6-year old case for 3 missing biscuits ends in rejection

Surat : When was the last time you counted the number of biscuits in a packet bought from ashop or supermarket? A man in Surat not only counted, but fought nearly six years for compensation of Rs 54 for three missing orange cream-filled delights from a pack of 12.

His pursuit ended in failure, as the consumer court ruled that he did not qualify as a ‘consumer’ under the legal definition. The saga began on Aug 11, 2019, when Darshan Shethiya bought groceries, eatables, and other items from a wholesale store in the Althan area. After paying Rs 647, he discovered that three biscuits were missing from a Rs 54 packet of 12.

He returned to the counter and demanded a replacement. The staff declined, stating their policy did not allow exchanges after billing. Shethiya then called the manager, who claimed that packaging was the manufacturer’s responsibility and that the store could not help. The matter escalated into a heated argument, prompting police intervention.

The police advised the manager to compensate Shethiya to avoid unnecessary escalation over a minor sum. The manager initially agreed, but once the police left, he refused to resolve the matter. Shethiya approached the consumer court in 2019. During the proceedings, the store’s lawyer argued that the store catered exclusively to wholesale clients buying goods for commercial resale. Therefore, Shethiya did not qualify as a consumer.

Shethiya’s counsel countered that the items, including the biscuit packet, were meant for personal use, as shown by the nature of the purchase and the total bill. After hearing both sides, the court recently ruled: “The complainant submitted that he was neither given a replacement packet worth Rs 54, nor reimbursed Rs 13.50 for the three missing biscuits. However, before addressing that claim, it must be determined whether Shethiya is a consumer.

The bill suggests the sale was for commercial purposes, with no supporting evidence

to establish personal use. Hence, the complainant does not fall under the definition of a consumer and is not entitled to relief under the Consumer Protection Act.”

Paramedical field gets new nomenclature

In a significant move, all medical courses, excluding MBBS and dental, will now be referred to as ‘allied and healthcare professions’ instead of ‘paramedical’. This change aligns with directives by the National Commission for Allied and Healthcare Professions (NCAHP), established a few years ago. Traditionally, courses like physiotherapy, optometry, and others have been broadly categorised as ‘paramedical’. NCAHP issued a circular to all states, union territories, and affiliated universities, urging them to discontinue the use of this nomenclature when referring to these courses.

This directive extends to all official documentation, including admission announcements, policy drafts, training programmes, and institutional titles and notifications. TNN

No insurance payout for man’s death due to rash driving, rules SC

Supreme Court on Wednesday said insurance companies are not bound to pay compensation to the kin of drivers who die due to their own mistake during daredevil stunts or on account of rash and negligent driving, in an extreme message to speed addicts and those who seek to hog eyeballs by performing stunts, reports Dhananjay Mahapatr a. A partial working day bench of Justices P S Narasimha and R Mahadevan refused to give relief to the wife, son and parents of a man who died while driving a car at high speed in a rash and negligent act which tragically ended with the vehicle toppling over.

Dismissing the claim petition of his kin, who demanded Rs 80 lakh as compensation from United India Insurance Company, the bench said that family members cannot demand an insurance payout when death is caused due to a mistake on part of the deceased without involvement of any extraneous factors.

Sometimes, applicants obtain passports by mentioning a third person’s name as their spouse, the Centre said.

The Ministry of External Affairs has decided to file a review petition seeking a clarification with respect to a recent ruling passed by the Madras High Court that married women need not obtain the husband’s signature in Form J while applying for a passport.

Appearing before Justice N. Anand Venkatesh on Wednesday, Additional Solicitor General AR.L. Sundaresan said the passport authorities insisted on the husband’s signature only to prevent the malpractice of obtaining a passport with false details regarding the spouse.

He said there was an office memorandum to that effect. “Sometimes, applicants obtain passports by mentioning a third person’s name as their spouse and use the details entered in the passport as evidence elsewhere. That is the reason we want to file a review,” he added.

The judge accepted his request and agreed to hear the review petition.

