உலகமே வியந்து பார்த்த மீட்புப் பணி: தாய்லாந்து குகையில் சிக்கிய சிறுவர்களை மீட்டது எப்படி?

குகையில் இருந்து அனைவரையும் பத்திரமாக வெளியில் அனுப்பிவிட்டு, கடைசியாக வந்த தாய்லாந்து ‘சீல்’ படையினர் 4 பேர் மகிழ்ச்சியில் வெற்றி சின்னம் காட்டினர்.



தாய்லாந்தில் உள்ள தாம் லுவாங் குகையில் கால்பந்து அணியை சேர்ந்த 12 சிறுவர்கள், பயிற்சியாளர் என 13 பேர் சிக்கிக் கொண்டனர். அவர்களை மீட்க இரவு பகலாக மும்முரமாக மீட்புப் பணியில் ஈடுபட்ட வீரர்கள்.



குகையில் இருந்து அனைவரையும் பத்திரமாக வெளியில் அனுப்பிவிட்டு, கடைசியாக வந்த தாய்லாந்து ‘சீல்’ படையினர் 4 பேர் மகிழ்ச்சியில் வெற்றி சின்னம் காட்டினர்.



தாய்லாந்தில் உள்ள தாம் லுவாங் குகையில் கால்பந்து அணியை சேர்ந்த 12 சிறுவர்கள், பயிற்சியாளர் என 13 பேர் சிக்கிக் கொண்டனர். அவர்களை மீட்க இரவு பகலாக மும்முரமாக மீட்புப் பணியில் ஈடுபட்ட வீரர்கள்.

தாய்லாந்து குகைக்குள் சிக்கிய 12 சிறுவர்களையும் பயிற்சியாளரையும் உயிருடன் மீட்டது உலகை ஆச்சரியப்படுத்தி உள்ளது.

தாய்லாந்தின் வடக்குப் பகுதியில் மியான்மர் எல்லையை ஒட்டி உள்ளது தாம் லுவாங் குகை. சுமார் 10 கி.மீ. தூரமுள்ள இந்தக் குகைக்கு கடந்த மாதம் 23-ம் தேதி ‘காட்டுப் பன்றிகள்’ என்ற கால்பந்து அணியைச் சேர்ந்த 12 சிறுவர்கள் மற்றும் பயிற்சியாளர் என 13 பேர் சாகச பயணம் மேற்கொண்டனர். மலை உச்சியில் இருந்து 800 மீட்டர் ஆழத்தில் இந்தக் குகை அமைந்துள்ளது.

இவர்கள் குகைக்குள் ஒரு கி.மீ. தூரம் சென்ற போது திடீரென பலத்த மழை பெய்தது. இதில் குகைக்குள் வெள்ளம் சூழ்ந்ததால் அதிர்ச்சி அடைந்த சிறுவர்களும் பயிற்சியாளரும் குகைக்கு உள்ளே மேலும் சிறிது தூரம் சென்று மேடான பாறை இடுக்கில் ஏறிவிட்டனர். வெள்ளம் சூழ்ந்ததால், அவர்களால் வெளியில் வர முடியவில்லை. குகைக்கு வெளியே அவர்கள் நிறுத்தியிருந்த சைக்கிள்களைப் பார்த்தவர்கள் அதிர்ச்சி அடைந்தனர். பின்னர் தாய்லாந்து, பிரிட்டன், இந்தியா உட்பட பல நாட்டு குகை மீட்பு வல்லுநர்கள், முக்குளிப்பு வீரர்கள் அங்குக் குவிந்தனர்.

ஒன்பது நாட்களுக்குப் பிறகுதான் அவர்கள் உயிருடன் இருப்பது வெளியுலகுக்குத் தெரிய வந்தது. அதன்பின் கடந்த ஞாயிற்றுக்கிழமை 4 சிறுவர்கள், திங்கட்கிழமை 4 சிறுவர்களை மீட்டு வந்தனர். கடைசியாக செவ்வாய்க்கிழமை 4 சிறுவர்கள் மற்றும் பயிற்சியாளரை தாய்லாந்து ‘சீல்’ படையினர் (கடல், வான், நிலம் ஆகிய 3 பகுதிகளிலும் செயல்படும் திறமை மிக்க வீரர்கள்) உயிருடன் பத்திரமாக மீட்டனர். இதை தாய்லாந்து நாடே மிகப்பெரிய விழாவாகக் கொண்டாடி வருகின்றனர்.

குகைக்குள் சிக்கியவர்களை மீட்டது சாதாரண விஷயமல்ல. சோதனை முயற்சி, தவறுகள், அனுபவம் இல்லாமல் உடனுக்குடன் எடுத்த முடிவுகள், திறமை, தண்ணீரை வெளியேற்றும் ஏராளமான குழாய்கள், மோட்டார்கள், வெள்ளத்தில் மூழ்கிக் கிடக்கும் குகைக்குள் ஆக்ஸிஜன் சிலிண்டர்களை கொண்டு சென்றது போன்ற ஒவ்வொரு விஷயமும் சிலிர்க்க வைக்கும் நடவடிக்கையாகும்.

பிரிட்டனை சேர்ந்த 2 முக்குளிப்பு வீரர்கள்தான் முதலில் 12 சிறுவர்களையும் (ஜூலை 2-ம் தேதி) கண்டுபிடித்தனர். அவர்கள் வெளியில் வந்து சிறுவர்கள் எங்கிருக்கிறார்கள், எப்படி செல்வது போன்ற எல்லா விவரங்களையும் தெரிவித்தனர். அதில் முக்கியமானவர் ஜான் வோலந்தன். அவரைப் பார்த்ததும் சாப்பிட ஏதாவது கிடைக்குமா, இப்போதே எங்களை அழைத்து செல்ல முடியுமா என்றுதான் சிறுவர்கள் கேட்டுள்ளனர். ஆனால், பிரிட்டன் முக்குளிப்பு வீரர்கள் வெளியில் வந்து தகவல் சொன்ன 6 நாட்களுக்குப் பிறகுதான் முழு வீச்சில் மீட்புப்பணியைத் தொடங்க முடிந்தது. அதன்பின், தாய்லாந்தை சேர்ந்த 4 முக்குளிப்பு வீரரர்கள் குகைக்குள் சென்று அங்கேயே தங்கி சிறுவர்களுக்குத் தேவையான அதிக புரோட்டீன் உள்ள உணவுகளைக் கொடுத்து பாதுகாத்துள்ளனர்.

இதற்கிடையில் சிறுவர்கள் இருக்கும் இடத்துக்கு துணிச்சலாக தனியாளாக சென்று ஆக்ஸிஜன் சிலிண்டர் கொடுத்து விட்டு திரும்பும் போது தனக்கு ஆக்ஸிஜன் தீர்ந்து போனதால் தாய்லாந்து கடற்படை முன்னாள் வீரர் சமன் ககன் என்பவர் கடந்த 6-ம் தேதி பரிதாபமாக இறந்தார். இதுவே குகையின் அபாயத்தை மற்றவர்களுக்குப் புரிய வைத்தது.

தாம் லுவாங் குகை நேர் வழி பாதையாக இல்லை. சில இடங்களில் 33 அடி உயரத்துக்கு இருந்தாலும், பல இடங்களில் குறுகிய பாதை, ஏறி இறங்கும் சிறுசிறு குன்றுகள் போன்ற அமைப்புடையது. குகைக்குள் சிக்கிய சிறுவர்களில் பலருக்கு நீச்சலும் தெரியாது. குறுகிய பாதை இருக்கும் இடங்களை ஆக்ஸிஜன் சிலிண்டர்களுடன் கடந்து வருவதும் ஆபத்தானது.

எனவே, சிறுவர்களுக்கு நீச்சல் கற்றுத் தந்து மீட்க வேண்டும். அல்லது வெள்ளம் வடியும் வரை சுமார் 4 மாதம் குகையிலேயே காத்திருக்க வேண்டும். அதுவரை அவர்களுக்குத் தேவையான உணவு, ஆக்ஸிஜன் போன்ற அத்தியாவசியப் பொருட்களை வழங்குவது என்று தாய்லாந்து ராணுவம் முதலில் முடிவு செய்தது. ஆனால், ஒவ்வொரு முறையும் முக்குளிக்கும் வீரர்கள் குகைக்குள் சென்று வருவது ஆபத்தாக இருக்கும். நேரமும் ஆகும் என்று கணிக்கப்பட்டது.

எனவே, மலை உச்சியில் ஓட்டை போட்டு குகைக்குள் இருக்கும் சிறுவர்களை மீட்க முயற்சி மேற்கொள்ளப்பட்டது. குகை சுமார் 10 கி.மீ. தூரம் இருந்தாலும், முட்டு சந்து போல் முடிந்து விடும். குகைக்கு மறுவழி என்று எதுவும் இல்லை. அதனால் குகை முடியும் இடத்தில் பள்ளம் தோண்டி சிறுவர்களை மீட்க முயற்சி நடந்தது. இவை எல்லாம் தோல்வியில் முடிந்தன.

