MADURAI: The Madurai Bench of Madras High Court adjourned a Public Interest Litigation seeking compensatory marks for Tamil medium students who took the National Eligibility-cum-Entrance Test this year, following disparities and errors in the Tamil medium question paper, to Monday.

A division bench comprising Justices C T Selvam and A M Basheer Ahamed heard the counter petition filed by the Central Board of Secondary Education and the Central and State governments which stated that the students, while applying for the exam, were clearly informed by the board that in case of ambiguity in the questions in the regional language, the English version of the question will be final.

The counsels, further defending the government, contended that the petitioner, instead of approaching the court after publishing the results, should have come up with the grievance earlier when the board published its answer keys. They also stated that the rank list for the Tamil Nadu candidates were to be published on June 28 and the subsequent activities including counselling for the admissions should be carried out next week.

Hearing the counter, the judges pulled up the government saying that the mistakes in the questions in the question paper were not mere ambiguity. “This seems to be an escape clause on the cost of the students,” the Judges said and criticised the board asking whether the marks of Tamil students in the examination would be decided based on their proficiency in English. Stating thus, the judges adjourned the hearing.

CHENNAI: Chennai district tops the list of number of candidates eligible for medical and dental admission 2018-2019 counselling with Kancheepuram district in the second place and Tiruvallur district in third place.

Data accessed by Express showed that of the number of candidates eligible to attend the counselling, 2,939 candidates were from Chennai district,1,390 from Kancheepuram district and 1,344 candidates were from Tiruvallur district.

Among the top 10 districts, Salem stands in the fourth place with 1,317 candidates eligible to attend the counselling, Vellore in the fifth place with 1,256 candidates, Madurai in the sixth place with 1,251 candidates, Coimbatore seventh with 1,158, Tirunelveli eighth with 1,155, Tiruchy ninth with 1,144 and Kanyakumari in the 10th place with 975 candidates.

The performance of candidates from backward districts like Sivaganga, Ramanathapuram, Perambalur, and Ariyalur has been negligible. From Sivaganga, 373 candidates were eligible for counselling, Ramanathapuram 350, Perambalur 211 and Ariyalur 316 candidates.

The medical admission is done based on National Eligibility-Cum-Entrance Test (NEET) score. Students who cleared NEET-UG alone are eligible for admission to MBBS and BDS courses.

“This shows the accessibility to NEET coaching centres and socio-economic background of a child, whether the child is able to spend a year or two after completing higher secondary school. Children who can sit with textbooks most of the time without involving themselves in the socio-economic condition in the family can crack NEET. How many children from economically weaker section will get this privilege?” P B Prince Gajendra Babu, general secretary, State Platform for Common School said.

J Kathirvel, general secretary, Tamil Nadu Medical Officers Association said, “The data is a reflection of what we have been highlighting all these years. This shows the disparity between available resources in urban and rural areas. Students from backward districts like Sivaganga, Ramanathapuram and Ariyalur are affected by NEET,” he said.

Meanwhile, as there is a controversy over candidates from other States securing medical seat in the State counselling, the data with the selection committee also showed that 52 students from Kerala, 18 students from Andhra Pradesh, four from Karnataka and 34 from other States are eligible to attend counselling.

Chennai: Health Minister C Vijaya Baskar on Thursday told the Assembly that the President’s office has withheld till date the two Bills relating to NEET examination adopted unanimously by the Assembly last year and that the government had sought reasons for withholding the legislation.

The minister said this while responding to the issue raised by Leader of Opposition MK Stalin during the zero hour. Stalin wanted to know the status of the two NEET Bills and suggested that the government should move the Supreme Court seeking directives to the Centre to take an early decision on the bills. Stalin said there were reports that students hailing from neighbouring States could get admission for medical courses in Tamil Nadu since they managed to produce fake residential certificates. Denying this, the minister said enough screening was being done.

