Govt. concentrating more on liquor than water, says court

In a stinging verdict aimed at the failure of the State to protect wetlands, the Madras High Court has criticised the government for concentrating only on “artificial water” [liquor] than natural water. It ordered that the Tamil Nadu State Wetland Authority (TNSWA) chaired by the Minister for Forests should review the status of wetlands every month.

Justices M. Venugopal and S. Vaidyanathan ordered that the Tamil Nadu State Wetland Authority conduct periodic surprise inspections and field surveys besides creating boundary marks with respect to all wetlands in the State.

Monthly report

A report of such inspections should be submitted to the Chief Secretary every month and a compilation should be filed in court once in three months, they added.

The orders were passed on a public interest litigation petition filed against construction of government buildings on wetlands close to the Buckingham canal. Quoting Tamil poet Avvaiyar’s poem on a ruler’s duty to conserve water, the judges said the present rules of the State had misunderstood the poem and were concentrating only on production of artificial water.

“Likewise, the politicians, instead of taking steps to raise the standard of living of subjects, are enriching themselves and ensuring that their wards also become rich,” the judges indicted.

The judges went on to direct the TNSWA to take coercive steps such as disconnecting electricity and water supply to all those who had encroached upon wet lands.

Fixed responsibility

The TNSWA was also directed to ensure that no further encroachment or illegal construction was made on wetlands.

“This court fixes the responsibility on the Chief Secretary and Tamil Nadu State Wetland Authority for survey and removal of encroachments on the wetlands and any negligence/lethargic attitude noticed shall be viewed seriously,” the judges warned.

“The government should review the works prior to three months of the retirement of each official in the team and ensure that they have discharged their works satisfactorily, failing which the officials may be placed under suspension and dismissed from service for their misconduct,” the Bench said.

No lawyer clears district judge recruitment exam

A majority of candidates score negative marks

In a shocking revelation, not a single advocate out of the 3,562 lawyers who applied for direct recruitment to the post of district judge have been able to clear the preliminary examination conducted by the Madras High Court.

What is more, a majority of candidates have scored negative marks, the highest score being 13.5 out of 150.

On January 13, the High Court as well as the State government issued a joint notification calling for applications from practising advocates, pleaders, Assistant Public Prosecutors and civil judges as well as senior civil judges aged between 35 and 48 years, and with a work experience of more than seven years, for direct recruitment of 31 District Judges.

The selection was to be made through three successive stages with the first being a preliminary examination followed by a main examination and then a viva voce. The preliminary examination conducted on April 7 consisted of two papers containing 150 multiple choice questions in each paper. Paper I was related to civil laws and paper II concentrated on criminal laws.

It was made clear that every correct answer would be awarded one mark and that half a mark would be deducted for every wrong answer. Further, the minimum qualifying marks for Scheduled Caste and Scheduled Tribe candidates was fixed at 45 out of 150. While Backward Class candidates had to score 52.5, the qualifying marks for unreserved category was fixed at 60.

However, when the Recruitment Cell of the Madras High Court released the mark list on Tuesday, it was found that most of the candidates had scored negative marking. One of them had scored as low as -43.5 and the highest score of 13.5 marks was followed by a candidate who had scored 11.5.

This made none of them eligible to even attend the main examinations, scheduled to be held on May 25 and 26, and consisting of much tougher requirements of writing judgments, translating texts and writing essays on current developments in law.

While Backward Class candidates had to score 52.5, the qualifying marks for unreserved category was fixed at 60

CBSE Class 12: Chennai region pass percentage dips

The pass percentage of CBSE Class 12 students in the Chennai region, of which Karnataka is a part, is 92.93 this year. This is a decline of 0.94 percentage points when compared to the region’s performance in the 2018-19 academic year.

The exam results were announced on Thursday.

This year, the Chennai region has retained the second spot in the country in terms of pass percentage like last year. The first spot has been bagged by the Thiruvananthapuram region which secured 98.2 per cent pass.

No student from Karnataka made it to the top three spots, which has been shared by 23 students.

The State toppers are — Jeffin Biju from Sri Chaitanya Techno School and Ananya R. Burli from BGS National Public School. Both secured 493 marks.

HC ends tenure of Kaalikambal temple trustees

The Madras high court has ordered the removal of all the trustees governing the Sri Kaalikambal Kamateswara Devasthanam on Thambu Chetty Street in Parry’s Corner, as the present set of trustees failed to comply with the deadline to conduct election before March 31. The court appointed a ‘fit person’ to administer the affairs of the temple till the next elected board assumes office. New election notification shall be issued on or before the second week of October and election shall be conducted before November 15. The newly elected trust board shall be in a position to take office on or before November 30.

