address has also become redundant even under the law for preventing money laundering. Thing is, they are only interested in the UID number. That is to become ubiquitous so that people can be tracked. They don't really care about any of the other information. Thing is, this was never an ID for people. It was a number to track people. And standardising databases help that," she said.

On the other hand, the changes may make it difficult for people when dealing with several statutory matters.

Advocate VS Suresh Souli said, “Invariably, all the courts ask accused persons or those who sign surety to furnish Aadhaar and its used verify the father’s name. When Aadhaar is made mandatory for availing many benefits and filling the income tax, the additional information in the document should not be removed even though it is only meant for identity proof. Such a crucial document should have multiple purposes."

The Unique Identification Authority of India (UIDAI) has said its systems will be ready within three months to issue Aadhaar cards to NRIs with Indian passports without the mandatory 180- day waiting period, as announced in the Budget.

The legal measures would be notified soon, UIDAI CEO Ajay Bhushan Pandey said.

“We are working to make the appropriate technological changes and we will provide an appointment facility where people outside the country also can apply for a time slot and specify the place they would like to go to get their Aadhaar made... as soon as they come to India they can, very conveniently, go and get their Aadhaar made,” Mr. Pandey said.

Sources privy to the development said a notification by the IT Ministry was awaited.

The UIDAI — which has made operational two more Aadhaar Seva Kendras (ASKs) in Bhopal and Chennai after the fourth centre in Hisar was launched recently — is confident of meeting its target of opening 114 such centres in the coming months at an estimated cost of ₹300-₹400 crore to facilitate enrolment, updation and other activities.

The first Aadhaar Seva Kendra (ASK) in Tamil Nadu has become operational in Koyambedu in . The ASK is set up by the Unique Identification Authority of India (UIDAI) to extend Aadhaar-related services to the general public.

With a capacity to handle 1,000 requests a day, the ASK would charge ₹50 for updates in Aadhaar details and in case of fresh enrolment, it is free of cost. Except for Tuesday, ASK functions through the week between 9.30 a.m. and 6 p.m. The ASK is functioning from Ten Square Mall on Jawaharlal Nehru Road in Koyambedu.

By using the link https://appointments.uidai.gov.in/bookappointment.aspx, citizens could either make fresh enrolments or update details in the existing Aadhaar entries online. Through an OTP sent to the mobile number, prior appointments could be made.

A citizen gets a token for their Aadhaar-related work and then moves to a ‘verifier’ for document checking. Once the verification is completed, the resident moves to ‘cash counter’ for payment of ₹50 (charges for Aadhaar update, if required) and is then assigned an ‘operator counter’ from the 16 operator work stations, according to the UIDAI.

The UIDAI has plans to set up a total of 114 ASK in 53 cities across the country.

இதுதொடர்பாக உச்சநீதிமன்றத்தில், சமூக ஆர்வலர்கள் வழக்கு தொடர்ந்தனர். இந்த வழக்கை விசாரித்த உச்ச நீதிமன்ற அரசியல் சாசன அமர்வு கடந்த ஆண்டு செப்டம்பர் மாகம் 26 ஆம் தேதி வழங்கிய தீர்ப்பில், தனியார் நிறுவனங்கள் ஆதார் எண் கட்டாயப்படுத்தக் கூடாது என தீர்ப்பளித்து. முக்கியமாக குடிமக்களுக்கான அடிப்படை உரிமைகள் ஆதார் எண் இல்லை என்பதற்காக மறுக்கக் கூடாது, வங்கிக் கணக்குகள் தொடங்குவதற்கு, செல் போன் சிம் கார்டு வாங்குவதற்கு ஆதார் அவசியமில்லை என்றும், கல்வி என்பது ஒவ்வொருவரின் அடிப்படை உரிமை என்பதால், சிபிஎஸ்இ, நீட் தேர்வு மற்றும் பள்ளியில் மாணவர் சேர்க்கைபோன்ற எந்தவொரு செயலுக்கும் ஆதார் கட்டாயமாகக் கூடாது என உத்தரவளித்தது.