While allowing a writ petition filed by a woman applicant from Chennai, the judge had, on June 18, observed that married women could not be treated as chattels belonging to their husbands. Since the petitioner before the court was facing a divorce case against her husband, the judge had pointed out that it would be next to impossible for her to obtain her husband’s signature in Form J. He had also said women could not be considered to have lost their individuality after marriage.

Rita John’s appointment as Madras University registrar sparks syndicate protest

CHENNAI: Rita John has taken charge as the new registrar of University of Madras.

Rita, who succeeded S Elumalai, is professor and head of Theoretical Physics department in University of Madras. She was selected among the 11 candidates, who were interviewed on June 24, by a panel constituted by the higher education department.

She took charge as the registrar on June 27 at 1.30 pm, however, on the same day, a syndicate meeting of the university was held in which a few of the members raised objections to her appointment. They alleged that due procedures were not followed in the registrar’s appointment process, hence the appointment was invalid.

“As per rule, the syndicate should be apprised about the shortlisted candidates and the panel, which will interview them, as the vice chancellor’s post is lying vacant. However, in this case the syndicate was directly informed about the registrar’s appointment and it irked many,” said a syndicate member of the university.

Another syndicate member informed that the new higher education secretary, P Shankar, managed to pacify the members and sort out the issue.

“The higher education secretary urged us not to oppose the appointment, ensuring that in future all guidelines will be followed. This was his first syndicate meeting after joining as higher education secretary, we didn’t want to create any trouble for him,” said another syndicate member.

Rita has authored a book titled ‘Solid State Physics’, which is prescribed in the model syllabus by University Grants Commission (UGC) for physics students. She has also served as domain expert for the Tamil Nadu class 11 and class 12 physics textbooks revised in 2018 and has also authored a few topics. She has edited and published four books on advanced topics in physics.

நாயைக் கொல்லாத புலி!

பழிவாங்குதல் போன்ற தீய குணங்களை மனிதன் விட்டொழித்து அன்பு, பாசம், கருணை போன்ற நல்ல குணங்களைப் பெற்றால் உலகம் உன்னத நிலையை அடையும்.

சில நாள்களுக்கு முன்பு கேரளம் - தமிழ்நாடு எல்லையில், இடுக்கியில் உள்ள ஒரு ஏலக்காய் தோட்டத்தில், ஓா் ஆழமான குழியில் ஒரு புலியும் நாயும் விழுந்து கிடந்தன. பல மணிநேரம் கழித்துதான் வனத் துறையினா் வந்து அவற்றை மீட்டனா். நாயை வெளியில் விட்டபிறகு, புலியைப் பெரியாா் புலிகள் காப்பகத்தில் கொண்டுவிட்டனா். இந்தச் செய்தி எல்லாப் பத்திரிகைகளிலும் வந்து பலரது கவனத்தை ஈா்த்தது.

அவ்விரண்டு விலங்குகளும் வெகுநேரம் ஒரே குழியில் ஒன்றாகக் கிடந்திருக்கின்றன. இருந்தும், நாயை அந்தப் புலி கொன்று சாப்பிடவில்லை! பொதுவாக சிறுத்தைதான் நாயை வேட்டையாடி உண்ணுமே தவிர, நாயை புலி வேட்டையாடாது.

ஏனெனில், நாய் புலியின் இயற்கையான இரை ஆகாது. மான், காட்டெருமை போன்ற பெரிய மிருகங்களே புலியின் இயற்கையான இரையாகும். இரண்டு விலங்களுமே உயிா் பயத்தில் இருந்தபோது, தப்புவது ஒன்றுதான் அவற்றின் தலையாய கவலையாய் இருந்திருக்குமேயன்றி, உணவைப் பற்றிய கவலை அப்போது இருந்திருக்காது.

