Central employees cannot move HC without approaching CAT, says HC

CHENNAI: The Madras high court has made it clear that employees of public sector undertaking or similar institutions defined as workmen under the provisions of the Industrial Disputes Act, cannot approach the high court directly without approaching the Central Administrative Tribunal (CAT).

Justice T Raja passed the order while dismissing a plea moved by D Inbavalli, an employee of State Bank of India (SBI), challenging the show cause notice issued to her. It was alleged that the petitioner, while serving as a special assistant in the bank's Koyambedu branch, was involved in misappropriation of Rs 1,000 belonging to a customer. Based on a complaint, the administration issued a charge memo on May 10, 2012.

Noting that the plea is not maintainable for various reasons, the judge said, "Firstly, the petition is not maintainable, for the simple reason that the petitioner being a workman under section 2(s) of the Act, has to approach the CAT, Chennai by rising a dispute after final order is passed by the employer.

That stage has not yet come. Secondly, CAT in the event of entertaining the industrial dispute, could go into the correctness of the charges, the fairness of enquiry and the quantum of punishment, if any, imposed on the petitioner. That stage also has not yet reached. Thirdly, the issuance of second show cause notice indicating the proposed punishment having been dispensed with by the Constitution (42nd Amendment) Act, 1976, the writ petition is not maintainable under Article 226 of the Constitution of India."

We are fully prepared for rain, says Tamil Nadu government

Chennai: Amid allegation from the opposition about poor monsoon preparedness, the state government on Wednesday said it was fully prepared to meet any exigencies that may arise due to heavy rains and resultant flooding. The government said that 33,612 water bodies owned by the public works department and that of local bodies across the state, had been de-silted so far much ahead of the monsoon. Incidentally, the state fixed a target of over 45,000 water bodies under the kudimaramathu, the traditional maintenance scheme with the support of local community.

"The water bodies could retain 1.75tmcft (thousand million cubic feet of water). As many as 22,538 channels and inlets too have been de-silted, besides eviction of 7,030 encroachments in water bodies to ensure free flow of water," K Satyagopal, commissioner of revenue administration and disaster management said. Thrust has been given to remove blockages beneath bridges and culverts to ensure road connectivity undisrupted during rains. "We are fully prepared from the district collector to the officials at the field-level. Action is taken on a war-footing manner," he added.

The inter-departmental zonal teams have been set up in all the districts for undertaking relief measures at the earliest, the officer said. The team comprising members of police, fire service, rural development, agriculture and municipal administration will be closely monitoring situation and exigencies arising out of heavy rains. "Since the coastal districts are receiving heavy rains, the focus has been on them," another official said. Going by the legacy data, the state government identified 4,399 areas depending on vulnerability last year. These areas, including 207 identified this year, have been linked to nearby relief centres for timely evacuation of affected people.

Separate teams have also been deployed in relief centres to render necessary assistance. Ensuring community participation in the rescue and relief operations, 23,325 volunteers have been roped in and given training this year. This includes 6,740 women and fishermen. "In addition, we have four teams of National Disaster Response Force and another 1,200 personnel trained exclusively in State Disaster Response Force for rescue measures," Satyagopal said. The state has not requested pre-positioning of NDRF teams still, but monitoring the developments with the regional meteorology department, Chennai. Chief secretary Girija Vaidyanathan took stock of the situation at a high-level meeting with line departments and defence recently at Secretariat and "directed better coordination among all."

Chennai rain: City schools to remain closed on Thursday, more showers forecast

CHENNAI: Schools in Chennai district will remain closed for the third consecutive day on Thursday as more showers are forecast. The district collector declared the holiday for schools.

According to the India Meteorological Department, rain is likely to occur in most parts of south Tamil Nadu, north coastal Tamil Nadu and Puducherry and in a few places in north interior Tamil Nadu and on Thursday.

Chennai didn't receive heavy rain on Wednesday. However, it was drizzling in the city almost throughout the day.

Schools in Chennai, Kancheepuram and Tiruvallur districts remained closed for the second consecutive day on Wednesday. While several colleges were closed in Chennai on Tuesday, most institutions continued to function as semester examinations are ongoing on many campuses.

Many school grounds and campuses were inundated with water following rain on Monday and Tuesday night. The school education department has instructed schools to ensure that campuses are kept clean and stagnated water drained out.

A committee of health department and education department officials will be carrying out inspections on the campuses to check on the cleanliness level.