ஆனால், ராட்சத மோட்டார்கள் வைத்து குகைக்குள் இருந்து தண்ணீரை வெளியேற்றும் முயற்சி கை கொடுத்தது. அத்துடன் குகைக்குள் தண்ணீர் நுழைவதைத் தடுக்க உடனடியாக சிறிய அணை உருவாக்கப்பட்டது. குகையில் உள்ள சிறுவர்கள், பயிற்சியாளருக்கு உணவு, மருந்து, ஆக்சிஜன் சிலிண்டர் ஆகியவற்றை சப்ளை செய்யும் பணியை முக்குளிக்கும் வீரர்கள் மேற்கொண்டனர். இந்த மீட்புப் பணியில் கடற்படை வீரர்கள், ராணுவ வீரர்கள், தன்னார்வலர்கள், 20 அரசு துறைகள், முக்குளிப்பு வீரர்கள், குகைக்குள் சிக்கியவர்களை மீட்கும் வல்லுநர்கள் என ஒரு பெரும் படையே ஈடுபட்டது.

இதற்கிடையில் குகைக்குள் 2 முக்குளிக்கும் வீரர்கள் செல்வது, அங்கிருந்து இருவரும் ஒரு சிறுவனை மீட்டு வருவது என்று திட்டம் தீட்டப்பட்டது. முன்னதாக குகையில் இருந்து வெளியில் வரும் வழி முழுவதும் ஒரு கயிறு போடப்பட்டது. அதன் வழியாக 2 மீட்பு வீரர்களும் ஒரு சிறுவனும் நீந்திக் கடக்கும் வகையில் திட்டமிடப்பட்டது. குகைக்குள் செல்லும் 2 வீரர்களில் ஒருவர், சிறுவனுக்கு பொருத்தப்படும் ஆக்ஸிஜன் சிலிண்டரை சுமந்து கொள்வது, மற்றொரு வீரர் சிறுவனை பத்திரமாக வெளியில் கொண்டு வருவது என்று திட்டமிட்டனர். நீச்சல் தெரியாததால், சிறுவர்களுடைய முகத்தில் மூச்சுக் கவசமும் பொருத்தப்பட்டது. ஏற்கெனவே குகைக்குள் உள்ள கயிற்றை பிடிமானமாக வைத்துக் கொண்டு ஒவ்வொரு சிறுவனாக மீட்டுள்ளனர்.

ஆனால் தாம் லுவாங் குகை மேடும் பள்ளமுமாக, சில இடங்களில் குறுகலாகவும் இருந்ததால், நீந்துவது மட்டுமல்லாமல், சில இடங்களில் நடக்கவும், சில இடங்களில் பாறை மீது ஏறுவதும் இறங்குவதுமாக இருந்தது. குகையின் நுழைவு வாயிலில் இருந்து சற்று தொலைவில் மீட்புப் படையினர் முகாம் அமைத்திருந்தனர். அதுவரை சிறுவர்கள் வந்துவிட்டால் ஆபத்து நீங்கி விடும். அங்கிருந்து நடந்தே வெளியில் வரலாம். ஆனால், அந்த முகாம் வரை சிறுவர்களை கொண்டு வருவதுதான் மிகப்பெரும் சவாலாக இருந்தது.

இதுகுறித்து தாய்லாந்து கடற்படையினர் பேஸ்புக்கில் வெளியிட்ட செய்தியில், ‘‘இது அதிசயமா, அறிவியலா, வேறு எதுவோ தெரியாது. 13 பேரும் இப்போது குகைக்கு வெளியில் வந்துவிட்டனர்’’ என்று மகிழ்ச்சி தெரிவித்துள்ளனர்.

பயிற்சியாளர் எக்காபோல் சன்டாவாங்கையும் பாராட்டி வருகின்றனர். வெளியில் இருந்து உதவி வரும் வரை அவர்தான் 12 சிறுவர்களுக்கும் 9 நாட்களாக தைரியம் சொல்லி உயிருடன் இருக்கவும், அவர்கள் சோர்ந்து போகாமல் இருக்கவும் உதவி செய்துள்ளார்.

இந்திய அரசுக்கு தாய்லாந்து நன்றி

தாய்லாந்து வெளியுறவு அமைச்சர் டான் பிரமுத்வினய், மத்திய வெளியுறவு அமைச்சர் சுஷ்மா ஸ்வராஜுக்கு எழுதியுள்ள கடிதத்தில் கூறியிருப்பதாவது:

தாய்லாந்து குகையில் சிக்கிய 12 சிறுவர்கள் மற்றும் அவர்களுடைய கால்பந்து பயிற்சியாளர் உள்ளிட்ட 13 பேரும் பத்திரமாக மீட்கப்பட வேண்டும் என வாழ்த்தியதற்காக இந்திய அரசு மற்றும் இந்தியர்களுக்கு பாராட்டுகளை தெரிவித்துக் கொள்கிறேன். குறிப்பாக, இவர்களை மீட்பதற்காக கிர்லோஸ்கர் பிரதர்ஸ் நிறுவனத்தின் தாய்லாந்து துணை நிறுவனத்தின் மூலம் தொழில்நுட்ப உதவி (திரவ மேலாண்மை) வழங்க ஏற்பாடு செய்த இந்திய தூதரகத்துக்கு நன்றியை தெரிவித்துக் கொள்கிறேன். 13 பேரும் உயிருடன் மீட்கப்பட்ட செய்தியைக் கேட்டு எங்கள் நாட்டு மக்கள் மிக்க மகிழ்ச்சி அடைந்தார்கள். தாய்லாந்து மட்டுமல்லாது பல்வேறு நாடுகளின் நிபுணர்களின் ஒத்துழைப்பு இல்லாவிட்டால் இந்த மீட்புப் பணி சாத்தியமாகி இருக்காது.

இந்த மீட்பு பணியில் இந்திய அரசும் தனியார் துறையும் பெருந்தன்மையுடன் உதவியது இரு நாடுகளுக்கும் இடையே இதயப்பூர்வமான நட்புள்ளது என்பதை பிரதிபலிக்கிறது. அதற்காக, உங்களுக்கும் இந்திய மக்களுக்கும் தாய்லாந்து அரசு, மக்கள், குகையில் சிக்கியவர்களின் குடும்பத்தினர் சார்பில் மனமார்ந்த நன்றியை தெரிவிக்கிறேன். இவ்வாறு அதில் கூறப்பட்டுள்ளது.

உதவி செய்த இந்திய நிறுவனம்

மகாராஷ்டிர மாநிலம் புனேவில் தலைமை அலுவலகத்தைக் கொண்டு ‘கிர்லோஸ்கர் பிரதர்ஸ் லிமிடெட்’ (கேபிஎல்) நிறுவனம் செயல்படுகிறது. இதுகுறித்து கேபிஎல் நிறுவனம் வெளியிட்ட அறிக்கையில் கூறியிருப்பதாவது:

கர்நாடகாவில் கொட்டி தீர்க்கும் கனமழையால் த‌மிழகத்துக்கு 55 ஆயிரம் கனஅடி நீர் திறப்பு: காவிரியில் வெள்ளப்பெருக்கு

காவிரி நீரை தேக்கி வைக்கும் மேட்டூர் அணையின் முழுத் தோற்றம். - (கோப்புப் படம்)

கர்நாடகாவில் கனமழை பெய்துவருவதால் காவிரி ஆற்றில் வெள்ளப்பெருக்கு ஏற்பட்டுள்ளது. இதனால் அணைகளுக்கு நீர்வரத்து அதிகரித்துள்ள‌தால் தமிழகத்துக்கு விநாடிக்கு 55 ஆயிரம் கன அடி நீர் திறக்கப்பட்டுள்ளது.

கர்நாடக மாநில‌த்தில் கடந்த இரு மாதங்களாக தென்மேற்கு பருவமழை பரவலாக பெய்து வருகிறது. கடந்த ஒரு வாரமாக அரபிக்கடலோர மாவட்டங்களிலும் மலநாடு பகுதிகளிலும் விடிய விடிய பலத்த மழை பெய்து வருகிறது. இதனால் தட்சின கன்னடா, வட கன்னடா, உடுப்பி, ஷிமோகா உள்ளிட்ட மாவட்டங்கள் வெள்ளத்தில் மிதக்கின்றன. மங்களூரு, பட்கல், சுள்ளியா, தீர்த்தஹள்ளி உள்ளிட்ட இடங்களில் வெள்ள நீர் சூழ்ந்துள்ளதால் 500-க்கும் மேற்பட்ட வீடுகள் இடிந்து விழுந்துள் ளன.

இதேபோல‌ காவிரி நீர்ப்பிடிப்பு பகுதிகளான குடகு, மைசூரு, மாண்டியா, ராம்நகர், பெங்களூரு உள்ளிட்ட மாவட்டங்களி லும் தொடர்ந்து இரவு பகலாக ம‌ழை பெய்து வருகிறது.

