இந்தியா முழுவதும் கடந்த சில நாட்களாக சிறுகுழந்தைகளை பாலியல் பலாத்காரம் செய்யும் சம்பவங்கள் நடைபெற்று வருவது எல்லோருடைய மனதையும் துடிதுடிக்க வைக்கிறது. கதுவா சம்பவம் வெளிவந்த உடனேயே மத்திய மந்திரி மேனகா காந்தி, சிறுமிகளை பாலியல் பலாத்காரம் செய்பவர்களுக்கு மரண தண்டனை விதிக்கும் வகையில் ஒரு வரைவு மசோதாவை தன் அமைச்சகம் தயாரித்துக்கொண்டிருக்கிறது என்று சொன்னார். அரசு எந்திரம் நினைத்தால் எவ்வளவு வேகமாக சுழலமுடியும் என்பதற்கு எடுத்துக்காட்டாக, 12 வயதுக்கு குறைவான சிறுமிகளை பாலியல் பலாத்காரம் செய்யும் குற்றவாளிகளுக்கு அதிகபட்சமாக மரண தண்டனை விதிக்கும் வகையில் ஒரு அவசரசட்டம் கொண்டுவருவது குறித்து கடந்த சனிக்கிழமை மத்திய அமைச்சரவை முடிவு செய்து ஒப்புதலும் அளித்தது. அடுத்த நாளே இந்த அவசர சட்டத்துக்கு ஜனாதிபதியும் ஒப்புதல் கொடுத்து உடனடியாக அமலுக்கும் வந்துவிட்டது.


இந்த சட்டத்தின் கீழ் 12 வயதிற்கும் குறைவான சிறுமிகளை பாலியல் பலாத்காரம் செய்பவர்களுக்கு குறைந்தபட்சம் 20 ஆண்டுகள் ஜெயில் தண்டனை அல்லது ஆயுள் முழுவதும் ஜெயில் தண்டனை அல்லது மரண தண்டனை விதிக்க வகை செய்யப்பட்டுள்ளது. பலர் கூட்டாக சேர்ந்து 12 வயதிற்குட்பட்ட சிறுமியை பாலியல் பலாத்காரம் செய்தால், ஆயுட்காலம் முழுவதும் தண்டனை அல்லது தூக்கு தண்டனை விதிக்க வகை செய்யப்பட்டுள்ளது. இத்தகைய வழக்குகளில் புலன்விசாரணை 2 மாதங்களுக்குள் முடிவடையவேண்டும். நீதிமன்ற விசாரணை 2 மாதங்களுக்குள் முடிவடைந்து தீர்ப்பு வழங்கப்பட வேண்டும். மேலும் இதுதொடர்பான குற்றங்களுக்கு கூடுதல் தண்டனை அளிக்கும் பல அம்சங்கள் இந்த அவசர சட்டத்தில் கூறப்பட்டாலும், மரண தண்டனை மட்டுமே இத்தகைய குற்றங்களை தடுத்துவிடுமா? என்பதில் எல்லோருக்கும் சற்று மாற்றுக்கருத்துகள் இருக்கின்றன. 2012 டிசம்பர் மாதத்தில் நடந்த நிர்பயா கற்பழிப்பு வழக்கில் நியமிக்கப்பட்ட ஓய்வுபெற்ற உச்சநீதிமன்ற நீதிபதி வர்மா தலைமையிலான கமி‌ஷன், ‘கற்பழிப்புக்கு தூக்கு தண்டனை என்பது ஏற்கத்தக்கதல்ல’ என்று கூறியுள்ளது. உச்சநீதிமன்ற வக்கீல் ரவிகாந்த், ‘கற்பழிப்புக்கு தூக்கு தண்டனை விதிக்கும் வெளிநாடுகளில், கற்பழிப்புக்கு பிறகு கொலை செய்யும் சம்பவங்கள் நடக்கின்றன’ என்று அதிர்ச்சியூட்டும் தகவலை தெரிவித்துள்ளார். இதுமட்டுமல்லாமல், இந்த அவசர சட்டம் பிறப்பிக்கப்பட்ட பிறகு தமிழ்நாட்டில் சட்டம் தெரிந்த ஒரு வக்கீலே கடந்த ஞாயிற்றுக்கிழமையன்று ஓடும் ரெயிலில் 9 வயது சிறுமியிடம் சில்மி‌ஷம் செய்ததாக கைது செய்யப்பட்டுள்ளார்.


