Chennai: The Madras high court has clarified that the exclusive sessions court for bomb blast cases in Chennai and Coimbatore are not special courts established under any statute, but are ordinary additional sessions courts created to lessen the burden of the existing courts. 

A division bench of Justice R Subbiah and Justice G Jayachandran made the clarification while directing the subordinate courts not to mechanically transfer all cases registered under the Explosive Substances Act to the two courts.

The bench passed the direction on a batch of pleas moved by M Manimuthu and five others challenging the orders passed by sessions judges of various districts, transferring the trial of such cases to Chennai and Coimbatore bomb blast courts.

“These two courts are not akin to the special courts for NDPS cases, SC/ST (Prevention of Atrocities) Act cases. They are similar to the mahila courts (sessions level) functioning in various districts to deal with offences against women,” the bench clarified.

No evidence of bribery to RK Nagar voters, says HC; upholds Dhinakaran election

Chennai: Giving a clean chit to Amma Makkal Munnetra Kazhagam (AMMK) leader T T V Dhinakaran, the Madras high court on Wednesday dismissed a petition challenging his election from R K Nagar assembly constituency. 

Noting that there was no material evidence to show that Dhinakaran had bribed voters during the December 2017 bypoll, Justice G Jayachandran dismissed the election petition filed by an independent candidate M L Ravi. He had secured 246 votes in the byelection, caused by the death of former chief minister Jayalalithaa.
“As cautioned by the Supreme Court, the will of the people of RK Nagar constituency reflected in returned candidate as their representative to the assembly. He should not be dragged to contest to defend vague allegations based on reports of social media and press without any substantiate and corroborative materials,” said Justice Jayachandran in his order.
“The complaints sent by the petitioner to the Election Commission falls short of material facts. The complaints are vague, bald and contains only general allegations that the candidates of recognised political parties are spending over and other than the permissible limits. A plain reading of the election petition and the affidavit accompanying the petition does not make out any specific material fact which specifically attributes Dhinakaran for corrupt practices. The petitioner is unable to say who is the ‘somebody’ who distributed currencies to voters for voting in favour of whom,” Justice Jayachandran said. 

‘An election petition shall contain a conscience statement of material facts on which the petitioner relies in case, if he pleads corrupt practice. Then the petitioner must put forth all the particulars of such corrupt practice in the petition. This court finds that the averments put forth in the petition lacks material facts to form triable issues and also does not satisfy the mandatory requirement laid down under the Act,” Justice Jayachandran said.

In his petition, Ravi said the byelection was marred by corrupt poll practices and the process was not free and fair. Denying the allegations, Dhinakaran submitted that the basis of the petition was “fraudulently untenable, misconceived, misdirected and full of falsehood.” The allegations were not substantiated with material evidence and the plea deserves to be dismissed, he said.

This teacher is ‘Bhagawan’ for students as they protest his transfer out of school

CHENNAI: As 28-year-old Bhagawan tried to exit the gates of the government high school in Velliagaram on Wednesday, he was engulfed in hugs and tears while his students held on to his arms. Their stance was clear – their beloved English teacher could not be transferred out. 

Demonstrating a kind of love and admiration that is rare to witness in schools today, students of the school in Tiruvallur district staged protests soon after they received the news of their teacher’s transfer. Bolstered by the support of their parents, students even decided not to go to the school on Tuesday to show that the government’s decision of transferring their teacher was not agreeable.

“We don’t want him to be transferred. He has been one of the most supportive staff members and has been like a brother to many of us,” said Nithya, a student. Not every teacher can boast of such love from students. “But then, not all teachers are Bhagawan Sir,” say his students. In a matter of four years, the teacher has formed long-lasting friendships with his students, comforting the teens as brother, ally and guide.

“Many of us were not comfortable with English but with his encouragement, we were able to improve. He was always available to clear doubts at any time of the day and we could call him even late in the evenings after the special classes,” said Tamilarasan, a student.

Instead of merely focusing on syllabus, students said he gave them information on GK, social service, developing skills and prepare for competitive exams and focused on employment-oriented education.

Principal A Aravind said that he had submitted a representation to officials of the education department based on the requests by parents and students. “We have requested the department if there is a possibility of retaining the teacher. He is one of the best teachers we have, completely involving himself in teaching students. During special classes that would go beyond school hours, he would help in arranging food for students and had been overall very friendly,” he said. “The students too are very affectionate by nature, something I find more common in rural schools. It is usually difficult for them to let go of their teachers but this time even parents got emotional,” he added.

Meanwhile, education department officials said the transfer is part of the usual deployment and based on teaching hierarchy. They have to carry it out as per the requirement.

HC declines abused wife’s plea to terminate pregnancy

The Bombay high court on Tuesday refused to entertain the plea a 20-year-old woman, who claimed to be a victim of domestic violence, to medically terminate her 21-week “unwanted’’ pregnancy.