குடகு மாவட்டத்தில் தலக்காவிரி, பாகமண்டலா, மடிகேரி உள்ளிட்ட இடங்களில் நேற்று பெய்த பலத்த மழையால் காவிரி ஆற்றின் குறுக்கே உள்ள ஹாரங்கி, ஹேமாவதி, கிருஷ்ணராஜசாகர் உள்ளிட்ட அணைகளுக்கு நீர்வரத்து பன்மடங்கு அதிகரித்தது.

கபினி ஆறு உற்பத்தியாகும் கேரள மாநிலம், வயநாடு மலைப்பகுதிகளில் தொடரும் மழையால் மைசூரு மாவட்டத்தில் உள்ள கபினி அணைக்கு நீர்வரத்து அதிகரித்துள்ளது. இந்த கனமழையால், கர்நாடகாவில் உள்ள கிருஷ்ண ராஜசாகர் (கேஆர்எஸ்), கபினி, ஹாரங்கி, ஹேமா வதி உள்ளிட்ட 4 அணைகளும் வேகமாக நிரம்பி வருகின்றன. குறிப்பாக கபினி, ஹாரங்கி ஆகிய இரு அணைகளும் முழு கொள்ளளவை நெருங்கிவிட்டன. கிருஷ்ண ராஜசாகர் அணையின் நீர்மட்டம் 11 ஆண்டுகளுக்கு பிறகு ஜூலை மாதத்தில் 115 அடியை தொட்டுள்ளது.

தமிழகத்துக்கு தொடர் நீர் திறப்பு

நேற்று மாலை 6 மணி நிலவரப்படி, மாண்டியா மாவட்டத்தில் 124 அடி உயரமுள்ள கிருஷ்ண ராஜசாகர் அணையின் நீர்மட்டம் 115.20 அடியாக உயர்ந்திருக்கிறது. அணைக்கு விநாடிக்கு 35,980 கனஅடி நீர் வந்து கொண்டிருக்கும் நிலையில், 3,612 கனஅடி நீர் வெளியேற்றப்படுகிறது. கடல் மட்டத்தில் இருந்து 2,859 அடி உயரத்தில் உள்ள‌ ஹாரங்கி அணையின் நீர்மட்டம் 2,857.22 அடியாக உயர்ந்திருக்கிறது. இந்த அணைக்கு விநாடிக்கு 14,973 கனஅடி நீர் வந்து கொண்டிருக்கும் நிலையில், 12,388 கன அடிநீர் வெளியேற்றப்படுகிறது.

இதேபோல கடல் மட்டத்தில் இருந்து 2,922 அடி உயரத்தில் உள்ள ஹேமாவதி அணையின் நீர்மட்டம் 2,912.50 அடியாக அதிகரித்துள்ளது. அணைக்கு விநாடிக்கு 10 ஆயிரம் கனஅடி நீர் வந்து கொண்டிருந்த நிலையில், நேற்று 20,535 கனஅடி நீராக அதிகரித்தது. இதனால் விநாடிக்கு 3,100 கனஅடி நீர் திறந்துவிடப்பட்டுள்ளது. மைசூரு மாவட்டத்தில் கடல் மட்டத்தில் இருந்து 2,284 அடி உயரத்தில் உள்ள கபினி அணையின் நீர்மட்டம் 2282.22 அடியாக அதிகரித்துள்ளது. கபினி அணைக்கு விநாடிக்கு 40,363 கனஅடி நீர் வந்து கொண்டிருப்பதால் 39,667 கனஅடி நீர் மதகுகள் மூலம் திறக்கப்பட்டுள் ளது.

அதிகபட்ச நீர் திறப்பு

கிருஷ்ண ராஜசாகர், கபினி, ஹாரங்கி, ஹேமாவதி ஆகிய 4 அணைகளில் இருந்து மைசூரு, மாண்டியா மாவட்ட விவசாயிகளுக்குப்போக, விநாடிக்கு 55 ஆயிரம் கனஅடி நீர் காவிரியில் தமிழகத்துக்கு திறந்துவிடப்பட் டுள்ளது.

நிகழாண்டில் அதிகபட்சமாக 55 ஆயிரம் கனஅடி நீர் தமிழகத்துக்கு திறக்கப்பட்டுள்ளதால், காவிரியில் வெள்ளப்பெருக்கு ஏற்பட்டுள்ளது. இதனால் காவிரி கரையோர கிராம மக்களுக்கு வெள்ள அபாய எச்சரிக்கை விடுக்கப்பட்டுள்ளது. வெள்ளத் தால் பாதிக்கப்பட்ட மக்கள், பாதுகாப்பான இடங்களில் தங்க வைக்கப்பட்டுள்ளனர்.

காவிரியில் ஏற்பட்டுள்ள வெள்ளப்பெருக்கின் காரணமாக கர்நாடகா - தமிழக எல்லையில் உள்ள பிலிகுண்டுலுவுக்கு நீர்வரத்து அதிகரித்துள்ளது.

இதனால் மேட்டூர் அணையின் நீர்மட்டம் வேகமாக உயர்ந்து வருகிறது. இதன் காரணமாக தமிழக விவசாயிகள் மகிழ்ச்சி அடைந்துள்ளனர்.

மீன் வளர்ப்பின் முக்கியத்துவத்தை எடுத்துரைப்பதுடன், மீன் வளர்ப்போரை ஊக்குவிக்கவும், உள்நாட்டு மீன் உற்பத்தியை அதிகரிக்கவும் மத்திய அரசு 2001–ம் ஆண்டு அறிவித்தப்படி, ஒவ்வொரு ஆண்டும் ஜூலை 10–ந்தேதி தேசிய மீன் வளர்ப்போர் தினமாக கடைப்பிடிக்கப்பட்டு வருகிறது.

தமிழகத்துக்கு மொத்த தேவையில் 70 சதவீதம் அளவுக்கு மட்டுமே மீன்கள் பிடிக்கப்படுகின்றன. அவற்றை ரசாயனங்களை பயன்படுத்தி பதப்படுத்தி வைக்க வேண்டும் என்ற அவசியம் கிடையாது. எனவே, பொதுமக்கள் அச்சப்பட வேண்டாம்.

CHENNAI: Even as students celebrate the court’s directive to CBSE to offer grace marks to students who wrote NEET in Tamil, CBSE officials are contemplating appealing further. “We are waiting for a copy of the judgement. After that we will decide, the further course of action,” said Sanyam Bharadwaj, CBSE-NEET director, who in a previous interaction with Express denied any error in Tamil question paper.

About 24,000 students wrote NEET in Tamil, and if all of them are awarded 196 marks as directed by the court, almost all of them will qualify the exam even if they have scored zero in their original evaluation. That is, all students who got more than -77 marks in the general category, and more than -100 marks in the reserved categories will clear the exam.

The NEET cut off this year was 119 for general category students and 96 for SC, ST and OBC students.

Tamil Nadu has 3,328 medical seats in government and private medical colleges under the State quota. Apart from this, there are 516 seats for students under management quota. Over 2,447 students have already been admitted to 22 government medical colleges in the first round of counselling.

“Tamil Nadu government hurried the medical counselling despite the pending case in court. They shouldn’t have rushed into it without considering the seriousness of the case,” said educationalist Prince Gajendrababu.There were 49 translation errors out of 180 questions in the Tamil NEET question paper, pointed Tech4All, a city-based NGO that provides tech solutions for social problems. The questions with errors account for a total of 196 marks.

T K Rangarajan, MP from the Communist Party of India (Marxist) filed a public interest litigation seeking grace marks for all students who wrote NEET in Tamil.However, there is no decision yet if UG medical counselling will be re-conducted, taking these students into account. Engineering admissions too may get delayed if medical counselling gets pushed.

When asked if the medical admission counselling will be conducted again fresh, Health secretary J Radhakrishnan said “We can’t comment on direction to CBSE. Let us wait for CBSE to decide (its) next course.”

Higher education Minister KP Anbalagan on Tuesday said the dates for Tamil Nadu Engineering Admissions would be declared soon even if there is a delay in medical admissions.Only 1,337 students of the 9,154 (14.6 per cent) students who cleared the exam were from government schools in Tamil Nadu. This judgement may change that percentage drastically.

Fly Emirates, pay less for some UAE tourist visas from July 1

People flying Dubai-based Emirates will now need to pay less for some categories of UAE visas. The visa fee for 30-day validity tourist visa has from July 1 been dropped from previous ₹6,300 to ₹5,230, Dubai Visa Processing Centre (DVPC), an exclusive facility of VFS Global for Emirates and government of Dubai for processing UAE visas, has told Indian travel agents in a circular. The DVPC visa fee for express tourist/ express 14 days and express 96 hours visas have been dropped to ₹6,715 and ₹4,945 from ₹7,775 and ₹6,005 earlier, respectively. Thanking ‘patrons’, DVPC says in the circular: “Over 15 years of your valued partnership with VFS Global’s UAE visa… It’s only your trust in us which has helped us process over 3 million applications since our inception and helped us become experts in UAE visa processing… We extend our happiness to you by revising our prices.”

