CHENNAI: The Madras High Court has stayed the operation of a GO, dated June 14 last, of the Housing and Urban Development department secretary, directing that all buildings of educational institutions constructed prior to January 1, 2011 in a non-plan area must apply for concurrence to the Directorate of Town and Country Planning (DTCP).

Justice S S Sundar granted the injunction while passing interim orders on a petition from the All India Private Educational Institutions Association, by its State general secretary K Palaniyappan of Saligramam, on Friday.

The main prayer of the petitioner is to declare the June 14 GO and the consequential order dated June 25 of the School Education secretary as illegal and unconstitutional and inconsistent with the legislative domain conferred under Articles 243 (g), 243 (w), 243ZD read with Article 40 of the Constitution.

According to petitioner, most of the educational institutions, which were functioning in non-plan area, had applied to the local body for planning permission and got them approved. The government, however, at a later stage started issuing lock & seal notices to all member institutions of the petitioner association, by invoking sections 56 and 57 of the TN Town and Country Planning Act.

All the consequential actions of government were challenged before the HC and on various occasions, the court had settled the legal proposition that a planning permission issued by a competent authority cannot be said to be invalid, unless otherwise it is cancelled or revised in a manner known to law.

Following this, the proceedings invoked under the TN Town and Country Planning Act were set aside in all the cases.

While so, the government now in an indirect manner has issued the impugned June 14 GO stating that the buildings of the educational institutions constructed prior to January 1, 2011 in non- plan areas must apply for concurrence to the Directorate of Town and Country Planning.

CHENNAI: An eight-storeyed Institute of Rheumatology building constructed at the cost of Rs 23 crore with public money has been lying idle at the Rajiv Gandhi Government General Hospital for two years due to shortage of staff and pending works.

The Department of Rheumatology was upgraded as an Institute of Rheumatology on July 18, 2015. Then, Director and Head of Rheumatology Institute Dr S Rajeshwari got a sanction for a separate building containing ground plus seven floors and the government sanctioned Rs 23 crore for the construction. Though the building was completed in one year, it is yet to be made functional.

Speaking to Express, an official said, “The Public Works Department sent a proposal for sanction of transformer for power supply for the building and it is pending”. “Additional funds of Rs 3 crore is needed for transformer, and the file is pending with the government,” said another source.

The irony is that the Institute doesn’t have sufficient faculty for two years. “There is no Rheumatology professor. Now, a professor, who is the Director of General Medicine, has been appointed as director-in-charge of Institute of Rheumatology,” said a senior doctor.

Patients from across Tamil Nadu come here for the treatment, but due to staff shortage, the doctors couldn’t handle the cases. “The department has become dysfunctional. The government has sanctioned crores of funds for construction of the building, but hasn’t fill up vacancies,” said the doctor.
The Institute also has four DM Rheumatology seats. “During an Medical Council of India inspection, the government will show Assistant Professors as Associate Professors and get the seats sanctioned,” another source said.

Dr A Edwin Joe, Director of Medical Educations, said “We are now working on the vacancies in all departments. Once we complete that work, we can come out with the actual shortage. We will also look at the Rheumatology department,” he added.

BENGALURU:A 31-year-old pregnant woman left her husband and eight-year-old son after they ate chicken biryani at their house in Kammagondanahalli in Gangammanagudi police station limits. On Thursday, she called her family from her native to inform she would never come back.

The woman is Anitha Sarkar, a native of Sathna in Madhya Pradesh and her husband Raju, a technician had approached Ganagammanagudi police last Wednesday.

A senior police officer said the complainant Raju alleged that on August 28, he had brought home some chicken biryani from a nearby hotel for dinner and ate it along with his little son Adarsha. After noticing that, Anitha picked a quarrel with Raju and warned that she did not like the smell of chicken inside her home and she would now never cook in that kitchen again. In the early hours, she left home and her son and husband went in search of her.

As he did not find her anywhere, he came to Gangammanagudi police station and informed the police about the incident. However, on Thursday morning, she called her husband over phone and informed him that she was at her parents’ house in Sathna in Madhya Pradesh, and disconnected the call without saying anything further. Raju then informed to the police.

The couple had come to Bengaluru eight years ago. Raju hails from West Bengal.They were residing in a rented house at Abbigere. Reportedly, Raju had told her before they got married that he would never eat non-vegetarian food as he did not like its smell. But the August 28 incident made her livid and left the house without informing anyone.

CHENNAI: When it comes to pursuing Masters of Philosophy programmes in Tamil Nadu, women are way ahead of their male counterparts. According to a survey released by the All India Survey of Higher Education (AISHE) 2017-18, of the 17,179 students across the state, 12,755 are females and 4424 are males.

A total of 34,34,781 students are enrolled in various higher education programmes including PhD, M Phil Post Graduate Under Graduate, PG Diploma, Diploma, Certificate and Integrated courses in Tamil Nadu. Meanwhile, more than half of all students pursuing Masters of Philosophy in India and a third of all students enrolled for PhD are from Tamil Nadu.

Contrary to the nation-wide data that shows lesser women pursue higher education, there is a greater female enrolment for most high education programmes. The survey reveals that the number of women pursuing MPhil in Tamil Nadu is thrice as much as men, and in case of PhD, the number of enrolled male and female students are almost equal.

A total of 34,34,781 students are enrolled in various higher education programmes including PhD, MPhil, Under Graduate, PG Diploma, Diploma, Certificate and Integrated courses in Tamil Nadu. Of the 17,179 students enrolled in various M Phil programmes across the State, 12,755 are female and 4,424 are males.