The woman didn’t want to get pregnant until she was educated and had a job, said her lawyer requesting anonymity. “She couldn’t take contraceptive pills as she has epilepsy and her husband refused to use contraception. We presented this as a case of failed contraception that could be treated as an exception in the Medical Termination of Pregnancy Act, but the court rejected the plea,’’ said the lawyer. The woman’s doctors also feared for her mental health if the pregnancy continued. The foetus had no medical anomaly.

On Wednesday evening, Malad-based gynecologist Dr Nikhil Datar posted a message on a social media site about the woman’s case. Stating the woman had registered a case of domestic violence against her husband, he wrote, “They disallowed her to continue her education. (They) kept her nearly in confinement till she went beyond 20 weeks of her pregnancy and then left her.’’ He said the woman came to him for advice after leaving her husband’s home. “However, her pregnancy was 21 weeks—beyond the permitted 20-week abortion deadline under the MTP Act,’’ said Dr Datar. “The cut-off seems illogical and arbitrary,’’ he added.

The woman’s lawyer told TOI that the woman was promised that she would be allowed to study after marriage and the couple would wait before having a child. “But she was forced to stop her studies, there was no use of contraception and she was subjected to violence as well as harassment for dowry,’’ the lawyer added.

“The court refused to entertain the plea stating the woman was married, the foetus had no anomaly and this case didn’t qualify as an exception,’’ the lawyer added.

  செயின் பறிப்பை உள்ளூர் இளைஞர்கள் மட்டுமே செய்வார்கள் என்று போலீஸார் கருதி வந்த நிலையில் இதில் ஈரானியக் கொள்ளையர்களும் ஈடுபட்டிருப்பது போலீஸாரை அதிர்ச்சியில் ஆழ்த்தியுள்ளது. ஒவ்வொரு வகை குற்றவாளிக்கும் ஒவ்வொரு நடைமுறை உண்டு. வீட்டின் பூட்டை உடைத்து திருடுபவர் வழிப்பறி செய்ய மாட்டார். வழிப்பறி செய்பவர்கள் வீடுபுகுந்து திருட மாட்டார்கள்.

வீடு புகுந்து திருடுபவர்களிலும் பலவிதம் உள்ளனர். பீரோ புல்லிங் என தனி வகையான கொள்ளையர்கள் உள்ளனர். 2009-களில் சென்னை புறநகர் பகுதியில் போலீஸாருக்கு சவாலாக பீரோ புல்லிங் கொள்ளையர்கள் இருந்தனர். இதே போன்று கவனத்தை திசை திருப்பி திருடும் கூட்டம் ஒன்று சென்னையில் ஊடுருவி போலீஸாரை திணறடித்தது. சிபிஐ அதிகாரி போல், போலீஸ்போல், வழிப்பறி நடக்கிறது நகையை கழற்றி பத்திரமாக எடுத்துச் செல்லுங்கள் என பொட்டலம் மடித்துக் கொடுப்பது போல் ஏமாற்றி பறித்துச்செல்லும் கூட்டம் ஒன்றும் இருந்தது. இவர்கள் ஈரானியக் கொள்ளையர்கள் என்று அழைக்கப்பட்டனர்.

கடந்த 2013-ம் ஆண்டு இவர்கள் தொடர்ச்சியாக, 50-க்கும் மேற்பட்ட இடங்களில் கவனத்தை திசைதிருப்பி வழிப்பறியில் ஈடுபட்டது போலீஸாருக்கு பெரும் தலைவலியாக இருந்தது. போலீஸார் உள்ளூர் நபர்களை தேடிக்கொண்டிருக்க ஒரு சின்ன க்ளூ மூலம் குற்றவாளி சிக்கினார். அவர் மகாராஷ்டிரா மாநிலம், தானே மாவட்டம், அம்பிவேலியைச் சேர்ந்த, ஆசிப் சபீர் (50) என்பவர் ஆவார்.

போலீஸார் நடத்திய விசாரணையில் அவரது பூர்வீகம் ஈரான் நாடு என்பது தெரியவந்தது. 1970-களில் நூற்றுக்கணக்கான குடும்பத்தினர், ஈரான் நாட்டில் இருந்து இடம் பெயர்ந்து, மகாராஷ்டிரா மாநிலம், அம்பிவேலியில் குடியேறியதாகவும் பின்னர் ஆந்திரா, கேரளா மற்றும் தமிழகத்தில், காரமடை, திருப்பத்தூர், மணப்பாறை உள்ளிட்ட இடங்களுக்கு இடம் மாறியதாகவும் தெரிவித்தார். இவர்களது பிரதான தொழிலே வழிப்பறிதான்.

சிபிஐ அதிகாரிகள், போலீஸார் போல் நடித்து கொள்ளையடிப்பதே இவர்கள் ஸ்டைல். இவர்கள் ஸ்டைலே விமானத்தில் பறந்து வந்து, வழிப்பறி கொள்ளையில் ஈடுபட்டு பின்னர் ஒரு வாரம் தங்கி, வேலை முடிந்ததும், மீண்டும் விமானத்தில் பறந்து சென்று விடுவார்கள். அல்லது சொந்தமாக கார் வைத்திருப்பார்கள். காரில் வந்து வழிப்பறி செய்துவிட்டு பின்னர் காரிலேயே சொந்த ஊருக்கு சென்றுவிடுவார்கள். சென்னை உள்ளிட்ட இந்தியாவின் முக்கிய பெரு நகரங்களில் இவர்கள் கைவரிசை காட்டியுள்ளனர்.