The move comes less than a month after UAE decided that people flying between India and the rest of the world through its mega hubs like Dubai and Abu Dhabi will be able able to get a free transit visa to spend up to two days there. The UAE government has decided to grant free transit visas for first 48 hours to transit passengers and this visa can be extended for up to 96 hours by paying 50Dirhams(about₹930).However,thedate from which this will be allowed is yet to be announced. Seeking to clear the air over inclusion of the Jio Institute of Reliance Foundation as an institute of eminence, the government said on Tuesday that the institute has been given a letter of intent and will not get the full fledged status till it complies with required regulations in three years.

In the wake of a social media storm over Jio Institute’s selection despite it not being up and running, the government said the University Grants Commission regulations provide for a completely new proposal for greenfield projects and said it is likely to announce another list of “institutions of eminence” soon.

The ministry of human resource development stated that the status has been granted under the “greenfield” category based on the empowered experts committee’s (EEC) recommendation.

But with many established institutions ignored in the list of IoEs announced on Monday while the yet to be launched Jio Institute getting the nod, there was a flurry of adverse commentary. Among political parties, CPM strongly criticised the decision.

A clarification by the HRD ministry said a separate category of applications has been invited from sponsoring organisations for setting up new or greenfield projects according to UGC rules.

According to R Subrahmanyam, secretary, higher education, MHRD, “The regulation of institution of eminence has given three categories – public institutions, institutions which are currently running under which BITS Pilani and Manipal were recommended and the third is the greenfield institutions, which are private institutions which are not there right now. Recommendations of the EEC were on all three categories.”

In all 114 institutions applied for IoE, including 29 currently functioning private institutions, of which two were selected. In the greenfield category there were 11 proposals.

On the Jio decision, Subrahmanyam said: “Where the institution is starting on a greenfield mode they will only get a LoI. The LoI says that you must set up the institutions within three years...It is only a LoI given to Jio and if they set up an institution with good vice-chancellor and a requisite campus will they get affiliation.”

He said the government has gone with the recommendation of the committee that found only one application was eligible in the greenfield category. “The committee in their own wisdom after due diligence after reading their proposals and their vision statements and looking at their ability to mobilise land, building and other core team they have come to a conclusion...We are respecting their judgement as this committee consists of people with impeccable integrity and lot of public service,” added Subrahmanyam.

Interdisciplinary courses expose students to a lot more than their regular curriculum. Any interdisciplinary course has a huge advantage over a pure disciplinary course. The core difference between the two is that the latter makes a person more adaptable. Several interdisciplinary programmes have received an overwhelming response from students and teachers alike, thanks to the variety they offer. A classic example is courses in mass media offered by many universities.

The beauty of such programmes is that it exposes students to several streams like pure arts, liberal arts, fine arts, commerce and management at one go. They also learn film-making, research, history, advertising and journalism. While a number of students looking to make a career in this sector continue to opt for the traditional B.Com. degree, universities across the country are now offering a multitude of professional degree courses that enable a better understanding of the industry while opening up a number of job prospects. Also, interdisciplinary courses make students more employable. This is because most of these courses focus on live projects and seminars beyond the syllabus, in comparison to pure disciplinary courses that usually focus on theory.

BJP president Amit Shah’s cryptic statement about Tamil Nadu being among the most corrupt states in the country may have created some political ripples, but senior leaders admit that AIADMK and actor Rajnikanth were very much in the saffron party’s scheme of things for forging a strong alliance for the 2019 Lok Sabha elections.

Much of Shah’s political speech targeted UPA and there was no mention of AIADMK, pointed out state BJP leaders. Ahead of Shah’s tour to Chennai on Monday fora party meeting to draft a TN strategy for the general elections, BJP national general secretary Muralidar Rao said Rajini would play a significant part in the party’s poll plans for the state.

Rajini’s preference for ‘spiritual politics’ would suit BJP’s Hindutva ideology, state leaders said. “There has been no open talk about alliance matters yet,” said an office-bearer of the party, who attended a meeting of senior leaders with Shah on Monday.

“But we read the mind of our leader during the meeting. It’s a clear message that our options are open. Rajinikanth and AIADMK are definitely on the top of the party’s list and even the DMK is not being ruled out,” said the leader.

BJP state president Tamilisai Soundararajan said that the party president had insisted on developing and strengthening all the microlevel committees and roping in representatives from all the dominant linguistic and caste groups.

“We will discuss about the alliances once we strengthen our base. We are aiming at increasing the booth level committee members to 1.25 lakh. We are half way to achieving it. But we are not ruling out any possibility,” she said when asked about potential alliance partners AIADMK and Rajinikanth.

The state BJP would strive to fulfill its Tamil Nadu Mission to have a strong presence in all the 66,000 booths for the coming election. But, it is keen on having superstar Rajinikanth with his huge mass appeal or a party like the AIADMK “that has widespread and deep rooted base” in Tamil Nadu or both.

“Such a combination will help us strengthen our base in the state. We are working on other options too,” said another leader, who attended the meeting.



‘Shah speech was poorly translated’

Seeking to play down BJP president Amit Shah’s criticism that Tamil Nadu was the most corrupt state in the country, the ruling AIADMK on Tuesday said the BJP leader only meant electoral corruption and it was not aimed at the government. Senior minister D Jayakumar said Amit Shah’s speech was poorly translated during the party event held in Chennai on Monday. “A national leader visits the state to strengthen the party and propagate his party’s principles, like any other party. He would have talked nicely about the government. I think the translator got it differently,” the minister said. The BJP president talked about cash for vote and AIADMK had nothing to do with it, he said. “DMK is notorious for its Thirumangalam formula (the January 2009 byelection in this assembly constituency was marked by allegations of voter bribing). There is also another ‘Token king’ (referring to allegations of voter bribing against T T V Dhinakaran in the December 2917 R K Nagar byelection). Amit Shah would have talked about it,” said the minister. Meanwhile, TNCC chief S Thirunavukkarasar said in Madurai that the BJP had no base in Tamil Nadu and Shah’s statement that Tamil Nadu was a corrupt state was highly condemnable. TNN

Mobile ban makes Meenakshi temple more hospitable

The ban on use of mobile phones at the Sri Meenakshi Sundareswarar temple has turned out to be a blessing in disguise as pilgrims are now moving faster without hindering the movement of others. The temple draws thousands of devotees, including tourists, every day.

After the fire ravaged the Vasantharayar Mandapam within the temple in February this year, the Madras high court had suggested the Hindu Religious and Charitable Endowments (HR&CE) department to takes steps to control the use of mobile phones within the temple premises as a security measure.

Special locker facility has been set up at the five-tower entrance for safekeeping of cellphones which the devotees bring along with them to the temple. The facility can store 8,000 cellphones at a time, with 40 employees deputed to take care of them.

Joint Commissioner of the temple N Natarjan said that managing the crowds within the temple has become easy after the mobile phones were banned. “They move faster now. Earlier, our employees faced problems with some pilgrims who were trying to take videos of deeparathana. All that has come to an end,” he said. Natarajan says that this is a good model to be implemented in other temples also.

An employee at the cellphone keeping centre said that the only problem was the entire process of collecting the details of the phone as well as the owner, which is done manually by noting down on a paper and giving a carbon copy of it to the customer. “Processing will be faster if it is computerised,” he said.

A photographer has been appointed by the temple to give anyone have their visit to the temple photographed. Earlier, when mobile phones were allowed, almost everyone used to click pictures including selfies at the temple. Now only about 100 pose for a snap by the temple photographer.

“People have become so obsessed with their phones. Some come out in half-an-hour, anxious over the safety of their phone. Anyone coming to this temple knows that going around in less than an hour is not possible,” said a temple employee.

Hurried Tamil Nadu Lokayukta Bill makes a mockery of its people

The way the Lokayukta Bill was introduced and hurriedly passed on the last day of the state assembly session gives an inkling about the intention and effort that went into it — making one wonder whether it was done to protect the corrupt or to fight corruption.

The Lokpal and Lokayuktas Act, 2013 was passed in Parliament after a significantly large people’s movement and following a series of consultations. Section 63 of the act clearly stated that every state shall pass a Lokayukta Act within a year of the central act coming into effect. However, Tamil Nadu had no intention of doing so until the Supreme Court asked them to implement Lokayukta and report progress by July 10.

On Monday, the draft bill was placed in the assembly and passed within a few hours without much discussion and zero amendments. Multiple requests from civil society to place the draft bill for public view were not heeded. The need for Lokayukta is to have an independent investigating agency as the present body, Directorate of Vigilance and Anti-Corruption (DVAC), is under the control of the state government. This basic point has been defied in Tamil Nadu’s Lokayukta Bill.

The Lokayukta Bill passed in the assembly is just a copy of the central act with few changes. While the Lokpal has several flaws, the Lokayukta Bill has made it worse. One of the most important requirements of independence in selection and appointment of staff has been ignored. The head of the Lokayukta in Tamil Nadu will be appointed by the chief minister, assembly speaker and opposition leader, making it convenient for the ruling party to have a person of its choice as head.