Chennai: Upholding the jail term of 10 years awarded to a school teacher on charge of sexually assaulting a minor girl by a trial court, the Madras high court said that duty of the teacher is not only to impart education, but also to teach moral values and ethics to his students.

Dismissing the petition from science teacher Sivanesan, Justice RMT Teekaa Raman said that, “teachers should be a role model to students.”

According to prosecution, Sivanesan had committed sexual assault on a 11-year-old student in the classroom of a government school near Thirunallar on August 4, 2016, at 3.45 pm. The minor girl sustained injuries and was adm

itted to Government General Hospital, Karaikal.

itted the offence on his student, the trial court has correctly laid the conviction under Section 3(b) and 5(f) of Pocso Act and found him guilty. He is sentenced to undergo RI for 10 years and also to pay a fine of `5,000.”

Dismissing the petition, the judge said, “considering the entirety of the circumstances and the evidences placed by the prosecution witnesses, I am not inclined to grant relief for the present.”

Better to reject loan than running after defaulters: Madras HC

Chennai: In significant observations amid bank fraud cases rocking the country, the Madras High Court on Thursday said banks were giving loans to several persons "under various political pressures" and those who default on repaying them flee from the country.

Justice S Vaidyanathan made the observation in his order rejecting a petition by an aspiring nursing student seeking a direction to the State Bank of India for sanctioning her an education loan after the bank denied it on the ground that her father was a defaulter.

Noting that whether the amount was small or huge, it needed to be recovered from the defaulters, the judge said in this case the SBI was right in rejecting the petitioner's loan application.

"Banks/Financial Institutions are giving loan to several persons under various political pressures and ultimately public money is being misappropriated and defaulters flee from the country. Innocent employees, who are forced to sign the loan grant are ultimately taken to task," he said in the order.

"Rather than running behind the defaulters, a loan can better be rejected at the threshold by identifying a person's credentials. In this case, the bank has rightly done so, as the petitioner's father has defaulted in paying several loans," Justice Vaidyanathan said.

The judge's observations come at a time when the country has been rocked by the Rs 13,000 crore Punjab National Bank fraud allegedly involving diamantaire Nirav Modi and the alleged default by liquour baron Vijay Mallya in paying loan of over Rs 9,000 crore to various banks.

Petitioner submitted she belonged to a downtrodden community and had approached the SBI for an educational loan of Rs 3.40 lakh for pursuing BSC Nursing course.

The bank insisted that she bring the income certificate, identity card, address proof and other relevant documents for obtaining the loan.

Though an application, along with relevant documents, was submitted, the bank refused to grant loan, saying the course does not come under Indian Banks Association's (IBA) educational loan scheme and also that her father was a defaulter.

The bank submitted that the several suits for recovery of loan amounts were pending against the petitioner's father.

நாகை மாவட்டத்தை சேர்ந்த நர்சிங் மாணவி ஏ.தீபிகா. இவர், வேதாரண்யம் பாரத ஸ்டேட் வங்கியில், கல்விக்கடன் கேட்டு விண்ணப்பம் செய்தார். இவரது விண்ணப்பம் நிராகரிக்கப்பட்டதால், சென்னை ஐகோர்ட்டில் வழக்கு தொடர்ந்தார்.

இந்த வழக்கு நீதிபதி எஸ்.வைத்தியநாதன் முன்பு விசாரணைக்கு வந்தது. அப்போது வங்கி நிர்வாகம் சார்பில் ஆஜரான வக்கீல் எஸ்.ஆர்.சுமதி, ‘தீபிகாவின் தந்தை வாங்கிய கடனுக்கு தவணையை முறையாக செலுத்தவில்லை. வழக்குதாரர் கல்லூரி நிர்வாக இடஒதுக்கீட்டின் கீழ் நர்சிங் படிப்பில் சேர்ந்துள்ளார். இந்த நர்சிங் படிப்பு, கல்விக்கடன் வாங்கும் திட்டத்தில் இடம் பெறவில்லை. அதனால் அவருக்கு கல்விக் கடன் வழங்க முடியாது’ என்று வாதிட்டார்.