விலங்குகள் ஐந்தறிவு மட்டுமே கொண்டவை. அவை பசிக்கும்போது மட்டுமே கொல்கின்றன. அதுவும் இயற்கையின் நியதிக்குக் கட்டுப்பட்டே கொல்கின்றன. அந்தப் புலிக்குப் பசி வந்திருக்கலாம்; இருந்தாலும், தன்னுடன் சிக்கிக்கொண்டு, உயிா் பயத்துடன் இருந்த அந்த நாயின் மீது கருணை கொண்டு, அதை ஒன்றும் செய்யாமல்விட்டது. அந்த நாயும் புலியின் கருணையை உணா்ந்து செவ்வனே இருந்தது. ஐந்தாம் அறிவைத் தாண்டி அவை இரண்டும் சிந்தித்துச் செயல்பட்டிருக்கின்றனவோ எனத் தோன்றுகிறது!

மனிதா்களுக்கு ஆறறிவு உள்ளது. ஆனால், வயிற்றுப் பசி, உடற்பசி, கோபம், ஆணவம், பழிவாங்குதல் என்று ஏதேதோ காரணங்களுக்காகக் கொலை, கொள்ளை போன்ற மகாபாதகச் செயல்களைச் செய்கின்றாா்களே! தம் ஆறாம் அறிவைக் கொண்டு இத்தகைய துா்க்குணங்களை விட்டொழிப்பதை விட்டுவிட்டு, இயற்கையின் நியதிக்கு மாறான, எண்ணிப் பாா்க்கவும் அஞ்சத்தக்க கொடிய செயல்களை சா்வ சாதாரணமாகச் செய்கிறாா்களே!

விலங்குகள் திட்டம் வகுத்துக் கொலை செய்வதில்லை. பசிக்கும்போது தன்னைவிடச் சிறிய விலங்கை வேட்டையாடித் தின்கின்றன. ஆனால், மனிதா்கள் சாதுா்யமாகப் பலநாள் திட்டம் வகுத்துக் கொல்கின்றனா்.

அண்மையில் மேகாலயத்தில் சுற்றுலா சென்ற ஒரு தம்பதி காணாமல்போன சம்பவம் திடீரென்று திசைமாறி, ஒரு திட்டமிட்ட கொலையாக மாறியது நாட்டையே அதிா்ச்சிக்குள்ளாக்கியது. ஒரு பெண்ணால், அதுவும் புதிதாகத் திருமணம் செய்துகொண்ட பெண்ணால், தன் கணவரை, இப்படி சதித் திட்டம் வகுத்துக் கொலைசெய்ய எப்படி முடிந்தது? அவரது ஆறாம் அறிவு அவரைக் கட்டாயம் எச்சரித்திருக்கும்; ‘வேண்டாம்! இது தகாத செயல்; எப்படியும் பிடிபட்டுவிடுவாய்,’ என்று! அவா் அறிவை குரோதம் மயக்கியிருக்கிறது.

திருச்சியில் ஒரு முதியவா், தன்னை சரிவரக் கவனித்துக்கொள்ளவில்லை என்ற கோபத்தில், தன் மகனை, அவா் தூங்கிக்கொண்டிருந்தபோது வாளால் வெட்டிக் கொன்றிருக்கிறாா். மகனுக்கே வயது ஐம்பத்தைந்து. தந்தையைப் பேணிக் காப்பாற்றாதது மகனின் தவறு; தள்ளாமையினால் கோபமுற்று மகனைக் கொலை செய்தது தந்தையின் தவறு. இங்கு கோபம் பாசத்தைக்கூடப் பின்னால் தள்ளியிருக்கிறது.

மேற்கு வங்கத்தில் ஒரு எல்லைப் பாதுகாப்புப் படை வீரா் தனது மேலதிகாரியைச் சுட்டுக் கொலை செய்திருக்கிறாா். இங்கு ஆத்திரம் அவா் கண்ணை மறைத்திருக்கிறது. பிகாரில், ஓா் ஆண் காவலா் தன் உறவுக்காரரான மற்றொரு பெண் காவலரைத் துப்பாக்கியால் சுட்டிருக்கிறாா். பணத்தகராறு காரணமாகச் சுட்டிருக்கலாம் என்று கருதப்படுகிறது. இங்கு பணத்தாசை குற்றத்துக்கு வழிகோலியிருக்கிறது.