In contrast, the Lokpal selection committee had the Chief Justice of India and an eminent person selected by the other four apart from the Prime Minister, Speaker of the Lok Sabha and leader of the opposition. Second, with respect to appointment of officials and staff, the Lokpal Act and several other states have given the power to the head of the institution. In Tamil Nadu, this power too rests with the government.

While making inquiries about elected representatives will be done by the Lokayukta, the preliminary investigation of all Group A, B, C, D officials is to be done by the vigilance commission, which is under the state government. For Group A and B officials, the commission will submit a report to the Lokayukta, which will conduct a detailed inquiry if needed. For Group C and D officials, the vigilance commission will decide on the next course of action. This makes the investigation meaningless and dependent on the state. In such a case, the DVAC should have come under the Lokayukta. Further, the Lokayukta after inquiry will forward the report to the competent authority in the government for action. This means the body in TN has no independence in terms of functioning. Lokpal and states such as Bihar, Odisha and Karnataka have their own prosecution wing to chargesheet the accused and prosecute in a special court. Absence of these provisions has meant the Lokayukta in Tamil Nadu will be toothless.

The state government also imposes a limitation of four years regarding filing of complaints from the occurrence of alleged corruption. States like Bihar have no such time restrictions, while Odisha and the Lokpal Act allow for seven years.

States like Odisha and Karnataka, and the Lokpal Act mandate declaration of assets of public servants every year, but the Lokayukta in Tamil Nadu has no such provision. Exempting matters related to local bodies, transfers, postings and contracts from investigation raises serious doubts over the bill.

The bill must be returned by the governor as it lacks the essence of an independent investigation agency.

‘Politicking in educational institutions should TOI stop’

Why has no Tamil Nadu institute made it to the list?

Most of the state-run institutions don’t have enough money and many staff positions are vacant. Though it was not a criterion, we looked at staff vacancies because it affects research. While old institutions such as Madras University have invested in research, newer institutions focus only on teaching. The target in the next 10 years is not to be just a top Indian institution, but to feature in the top 500 international rankings. The capability is assessed from that point of view. International rankings have fixed parameters and focus should be on research and output of faculty. And it’s not any just research paper. We look for papers that have high citations. Unless it’s worthwhile it won’t get quoted. If universities are not ready with ’ these they won t make it to the list.

IIT-M has a high research output, it is also considered to be one the best in the country. Why did it not make it to the list?

There is no doubt that it is a good institution. We had given a longer list to the Centre, but it was decided to have just three institutions in the private sector and three in the public sector. So to qualify for the top three, we had to choose the one that does better. With higher slots in the international rankings, IIT Delhi and Bombay had better chances. And it’s not IIT-M’s fault. In world rankings, the number of foreign faculty and students play a part. Many don’t choose Chennai because of the heat; they prefer a more salubrious climate. So, although research and per person output at IIT-M may be good, they were behind others in the international ranking.

What should institutions do to get on to the list next time?

The institutions themselves know this. Look at the scandals in Tamil Nadu’s universities. Despite this they did not do badly in the recent Indian ranking. Madras University did well and Anna University did better. These institutions have displayed they have potential.

If they are good, where is the problem?

Politicking should stop in educational institutions. Many of the government institutions across the country are fund-starved. If you increase salary of teachers without increasing fee as a social welfare policy, it’s the state’s choice. But for this you can cut other budgets. Some universities have up to 50% staff vacancies. How can we expect proper teaching? Where is the time to invest on research? Ensure selection of teachers is based on merit and not on a phone call. Like many developed countries, we may not be able to afford one teacher for 30 students, but we must at least not have vacancies in sanctioned strength.

Jio University is yet to come up. How did you grant it IoE status?

The policy was framed to allow institutions to apply under the ‘green field’ category. Unlike the five other institutions, Jio University will not have the status from day one.

They will get the letter of intent only after we sign a memorandum listing all the promises they have made. In three years, they will have to write to the Centre saying they have fulfilled all the promises and then they will be awarded the status. It was a stringent evaluation process. There were 113 applications, of which 40 were from private and 73 public institutions.

About 16 months after S Dashvanth, a computer engineering graduate, sexually assaulted and murdered a seven-yearold girl at his house in Mugalivakkam, the Madras high court confirmed his death sentence saying his character was beyond redemption and that his reformation was but a distant dream.

Issuing the order against the 23-year-old, a division bench of justices S Vimala and S Ramathilagam, said: “Let the last second of this accused, at the long end of the rope, be the last second of the lust of potential offenders of the world towards womenfolk.” If at all there is a case warranting award of death, it is this, the judges said.



‘Mind of the accused reflected in the way he tried to dispose of the body’

Dashvanth lured a seven-yearold girl, his neighbour, sexually assaulted her and killed her. He took the body in a bag and torched it in a deserted area in February 2017. Till his role was exposed, he joined the team of police and family members searching for the missing girl. After a long stay in jail, he came out on bail, only to murder his own mother and flee to Mumbai with jewellery stolen from his own house. He was nabbed in Mumbai, but escaped from police custody, before being caught again within a day.

After so much drama, Dashvanth was sentenced to death by Chengalpet mahila court in the sexual assault-murder case on February 19, 2018. The present bench of the high court heard both the mandatory referred trial (RT) and regular appeal filed by Dashvanth against his conviction.

Confirming his death sentence with heavy heart, the all-women bench of the high court on Tuesday said: “Opponents of capital punishment may brand it as surrender of our emotions to grief and fear. But for the supporters, this is totally false. Many of us would find it hard even to kill an ant, much less a man. Accepting capital punishment means not that we surrender our emotion, but that we overcome it.”

Further, pointing out to the allegation that he had even murdered his mother, before fleeing to Mumbai jumping bail during the trial in the present case, the court said the act of accused clearly shows that reformation of the accused is a distant dream and, therefore, prudence should prevail in sentencing the accused to death.

Noting that the court though swayed by the demands for abolition of capital punishment from the pages of penology, is still conscious of the larger social interest and attendant implications of letting out the criminals involved in child sexual abuse, the bench said: “Left with the Hobson’s choice of sticking to the capital punishment as the appropriate punishment for the accused, we thereby, concur with the reasoning offered by Brutus after assassination of Caesar in Shakesperian history. Brutus said, I loved Caesar less, by that I loved Rome more.”

Answering to an ancillary contention to consider that the age of the accused must be considered, while imposing punishment, the bench said, it is to be pointed out that though age is a factor, it is not a determinative factor, for deciding the punishment. “This court is of the considered opinion that the mind of the accused is reflected in the way the body of the deceased had been tried to be disposed of. It shows the ruthless character of the accused, which shows that the mind is beyond reformation,” the court added.

After pronouncing the judgment, the court granted leave to the accused to file appeal in the Supreme Court as requested by the counsel for accused.

First transsexual SI files police plaint against ex

The country’s first transsexual police officer, K Prithika Yashini, has charged her former boyfriend with harassment.

In a complaint to the Aminjikarai police, Prithika, a sub-inspector, said she had a relationship with Janardhanan after meeting him on Facebook a few years ago.

They had differences of opinion and separated around the time she received her first police posting a year ago, she said. She had not been in touch with him since then.

She recently started to receive disturbing calls and messages from Janardhanan, Prithika said in the complaint. She said she made it clear to Janardhanan that the messages and calls were unwelcome.

The Aminjikarai police registered a case and questioned Janardhanan. They let him off with a warning after he promised officers that he would not attempt to contact Prithika again.

“We took an undertaking from Janardhanan before letting him go,” a police officer said.

Prithika, born in Salem in 1990, was the son of an autorickshaw driver, P Kalaiarasan, and a homemaker, Sumathi. As an adult, she underwent a sex change operation and changed her birth name of Pradeep Kumar.

She applied for the post of sub-inspector in February 2015, but came up against a brick wall in the Tamil Nadu Uniformed Services Recruitment Board, which rejected her application. Prithika moved the Madras high court, stating that the board had rejected her application for the post of SI on the grounds that the application had only two columns — male and female — for candidates to indicate their gender.

In a milestone November 2015 ruling, the court directed the board to include members of the transgender community under a “third category”.

TN to write to Centre on UGC revamp: Higher edu minister

Tamil Nadu will soon be writing to the Centre against the revamp of University Grants Commission (UGC) and continue with the present model of funding universities across the country, said Tamil Nadu higher education minister K P Anbalagan.

The ministry has set a July 20 deadline and plans are on to send the letter this week, he added on the sidelines of an event here on Tuesday.

In response to queries on Anna University counselling, he said the government will be approaching the Madras high court on July 13 to take a call on the schedule to fill seats.

Referring to colleges in neighbouring states, he denied claims that there was no significant change in number of students aspiring to join engineering in colleges affiliated to Anna University though more have expressed interest in joining arts and science colleges.

The Madras HC order awarding 196 ‘grace marks’ to students who appeared for NEET in Tamil has in one stroke guaranteed admission for even those whose original score was zero or even minus

100. After the HC pronounced its order, 24,720 students who wrote the exam in Tamil were excited, as almost all of them will automatically qualify for MBBS/BDS admission.

Smiles, however, were off the faces of many students already given admissions, with many saying the court largesse would hit their prospects. The students awaiting the second round of counselling, under state and all-India quota, fear the order will scuttle their chance of getting a seat.

