HC ends tenure of Kaalikambal temple trustees

The Madras high court has ordered the removal of all the trustees governing the Sri Kaalikambal Kamateswara Devasthanam on Thambu Chetty Street in Parry’s Corner, as the present set of trustees failed to comply with the deadline to conduct election before March 31. The court appointed a ‘fit person’ to administer the affairs of the temple till the next elected board assumes office. New election notification shall be issued on or before the second week of October and election shall be conducted before November 15. The newly elected trust board shall be in a position to take office on or before November 30.

Justice R Suresh Kumar, passing orders on an application filed by devotee JV Mani Achari, held the present trustees could not continue anymore. Pointing out that there is no valid register of worshippers/voters list since the period to enrol the worshippers/voters is available till September 30,he said election for a new trust board can be possible only beyond September. Between now and till the election is completed and new board takes office, the devasthanam shall be administered by a ‘fit person’, said the judge. In accordance with the scheme decree for the board, dated September 25, 1935, Justice Suresh Kumar then named advocate M Baskar ‘fit person’. Along with him, an officer not below the rank of assistant commissioner of HR&CE department, shall be sponsored by the commissioner of HR&CE as the additional ‘fit person’.

According to the decree, there must be five trustees for the board, among them one will be the managing trustee. The board of trustees shall have a tenure of three years (now cut short to two years) and the trustees shall be elected by direct election through ballot. The electoral college will consist of male members having residence in Chennai, aged not less than 25 and not more than 65. Registration of devotees opens between April 1and September 30 of every financial year, and their membership shall expire at the end of financial year.

Since no election was conducted before March 31, the existing voters list has got lapsed. To conduct the new election, a register for worshippers shall be opened between April 1 and September 30. New election process shall start thereafter.
