Can't Intervene in Tasmac Liquor Sale : Madras HC

CHENNAI: The Madras High Court on Tuesday refused to prohibit TASMAC from selling liquor, holding that it cannot intervene in policy matters.

“Unfortunately this is a decision on which court’s opinion cannot be called for,” said the first bench comprising Chief Justice SK Kaul and Justice TS Sivagnanam while closing the public interest litigation moved by a journalist. “It is a policy decision taken by the State government and the State legislature,” the bench pointed out.

Citing Article 47 of the Constitution which speaks about the duty of the State to raise the level of nutrition and the standard of living and to improve public health, the petitioner argued that under the article, “it is the duty of the State to bring about prohibition.” But contravening the constitutional mandate, the Tamil Nadu government came up with TN Liquor Retail Vending (in shops and bars) Rules, 2003, enabling TASMAC to sell liquor through its retail outlets, the petitioner said, seeking the court to strike down the rule as against the Constitution of India, particularly against Article 47.

Responding to the petition, government pleader submitted that the State is continuously discouraging consumption of alcohol. “The tax on liquor in TN is highest in the country. The number of retail outlets which were 7,800 in 2003 has been reduced to 6,800 in 2015. That apart, working hours of the shops which was earlier from 8 am to 12 pm has been reduced to 10 am to 10 pm,” he added.

Recording the submissions, the bench said, “We are of the view that the court cannot really issue any direction in the matter,” and closed the writ petition.

Medical Students to Lose A Year

BHAWANIPATNA:The Sardar Rajas Medical College at Jaring in Kalahandi district has run into fresh trouble. This time, first year students of second batch of the medical college, who took admission in 2014-15 academic year on Supreme Court order, cannot appear at the first medical professional examination scheduled to be held in August. Because, the college has failed to get provisional affiliation of Sambalpur University for the session.

Speaking to media persons, the 24 affected students and their guardians alleged that the college could not get the provisional affiliation because of negligence on part of Department of Health and Family Welfare. The department has issued the recognition letter for the college for 2015-16 instead of 2014-15.

About the problems faced by them, the students said while part-time faculty has been conducting classes, the arrangement is inadequate to ensure quality education. The college also lacks infrastructure facilities, sufficient number of doctors and administrative staff.

The students and parents sought immediate intervention of the Government in the matter. They demanded that the Department should rectify its mistake at the earliest and Sambalpur University should allow students to appear at the ensuing examination so that they would not lose one year.

An administrative official of the medical college Saif Saiffuddin said, “We are pursuing the matter with the Department and after getting recognition year corrected, we will approach Sambalpur University and make all efforts to ensure that students write their examination in August.”

It may be mentioned that the Medical Council of India (MCI) had allowed admission to 100 seats in the medical college in 2013-14. But the Medical Council cancelled admission for 2014-15 session citing lack of adequate infrastructure. Challenging the MCI order, the college authorities had filed a writ petition in the Supreme Court.

In 2014, the apex court allowed admission in the medical college with immediate effect. While directing the MCI to visit the medical college within three months, the court told the college authorities to fulfil necessary infrastructure requirements as per the suggestions of the MCI.

Accordingly, MCI’s fact-finding team visited the college in February this year for verification of facts and document submitted earlier. The team submitted its report to the MCI but did not reveal anything about their findings. Meanwhile, CBI took over the investigation on February 23.

Expenses at president Pranab Mukherjee's secretariat up: RTI

A Right to Information (RTI) query to president's office by applicant Mansoor Umer Darvesh revealed that in 2012-13 the expenditure on president's secretariat under Major Head, Appropriation-Staff, Household and Allowances of the president was Rs30.96 crore. The following year, it increased to Rs38.70 crore. During the last fiscal — 2014-15 — it shot up to Rs41.96 crore.

President Mukherjee had taken charge in July 2012 as the 13th President of India. There are a total of 754 people working in the president's secretariat, of which 9 are private secretaries, and 27 are drivers.

The salaries of the staff at the secretariat come to a sum of over Rs1.5 crore. "Total salary of all employees of the president's secretariat for the month of May 2015 is Rs1,51,48,958," read the RTI reply.

Whereas monthly telephone bills are over five lakhs rupees. In May 2015 the telephone bill was Rs5,06,531.

"I had even sought details about the total number of security staff deployed as well as expenditures incurred on electricity. But details on the same has not been provided with by Central Public Information Officer Shakil Alam at the secretariat," said Darvesh.

Staff, students hold sign campaign against institution

COIMBATORE: Teaching, non-teaching staff and students of Avinashilingam deemed university for women intensified their protest against the institution, conducting a signature campaign at Gandhipuram, asking the Ministry of Human Resource Development (MHRD) to take over the university under the control of University Grants Commission (UGC).

B Nalini, general secretary, Avinashilingam deemed university unit of Association of University Teachers said that the Avinashilingam Educational Trust is not willing to leave the administrative power to the UGC and is attempting to suppress the facts and mislead the general public. The university management has failed to submit the memorandum of agreement to the UGC for the last five years. So, UGC may stop funding to the university.

"UGC is not giving any assurance that funds would be released if the university does not comply with the UGC regulations. On one hand, the university claims that they do not have any proposal to convert the university into a self-financing institution. But on other hand they are reluctant to comply with UGC regulations regarding the governance structure," said Nalini.

The teaching and non-teaching staff has decided to conduct a general body meeting on Friday and would take a decision on further course of action against the management.