‘CBSE doesn’t have capacity to run its own examinations

’A beaming E Manikantan said, “There is some justice finally. Our son wrote the examination in Tamil and had scored 182. But he was unable to get a MBBS seat as cut-off for BC category in all colleges in the state counselling was 344. Now, with 378 marks he will get a seat in a government college.”

However, P K Jhanavi, who secured 462 in NEET and was admitted to Kilpauk Medical College and Hospital in the first round of counselling, said: “Why couldn’t they have pushed counselling until the judgment is delivered? I am ready to start classes and it would be sad if I have to give up my seat,” she said.

While officials at the CBSE said they were seeking legal opinion to go on an appeal, state selection committee secretary Dr G Selvarajan said he was awaiting instructions from the government.

The state government is unlikely to go on an appeal as the order favours those who wrote the examination in Tamil.

Educationist S S Rajagopalan demanded absolute power to state government for admission. “CBSE doesn’t have the capacity to run its own examinations and is haggled with the responsibility of conducting such a big examination without human resources. NEET should be abolished,” he said.

Career consultant Jayaprakash Gandhi said, “We have no option but to create additional seats in government colleges to accommodate larger number of students.”

S Vaidhyasubramaniam, Sastra University dean (planning and development), said it would have a cascading effect on other professional counselling, including engineering, veterinary sciences, agriculture and Indian medicine.

“Premier colleges may lose students in the top slot if the entire rank list gets altered,” he said.

Madurai: In a ruling that can upend the ongoing MBBS and BDS admissions across the country, the Madras high court on Tuesday ordered awarding 196 ‘grace marks’ to more than 24,000 students who wrote NEET-2018 in Tamil. The court also stayed the ongoing MBBS admissions based on the present merit list, and gave CBSE two weeks to come out with a fresh list of qualified candidates factoring in the grace marks.

Lambasting the CBSE for inaccuracy and wrong translation of 49 questions, each carrying four marks totalling 196, a division bench of justices CT Selvam and AM Basheer Ahmed said: “The list of qualified candidates shall be kept in abeyance as would the counselling, pending publishing details of the qualified candidates afresh.”

The bench was passing orders on a PIL filed by CPM MP T K Rangarajan who claimed that there were translation errors in the Tamil NEET question paper and sought grace marks for all the students. For instance, the word ‘cheetah’ was translated literally as ‘Seetha’ while technical words like multiple allele and Ureter were also translated incorrectly, he had said.

The judges, observing that students who took the exam in Tamil should be given a level playing field, directed the CBSE to grant 4 marks each to the 49 erroneous questions for all those who wrote the exam in Tamil.

The judges also rejected the CBSE’s response, submitted to the court on July 6, that subject experts in regional languages concerned had been requested to translate the NEET question paper from English, and that since they were already teaching the subjects in regional medium, they were aware of the technical terms and so did the students.



Unable to accept CBSE’s response, says Madras HC

The judges said, “We are unable to accept the response given by CBSE.” They added that assuming students’ knowledge of technical terms because their teachers knew them was presumptuous.

They also questioned the board as to how could they determine the marks of Tamil medium students based on their knowledge of English.

“We are left wondering whether the CBSE, a board entrusted with the conduct of examination at the national level, can be so uncertain about the answers to questions raised by it,” the order said, pointing out that such an ambiguity could be acceptable in civil services, but not in NEET which was meant for students in the age group of 17-18.

“The difficulty of a student taking the exam of such importance in understanding rightly a wrong question, be however so mild, is to be appreciated placing ourselves in their shoes and not in the shoes of those having leisure of easy chair reflection,” the order said.

On a parting note, the order also touched upon the issue of private students being ineligible to appear for NEET exams.

Stating that there are tens and thousands of students who pursue private study by working since they are in a position to support their families financially, the court said the board should allow such students in future. “At the end of the day, our constitutional scheme is inclusive, not exclusive. We trust the issue will engage the attention of the authorities,” the order said.

He committed the crime in a fit of rage, say police

Daswant is set to face trial soon at the mahila court in Chengalpattu for the murder of his mother Sarala.

After being convicted by the same court here in February for the rape and murder of a 7-year-old girl, Daswant was charged in March with the murder of his mother.

Filing a chargesheet against him before the judicial magistrate’s court, Sriperumbudur, the Kundrathur police accused him of killing his mother, enraged over her refusal to give him money for personal expenses and for chiding him for murdering the girl.

Following the girl’s murder, the family shifted to Madhanandhapuram, near Kundrathur, and he stayed with his parents while on bail. Just before the commencement of trial, he murdered his mother and fled to Mumbai. After a long struggle, the police traced him on December 8 in Mumbai.

The case of the prosecution is that on December 3, Daswant took an iron hammer and hit his mother on the head. Sarala died on the spot, of injuries due to shock and haemorrhage. The accused knowingly and intentionally committed the offence of murder punishable under Section 302 of the IPC, the police charged.

Framing of charges

The chargesheet was forwarded to the mahila court for trial. Mahila court judge P. Velmurugan, after taking the file, completed framing of charges against Daswant.

DGCA amends rules on flight duty

Pilots and flight attendants will now have to work longer hours after the aviation regulatory body, the Directorate-General of Civil Aviation (DGCA), amended its rules to allow airlines to extend duty timings of the crew during a medical emergency, a natural calamity, technical malfunction and unfavourable weather conditions.

Mandatory timings

The DGCA has laid down flight duty time limitation (FDTL) and rest timings for pilots and flight attendants, which have to be followed mandatorily by all airlines to prevent fatigue-related safety issues.

While the rules allowed airlines exemptions under exceptional circumstances, they did not define what those situations would be.

The aviation regulatory body has now spelt out the circumstances during which airlines will be allowed to extend shift timings of their crew to “avoid inconvenience to passengers.”

‘Duty-bound to listen to cries of victims’

Observing that courts were duty-bound to listen to the silent cries of victims of child sexual abuse, the Madras High Court on Tuesday confirmed the death sentence imposed by a trial court on 23-year-old S. Daswanth for sexually assaulting and murdering a seven-year-old girl at an apartment in Mugalivakkam near here on February 5, 2017.

An all-women Division Bench of Justices S. Vimala and S. Ramathilagam, constituted by Chief Justice Indira Banerjee especially for hearing cases related to crimes against women and children, dismissed an appeal preferred by the convict and upheld the capital punishment imposed on him by a mahila court in Chengalpattu on February 19.

“The brutality and the beastly act of the convict cannot be described in words... Justice demands that courts should impose punishments befitting the crime so that it reflects public abhorrence to the crime. Crimes like the one before us cannot be looked with magnanimity... If at all there is a case warranting award of death sentence, it is the present case,” the Bench said.

Authoring the judgment, Ms. Justice Vimala said the Constitution envisages a happy and healthy childhood free from abuse and exploitation. “But we live in a society where safety and security of children remains an unfulfilled promise,” she added after pointing out how the convict had lured the victim to his flat when she was playing on the ground floor of the apartment.

The sole stimulus for the crime was to satisfy physical pleasure.

After achieving that object, the convict had gone to the extent of murdering the child, hiding the body for quite some time in his house while pretending to be searching the child along with her parents and then burning the body with petrol at a remote location, the court pointed out.

“The diabolical ingenuity with which the body has been disposed off by the accused to ward off any attraction to him has led to the budding flower being reduced to ashes even before blossoming. The mindset of the accused to commit such a heinous act is more cruel than the act itself,” the judges said.

Conscious about the criticism that they would face for confirming the death sentence, the two judges said, opponents of capital punishment might brand the verdict as a surrender of emotions to grief, fear and so on. However, stating that “many of us would find it hard even to kill an ant, much less a man,” the Bench went on to say: “Accepting capital punishment means not that we surrender to our emotion, but that we overcome it.”

If imposition of death penalty amounts to taking away the right to life guaranteed under Article 21 of the Constitution, “would not the act of violating physical space of women and children amount to violation of Article 21?” the judges asked. They said victims of sexual abuse go through an “unfathomable, emotional, physical and psychological pain” not only at the ignominious point but throughout their life.

Nevertheless, the aspect of punishment for criminal offences always revolves around the interest of the accused alone, the judges lamented. They emphasised the need to think of the fact that children who suffer sexual abuse during childhood continue to suffer throughout their life, facing problems even in marital relationship.

Another murder case

It recorded the submission of State Public Prosecutor (in-charge) C. Emalias and Additional Public Prosecutor M. Mohammed Riyaz that Daswanth was also facing another case for having allegedly murdered his mother when he was out on bail.

However, the judges did not advert to it since it was a separate case altogether.

They held that the facts of the present case were enough to exhibit the “ruthless character of the convict” and prove that his “mind is beyond reformation.”

சென்னை, போரூரை அடுத்த மதநந்தபுரத்தை சேர்ந்தவர் பாபு. இவரது 6 வயது மகள் கடந்த 2017-ம் ஆண்டு பிப்ரவரி மாதம் 5-ந் தேதி வீட்டின் வெளியே விளையாடிக்கொண்டிருந்தபோது திடீரென்று மாயமானார். இதுகுறித்து மாங்காடு போலீசில் அவரது பெற்றோர் புகார் செய்தனர்.