Sri Ranganathaswamy Temple in Srirangam bags Unesco award

TRICHY: The Sri Ranganathaswamy Temple in Srirangam has bagged an Award of Merit from Unescofor conserving cultural heritage.

The temple got the international recognition for the Rs 20crore beautification and renovation work taken up prior to a consecration ceremony in 2015, without affecting its centuries' old heritage.

Temple authorities said they received a communique from Unesco on Tuesday mentioning that the temple has been selected for the award. The Sri Ranganathaswamy Temple is the first temple in Tamil Nadu to receive a Unesco award, according to them.

There were 43 applications from 10 countries for the 2017 Unesco Asia-Pacific Awards for Cultural Heritage Conservation. The Sri Ranganathaswamy Temple is the only religious centre in south India to bag award this year. Mumbai's Christ Church and Royal Bombay Opera House were the other monuments in India that received the Award of Merit this year.

The awards are classified under four categories -- Award of Excellence, Awards of Distinction, Awards of Merit and Award for New Design in Heritage Context. The awards are being given to encourage the efforts of all stakeholders and the public in conserving and promoting the monuments and religious institutes with rich heritage in the Asia-Pacific region.

A jury comprising nine international heritage conservation experts reviewed the development and conservation work taken up by the Sri Ranganathaswamy Temple management.

Mudichur let down by politics, bureaucracy

CHENNAI: Why does it flood in Mudichur is not a relevant question anymore. Rather, what to do when it floods is what the Tamil Nadu government must answer. But on the ground, the government appears as clueless as it was in 2015.

On Wednesday, the third day of monsoon, the area recorded only 4cm of rainfall, yet the Mudichur Main Road resembled a water channel. When the water levels rose on one side of the road, the state highways department which maintains the road, broke the median and then some parts of the road for the water to flow out of the area.

It not only affected vehicular movement but also it became risky for two-wheeler riders to navigate the stretch. The Mudichur Road has been a slush track as the road was not relaid after Chennai Metrowater finished laying pipelines recently. With the highways breaking the road, loose gravel started peeling off under the force of flowing water.

According to Peter J, a resident, the highways department's incomplete storm water drains were complicating the situation. S R Raja, Tambaram MLA (DMK), said the work order was issued more than 18 months ago. He alleged the contractor illegally sublet the work to an unqualified person, resulting in poor construction quality. "Even if the drain is complete, Mudichur will still be flooded. Because the drain's capacity is small," said Raja, a point echoed by Tambaram municipality officials as well.

After the highways' workers broke the median, water gushed into the neighbouring residential locality of Mullai Nagar and Pandian Nagar. In minutes, the localities were submerged in 2ft water. This also resulted in a skirmish between residents, one of whom had encroached upon poramboke land blocking rainwater flow, said Shanthi, a resident.

"The municipality officials are in cohorts with the encroacher," she added. With the cops as mute spectators, the alleged encroacher engaged in fisticuffs with another person. Locals protested against the police inaction and staged a road roko affecting traffic for a short duration.

As the action unfolded, in neighbouring Varadarajapuram, rural industries minister P Benjamin was spotted posing for photographs. After two days of hip-deep water, the administration was alerted to Varadarajapuram residents' plight early on Wednesday.

Workers were engaged to desilt the flood carriers, again raising question about the monsoon preparedness. No sooner had the minister's convoy left, the workers followed suit leaving the job that they come to do unfinished.

மன்னார்குடி-சென்னை எக்ஸ்பிரஸ் ரெயில் திருவாரூர் வழியாக இயக்கப்படும் என்ற அறிவிப்பினை ரெயில்வே துறை வெளியிட்டது. இதற்காக முயற்சி செய்த நாகை டாக்டர் கே.கோபால் எம்.பி.க்கும், ரெயில்வே நிர்வாகத்திற்கும் பாராட்டு விழா நடந்தது. விழாவிற்கு திருவாரூர் விஜயபுரம் வர்த்தக சங்க தலைவர் பாலமுருகன் தலைமை தாங்கினார். விழாவில் நாகை டாக்டர் கே.கோபால் எம்.பி. கலந்து கொண்டு பேசினார். அப்போது அவர் கூறியதாவது:-

இந்த பணிகளை துரிதப்படுத்திட ரெயில்வே அமைச்சரிடம் வலியுறுத்தப்பட்டுள்ளது. எனவே விரைவில் பணி முடிந்து ரெயில் போக்குவரத்து தொடங்கும். திருவாரூர் மற்றும் நாகை பகுதிகளுக்கு சில ரெயில்கள் நீட்டிப்பு செய்யப்படுவதற்கான முயற்சிகள் எடுக்கப்பட்டு வருகிறது. அதே போல தஞ்சாவூர்-நாகை தேசிய நெடுஞ்சாலை பணிகளை விரைந்து முடித்திடவும் மத்திய அரசிடம் வலியுறுத்தப்பட்டுள்ளது.