There are multiple reasons for why M Phil is on high demand in the State explain experts. TN allows colleges to conduct M Phil programmes, as opposed to many states that allow only the course only on university campuses.

“We have a large number of liberal arts and science colleges that offer MPhil programmes. This one year course offers a cushion period for students to decide whether they want to get employed or dive into research,” said P Duraisamy, the Vice Chancellor of University of Madras.

Enrolment of women in government aided MPhil is much higher in aided colleges, in particular, said Alexander Jesudasan, principal of Madras Christian College. Commenting on significantly lower enrolment of men, he said, “Males are often under pressure to take up employment after Masters. So they do not take up one year courses that do not drastically improve their chance of getting a job.” He added that female students use the one year programme to prepare for competitive exams.

The gender ratio is however inverted when it comes to enrolment in diploma courses. Only about 17 per cent of the 3,87,706 candidates enrolled in diploma courses are women.

Duraisamy said that this data shows the role of welfare schemes in promoting female enrolment. “Most diploma colleges are run by private institutions where government aid is lesser. Further diploma courses are cut out for employment rather than education for knowledge propagation alone. Incentives for women are lesser therefore,” he said.

When it comes to PhD programmes, of nearly 30,000 students pursuing PhD in the State, 16,200 are males and 13,500 are female. Tamil Nadu has the second highest enrolment after Delhi, the data shows. About 32,000 students are pursuing PhD in Delhi. At the post graduate level, there are twice as many students as male students. Out of the 4.4 lakh students pursuing masters 2.6 lakh (60 per cent) are women.

Though TN has a good enrolment rate for higher education, providing employment for students is becoming more and more tedious, observed MK Surappa, Vice Chancellor of Anna University. “Women should get involved more in long-term research and indulge in start-ups,” he said.

மனம் பழையவற்றை வசந்தகாலமாக எண்ணிப் பார்க்கும் விசித்திரம் கொண்டது. சிலநேரங்களில் விடு பட்டவைகூட மகிழ்ச்சியானதாக தோன் றும். விடுதலையானவன் சிறைச்சாலையைக் கடக்கும்போது சோகப்படுவதுபோன்ற ஒருவித மயக்கம் அது. சமூக அளவில் இந்த 50 ஆண்டுகளில் எத்தனையோ விரும்பத்தக்க மாற்றங்கள் நிகழ்ந்திருக் கின்றன. கல்லூரியில் கிராம முகாம் சென்றபோது, அங்கிருந்த தேநீர் கடைகளில் இரட்டைக் குவளைகள் இருப்பதைப் பார்த்து வேதனைப் பட்டோம். ஒருவரை ‘ஒதுக்கிவைக்கப்பட்டவர்’ எனக் குத்திக் காட்டு வதற்கு அதனினும் வேறு முத்திரை இல்லை. இன்று எல்லா இடங் களிலும் காகிதக் குவளைகள் அந்த அவலத்தை அறவே நீக்கி விட்டன. மனிதர்கள் செய்ய முடியாததை தொழில்நுட்பம் சாதித்துவிட்டது.

இந்திய ஆட்சிப் பணி என்பது கனவாக இருந்த காலம் மாறி எண்ணற்ற சிற்றூர்களில் இருந்து தமிழில் படித்தவர்கள் எழுதித் தேர்ச்சி பெற்று இந்தியாவெங்கும் உயர்ந்த பணிகளில் உட்கார்ந்திருப்பதைப் பார்க்கிறோம். மாதிரித் தாள்கள் எப்படி இருக்கும் என்று அறிந்து கொள்ள சென்னையில் ஒரு வாரம் தங்கியிருந்து நடையாக நடந்து அவற்றைப் பெற்ற அனுபவம் எனக்கு உண்டு.

இன்று விரலைச் சொடுக்கினால் விவரங்கள் குவியல் குவியலாக வந்துவிழும் இணைய வசதி. அரிய புத்தகங்களை எளிதில் பெறும் வசதி. உலகின் எந்த மூலையில் கிடைக்கும் புத்தகத்தையும் கணினியில் பதிவிறக்கம் செய்து விடலாம். அறிவு ஒரு சாராருக்கே சொந்தம் என்பதை அடித்து ஒடித்த விஞ்ஞான முன்னேற்றம். எந்த நாட்டுக்கும் ஒரு விநாடியில் மின்னஞ்சல் அனுப்ப முடியும் என்ற அதிவேக தகவல் பரிமாற்ற வசதி.

நிறைய குழந்தைகள் பெரிய வயிற்றுடன். வெளிறிய முகத்துடன். குழி விழுந்த கண்களுடன் போஷாக்குக் குறைவுடன் இருந்த நிலை மாறி இன்று ‘ஊளைச் சதையை குறைப்பது எப்படி?’ என்கிற கவலையில் பெற்றோர். அன்று கோழிமுட்டை என்பது ஒரு சில கடைகளில் இரும்புக் கூடையில் உறியில் தொங்கும் அபூர்வ வஸ்து. பால் காலையில் மட்டுமே கிடைக்கும் அரிய பண்டமாக இருந்த நிலை மாறி, 24 மணி நேரமும் பாக்கெட்டில் வாங்கி வரும் பொருள்.

வதவதவென பிள்ளைகளைப் பெறுவது வாடிக்கையாக இருந்தது. பெண்கள் உடல்நலம் குறைந்து, ஆண்கள் கவலைகள் நிறைந்து அப்போதெல்லாம் கதைகளில் ‘40 வயதுப் பெரியவர்’ என்று எழுதும் வழக்கம் இருந்தது. இன்று 60 வயது நிறைந்தவர்களும் 20 வயதுபோல இருக்க முனைகிறார்கள். வயது என்கிற வரையறை இன்று எடுபடுவதில்லை.