போலீசார் நடத்திய விசாரணையில், அதே பகுதியில் குடியிருக்கும் தஷ்வந்த் என்ற வாலிபர், அந்த சிறுமியை தன் வீட்டிற்கு அழைத்து சென்று பாலியல் கொடுமை செய்து, கொலை செய்தது தெரியவந்தது.

இதையடுத்து தஷ்வந்தை போலீசார் கைது செய்தனர். பின்னர், இவரை குண்டர் தடுப்பு சட்டத்தின் கீழ் சிறையில் அடைக்க போலீஸ் கமிஷனர் உத்தரவிட்டார். இதை எதிர்த்து தஷ்வந்தின் தந்தை ஐகோர்ட்டில் வழக்கு தொடர்ந்தார். இந்த வழக்கை விசாரித்த ஐகோர்ட்டு, கமிஷனரின் உத்தரவை ரத்து செய்தது. இதையடுத்து, தஷ்வந்த் ஜாமீனில் வெளியில் வந்தார்.

கடந்த டிசம்பர் மாதம் 2-ந் தேதி தன்னுடைய தாய் சரளாவை தஷ்வந்த் கொலை செய்தார். இதுகுறித்து போலீசார் வழக்குப்பதிவு செய்து, தலைமறைவான தஷ்வந்தை மும்பையில் கைது செய்தனர்.

இதற்கிடையில், சிறுமியை கற்பழித்து கொலை செய்த வழக்கை செங்கல்பட்டு மகளிர் கோர்ட்டு நீதிபதி வேல் முருகன் விசாரித்து தஷ்வந்துக்கு தூக்கு தண்டனை விதித்து, கடந்த பிப்ரவரி 19-ந் தேதி தீர்ப்பு அளித்தார்.

இந்த தூக்கு தண்டனையை உறுதி செய்ய, இந்த வழக்கு சென்னை ஐகோர்ட்டுக்கு அனுப்பி வைக்கப்பட்டது. அதேபோல, இந்த தண்டனையை எதிர்த்து தஷ்வந்த் மேல்முறையீடு செய்தார்.

இந்த வழக்கை நீதிபதிகள் எஸ்.விமலா, எஸ்.ராமதிலகம் ஆகியோர் விசாரித்தனர். அப்போது அரசு தரப்பில் மாநில தலைமை குற்றவியல் வக்கீல் சி.எமிலியாஸ், அரசு குற்றவியல் வக்கீல்கள் முகமது ரியாஸ், பிரபாவதி, கொலை செய்யப்பட்ட சிறுமியின் பெற்றோர் சார்பில் வக்கீல் வி.கண்ணதாசன், மனுதாரர் தஷ்வந்த் சார்பில் பி.வி.செல்வராஜன் ஆகியோர் ஆஜராகி வாதிட்டார்கள்.

அனைத்து தரப்பு வாதங்களையும் கேட்டறிந்த நீதிபதிகள், இந்த வழக்கின் தீர்ப்பை தேதி குறிப்பிடாமல் தள்ளிவைத்து கடந்த ஏப்ரல் மாதம் உத்தரவிட்டனர். இந்த நிலையில், இந்த வழக்கின் தீர்ப்பை நேற்று பிறப்பித்தனர்.

அதில் நீதிபதிகள் கூறியிருப்பதாவது:-

தஷ்வந்த் தரப்பு வக்கீல் தன்னுடைய வாதத்தில், இந்த கொலை வழக்கில் சான்றுப் பொருட்களை பறிமுதல் செய்ததில் பல குளறுபடிகள் உள்ளன. சாட்சிகளும் முன்னுக்குப்பின் முரணாக வாக்குமூலம் அளித்துள்ளனர். இதை கீழ் கோர்ட்டு கவனிக்க தவறிவிட்டது. எனவே தூக்கு தண்டனையை ரத்து செய்ய வேண்டும் என்று கூறினார்.

இதற்கு அரசு தரப்பில் ஆஜரான வக்கீல்கள் கடும் எதிர்ப்பு தெரிவித்து வாதிட்டனர். 6 வயது சிறுமி என்று கூட பாராமல், பாலியல் கொடுமை செய்து, கொலை செய்து, அந்த உடலை பெட்ரோல் ஊற்றி தீ வைத்து தஷ்வந்த் எரித்துள்ளார். அவரது செயல் கொடூரமானது. எனவே, அரிதிலும், அரிதான வழக்காக கருதி, தஷ்வந்துக்கு விதிக்கப்பட்ட தூக்கு தண்டனையை உறுதி செய்ய வேண்டும் என்று வாதிட்டனர்.

இதேபோல, சிறுமியின் பெற்றோர் தரப்பில் ஆஜரான வக்கீலும் வாதிட்டார்.

சிறுமியை கொடூரமாக, மனிதத்தன்மையின்றி தஷ்வந்த் கொலை செய்துள்ளார். இதற்காக அவருக்கு கீழ் கோர்ட்டு தூக்கு தண்டனை வழங்கியுள்ளது.

இந்த வழக்கை பொறுத்தவரை, 6 வயது சிறுமியை அவரது பெற்றோர் இழந்துள்ளனர். அவர்களது வாழ்க்கையில் மிகவும் மகிழ்ச்சியை தந்த மகள் உயிரோடு இல்லை. காட்டுமிராண்டித்தனமாகவும், கொடூரமாகவும் அந்த சிறுமி கொலை செய்யப்பட்டுள்ளார்.

தன் மகள் கொடூரமாக கொலை செய்யப்பட்டுள்ளார் என்ற தகவல் தெரிந்த நொடிப்பொழுதில் இருந்து அந்த பெற்றோர் அனுபவித்து வரும் வேதனையை வார்த்தைகளால் கூற முடியாது.

இது ஒரு புறம் இருக்க, இந்த வழக்கில், போலீசார் அனைத்து குற்றச்சாட்டுகளையும் சந்தேகத்துக்கு இடமின்றி நிரூபித்துள்ளனர். அதனால், தஷ்வந்த் குற்றவாளி என்பதை உறுதி செய்கிறோம். அதேநேரம், அவருக்கு வழங்க வேண்டிய தண்டனை குறித்து பரிசீலிக்க வேண்டியதுள்ளது.

குற்றவாளிக்கு தண்டனை வழங்குவது என்பதற்கு பல காரணங்கள் உள்ளன. அரிதிலும், அரிதான வழக்கில் மட்டுமே உச்சபட்ச தண்டனையான மரண தண்டனையை வழங்க வேண்டும் என்று சுப்ரீம் கோர்ட்டு பல வழக்குகளில் கூறியுள்ளது.

இந்த வழக்கை, சுப்ரீம் கோர்ட்டு கூறும் அரிதிலும் அரிதான வழக்காக கருத முடியுமா? என்ற கேள்வி எழுகிறது.

நம்முடைய அரசியல் சாசனம், ஆரோக்கியமான, மகிழ்ச்சிகரமான, பாதுகாப்பான வாழ்க்கையை குழந்தைகளுக்கு கொடுக்க வேண்டும் என்று கூறுகிறது.

பெண்களுக்கு எதிரான குற்றச்செயல்கள் அதிகரித்து வருகிறது. சிறுவயதில் இதுபோல பாலியல் ரீதியான துன்பத்துக்கு ஆளாகும் பெண்கள், அந்த துயர சம்பவத்தை வாழ்நாள் முழுவதும் மறக்க முடியாமல், மனதுக்குள் வைத்து அழுதுகொண்டு இருக்கின்றனர்.

இதுபோன்ற சம்பவங்களால், திருமணத்துக்கு பின்பு அந்த பெண்களின் இல்லற வாழ்விலும் பிரச்சினை வருகிறது. எதற்காக இவர்கள் இப்படி ஒரு துயரங்களை அனுபவிக்க வேண்டும்?

தஷ்வந்துக்கு விதிக்கப்பட்ட தூக்கு தண்டனையை குறைத்து, ஆயுள் தண்டனையாக மாற்ற முடியாது. அவ்வாறு தண்டனையை குறைக்க சட்டரீதியாக எந்தவொரு நியாயமும் எங்களுக்கு கிடைக்கவில்லை.

காமவெறியனாக, அரக்கத்தனமாக இதுபோன்ற செயலை செய்த தஷ்வந்தை ஒருபோதும் மன்னிக்க முடியாது. ஒரு பச்சிளம் குழந்தை அவர் மீது வைத்திருந்த நம்பிக்கையை அவர் சிதறடித்துவிட்டார். தனது காமவெறியை தீர்த்துக்கொள்ள அந்த சிறுமியை ஒரு பொம்மை போல பயன்படுத்தியுள்ளார். இறுதியில் அந்த உயிரையும் உலகில் இருந்து பிரித்துவிட்டார்.