இதற்கு எதிர்ப்பு தெரிவித்து மாணவி தரப்பில் ஆஜரான வக்கீல் விஜேந்திரன், ‘வழக்குதாரர் தந்தை தவணை செலுத்தவில்லை என்ற காரணத்துக்கு கல்விக்கடனை வழங்க மறுப்பது சரியானது இல்லை. வாங்கிய கடனுக்கு தவணையை வழக்குதாரர் தான் செலுத்த போகிறாரே தவிர, அவரது தந்தை இல்லை’ என்று வாதிட்டார்.

இருதரப்பு வாதங்களையும் கேட்டறிந்த நீதிபதி எஸ்.வைத்தியநாதன் வழங்கிய தீர்ப்பில் கூறியிருப்பதாவது:-

அரசியல் நிர்ப்பந்தத்தின் அடிப்படையில், பல பெரும் புள்ளிகளுக்கு பெரும் தொகையை வங்கிகள் கடன் வழங்குகின்றன. அவ்வாறு கடன் வாங்குபவர்கள், கடனை திருப்பிச் செலுத்தாமல், வெளிநாடுகளுக்கு தப்பி ஓடிவிடுகின்றனர். இதனால், கடன் வழங்க கையெழுத்திட்ட வங்கி ஊழியர்கள் தான் பிரச்சினையை எதிர்கொள்கின்றனர். அதுமட்டுமல்ல, இவ்வாறு கடன் வழங்குவதால், பொதுமக்களின் பணம் முறைகேடு செய்யப்படுகிறது.

கடன் தொகை சிறியதோ, பெரியதோ பிரச்சினை இல்லை. கடன் வாங்கியவர்களிடம் பணத்தை திரும்ப வசூலிக்க வேண்டும். இதற்காக கடன் கொடுத்து விட்டு அதை வசூலிக்க, கடன் வாங்கியவர்களின் பின்னால் வங்கி அதிகாரிகள் ஓடுவதைவிட, கடன் வழங்காமல் இருப்பதே நல்லது.

எனவே, வழக்குதாரரின் தந்தை தவணை தொகையை திருப்பிச் செலுத்தாததால், இவருக்கு கடன் வழங்க முடியாது என்று வங்கி நிர்வாகம் சரியாக முடிவு எடுத்துள்ளது. நர்சிங் படிப்பு, கல்விக்கடன் திட்டத்தில் இடம்பெறாததால், வழக்குதாரர் கல்விக்கடன் பெறமுடியாது. இந்த வழக்கை தள்ளுபடி செய்கிறேன்.

இவ்வாறு தீர்ப்பில் நீதிபதி கூறியுள்ளார்.

தமிழ்நாட்டில் மொத்தம் 22 அரசு மருத்துவ கல்லூரிகள் உள்ளன. இதில் அகில இந்திய இடஒதுக்கீட்டு இடங்கள் போக அரசு மருத்துவ கல்லூரிகளில் 2 ஆயிரத்து 447 இடங்கள், ராஜா முத்தையா மருத்துவகல்லூரியில் 127 இடங்கள், சென்னை கே.கே.நகரில் உள்ள இ.எஸ்.ஐ. மருத்துவகல்லூரியில் 65 இடங்கள், சுயநிதிகல்லூரியில் உள்ள அரசு ஒதுக்கீட்டு இடங்கள் 689 என மொத்தம் 3 ஆயிரத்து 328 அரசு ஒதுக்கீட்டு இடங்கள் இருக்கின்றன. இதுதவிர 516 நிர்வாக ஒதுக்கீட்டு இடங்களும் உள்ளன.