எங்கு பார்த்தாலும் ஓலைக் குடிசைகள் இருந்த சிற்றூர்கள் இன்று மெல்ல மெல்ல மாறி வருகின்றன. அப்போது ஓட்டு வீடு அரிது. மாடி வீட்டை கல்வீடு என்று அழைப்பார்கள். இன்று பல வீடுகள் மச்சு வீடுகளாக மாறி வருகின்றன. அரசு கட்டித் தரும் வீடுகளும், மானியத்தால் உருவாக்கப்படும் இல்லங்களும் நிமிர்ந்து நிற்கின்றன. அன்று வசதியுள்ளவர் உபயோகித்த ஆடைகளை வாங்கி அணிந்து கொள்ள சிலர் ஆயத்தமாக இருந்தார்கள். இன்று பழைய துணிகளை யாரும் பெற விருப்பமாக இல்லை.

இன்றைய தலைமுறை சென்ற தலைமுறையைவிட உயரமாகிக்கொண்டிருக்கிறது. ஊட்டச்சத்துக்கள், புரதம் போன்றவை தாராளமாகக் கிடைப்பதும் இதற்குக் காரணம். தெளிவான முகமும், தோற்றப் பொலிவும் அனைவருக்கும் சாத்தியமாகும் நிலை உருவாகிக்கொண்டு வருகிறது. பலரது முகத்தில் படித்த களையும், கற்றறிந்த தேஜசும் காணப்படுகின்றன. கல்லூரிக் கல்வி ஒரு சில ருக்கு மட்டுமே என்பது மாறி மேனிலைப் பள்ளி களாக மூலைமுடுக்குகளிலெல்லாம் கிடைக்க ஆரம்பித்திருக்கிறது. பொறியியல் படிப்பு சிற்றூர்களிலும் கிடைக்கிறது. பள்ளிப் பக்கமே எட்டிப் பார்க்காத குடும்பங்களில் மருத்துவமும், பொறியியலும் சாத்தியமாகியிருக்கின்றன.

வாழ்க்கைத் தரம் உயர்ந்திருக்கிறது. வாங்கும் திறன் அதிகரித்திருக்கிறது. பஞ்சம், பட்டினி ஆகியவற்றின் தாக்கம் குறைந்திருக்கிறது. சோப்புகூட ஆடம்பரப் பொருள் என்று நிதிநிலை அறிக்கையில் அறிவிக்கப்பட்ட காலம் ஒன்று உண்டு. இன்று சின்னச்சின்ன ஊர்களிலும் உடல் தூய்மையை உறுதிசெய்யும் பொருட்கள் சின்னப் பொட்டலங்களாக கண் சிமிட்டி மின்னுகின்றன. ஊருக்கு ஓர் ஆங்கிலப் பள்ளி என்றிருந்த நிலை மாறி திரும்பிய பக்கமெல்லாம் ‘ஆங்கிலவழி படிப்பு’ என்று அந்நிய மொழியில் படிப்பது இப்போது சர்வசகஜமாகிவிட்டது. ஆனால், தமிழும் சரியாகப் படிக்கத் தெரியாமல் ஆங்கிலமும் முறையாக பேசத் தெரியாமல் ஆற்றில் ஒரு கால், சேற்றில் ஒரு காலாய்த் தடுமாறும் தலைமுறை ஒன்று உருவாகியிருக்கிறது.

இன்று சமூக விழிப்புணர்வு அதிகரித்திருக்கிறது. திரைத் துறையினரும் நடிப்பு மட்டுமே வாழ்வு என நினைக்காமல் மக்களின் நாடித் துடிப்புகளையும் அறிந்து களத்தில் இறங்கிப் போராடுகிறார்கள்.

ஆனால் இவற்றையெல்லாம் தாண்டி எதையோ தொலைத்த உணர்வு எங்கள் தலைமுறையில் அனைவருக்கும் இருக்கிறது. அந்த இனம்புரியாத சோகத்தை எப்படி ஆற்றுவது என்று புரியாமல் அடிக்கடி பழைய நினைவுகளில் மூழ்கி மகிழ்ச்சியாக இருந்த காலங்களை மனத்தால் வருடிப் பார்க்கின் றோம்.

பிள்ளைகளுக்கு எல்லாம் வாங்கித் தந்தும் அவர்கள் மகிழ்ச்சியாக இருப்பது போன்று தோன்ற வில்லை. ஆனால் அன்று எதுவுமே யாரும் வாங்கித் தராமலேயே நாங்கள் மகிழ்ச்சியாக இருந்த உணர்வு. இன்று வீட்டில் பொருட்களெல்லாம் குவிந்தும் ஒருவித வெறுமை. உறுப்பினர்கள் நிறைந்தும் ஒருவிதத் தனிமை.

மிகுந்த பாதுகாப்பான வாழ்க்கைக்கு நடுவில் ஏதோ பயம் ஊஞ்சலாடுகிறது. தூங்கி எழும்போது பொழுதை ரசித்துக்கொண்டு எழுபவர்கள் குறைவு. எதுவும் இல்லாதபோது இருந்த சுதந்தரம் எல்லாம் இருக்கும்போது பறிபோனதைப் போன்ற பரிதாபம்.

நம் உறவுகளையும், உரிமைகளையும் யாரோ வழிப்பறி செய்ததைப்போன்ற எண் ணம். ஏதோ ஒன்று குறைகிற மாதிரியே எப்போதும் இருக்கிறது. சுவர்கள் பலமாக இருந்தாலும் இதயம் பலவீனமாக இருக்கிறது.