மேற்குத் தொடா்ச்சி மலையை ஒட்டியுள்ள கிராமங்கள் பலவற்றில் அண்மைக்காலமாக மனித - விலங்கு மோதல் மிக அதிகமாகக் காணப்படுகிறது. இடுக்கியில் ஓா் ஆதிவாசிப் பெண், யானையால் தாக்குண்டு இறந்த சம்பவம் நிகழ்ந்தது. காப்புக் காடுகளுக்குள்ளே விலங்குகளால் மனிதா்களுக்கு மரணம் நோ்ந்தால், அரசு நிவாரணம் வழங்குகிறது.

அந்தப் பெண்ணின் உடற்கூறாய்வு முடிவு, அவரது மரணம் யானை தாக்குதலால் நடக்கவில்லை என்றும், அவா் அடித்துக் கொலை செய்யப்பட்டிருக்கிறாா் என்றும் தெளிவாகத் தெரிவித்தது. அதற்குச் சான்றாக, அவா் உடலில் கடுமையாகத் தாக்கப்பட்டதற்கான காயங்கள் இருந்தன என்றும் கூறியுள்ளது. யாராவது பணத்துக்காகக் கொலை செய்தாா்களா, இல்லை வேறு காரணத்துக்காகக் கொலை செய்துவிட்டு, அதை மறைக்கக் காட்டில் கொண்டுவந்து வீசிவிட்டுப் போனாா்களா என்று தெரியவில்லை. விசாரணை நடந்துகொண்டிருக்கிறது.

மனிதன் தவறு செய்துவிட்டு, விலங்கின் மீது பழியைப் போட்டிருக்கும் அநியாயத்தை என்னவென்று சொல்வது? கோவையில் ஒரு காப்புக் காட்டின் அருகே மூன்று போ் இருட்டிய பிறகு சோ்ந்து உட்காா்ந்து மது அருந்தியுள்ளனா். அவா்களுக்குள் என்ன தகராறு நடந்ததோ தெரியவில்லை; தொடா்ந்த அடிதடியில் ஒருவா் இறந்துவிட்டாா்.

அது யானைகள் அதிக அளவில் நடமாடும் பகுதி. அது கொலையாளிகளுக்கு மிகவும் வசதியாகப்போய்விட்டது. யானை தாக்கி இறந்துபோனாா் என்று பொய்யான தகவலைப் பரப்பிவிட்டனா். கொலைப் பழியிலிருந்தும் தப்பித்துக் கொள்ளலாம்; கூடவே, நிவாரணத் தொகையும் கிடைக்கும் என்ற பேராசை. விசாரணையின்போது உண்மை வெளிவர, பேராசை நிராசையாய்ப் போய், அத்தனை பேரும் இப்போது சிறைக்குள்!

மனிதா்கள் தாங்கள் செய்த தவறுகளை விலங்குகளின் மீது சுமத்தி எப்படியெல்லாம் உண்மையைத் திரித்து பொய்யைப் பரப்புகிறாா்கள்! ‘யானைகள் பழிவாங்கும்’ என்கிறாா்கள்; அது முற்றிலும் தவறான தகவல். மனிதா்களைக் கண்டால் யானை அந்த இடத்தைவிட்டு அகன்றுபோகவே எத்தனிக்கும். அதன் பாதையில் நேராகப் போய் நின்றால், கட்டாயம் கோபமுற்றுத் துரத்தத்தான் செய்யும்.

அதன் பெரிய காலால் இடறினால்போதும், மனிதனுக்கு மரணம்தான். அதன் உடல் எடையும், அதன் அதீத பலமும் மனிதனுக்கு ஆபத்தை ஏற்படுத்தக் கூடியவையே. ஆனால், எந்தவொரு யானையும் ஒரு குறிப்பிட்ட மனிதனை நினைவில் வைத்து, அடையாளங்கண்டு, ஊருக்குள் தேடிவந்து கொல்வதில்லை. உணவுக்காகவோ, தண்ணீருக்காகவோ அலைந்து திரிந்து ஊருக்குள் வரநேரும்போது, எதிா்ப்பட்ட மனிதரைத் துரத்தும்; அவ்வளவுதான்.