நாடு முழுவதிலும் அவசர சட்டம் பிறப்பிக்கப்பட்ட பிறகே பல சம்பவங்கள் தொடர்ந்து நடந்துகொண்டிருக்கின்றன. பொதுவாக கற்பழிப்பு வழக்குகளில் புலன்விசாரணை செய்து தண்டனை வாங்கிக்கொடுத்த வழக்குகளின் எண்ணிக்கை 25–லிருந்து 35 சதவீதமும், சிறுகுழந்தைகளை பாலியல் பலாத்காரம் செய்த வழக்குகளில் 20 சதவீதத்திற்கும் குறைவான வழக்குகளில்தான் தண்டனை வழங்கப்பட்டுள்ளது. இந்த நிலையில், புலன்விசாரணை உரியமுறையில் நடத்துவதற்கு போலீசாருக்கு பயிற்சி அளிக்கவேண்டும். இதுபோன்ற வழக்குகளை நன்கு திறமைமிக்க பெண் போலீஸ் அதிகாரிகளிடம் கொடுப்பது சாலச்சிறந்ததாகும். இந்த அவசர சட்டத்தில் சிறுமிகளை பாலியல் பலாத்காரம் செய்பவர்களைப் பற்றி தான் குறிப்பிடப்பட்டுள்ளதே தவிர, சிறுவர்களை பாலியல் பலாத்காரம் செய்பவர்களைப் பற்றி எதுவும் குறிப்பிடப்படவில்லை. மொத்தத்தில், தண்டனை வழங்க சட்டம் பிறப்பித்தால் மட்டும் போதாது. அதை வாங்கிக்கொடுக்கும் வகையில் போலீசாரின் புலன்விசாரணையும், நீதிமன்றத்தில் வாதாடும் அரசு வழக்கறிஞர்களின் திறமையிலும்தான் இருக்கிறது.

Coimbatore: Corruption charges and the arrest of former vice-chancellor of Bharathiar University A Ganapathi still fresh, another controversy erupted on Monday, this time in the form of a video. The clip that surfaced on Monday showed the head of the Tamil department D Gnanasekaran receiving money from a person, allegedly for a posting in the university.

In the video, Gnanasekaran is seen entering his residence, where people are waiting to meet him. He tells them he had come back after meeting the VC, but does not specify the VC’s name. Later, he is seen demanding money from a person who is not seen in the video, but purportedly a job aspirant. He then receives cash from the person.

The state higher education department has decided to send the video to the police department and probe its authenticity as well as the allegations. “We will send the video to the Directorate of Vigilance and Anti–Corruption for an inquiry,’’ higher education secretary Sunil Paliwal told TOI.

“They will conduct an interview, but there will be no selection list,” Gnanasekaran had said. He is also seen asking the aspirant for ‘payment’ and later receiving cash. He tells the aspirant that he will hand over the ‘payment’ to the VC.

However, when contacted, Gnanasekaran denied the allegations. “The voice in the video doesn’t seem to be mine. The video seems to have been taken around five years ago, as the track suit I’m wearing in the video was used by me back then. The situation might also have been an instance where a friend who had borrowed money from me had returned it. Also, I used to help friends and students by giving referrals, the video might also have been taken in such a situation,” said Gnanasekaran. He said he became the head of the department only in September 2017. “I was not the head of the department when the appointments were made during Ganapathi’s tenure,” he said. “I had contested for the post of the university's vice-chancellor last time. My name had also surfaced in the list of VC candidates for Thiruvalluvar University. The video seems to have been taken out of context by someone who wanted to tarnish my reputation,” he said. He added that he had explained his position to the university registrar and members of the convener committee. Gnanasekaran, however, said he could not recall the “friend” from whom he was seen receiving the money.

When contacted, registrar in-charge of the university B Vanitha said the university officials had come to know about the allegation only when the video was telecast in a Tamil news channel.