நாகையில் கல்லார் தர்காவில் கந்தூரி விழாவின்போது அங்கு இருக்கும் இஸ்லாமிய நண்பர்கள் அக்கரைப் பேட்டை நைனியப்ப நாட்டாரை `அப்பா’ என்று அழைப்பதைப் பார்த்து பூரித்துப் போயிருக்கிறேன். சின்ன வயதில் எங்கள் வீட்டுக்கு அருகில் இருக்கும் சுபான் பாயும், விக்டர் குடும்பமும் அண்ணன், தம்பிகளாக உறவு வைத்து அழைத்துப் பழகியது நினைவுக்கு வந்தது. இப்போது அக்கம்பக்கங்களில் ஏனோ கண்ணுக்குத் தெரியாத இமயத் தடுப்புகள் பிரி வினைகளின் பெயரால் எல்லா இடங் களிலும் விரவிக் கிடப்பதைப் போன்ற வேதனை.

புதிய புதிய சந்திப்புகளில் பழைய உறவுகளையும், நட்புகளையும் தொலைத்துக்கொண்டே இருக்கிறோம். எல்லாம் மேம்போக்காக இருக்கும் பழக்கத்தில் மையத்தைத் தவற விடுகி றோம்.

இழந்தவற்றை நினைவுபடுத்த எப்போதும் இல்லாத அளவு எல்லா இடங்களிலும் பழைய மாணவர்கள் சந்திப்பு. அங்கு வழியிலேயே இடறி விழுந்தவர்கள் நினைவில் இதயம் வலிக்கிறது.

ஓய்வுக்குப் பிறகு சகோதர சகோதரிகள் ஒரே இடத்தில் ஒன்றாய்த் தங்க முடியாதா! செலவைப் பிரித்து உணவைப் பகிர்ந்து உயிரை நீட்டிக்க முடியாதா! ஒரே சமையலறையில் உள்ளங்கள் ஒன்றாக மாலையில் பழங்கதைகள் பேசி களித்திருக்க இயலாதா! அதிக நாட்கள் முடியாவிட்டாலும் ஆண்டுக்கு ஒருமுறை ஒரு வாரமாவது ஒன்றாய்க் கூடி மகிழலாமே!

அப்போது அந்தப் பொற்காலம் திரும்பலாம்.

அன்பின் ஆதிக்கம் அனைத்து சுயநலங்களையும் ஒதுக்கித் தள்ளிவிட்டு எழும்பி நிற்கும் காலம்தானே பொற்காலமாக இருக்க முடியும்!

ராஜீவ் காந்தி கொலை வழக்கில் கைதான முருகன், சாந்தன், நளினி, பேரறிவாளன், ராபர்ட் பயாஸ், ரவிச்சந்திரன், ஜெயக்குமார் ஆகிய 7 பேரும் ஆயுள் தண்டனை கைதிகளாக சிறையில் அடைக்கப்பட்டு உள்ளனர்.

27 ஆண்டுகளாக சிறையில் வாடும் அவர்களை விடுதலை செய்ய முடிவு செய்த தமிழக அரசு அதற்காக மத்திய அரசின் அனுமதியை கோரியது. ஆனால் அதற்கு அனுமதி வழங்க மறுத்த மத்திய அரசு, 7 பேரையும் விடுதலை செய்வதற்கு எதிராக சுப்ரீம் கோர்ட்டில் வழக்கு தொடர்ந்தது.

இந்த வழக்கு நேற்று முன்தினம் நீதிபதிகள் ரஞ்சன் கோகாய், நவீன் சின்கா, கே.என்.ஜோசப் ஆகியோர் அடங்கிய அமர்வு முன்பு மீண்டும் விசாரணைக்கு வந்தது. அப்போது இரு தரப்பு வாதங்களையும் கேட்ட நீதிபதிகள், அரசியல் சாசன பிரிவு 161-ன் கீழ் தமிழக அரசு, 7 பேரையும் விடுதலை செய்வது தொடர்பாக ஒரு முடிவை எடுத்து கவர்னரின் பரிசீலனைக்கு அனுப்பி வைக்கலாம் என்று அறிவுறுத்தினார்கள்.

அத்துடன், சிறையில் இருக்கும் 7 பேரையும் விடுதலை செய்வதற்கு எதிராக மத்திய அரசு தாக்கல் செய்துள்ள மனுவை ஏற்றுக் கொள்வதற்கு முகாந்திரம் ஏதும் இல்லை என்று கூறி அந்த மனு மீதான விசாரணையை முடித்து வைத்து உத்தரவிட்டனர்.

சுப்ரீம் கோர்ட்டின் இந்த உத்தரவை வரவேற்று உள்ள தமிழக அரசியல் கட்சி தலைவர்கள், சிறையில் இருக்கும் 7 பேரையும் விடுதலை செய்வதற்கான நடவடிக்கைகளை தமிழக அரசு உடனடியாக மேற்கொள்ள வேண்டும் என்று கேட்டுக் கொண்டு உள்ளனர்.

சிறையில் இருக்கும் பேரறிவாளனின் தாயார் அற்புதம்மாள், தனது மகன் விடுதலை தொடர்பாக முதல்-அமைச்சரை சந்திக்க இருப்பதாக கூறி உள்ளார்.

சுப்ரீம் கோர்ட்டின் அறிவுறுத்தலை தொடர்ந்து, இந்த பிரச்சினையில் அடுத்த கட்டமாக என்னென்ன நடவடிக்கைகளை மேற்கொள்ளலாம் என்பது குறித்து தமிழக அரசு சட்ட நிபுணர்களுடன் ஆலோசனை நடத்தி வருகிறது.