Meanwhile, a group of students of the university, conducted a signature campaign at Gandhipuram on Thursday. Thanthai Periyar Dravidar Kazhagam general secretary K Ramakrishnan inaugurated the signature campaign.

The chancellor of the university, T S K Meenakshisundaram, had issued a public notice in the media stating that the Memorandum of Agreement has been submitted, and is awaiting MHRD's concurrence. But, the university has only submitted the governing structure of the university, and only after the MHRD concurs the governing structure, will the university have to submit the MoA complying with the UGC Code of Regulations, 2010 for deemed universities.

Staff of the university began the protest two weeks ago, demanding the institution submit the Memorandum of Agreement (MOA) to the Ministry of Human Resources Development immediately to facilitate its smooth functioning. They also requested the university administration to follow University Grants Commission (UGC) norms which mandate that a member of the trust, involved in the institution's management, could not be the chancellor.

MUHS invites applications for exchange program with University of Sydney

NASHIK: The Maharashtra University of Health Science (MUHS) has invited applications for PhD-level studies scholarships under a bilateral collaboration with the University of Sydney for the student clinical placement exchange programme.

Arun Jamkar, vice-chancellor of MUHS, said: "Candidates from the state having a minimum qualification of MBBS may apply for the programme. Two candidates will be selected through an examination and they will get a scholarship of $8,000. They will be sent to the University of Sydney for a period of four months."

The university had entered into an agreement with Sydney Medical School, Australia last year to boost education, training and research collaboratively. The agreement encourages exchange of faculties and students from both the universities. It will also conduct joint research on HIV, head and spondylitis cancer, carcinoma cervix and other subjects.

Jamkar said, "Chances like these help students develop new perspectives in the field of research and explore new avenues in medicine. The qualification earned will also open new prospects in countries like US, where the demand is huge."

The vice chancellor added that the students will attempt to understand global health issues, conduct research and find solutions for them. The scholarship is entirely sponsored by the University of Sydney and all the academic expenses of the students will be borne by it.

2-year bond for MBBS students in govt hospitals

JAIPUR: Students passing out after completing MBBS from government medical colleges will have to work for at least two years in government hospitals.

The medical education department issued letter to all the medical colleges of the state, undergraduate (UG) counselling board of directorate of medical education, Central Board of Secondary Education and Rajasthan University of Health Sciences (RUHS) college informing about the decision.

The letter issued has apprised the medical colleges that state government has made a bond for UG courses compulsory in government state medical colleges for all India and state quota students.

"It has been decided by the state government that the students selected for the UG course in MBBS will have to fill a bond for commitment to service the state government for 2 years. If they break the bond, they will have to pay Rs 5 lakh as penalty," wrote S P Singh, joint director medical education department, in the letter.

As per the directions, the new decision would be effective from the session 2015 and onwards.

According to health department sources, the government-run hospitals are facing shortage of doctors. Now, the government has decided to make it mandatory for doctors to work for at least a stipulated time for joining government services and for studying in medical colleges. Similar bond of Rs 25 lakh is mandatory for in-service doctors taking admission in one-year certificate course.

Through bonds, the health department is making efforts to retain doctors for longer period in government services so that the patients coming to government hospitals will be benefitted.

இந்தப் பிரச்னையில் அரசைவிடப் பள்ளிகளுக்கும், பெற்றோருக்குமே மிக அதிகமான பொறுப்பு இருக்கிறது. இவர்கள் இணைந்து செயல்பட்டால் 90 விழுக்காடு மாணவர்களை மதுவிலிருந்து காப்பாற்றிவிட முடியும். ஏனெனில், இந்த 90 விழுக்காடு மாணவர்களும் பள்ளி நேரத்தில் வெளியே சென்று மதுவை சுவை பார்க்கிறார்கள். வகுப்பில் மாணவர் இல்லை என்று தெரிந்தவுடன் அவரது பெற்றோருக்கு செல்லிடப்பேசியில் குறுந்தகவல் அனுப்பும் வழக்கத்தை அரசுப் பள்ளிகள் உள்பட அனைத்துப் பள்ளிகளும் மேற்கொள்ள வேண்டும்.
பள்ளி மாணவர்கள், மாணவிகளுக்கு மது, போதை மாத்திரைகள் கிடைக்கக் காரணம் அரசும், சமூக விரோதிகளும் மட்டுமே அல்ல. கணக்கு கேட்காமலேயே கைச் செலவுக்குப் பணத்தை வாரி வழங்கும் பெற்றோரும் காரணம். கணக்கில் தேவைக்கு அதிகமாகப் பணம் போட்டு, ஏடிஎம் அட்டையையும் கொடுக்கும் பெற்றோர் தங்கள் குழந்தை எவ்வளவு பணத்தை எதற்காக செலவழிக்கிறார் என்பதைக் கண்காணிப்பதும் கேள்வி கேட்பதும் பிரச்னையைப் பெருமளவு குறைக்கும்.
சந்தைப் பொருளாதாரத்தின் நிலையை சந்தை நிர்ணயித்துக் கொள்வது போல, ஜனநாயகத்தில் அவரவர் செய்கையை எந்தவித அரசு அல்லது சமூகக் கட்டுப்பாடும் இல்லாமல் அவரவரே தீர்மானித்துக் கொள்வது என்கிற போக்கு சரிதானா? நாம் சிந்திக்க வேண்டிய தருணம் வந்துவிட்டது.