Justice R Suresh Kumar, passing orders on an application filed by devotee JV Mani Achari, held the present trustees could not continue anymore. Pointing out that there is no valid register of worshippers/voters list since the period to enrol the worshippers/voters is available till September 30,he said election for a new trust board can be possible only beyond September. Between now and till the election is completed and new board takes office, the devasthanam shall be administered by a ‘fit person’, said the judge. In accordance with the scheme decree for the board, dated September 25, 1935, Justice Suresh Kumar then named advocate M Baskar ‘fit person’. Along with him, an officer not below the rank of assistant commissioner of HR&CE department, shall be sponsored by the commissioner of HR&CE as the additional ‘fit person’.

According to the decree, there must be five trustees for the board, among them one will be the managing trustee. The board of trustees shall have a tenure of three years (now cut short to two years) and the trustees shall be elected by direct election through ballot. The electoral college will consist of male members having residence in Chennai, aged not less than 25 and not more than 65. Registration of devotees opens between April 1and September 30 of every financial year, and their membership shall expire at the end of financial year.

Since no election was conducted before March 31, the existing voters list has got lapsed. To conduct the new election, a register for worshippers shall be opened between April 1 and September 30. New election process shall start thereafter.

TCS may hold online counselling for admissions to engg courses

In a first, the state government is likely to rope in Tata Consultancy Services (TCS) to conduct online counselling for admissions to engineering courses this year. The counselling, which will be held in two stages, will be monitored by the Directorate of Technical Education.

“The registration of application and certificate verification will be done through inhouse software. But, the government is likely to give the task of conducting online counselling to a vendor. The process is going on,” sources said. Officials from the higher education department said TCS is also under consideration.

As per the schedule, the online counselling will be held from July 3 to 28.

The online registration of applications began on a bright note with more than 15,000 candidates registering on Thursday. “Students continued to register throughout the day. The payment gateways also functioned smoothly,” officials said.

The last date for registering for online counselling is May 31.

“While most students submitted the applications from their own laptops and computers, some approached the facilitation centres put up at 42 places across TN,” officials added.

Officials expect more than 1.5L applicants

After registration, the students would receive confirmation mail and SMS for successful submission of applications. The officials are hoping that the number of applications would cross 1.5 lakh this year.

Anna University, which has conducted engineering counselling for the past 22 years, in 2018 introduced online counselling that passed off without any glitch, said officials.

This year, following differences over reconstitution of Tamil Nadu Engineering Admissions (TNEA) committee, M K Surappa, vice-chancellor of Anna University, resigned from the committee. After that, the government has designated Directorate of Technical Education (DOTE) to conduct the online counselling.

More than a million people are being moved to safety as a tense Odisha battens down the hatches to take on the might of the “extremely severe” Cyclone Fani, which is set to make landfall near Puri between 8am and 10am on Friday.

An estimated 10,000 villages and 52 towns in Odisha will come in the path of the cyclone, which could bring winds gusting up to 225kmph, the Union home ministry said after PM Narendra Modi held a top-level meeting on Thursday to assess preparations for the cyclone.

This could be the first time since the 1999 Super Cyclone that the state would bear the brunt of such a severe storm. The 1999 cyclone killed nearly 10,000 people, battering the state with winds of 270kmph to 300kmph. Cyclone Fani is expected to remain “extremely severe” for four to six hours after landfall, IMD officials said in New Delhi. It will then gradually weaken.

The meteorological department warned of “total destruction” of thatched huts and kutcha houses, major damage to roads and crops, the uprooting of power poles and potential danger from flying objects as the storm moves north-northeastwards after landfall and sweeps through Khurda, Cuttack, Jajpur, Bhadrak and Balasore districts before moving to neighbouring West Bengal.

Around 8 lakh people were evacuated from low-lying areas by 7pm on Thursday and more are being shifted to the safety of storm shelters in coastal areas.

Rail, road and air traffic have been completely suspended in coastal districts.

EC lifts model code of conduct for relief work

Flight operations at the Biju Patnaik International Airport have been suspended for 24 hours from Thursday midnight while more than 200 trains have been cancelled. Operations at Paradip, Gopalpur and Dhamra ports have been closed since Thursday.

The Election Commission of India has, meanwhile, lifted the model code of conduct from 11 districts to facilitate rescue and relief measures. It has also approved shifting of polled EVMs of four assembly constituencies in Gajapati and Jagatsinghpur districts to safer places.

Apart from the massive evacuation operations for cyclone Fani, the state government has appealed to the public to remain indoors on Friday morning and not to come out till the storm passes over.

All educational institutions, commercial establishments, shops and offices will remain closed on Friday morning while movement of vehicles has been restricted. “The state government is fully prepared to tackle the cyclone. Each life is precious for us,” chief minister Naveen Patnaik said, appealing to the people not to panic.

According to the India Meteorology Department (IMD) forecast at 5.30pm on Thursday, the cyclone lay centred at about 275km south-southwest of Puri.

District officials have identified 117 and 107 probable flood inundation villages under Vamsadhara and Nagavali rivers respectively, if they receive more than 1lakh cusecs of flood water. People from these villages would be evacuated.

The entire state administration is on its toes to minimize the damage and loss of lives in the impending calamity. Patnaik held a series of meetings with district collectors and senior officials and was briefed on the state’s preparedness.