மேலும், குழந்தைகளுக்கு ஆதார் எண் கட்டாயம் எனவும், ஆதார் சட்டத்தில் சில திருத்தங்களை கொண்டு வரவும் உச்ச நீதிமன்றம் தீர்ப்பில் தெரிவித்திருந்தது.

இதனிடையே, வங்கி கணக்கு மற்றும் செல்போன் இணைப்பு (சிம் கார்டு) பெறும்போது ஆதார் எண்ணை இணைப்பதற்கு மீண்டும் சட்ட அங்கீகாரம் அளிக்க மத்திய அரசு முடிவு செய்தது. இதற்காக டெலிகிராப் சட்டத்திலும், சட்டவிரோத பண பரிமாற்ற தடை சட்டத்திலும் திருத்தங்கள் கொண்டுவர பிரதமர் நரேந்திர மோடி தலைமையில் நடந்த மத்திய அமைச்சரவை கூட்டத்தில் ஒப்புதல் அளிக்கப்பட்டது.

இந்நிலையில், வங்கி கணக்கு மற்றும் செல்போன் இணைப்பு (சிம் கார்டு) பெறும்போது ஆதார் எண்ணை இணைப்பது கட்டாயம் என்ற அவசர சட்டத்துக்கு குடியரசுத் தலைவர் ராம்நாத் கோவிந்த் ஒப்புதல் அளித்துள்ளார்.

இதன்படி, சிம்கார்டு பெறவும், வங்கி கணக்கு தொடங்கவும் கட்டாயம் ஆதார் எண்ணை அளிக்க வேண்டும் என்பது குறிப்பிடத்தக்கது.

Aadhaar to be voluntary for mobiles, bank a/cs

The government on Monday decided to move amendments to at least three laws to allow voluntary use of Aadhaar for getting a mobile connection or opening bank accounts. At the same time, consumers will have the option to use any other identity or address proof for availing of these services.

The Union cabinet has proposed amendments to The Telegraph Act, Prevention of Money Laundering Act (PMLA) and the Aadhaar Act in what was described as a move to provide convenience to individuals who were willing to share their details. The amendments will once again open the doors for e- KYC, a biometric authentication facility for those who are open to share their Aadhaar details.

The plan will also help telecom companies, banks and financial technology firms, which were worried about massive paperwork after the Supreme Court ordered that Aadhaar could not be mandatory for services other than direct benefit transfer, social welfare schemes or issuing of permanent account number (PAN) by the income tax department. The apex court had said the provision in the law had no legal backing, though it had held constitutional validity of Aadhaar for the distribution of statesponsored welfare subsidies.

The amendments proposed by the government also include aprovision that gives a child the option to withdraw her Aadhaar details and thereby ask the Unique Authority of India (UIDAI) to strike down all the details from its servers once she turns 18. This will mean the UIDAI will have to delete all the data, including biometrics of the person who withdraws from the scheme.

“The amendments will enable use of Aadhaar in state’s interest and it will also ensure privacy of Aadhaar information,” said an official, adding that the changes are in compliance with the SC order. Sources said the government has also accepted some of the recommendations of Justice Srikrishna Committee along with the SC ruling and is proposing to penalize those who do not comply with the norms related to deletion of details or denial of service.

Conceptualized under the previous UPA regime in 2009, the extraordinary Aadhaar programme provides for giving every resident a biometric ID by assigning a unique 12-digit identification number after collecting their biometric data and photographs.

‘Disruption caused by the unique identity number led to 25 deaths’

adhaar is hurtling us towards a Black Mirror dystopia with even children not being spared from the unique identity project, Reetika Khera, Associate Professor, IIM-Ahmedabad, said.

“Children don’t understand what this is...the government doesn’t seem to understand the concept of consent. Now, because of the Supreme Court order, there is a possibility of the government implementing it properly,” Dr. Khera said, delivering the T.G. Narayanan Memorial Lecture 2018 on ‘Aadhaar, Welfare and the Media’, at the Asian College of Journalism on Monday.