எனவே, இந்த வழக்கை அரிதிலும் அரிதான வழக்காக கருதுகிறோம். தஷ்வந்துக்கு கீழ் கோர்ட்டு வழங்கிய தூக்கு தண்டனையை உறுதி செய்கிறோம். தண்டனையை எதிர்த்து தஷ்வந்து செய்த மேல்முறையீட்டு வழக்கை தள்ளுபடி செய்கிறோம்.

இவ்வாறு நீதிபதிகள் தீர்ப்பில் கூறி உள்ளனர்.

மக்கள் போக்குவரத்தில் ரெயில்வே மிக இன்றியமையாத பணிகளை ஆற்றி வருகிறது. மக்கள் ரெயில் பயணங்களை நாடிச்செல்வதற்கு முக்கியகாரணம் குறைவான கட்டணத்தில் நிறைவான பயணம். தூங்கும்வசதி, கழிப்பறைவசதி இருப்பதுதான். பல ரெயில்களில் ‘குறைவான லக்கேஜ்’, அதிகமான வசதி; பயணத்தை இனிதாக்குங்கள்’ என்று எழுதப்பட்டிருக்கும். ஆனால் நடைமுறையில் சில பயணிகள் ஏராளமான ‘லக்கேஜ்’களை கொண்டுவந்து சீட்டுக்கு அடியில் மட்டுமல்லாமல், நடுவிலும், வழியிலும், கதவுகள் பக்கத்திலும் போட்டுவைத்து மற்ற பயணிகள் கை–கால்களை நீட்டவோ, எளிதாக ஏறி, இறங்குவதற்கு முடியாமலோ பயணத்தை மகிழ்ச்சியற்றதாக ஆக்கிவிடுகிறார்கள். சிலநேரங்களில் குறைந்ததூரத்தில் செல்லும் வியாபாரிகளும் மூட்டைகளை கொண்டுவந்து பயணிகள் பெட்டியில் போட்டுவிடுகிறார்கள். இவ்வளவுக்கும் ஒரு பயணி ரெயிலில் எவ்வளவு லக்கேஜை கொண்டுபோகவேண்டும் என்ற விதி இருக்கிறது. கடந்த 30 ஆண்டுகளாக இருக்கும் இந்த விதியை யாருமே பின்பற்றுவதில்லை.

இந்த விதிகளை இப்போது கடுமையாக நடைமுறைப்படுத்த ரெயில்வே நிர்வாகம் முடிவுசெய்துள்ளது. அதன்படி, 2–வது வகுப்பில் பயணம் செய்யும் பயணி தன்னுடன் 35 கிலோ லக்கேஜையும், மேலும் 35 கிலோ வரை லக்கேஜை பணம் கட்டி அதேரெயிலில் லக்கேஜ் வேனில் எடுத்துச்செல்லலாம். 2–வது வகுப்பு படுக்கை வசதி பெட்டி பயணி தன்னுடன் 40 கிலோவும், லக்கேஜ் வேனில் 40 கிலோவும், 3–வது வகுப்பு ஏ.சி. பெட்டி பயணி 40 கிலோவும், மேலும் 40 கிலோ லக்கேஜ் வேனிலும், 2–வது வகுப்பு ஏ.சி. பெட்டி பயணி 50 கிலோவும், மேலும் 50 கிலோ லக்கேஜ் வேனிலும், முதல் வகுப்பு ஏ.சி. பெட்டி பயணி 70 கிலோவும், லக்கேஜ் வேனில் 80 கிலோவும் ஏற்றிச்செல்லலாம். இதுபோக, பயணிகள் தங்கள் பயணம்செய்யும் பெட்டியில் எடுத்துச்செல்லும் டிரங்க்பெட்டிகள், சூட்கேஸ்கள் மற்றும் இதரபெட்டிகள் 100 செ.மீ. நீளம், 60 செ.மீ. அகலம் மற்றும் 25 செ.மீ. உயரம் வரைதான் எடுத்துச்செல்லமுடியும். இதற்குமேல் உள்ள பெட்டிகள் பணம் கட்டி ‘லக்கேஜ்’ வேனில்தான் கொண்டுசெல்லமுடியும். இந்த விதிகளைமீறி ரெயில் பயணிகள் தங்களுடன் ‘லக்கேஜ்’களை கொண்டுசெல்வதை கண்டுபிடித்தால் 6 மடங்குவரை அபராதம் விதிக்கப்படும் என்று அறிவிக்கப்பட்டுள்ளது.

நிச்சயமாக இது நல்லமுறைதான். வரவேற்கத்தகுந்ததுதான். எல்லோருடைய பயணமும் இனிமையாகும் என்பதில் சந்தேகமில்லைதான். அனைத்து ரெயில் நிலையங்களிலும் பயணிகள் ரெயில் நிலையத்திற்குள் நுழையும்போதே ‘லக்கேஜ்’களை எடைபார்க்கும் வசதிகள் இருக்கவேண்டும். யாரும் காத்திருக்கவேண்டிய நிலை இருக்கக்கூடாது. இதுபோல, ‘லக்கேஜ்’ வேன்களில் கொண்டுசெல்லும் லக்கேஜ்களை, அந்தந்த ரெயில் நிலையங்களில் ரெயில் புறப்படுவதற்குள் ஏற்றிவைப்பது யார்?, இறக்கிவைப்பது யார்?. சில ரெயில் நிலையங்களில் ரெயில் ஓரிரு நிமிடங்கள்தான் நிற்கும். அப்படியிருக்கும்போது பயணிகள் பயணம்செய்யும் பெட்டியில் இருந்து இறங்கி ‘லக்கேஜ்’ வேனுக்கு வருவதற்குள் ரெயில் புறப்பட்டுவிடும். ஆக, அவர்களுடைய ‘லக்கேஜ்’கள் பத்திரமாக இறக்கிவைத்து உரியவர்களிடம் ஒப்படைப்பதற்கான வசதிகளையும் ரெயில்வே நிர்வாகம் உறுதிசெய்யவேண்டும். எனவே, பயணிகளிடம் கடுமையான விதிகளை நிறைவேற்றும்போது, அதற்குரிய வசதிகளை செய்துகொடுக்கும் பொறுப்பும் ரெயில்வே நிர்வாகத்துக்கு இருக்கிறது.

பல்வேறு நிகழ்ச்சிகளில் பங்கேற்பதற்காக நேற்று திருச்சிக்கு வந்த தமிழக பள்ளி கல்வித்துறை அமைச்சர் செங்கோட்டையன் நிருபர்களுக்கு பேட்டி அளித்தார். அப்போது அவர் கூறியதாவது:-

‘நீட்’ தேர்வு தமிழ் கேள்வித்தாளில் ஏற்பட்ட குளறுபடியால் பாதிக்கப்பட்ட மாணவர்களுக்கு தலா 196 மதிப்பெண் வழங்கவேண்டும் என்ற திருப்பு முனை தீர்ப்பினை மதுரை ஐகோர்ட்டு கிளை வழங்கி உள்ளது. இதனை உடனடியாக செயல்படுத்த வேண்டியது மத்திய அரசும், சி.பி.எஸ்.இ.யும் தான். அதன்பிறகு தான் முதல்-அமைச்சரும், துணை முதல்-அமைச்சரும் பள்ளி கல்வித்துறை மூலம் எடுக்க வேண்டிய நடவடிக்கைகள் பற்றி முடிவு செய்து அறிவிப்பார்கள்.

எங்களை பொறுத்தவரை நமக்கு இருக்கும் அதிகாரத்தை பயன்படுத்தி மத்திய அரசு கொண்டு வருகிற எந்த போட்டித்தேர்வாக இருந்தாலும், அதனை எதிர்கொள்ளும் வகையில் மாணவர்களுக்கு நன்றாக பயிற்சி அளித்து வருகிறோம். நீட் தேர்வில் இருந்து தமிழகத்துக்கு நிரந்தர விலக்கு அளிக்கவேண்டும் என்பது தான் தமிழக அரசின் கொள்கை முடிவு. இதுதொடர்பான வழக்கு உச்சநீதிமன்றத்தில் நிலுவையில் இருந்தாலும், மாணவர்களின் எதிர்காலம் பிரகாசமாக இருக்கவேண்டும் என்பதற்காக நீட் தேர்விற்கான பயிற்சியை அளித்தோம்.

25 ஆயிரம் மாணவர்களுக்கு சி.ஏ. எனப்படும் தணிக்கை பயிற்சி அளிக்கப்பட இருக்கிறது. சிறந்த தணிக்கையாளர்களை கொண்டு அவர்களுக்கு 500 இடங்களில் பயிற்சி வகுப்புகள் நடத்தப்படும். இந்த திட்டம் 12-ந் தேதி (நாளை) கோபிச்செட்டிப்பாளையத்தில் தொடங்கி வைக்கப்பட இருக்கிறது.

தமிழகத்தில் 762 பட்டதாரி ஆசிரியர்கள் நியமனத்திற்கான சான்றிதழ் சரிபார்ப்பு பணி முடிந்து விட்டது. விரைவில் அவர்களுக்கு பணி நியமன ஆணை வழங்கப்படும்.