இந்தநிலையில், தமிழக அமைச்சரவையின் அவசர கூட்டம் முதல்-அமைச்சர் எடப்பாடி பழனிசாமி தலைமையில் நாளை (ஞாயிற்றுக்கிழமை) மாலை 4 மணி அளவில் தலைமைச் செயலகத்தில் நடைபெறுகிறது.

இந்த கூட்டத்தில் முருகன், சாந்தன், பேரறிவாளன், நளினி உள்ளிட்ட 7 பேரையும விடுதலை செய்வது குறித்து கவர்னர் பன்வாரிலால் புரோகித்துக்கு பரிந்துரைத்து தீர்மானம் நிறைவேற்றப்படலாம் என்றும், பின்னர் அந்த தீர்மானம் கவர்னருக்கு அனுப்பி வைக்கப்படும் என்றும் தகவல்கள் வெளியாகி உள்ளன.

இந்த தகவலை நேற்று சிறையில் நளினியை சந்தித்து பேசிய அவரது வக்கீல் புகழேந்தி, பின்னர் நிருபர்களிடம் தெரிவித்தார்.

1991–ம் ஆண்டு மே 21–ந்தேதி சென்னையை அடுத்த ஸ்ரீபெரும்புதூர் அருகே மனித வெடிகுண்டு தாக்குதலால் ராஜீவ்காந்தி கொடூரமாக படுகொலை செய்யப்பட்ட சம்பவத்தை கடுகளவும் யாரும் நியாயப்படுத்த முடியாது. ராஜீவ்காந்தி விரும்பிய தமிழக மண்ணில் நடந்த இந்த சம்பவம் தமிழக மக்களின் மனதில் ஆறாத சோகவடுக்களை ஏற்படுத்தியது. இந்த வழக்கில் சி.பி.ஐ.யின் சிறப்பு புலனாய்வு பிரிவு தீவிர விசாரணை செய்து 26 பேரை கைது செய்தது. பூந்தமல்லியில் தடா நீதிமன்றம் இந்த வழக்கை விசாரித்து, 26 பேருக்கும் தூக்குத்தண்டனை விதித்து தீர்ப்பு கூறியது. இந்த தண்டனையை எதிர்த்து உச்சநீதிமன்றத்தில் அப்பீல் செய்யப்பட்டது.

CHENNAI: Doctors from MIOT hospitals removed a rare giant intra-abdominal cyst from a four-year-old Fijian boy. The procedure, which may have required opening of the abdomen with a large slit, was done using laparoscopy, leaving minimal scars. Slits that were smaller than a centimetre were used to remove the cyst, said Dr M Ragavan, paediatric surgeon, who operated on the boy.

Arnav was first diagnosed with hernia when he was barely 10 months old. When he was about 1.5 years old, doctors from the government hospital in Fiji performed an umbilical hernia surgery, which was followed by two other surgeries in the following year. But, Arnav’s condition did not improve.

Investigations on Arnav revealed an intra-abdominal fluid-filled cyst in his abdomen. “Only one in one lakh persons develop a lymphatic cyst. Most patients develop cysts under the armpits or near the neck. Only five per cent of all lymphatic cysts grow in the abdomen,” said Dr Ragavan.

The cyst that was about 10-cm wide, a year ago grew into an 18-cm wide structure. It had not only pushed other organs such as liver and urinary bladder to the periphery, but also applied pressure on the abdominal walls causing pains. “We did not want to open his abdomen up because he’s a young boy. It would have left a large permanent scar,” said Dr Ragavan.

Instead, a laparoscopic camera was sent in through an incision above his belly button. Two more incisions were made on either side of the belly button to insert the surgical equipment. “We cut the surface of the cyst first, removed the fluid inside, then pulled out the growth through the slits,” he said.

The surgery was performed for about two hours, after administering a general anaesthesia by Dr Sarva Vinothini, paediatric anaesthetist. “He recovered fully in a day and started having a good appetite,” she said. Arnav has gained nearly three kilograms in two weeks after the surgery, according to medical records. The surgery cost the family about `2 lakh.

Flown in from Fiji

Arnav’s mother Sonam Prasad told Express that doctors in Fiji had advised Arnav’s parents to remove the cyst at a later stage, when he was older, and that he could not be operated in the government hospital in Fiji’s capital Suva. “He was constantly in pain, and he was always underweight. He would not eat anything when he had bad stomach pain,” Sonam said, adding that she could not see her son suffer anymore. She and her husband then flew him to India to be treated at MIOT.

CHENNAI: Law Minister CVe Shanmugam on Thursday reiterated that the releasing of all seven convicts in the Rajiv Gandhi assassination case was the wish of the late Chief Minister, J Jayalalithaa, and the present government too had the intent.

“The SC gave certain directions today. The State will thoroughly study the verdict and the Chief Minister will take further steps in consultations with legal experts,” Shanmugam told reporters here.

In this connection, the minister also recalled that the State government had put in strong arguments before the SC that State government had powers to release these convicts.

The Madurai Bench of the Madras High Court on Thursday dismissed a plea of a doctor who sought a direction for the return of his documents entrusted to an eye hospital, with which he had executed a bond agreeing to serve it for two years.

The petitioner J. Praveen who completed his MBBS degree in 2011 applied for his postgraduation in MS (Ophthalmology). As per an allotment by the Director of Medical Education, he secured a seat at the Arvind Eye Hospital, Madurai.

The petitioner submitted eight original certificates at the time of admission and executed the bond that he would serve the institution for two years after the completion of the three-year postgraduation. He also agreed to pay Rs. 20 lakh in case of default of the agreement.