இவர்களுக்கு தமிழ், தெலுங்கு, மலையாளம், இந்தி உள்ளிட்ட பலமொழிகள் தெரியும். அந்த சம்பவத்தில் போலீஸார் ஈரானியக் கொள்ளையர்கள் 15-க்கும் மேற்பட்டோரை கைது செய்தனர். அதன் பின்னர் தற்போது 5 பேர் பிடிபட்டிருக்கின்றனர். இவர்கள் கூட்டாளிகளும் பிடிபடுவார்கள். இதன் மூலம் சென்னையில் செயின் பறிப்புகள் பெரிய அளவில் குறையும் என எதிர்பார்க்கப்படுகிறது.

தீரமுடன் விவேகமாக கொள்ளையர்களைப் பொறிவைத்து அவர்கள் காரில் சென்றதைக் கச்சிதமாக கண்டுபிடித்து தானே முன்னின்று துரத்திச் சென்று பிடித்த வடக்கு மண்டல இணை ஆணையர் பிரேமானந்த் சின்ஹாவுக்கு வாழ்த்துகள் குவிகின்றன.

பிரதமர் மோடியை கிண்டல் செய்யும் விதமாகப் பக்கோடா கடை தொடங்கிய காங்கிரஸ் தொண்டருக்கு லாபம் கிடைத்து அவரின் வாழ்க்கையையே மாற்றிவிட்டது. இன்று வதோதராவில் 35 கடைகளுக்குத் தனது பகோடாக்களை விற்பனை செய்ய உரிமம் அளித்து இருக்கிறார்.

குஜராத் மாநிலம், வதோதராவைச் சேர்ந்த இந்த இளைஞர் நாள்தோறும் 600 கிலோ பகோடாக்களை விற்பனை செய்து, ஆயிரக்கணக்கில் சம்பாதித்து வருகிறார்.

பிரதமர் நரேந்திர மோடி கடந்த சில மாதங்களுக்கு முன் ஒரு தொலைக்காட்சிக்கு அளித்த பேட்டியில், இளைஞர்கள் வேலையில்லாவிட்டால் வருத்தப்படத் தேவையில்லை, மாறாக, பக்கோடா கடைவைத்தால், நாள்ஒன்றுக்கு குறைந்தபட்சம் ரூ.200 வரை சம்பாதிக்க முடியும் என்று தெரிவித்தார். ஆனால், பிரதமர் மோடியின் கருத்து நாடுமுழுவதும் இளைஞர்கள் மத்தியில் பெரும் எதிர்ப்பை உண்டாக்கியது. காங்கிரஸ் கட்சியினர் பல்வேறு நகரங்களில் பக்கோடாக்களை விற்பனை செய்து மோடியின் பேச்சுக்கு எதிர்ப்புத் தெரிவித்தனர்.

இந்நிலையில், குஜராத் மாநிலம், வதோதாரைவைச் சேர்ந்தவர் நாராயண்பாய் ராஜ்புத். காங்கிரஸ் கட்சியின் என்எஸ்யுஐ உறுப்பினராக இருக்கிறார். பிரதமர் மோடியின் பேச்சைக் கேட்டு அவரைக் கிண்டல் செய்யும் விதமாகப் பக்கோடா கடை வைத்தார், ஆனால், அவரே எதிர்பார்க்காமல் அனைத்துச் செலவுகளும் போக, அவருக்கு நாள்தோறும் ரூ.200 முதல் ரூ.400 வரை லாபம் கிடைத்திருக்கிறது.

நான் பக்கோடா விற்பனை செய்கிறேன் என்பதற்காக பாஜகவில் சேரமாட்டேன். நான் சாகும்வரை காங்கிரஸ் தொண்டராகவே இருக்க விரும்புகிறேன். என்னுடைய அடுத்த ஜென்மத்திலும் காங்கிரஸ் தொண்டராகவே இருக்க விரும்புகிறேன்.

என்னுடைய கடைக்கு ராமர் என்று பெயர்வைத்துள்ளேன். ராமாயணத்தில் வருவதுபோல், தண்ணீரில் கற்கள் மிதக்க முடியும் என்றால், ராமர் பெயரைக் கூறி அமித் ஷாவும், மோடியும் நாட்டை ஆள முடியும் எனும்போது, என்னுடைய கடையும் ராமர் பெயரைச் சூட்டி நன்றாக விற்க முடியும்.

நான் 100 கிராம் பக்கோடாவை ரூ.10க்கு விற்பனை செய்கிறேன். காலையில் 7 மணி முதல் 11 மணிக்குள் 300 கிலோ உளுந்துவடை விற்பனையாகிறது, இதேபோல மாலையும் விற்பனையாகிறது