State Govt Signs MoU With iCARE

Chennai: To help improve areas of concern in the academic functioning of universities in the state, the Tamil Nadu higher education council on Tuesday signed an MoU with, Indian Centre for Academic Rankings and Excellence (iCARE).

The private firm will work for free and will also analyse different departments to identify its weaknesses and address them across 13 universities in the state. This would also automatically help improve the overall rankings in the National Institutional Ranking Framework (NIRF), said officials.

Higher education secretary Sunil Paliwal said institutions of Tamil Nadu were faring well in the NIRF rankings. Seven universities including Anna University, Bharathiar University, University of Madras, Madhurai Kamraj University, Bharathidasan and Periyar universities are among the top 100 institutions. With this partnership, the government hopes that the analysis undertaken by iCARE would help propel all its universities to higher positions on the ranking list.

“There are five broad parameters and 18 sub-parameters based on which performance of universities are measured. There will be a department wise analysis carried out by the firm. Each university’s authorities may be measuring the performance of the institution through his or her understanding. A more data-based analysis will help identify strengths and weaknesses and further enhance their academic performance,” said Paliwal.

Supreme Court declines plea for in-service doctors’ quota

Chennai: The state health department won’t be able to hold on to a 50% quota for in-service doctors, with the Supreme Court on Tuesday declined any interim relief to government doctors’ association. The court said admission to postgraduate medical courses should be as per Medical Council of India rules.

However, the state will not be able start the counselling process for at least a week. The selection committee will not release the merit list at least until Thursday, director of medical education Dr A Edwin Joe said.

Justice S Vaidyanathan of the Madras high court had quashed government orders of March 9 and March 23 which notified the department to award incentive marks for in-service candidates from remote or difficult areas. “A detailed order is expected on Thursday. Legal experts have told us that they will be able to offer their opinion on whether we should go on an appeal. If not we may have to issue a fresh order after reclassifying areas,” said Edwin Joe Either of these will take at least a week. Reclassification has to be worked out with data from the Directorate of Medical Education and the Directorate of Medical Services.

Meanwhile, on Tuesday, the Tamil Nadu Medical Officers Association submitted that instead of granting incentive marks to government doctors, serving in remote and difficult rural areas, in PG admissions, the state government should be allowed to continue with its own quota policy. After giving away 50% of its seats to the all India quota, the state reserved 50% of the remaining seats for in-service doctors. “We are unable to accede to the request,” a five-judge constitution bench headed by Chief Justice Dipak Misra said.

The bench, also comprising Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan, said the counselling process for admissions in PG courses would go on as per the MCI regulations and its final verdict will decide the fate of admissions.

No relief for PC wife from ED appearance

Chennai: In a major setback to former Union minister P Chidambaram’s wife and senior advocate Nalini Chidambaram, the Madras high court on Tuesday dismissed her plea challenging the summons issued by the Enforcement Directorate in connection with the Saradha chit fund scam.

Rejecting her primary contention that women are protected under section 160 of CrPC against such summons seeking their appearance outside their place of residence, Justice S M Subramaniam said, “By citing the general provisions of section 160, the petitioner cannot seek absolute exemption from personal appearance in the investigation process.”

The judge said, “In the present case, the ED was of the opinion that certain financial transactions had to be explained by the petitioner in person. When such an opinion is formed by the investigating authorities, the petitioner cannot say that personal appearance cannot be insisted upon.”

‘Laundering hitting growth of the nation’

The court expects that senior advocates like the petitioner do not shy away from cooperating in the investigation of offences committed under the provisions of the Prevention of Money Laundering Act, the judge said, adding that offences of money laundering are affecting the economic growth of the nation and the alleged laundering in the present case runs to several thousand crores.

As to the submission that protection under section 160 has been provided to women since they were considered to be vulnerable, the court said, “This court is aware of the fact that in certain circumstances, women in this country are vulnerable. But this is not the case in all circumstances in all areas. Women are now standing on par with men in all walks of life.”

Justice Subramaniam then directed the ED to issue a fresh summons, fix a date for the purpose of continuing the investigation and proceed with the same in accordance with the law.