However, after completion of the course, the petitioner aspired to work in the government sector and requested the eye hospital to return the original certificates. The request was denied citing the agreement.

Taking up the plea for hearing, Justice V. Parthiban observed the petitioner wanted to have the cake and eat it too, wanting the best of both worlds.

It said the petitioner was bound to serve the hospital for two years or make good the quantified damage as per the agreement.

High Court grants interim stay for two weeks and orders issuance of notices to the IPAB and Mr. Murali.

It gets embroiled in a legal dispute over trademark between the two sons of the firm’s founder N.K. Mahadeva Iyer

In a not so sweet news, the famous Sri Krishna Sweets, known for its mouthwatering Mysurpa, has got embroiled into a legal battle over its trademarks. What’s more is that the dispute is between M. Krishnan and M. Murali, the two sons of the firm’s founder N.K. Mahadeva Iyer.

The Madras High Court on Thursday entertained a batch of three writ petitions filed by Sri Krishna Sweets, represented by its Managing Director Mr. Krishnan, and stayed the operation of an order obtained by Mr. Murali from the Intellectual Property Appellate Board (PAB) on May 21. A Division Bench of Justices R. Subbiah and R. Pongiappan granted the interim stay for a period of two weeks and ordered issuance of notices to the IPAB as well as Mr. Murali. They also stayed all further proceedings initiated by the latter before the IPAB after the May 21 order.

In his affidavit, Mr. Krishnan, 64, stated to have started Sri Krishna Sweets Private Limited as a partnership firm in 1979. “I took lot of efforts and care for promoting the name of the business by giving due importance and emphasis for the name Krishna and coined the words Sri Krishna Sweets in such a way that it has a special appeal,” he said.

Claiming to have got three trademarks registered, he said the company was originally promoted by his wife and him. Mr. Murali was inducted as director only on March 23, 2002 and held the post till his resignation on August 27, 2010. It was further claimed that the younger brother was permitted to do use the trade marks in select territories. As per the leave granted by the writ petitioner, Mr. Murali opened branches of the sweet shop in Chennai, Puducherry, Tiruvannamalai, Kancheepuram and Tiruvallur. “I wrote a letter to the fourth respondent (younger brother) on September 30, 2015 requesting him to regularise the permission arrangement for which he did not cooperate.

“The petitioner also sent a letter on October 30, 2015 to the fourth respondent revoking the permission granted in favour of him in view of his failure to cooperate with the petitioner in regularising the permission granted to him. This resulted in a suit being filed by the petitioner before Additional District Judge, Coimbatore in 2016,” the petitioner said.

The main prayer in the suit was to restrain the younger brother from infringing the trademarks. Though the petitioner had also sought for an interim relief to restrain Mr. Murali from using the word ‘Krishna,’ the interlocutory application was dismissed by the district court on June 5, 2017. Further, the High Court too dismissed appeals preferred by the writ petitioner against the lower court’s refusal to grant interim relief. However, a direction was issued to the district court to complete the trial within a year and when the suit was ripe for trial, Mr. Murali filed petitions before the IPAB to get the petitioner’s trademark registrations cancelled.

There was a legal hitch before the IPAB, hence the younger brother’s counsel urged the Board to treat the petitions as abandoned with liberty to file fresh applications. The IPAB granted the liberty on May 21 and it was that order which was under challenge at present before the High Court.

Mr. Krishnan contended that the IPAB becomes functus officio after treating a petition as abandoned and it does not have any authority under law to grant liberty for filing a fresh application. Grant of such liberty had made Mr. Murali to file fresh applications challenging the writ petitioner’s trademarks, he said.

Jet’s senior staff to get salary in 2 instalments

Cash-strapped Jet Airways will pay its senior employees, pilots and aircraft engineers salary in two instalments for the next three months. The airline’s chief people’s officer Rahul Taneja sent a mail to employees on Thursday evening, saying “disbursal of salary for GMs and above, cockpit crew (pilots) and AMEs (aircraft maintenance engineers) will be postponed for the month of August 2018, and shall be disbursed in 2 instalments — 50% by September 11 and balance 50% by September

26. For the months of September and October 2018, the same disbursement schedule will be followed.” Jet’s employee remuneration cost was ₹2,995 crore in 2017-18.

The newly updated community guidelines have been introduced in Australia and New Zealand. It’s outlined that as of September 19 this year, people using the app in both countries could risk being blocked from the driving service if they fall below a certain score.

Amanda Gilmore, Uber’s New Zealand country manager, explains these changes have been introduced following feedback that the company has received from its drivers. “This change is really about setting good standards of behaviour, and creating a mutual level of respect between drivers and riders,” Gilmore added. Dubai-New York flyers may have caught flu

Eleven people on an Emirates flight were taken to a New York City hospital suffering flu-like symptoms on Wednesday after scores of passengers and crew complained of feeling sick during a 14-hour trip from Dubai, officials said.

Laboratory tests on respiratory samples from the patients have yet to confirm the illness, but their histories and symptoms — fever, cough and vomiting — indicate influenza, said Dr Oxiris Barbot, New York City’s acting health commissioner.

Some passengers in recent days had attended the annual Haj pilgrimage to the city of Mecca on the Arabian Peninsula, a region where the flu virus was circulating, and could have contracted the illness there, Barbot said. It was also possible the virus was transmitted between passengers during the lengthy flight, she said. All who were hospitalised were in stable condition and none was in need of “extreme” medical attention, Barbot said. The flu’s incubation period typically is one to seven days, Barbot said, and people who are infected can be contagious before showing signs of illness.