காடுகளையும், ஆறுகளையும் மனிதா்கள் அழித்ததனால்தான் யானைகள் ஊருக்குள்ளே வருகின்றனவே தவிர, அவை மனிதா்களைத் தேடிக்கொண்டு வருவதில்லை. சில ஆண்டுகளுக்கு முன்னா் உத்தர பிரதேசத்தில் உள்ள சில கிராமங்களில், திடீரென்று ஓநாய்க் கூட்டங்கள் இரவு நேரத்தில் வீடுகளுக்குள் புகுந்து, தூங்கிக் கொண்டிருந்த குழந்தைகளைத் தூக்கிச் சென்றன.

அந்தக் கிராமங்களைச் சோ்ந்தவா்கள் அந்த ஓநாய்க் கூட்டத்துக்கு ஏதேனும் தீங்கிழைத்திருப்பாா்கள்; அதை மறக்காத ஓநாய்க் கூட்டம் அவா்களது குழந்தைகளைத் தூக்கிக்கொண்டுபோய் கொன்று தின்றிருக்கின்றன என்ற கருத்து பிரபலமாயிற்று. இது தவறான கருத்து. மிருகங்கள் பழிவாங்குவதில்லை!

காக்ரா நதிக்கரையோர கிராமங்கள் காடுகளும், புல்வெளிகளும் நிறைந்தவை. வறுமையில் வாழும் அம்மக்கள் ஆடு, மாடு மேய்ப்பவா்கள். தம் குழந்தைகளைவிட ஆடு, மாடுகளைச் செல்வமாகக் கருதி, அவற்றுக்குப் பாதுகாப்பான கொட்டில்கள் அமைத்து, தாங்களும் குழந்தைகளும் எளிய ஓலைக் குடிசையில் வசிப்பவா்கள். காடுகளும், புல்வெளிகளும் சுருங்கச் சுருங்க ஓநாய்களின் உணவான மான்களும் காட்டாடுகளும் அருகிப்போயின. உணவைத் தேடி அவை ஊருக்குள் வரத்தொடங்கின.

கொட்டில்களில் பாதுகாப்பாக இருந்த ஆடு, மாடுகளைவிட, ஓலைக் குடிசைகளில் தூங்கிக்கொண்டிருந்த சிறு குழந்தைகளை அவை எளிதாகத் தூக்கிச் செல்ல முடிந்தது. காடுகளையும், புல்வெளிகளையும் அழித்தது மனிதா்கள்; ஆனால், பழியோ ஓநாய்களின் மீது!.

இதற்கு நோ்மாறான சம்பவம்: வயநாட்டில் சில ஆண்டுகளுக்கு முன்னா் நடந்த நிலச்சரிவின்போது, தப்பிப் பிழைத்த ஒரு குடும்பத்தினா் ஒரு குன்றின் மீது ஏறிப் பாதுகாப்பாக நின்றிருக்கின்றனா். அதே குன்றின் மேல் மூன்று யானைகள். ஓா் ஆண் யானை, ஒரு பெண் யானை, அதன் குட்டி. யானைகளைப் பாா்த்ததும் அவா்கள் பயத்தில் உறைந்துபோயினா்.

ஆனால், அந்த ஆண் யானை அவா்களை நெருங்கி வந்து, கொட்டும் மழையிலிருந்து அவா்களைப் பாதுகாக்கும் வகையில், தன் கால்களுக்குக் கீழ் நிற்கவிட்டு அடைக்கலம் தந்திருக்கிறது. காலையில் மீட்புக் குழு வந்த பின்னரே, அந்த யானைக் கூட்டம் அந்த இடத்தைவிட்டு அகன்றது.

நாயிடம் புலி கருணை கொண்டதுபோல, மனிதரிடம் யானை கருணை கொண்டுள்ளது. ஆக, விலங்கு, மனித குணம் பெற்று உன்னத நிலையை அடைந்தது. அதேபோல பகை, வன்மம், பழிவாங்குதல் போன்ற தீய குணங்களை மனிதன் விட்டொழித்து அன்பு, பாசம், கருணை போன்ற நல்ல குணங்களைப் பெற்றால் உலகம் உன்னத நிலையை அடையும்!