Dr. Khera said there have been around 25 deaths related to disruption caused by Aadhaar. Explaining the various schemes, she said the concept of corruption being diminished due to Aadhaar was more of rhetoric.

“In 2008, the Central government made it mandatory for wages to be paid into bank and post office accounts. In National Rural Employment Guarantee Act, 2005, the dramatic reduction in wages corruption is because of separation of the implementing agency and the payment agency.” she added. “As with PDS, the decline in corruption in NREGA pre-dates Aadhaar-integration”, she said.

Nightmarish experience

On the issue of making Aadhaar mandatory for children to avail of mid-day meals at school, she said the onus should be put on teachers and the school administration, who are inflating student figures to siphon off funds. The government should investigate them rather than putting the children to hardship, she added.

Dr. Khera said the process of linking of Aadhaar to various schemes, and especially to the PDS for the poor has been nightmarish. “There are many cases where the poor beneficiaries are either too old to walk, or ill, to go to an enrolment centre to get their Aadhaar linked, and the gram level officials are too stretched with work in every direction,” she said.

“Aadhaar has done very little role to fix corruption. You could still go to your ration shop and end up getting lesser quantity of ration than what you are entitled to.

“The corruption continues as before. Aadhaar is pain without gain,” Dr. Khera said.

CHENNAI : For the last five years, Prema Venkatesan has not been able to avail provident fund benefits from her office or apply for a bank loan as she does not have an Aadhaar card. But the reason for not having Aadhaar card is an unusual case of mix-up of bio-metric data between two family members — a clear case of administrative error.

Prema Venkatesan, a resident of Maduravoyal, has been unable to procure an Aadhaar ever since she and her family of four approached the local corporation office around October 2013 for issue of Aadhaar cards for all. Two months later, though all her family members got their respective cards, she did not get hers.

After multiple vain attempts to get an Aadhaar card, finally in 2018, she got to know the reason behind this. Officials at the e-Sevai centre at Alapakkam taluk office informed Prema that her fingerprints were wrongly imposed in the Aadhaar card issued to her father-in-law. “As I don’t have an Aadhaar card, I cannot collect my PF for which `500 was deducted every month for a period of three years I worked in a pharmaceutical company,” said 36-year-old Prema.


In March 2018, her father-in-law R Pavadai got a new Aadhaar card but Prema still didn’t receive hers. Even after five years, she is still unable to get an Aadhaar since her fingerprints have already been matched with another number. “Officials in the taluk office told us that first, they would cancel my father-in-law’s Aadhaar and after that, both will get new cards. Though he got his, I don’t have mine. In the name of Pavadai R, we have two cards now,” she said.

Further, the Aadhaar card issued for Pavadai in in 2014 has January 1, 1935 as his date of birth while the new card states his date of birth as September 12, 1946. Due to the goof-up, he stopped getting `1,000 as pension under the state government’s senior citizens pension scheme that he had been receiving since 2012. “After he got the new card, we have to apply once again to avail pension. For this, we need to visit the Ambattur taluk office. He is too old to travel. So we never applied for pension again,” said Prema.

Prema had re-applied for card thrice using Pavadai’s old Aadhaar number as her enrolment ID. As that also proved futile, she applied for a fresh card close to 10 times in the last five years. Two days ago when she called an Aadhaar helpline, an official from Bangalore asked her to write to them with the relevant documents and said it took one to two years for her to get a new card. “The official didn’t accept that it was the government’s mistake and instead blamed us for the mix-up of data. We have been running from pillar to post to rectify this but officials offer no help. Till she gets an Aadhaar card, no company is willing to offer her a job,” said Venkatesan P, Prema’s husband.

Owner of a local xerox shop in Maduravoyal had alerted an activist about Prema’s problem who, in turn, immediately informed officials through UIDAI’s official Facebook page about this. When Express contacted an official from UIDAI, he said, “An Aadhaar number must have been generated. If not, it will not appear as a duplicate. Seven years ago, we had many errors in the Aadhaar system but in the last two years, we have rectified the entire process. It is not possible for the lady’s fingertip to appear under her relative’s name. Using the enrolment ID, we can find out if a card was generated in the first place or not.”