அரசு பல் மருத்துவகல்லூரியில் அகில இந்திய இடஒதுக் கீட்டுக்கான 15 இடங்கள் போக 85 இடங்களும், ராஜா முத்தையா மருத்துவகல்லூரியில் அகில இந்திய இடஒதுக்கீட்டுக்கான 12 இடங்கள் போக 68 இடங்களும், சுயநிதி கல்லூரிகளில் 1,045 இடங்களும் என மொத்தம் 1,198 அரசு ஒதுக்கீட்டு இடங்கள் இருக்கின்றன. இதுதவிர 715 நிர்வாக ஒதுக்கீட்டு இடங்களும் உள்ளன.

மாணவர்களிடம் இருந்து 28 ஆயிரத்து 67 விண்ணப்பங்கள் பெறப்பட்டு இருந்தன. அதில் 181 மாணவர்களிடம் இருந்து ஒன்றுக்கு மேற்பட்ட விண்ணப் பங்கள் பெறப்பட்டுள்ளன. 2 ஆயிரத்து 469 விண்ணப்பங் கள் நிராகரிக்கப்பட்டுள்ளன. ஆக மொத்தம் 25 ஆயிரத்து 417 விண்ணப்பங்கள் ஏற்றுக்கொள்ளப்பட்டுள்ளன.

சிறப்பு பிரிவு விண்ணப்பங்களாக மாற்றுத்திறனாளிகள் பிரிவில்(மொத்த இடங்களில் 5 சதவீதம் ஒதுக்கீடு) 26 விண்ணப்பங்களும், விளையாட்டு வீரர்கள் பிரிவில்(மருத்துவபடிப்பு 7 இடங்கள், பல் மருத்துவம் ஒரு இடம்) 284 விண்ணப்பங்களும், முன்னாள் ராணுவ வீரர்களின் பிள்ளைகள் பிரிவில்(மருத்துவபடிப்பு 10 இடங்கள், பல் மருத்துவம் ஒரு இடம்) 469 விண்ணப்பங்களும் பெறப்பட்டு இருக்கின்றன.

வருகிற 1-ந்தேதி(ஞாயிற்றுக் கிழமை) தொடங்கி 10-ந்தேதி வரை மருத்துவ படிப்புக்கான முதற்கட்ட கலந்தாய்வு நடைபெறுகிறது. முதல் நாளில் சிறப்பு பிரிவு மாணவர்களுக் கான கலந்தாய்வும், 2-ந்தேதி முதல் பொதுப் பிரிவு மாணவர்களுக்கான கலந்தாய்வும் நடைபெறும்.

இந்த ஆண்டை பொறுத்தவரையில் அரசு ஒதுக்கீட்டுக்கு கூடுதலாக எந்த இடமும் கிடைக்கவில்லை. அதேபோல், நம்முடைய இடங்களையும் விட்டுக்கொடுக்கவில்லை. 3 தனியார் மருத்துவகல்லூரிகளின் அங்கீகாரம் இந்திய மருத்துவ கவுன்சிலிடம் இருக்கிறது. அங்கு சேர்க்கை கூடாது என்று கூறி இருக்கிறார்கள். அதை பின்பற்றுவோம்.

இரட்டை இருப்பிட சான்றிதழ், போலி சான்றிதழ் சமர்பிக்கப்படுவதை தடுக்க இந்த ஆண்டு விதியை கடுமையாக பின்பற்றுவோம். தமிழகத்தை பொறுத்தவரையில் தமிழக இடங்களுக்கு விண்ணப்பிக்கும் மாணவர்கள் வேறு மாநிலங்களுக்கோ, வேறு மாநிலத்தில் விண்ணப்பித்தவர்கள் தமிழக இடங்களுக்கோ விண்ணப்பிக்க முடியாது. சுயநிதி கல்லூரியில் அரசு ஒதுக்கீட்டு இடங்களில் முதல் முறையாக வேலூர் சி.எம்.சி. மருத்துவகல்லூரியும் இணைக்கப்பட்டுள்ளது. கலந்தாய்வு வெளிப்படைத்தன்மையுடன் நடைபெறும். இவ்வாறு அவர்கள் தெரிவித்தனர்.