The airliner, with at least 521passengers, landed at John F Kennedy International Airport and was surrounded by dozens of emergency vehicles as passengers waited to be evaluated by health officials. The airline and the mayor’s office said 19 people were confirmed ill. Three passengers and seven crew members went to a hospital, and nine other passengers medically evaluated at the scene were released afterward, Emirates said. The rest were allowed to leave and clear customs, the airline said.

The Tamil Nadu government will take a decision on the release of convicts in the Rajiv Gandhi assassination case after going through the Supreme Court’s order based on a plea by one of them. The government said it is for the release of all seven convicts currently in jail.

“It is our stand and desire of Amma (Jayalalithaa) that all the seven convicts should be released. Chief minister (Edappadi K Palaniswami)

will take a decision after going through the Supreme Court’s order,” law minister C Ve Shanmugam told reporters here on Thursday.

He was reacting to the court’s order directing Tamil Nadu governor to consider the mercy petition of A G Perarivalan, one of the seven life convicts in the case. An apex court bench comprising Justices Ranjan Gogoi, Naveen Sinha and K M Joseph disposed of the Centre’s petition on the Tamil Nadu government’s proposal for the release of the convicts.

Earlier in the day, Perarivalan’s mother Arputhammal appealed to the state government to initiate steps for the early release of her son. She expressed hope that her son could be set free within the next one week.

Welcoming the order, DMK president M K Stalin urged chief minister Palaniswami to convene the state cabinet meeting at the earliest, to take this forward. DMK’s alliance partner Congress was cautious in its reaction. “Whatever measures legally allowed in this, should be legally followed,” TNCC president S Thirunavukkarasar told reporters in New Delhi.

While PMK youth wing president Anbumani Ramadoss urged the state government to release all the seven convicts immediately, CPM state secretary R Balakrishnan asked the state government to avoid any further delay in releasing all the convicts. “I request the chief minister to immediately convene a cabinet meeting, pass a firm resolution to release all the seven convicts and recommend the same to the governor,” MDMK general secretary Vaiko said in a statement.

HC asks doctor to honour contract with hosp or pay up

Terming the petition of a doctor urging a Madurai-based ophthalmology institute to return his MBBS and postgraduate provisional certificates without serving his contract unreasonable, the Madurai bench of the Madras high court directed the doctor to complete his contract of two years at the hospital or pay up the ₹20 lakh as per the agreed terms.

Dr J Praveen had moved the bench seeking directions to Aravind Eye Hospitals, Madurai to return his original certificates. After completing MBBS in 2011, Praveen applied for postgraduation in ophthalmology in 2014 and was allotted the three-year course at Aravind institutions. At the time of admission, Praveen executed a bond with the institution to the effect that he would serve in the hospital for two years after completing the course, failing which he would pay ₹20 lakh to the institution. However, on completing the course in July 2017, Praveen requested the institution to return the original certificates and since it did not consider his representation, he approached the court.

The doctor’s counsel submitted that when the bond was executed, he was under the impression that he was required to serve only in government service and not Aravind institute. When Anna University had to renovate the ceiling of Vivekananda Auditorium at a cost of ₹28 lakh in 2015, it floated three separate tenders, one for the VIP area, one for the student area and another for the stage, despite all three being under one roof and one contractor eventually executing the work.

This was to keep each tender estimate under ₹10 lakh and thus avoid placing an advertisement in newspapers, thereby favouring a select coterie of contractors, says Jayaram Venkatesan, social activist. Such tender notices were put up only on the estate office notice board.

This modus operandi was followed for almost every civil work tender from 2013 till date. In 2017, authorities began to put up notices on the website.

“This has cut down on competition, leading to inflated costs, over-invoicing and loss of public money,” said Venkatesan.

Venkatesan and another whistle-blower have given a complaint to the Directorate of Vigilance and Anti-Corruption, vice-chancellor and Governor. The complaint is based on replies by the university to dozens of RTI applications.

Around 20 contracts awarded in this manner were worth ₹13 crore. The university awards at least 100 such small contracts every year.

For instance, Anna University issued five separate tenders (less than ₹10 lakh each) in the last one week for renovation of the corridor in the AC Tech main building. This was split as renovation on west wind, north west corner, north wing, north wing outer and inner quadrangle.

In another case in 2013-14, provision of electrical fittings, fans and power plugs for the three-storied ladies hostel was divided into eight separate tenders, all won by the same contractor.

Work for laying storm water drain and roofs for staff quarters was divided into houses in the A, B and C block and tendered separately, despite the work being the same. In 2014, the university floated separate tenders to paint the front and rear wing rooms of the international student hostel, executed by the same contractor.

Vice-chancellor V K Surappa, who has received a copy of the documents, told TOI that he would inquire into the issue. For work up to ₹6 lakh, the estate officer issues tenders; the registrar issues tenders for work up to ₹10 lakh.

Documents show that for most such work, there was an excess payment of up to 10%, which can be approved only by the vice-chancellor.

The estate officer, Professor V K Stalin, who has occupied the post since 2013, said the tenders were floated based on requests by individual departments. But he did not elaborate on why the same work was being divided into smaller tenders.

“There is no irregularity in this,” he said.

The ongoing strike by government doctors seeking a pay hike became more intense on Thursday when faculty members of the Madurai and Tirunelveli medical colleges refused to appear before the Medical Council of India’s inspection committee for a head count ahead of an increase of 100 seats each in the two institutions.

The joint action committee of the government doctors’ association spearheading the strike told director of medical education Dr A Edwin Joe on Thursday that they would not be attending the mandatory head count before the inspection committee. The two-member panel inspected hospitals, classrooms and labs at the two colleges and waited with the dean for the faculty members to turn up but there was a no-show.