சென்னை புறநகர் பகுதிகளான கிண்டி, ஆலந்தூர், ஆதம்பாக்கம், பரங்கிமலை, மடிப்பாக்கம், பள்ளிக்கரணை, துரைப்பாக்கம், பெரும்பாக்கம், மேடவாக்கம் புழுதிவாக்கம், வேளச்சேரி, கீழ்க்கட்டளை உள்ளிட்ட பல பகுதிகளில் நேற்று முன்தினம் காலை முதல் நள்ளிரவு வரை பலத்த மழை கொட்டியது. இதனால் இந்த பகுதிகளில் உள்ள குடியிருப்புகளில் மழைநீர் சூழ்ந்தது.

ஆலந்தூரில் உள்ள சாலைகளில் மழைநீர் தேங்கி இருந்ததால் பொதுமக்கள் பாதிக்கப்பட்டனர். மடிப்பாக்கம்–புழுதிவாக்கம் ராம்நகர் வடக்கு பகுதியில் உள்ள 10–க்கும் மேற்பட்ட பகுதிகளில் உள்ள தெருக்களில் முழங்கால் அளவுக்கு மழைநீர் தேங்கி உள்ளது. இந்த பகுதிகளில் உள்ள மழைநீர் கால்வாய்கள் சரியாக தூர்வாரப்படாததால் தண்ணீர் செல்ல வழியின்றி கழிவு நீருடன் தேக்கம் அடைந்துள்ளது.

ஒரே நாளில் பெய்த மழையிலேயே முழங்கால் அளவுக்கு தண்ணீர் தேங்கி இருப்பதால் மீண்டும் மழை பெய்தால் வீடுகளை விட்டு வெளியேறக்கூடிய நிலை ஏற்படும் என்ற அச்சத்தில் இருப்பதாகவும், மாநகராட்சி அதிகாரிகள் விரைந்து வந்து தண்ணீரை அகற்றி நிரந்தரமாக வடிகால்வாய்களை அமைக்க வேண்டும் என அப்பகுதியினர் கோரிக்கை விடுத்தனர்.

வேளச்சேரி பாரதி நகர், உதயம் நகர் போன்ற பகுதிகளிலும் மழைநீர் முழங்கால் அளவுக்கு தேங்கி இருந்ததால் பொதுமக்கள் வீடுகளில் இருந்து வெளியே வரமுடியாத நிலை ஏற்பட்டது. கீழ்கட்டளை காசிவிஸ்வநாதபுரம் பகுதியில் வீடுகளை மழைநீர் சூழ்ந்தது. கோவிலம்பாக்கம் என்ஜீனியர்ஸ் அவென்யூ பகுதியில் உள்ள ஓடை தூர் வாரப்படாததால் மழைநீர் வீடுகளுக்குள் புகுந்தது.

கிண்டி கத்திப்பாரா மேம்பாலத்தின் கீழ் உள்ள சுரங்கப்பாதை வழியாக போரூர், வடபழனி போன்ற பகுதிகளுக்கு வாகனங்கள் சென்று வருகின்றன. ஆனால் இந்த சுரங்கப்பாதை மழைநீரினால் குளம்போல் நிரம்பியதால் போக்குவரத்து துண்டிக்கப்பட்டுள்ளது. இதனால் வேலைக்கு செல்வோர் என அனைவரும் கடுமையாக பாதிக்கப்பட்டனர்.

மின்மோட்டார் மூலம் அங்கு இருக்கும் தண்ணீரை அகற்ற நெடுஞ்சாலை துறையினர் நடவடிக்கை எடுத்து வருகின்றனர். கால்வாய்களில் ஏற்பட்டுள்ள அடைப்புகள் அகற்றப்படாததே மழைநீர் தேங்குவதற்கு காரணம் என்று பொதுமக்கள் குற்றம்சாட்டினார்.