“Head count is a mandatory part of the inspection and we may lose these seats if the doctors don’t appear. Fortunately, the team has agreed to stay back tomorrow as well. We have told the doctors that disciplinary action will be taken if they skip the inspection,” said Joe.

The committee chairman Dr K Senthil, who also heads the government doctors’ association, said doctors will skip the head count on Friday if the government did not meet their demands.

Government doctors have not entered classrooms of medical colleges across the state since Monday. They have also stopped signing attendance registers, boycotted all government meetings and audits, refused to sit on the medical board or send daily reports, and stopped signing papers for pregnant women to get money from the Muthulakshmi Maternal Benefit Scheme.

“We will continue the stir until our demands are met. But we have promised that treatment of patients will not be affected,” he said.

The salary for doctors in state and central services is the same when they join duty, but doctors in central government services receive promotions in four, nine, 13 and 20 years, compared to eight, 15, 17 and 20 years in the state government.

“We start with the same salary but there is a difference in our basic pay from the fourth year. We understand we won’t get the allowances as we are allowed to do private practice, but we are demanding parity in basic pay,” he said.

Doctors in government service also get a salary that is lower than lecturers or professors at arts/science colleges, although government doctors work for at least 50 hours a week compared to 32 hours of the teaching faculty.

On Tuesday, members of the committee met health minister C Vijayabaskar and senior department officials including health secretary J Radhakrishnan to press their demands.

“We have been demanding this for more than a decade. Even this boycott happened after three months’ notice. Neither the minister nor officials promised a hike. We will withdraw our strike if they come out with an announcement on revised pay,” said Dr A Ramalingam from the Stanley Medical College and Hospital.

Deadline nears, but 50-plus BDS seats in govt quota go abegging

With less than a week’s deadline for the state to complete admission formalities for the undergraduate dental course, the selection committee has received only 207 applications for the 264 BDS seats in government quota. According to the tentative mop-up counselling schedule for BDS released by the selection committee, counselling will be held on Monday.

This year nearly 50% of BDS seats — including 23% under the government quota — were vacant at the end of counselling. With 833 out of 1,993 seats vacant, the selection committee called for fresh applications on Friday after it exhausted the rank list. Several self-financing colleges are wooing students by slashing the tuition fees from Rs 6 lakh to Rs 2.5 lakh. “We will complete counselling by Wednesday,” said selection committee secretary Dr G Selvarajan.

The last date for joining dental courses for 2018 fixed by Dental Council of India is September 15. The selection committee will handover the remaining seats to college managements after September 12. Colleges will have to admit students before the deadline. “We have asked colleges to reduce fees so they can fill seats,” he said.

Last year, 265 management quota seats in self-financing colleges remained vacant. Many students told TOI that they would appear for NEET 2019 to better their scores and apply for MBBS than taking up a seat in BDS this year.

TN Dr MGR Medical University governing council member Dr Yashwanth Kumar Venkataraman said DCI should close down dental colleges with poor infrastructure and less patients, after giving them six months time to correct inadequacies. Meanwhile, Tamil Nadu should also ensure it has more government dental colleges and departments in other medical colleges, so jobs can be created. “It will also create awareness among people on the need for good oral health and hygiene,” he said.

Dentists said a separate university for dentistry should be set up and students with the right aptitude taken in. “As of now most students choose dentistry either because their family owns a clinic or a hospital or because they did not get an MBBS seat,” said Dr Venkataraman.

10K seekers for 2K nursing seats

More than five students will compete for every diploma seat in nursing this year, with toppers having a cut-off touching 98.75 in Class XII examinations.

For about 2,000 diplomas in nursing seats in government colleges, the state selection committee has received 10,500 applications. There are two reasons for the rush, said officials. The government will start sale of applications for four-year paramedical degree courses, including nursing, only on Monday. Hence, students have applied for diploma which is a three-year course. “Also, students are accommodated in secure hostels. They get good food and education and are paid a small stipend,” said S Senbarithi, a nurse working for a private hospital. TNN

Aircraft aborts landing after pilot spots vehicle on runway

The pilot of an IndiGo aircraft had to abort his plan for landing and pull up after he spotted a vehicle crossing the runway at Chennai airport. The incident took place on Tuesday afternoon, when planes were being routed to land on the second runway as the main runway was closed for operation.

Airports Authority of India (AAI) has kept the main runway closed for taxiway work daily, between 12.30pm and 6.30pm, and flights are handled by the second runway during the period.

“The IndiGo A320 aircraft was on its final approach to touch down on the GST Road end of the second runway (03 end), when the pilot spotted the vehicle on the runway. He made a quick decision to not land and revved up and flew away,” said a source. Planes glide down from 1,000feet to 550feet during final approach. AAI and the directorate general of civil aviation (DGCA) are investigating the incident.

Sources said the vehicle belonged to a contractor engaged for soil test in connection with the ongoing work to link the rapid exit taxiways to the main runway. The pilot reported the incident to the air traffic control and filed an incident report.

An official said the driver drove the vehicle across the second runway thinking it was part of a road inside the airport, to pick up a few workers on the other side. Work is underway on both sides of the runway.

Drivers engaged by contractors undergo a classroom training on speed limits and no-go zones before an airfield driving permit (ADP) is issued. A senior official said, “We stopped the runway work and did an investigation on the driver violating rules on driving inside an airfield.”

Airport director G Chandramouli said, “A watch-andward stopped the vehicle immediately. This incident happened despite drivers engaged by contractors undergoing training. We have adopted remedial measures.”

Sources said the incident points to poor coordination between the projects wing, which is in charge of the construction work, and staff in charge of operations at the airport.
