Six years after retirement, government servant to get terminal benefits, pension

MADURAI: The Madras high court Madurai bench has directed the accountant general and director of co-operative audit, to disburse terminal benefits and monthly pension due to a government servant, six years after his retirement.

T Thangaraj of Madurai, worked as junior inspector of co-operative audit office and retired on November 30, 2009. But, his employer did not send his pension proposal to the accountant general on account of excess salary paid to him. Though he had taken the issue with the concerned officials, there was no response.

Thus, he filed a case seeking direction to the respondents to disburse the retirement benefits with 18% interest from the date of his retirement.

The co-operative side submitted a counter justifying its action and said the petitioner, while in service, was paid higher wages to the tune of Rs 2.01 lakh, which he was not eligible, and thus, his retirement benefits and pension was withheld till the remittance of that amount.

After hearing, justice S Vaidyanathan said, "As per the provisions of the Tamil Nadu Pension Rules, every government servant should submit an application for pension at least one year in advance of the date of his anticipated retirement, whereas in this case the petitioner submitted it only during the month of his superannuation. Hence, the officials could not be blamed for any delay in arriving at the amount."

At the same time, for no fault of the petitioner for wrong fixation of his pay, the petitioner alone could not be proceeded with in ordering recovery of the excess amount, when the respondents had not reserved their rights to do so at the time of granting higher pay. Hence, no recovery could be effected from the petitioner. The respondents are directed to release the gratuity amount due to him, the judge said.

Besides, even though there is a statutory duty cast on the employer to pay the amount together with interest, the petitioner is entitled to interest on gratuity at 9% per annum and to 6% on the arrears of pension benefits, if any. If the amount is not paid within two months, he will be entitled to 15% interest on the gratuity and pension arrears, the judge said.

Paying off lawyers tougher than accident for kin

CHENNAI: Court experience of road accident victims is turning out to be a bigger torment than the accident itself, as painfully realised by an 82-year-old retired teacher who came close to parting with about 50% of the compensation amount to her lawyers.

It is common knowledge that victims or their kin, who battle for nearly five years for first round win, have to pay anywhere between 10% and 30% to lawyers. Assuming a worker, aged under 30 years and with neither income proof nor filed income tax returns, gets killed in a road accident, his kin are likely to get a compensation of about 8 lakh. Dispute arises when the aggrieved family has to shell out a huge 'fees' at the end of the court ordeal.

"But, it is unfair to blame the lawyer alone," said a motor accidents case specialist, adding, "Policeman gets the case to the lawyer, government doctors perform surgery or autopsy and give relevant medical documents, insurance company counsel and executives incharge of filing counter expeditiously and help end the case early, and judicial officers enjoy significant discretionary powers to enhance compensation package. At every stage, in most cases, it is the lawyer who makes payments."

Ambulance-chasing advocates (comes from the stereotype of lawyers that follow ambulances to the emergency room to find clients) are passe. The nexus among these professionals is so strong, it is almost impossible not to pay anyone of these and get a fair compensation within a reasonable time, lawyers said.

Every traffic investigation wing police station has a 'resident agent' of a 'recognised' advocate who even makes payment in advance to police manning the station. "At present, the going rate is anywhere between 30,000 to 40,000, and these agents protest if an 'outside' advocate happens to enter the scene." Usually, policemen who take signatures of victim/kin at their moment of grief would sneak in the vakalatnama of the 'recognised' advocates and make them his clients without their own knowledge. "By the time they realise that they had 'engaged' the services of an X-lawyer, it is too late. We do not encourage people to cancel vakalatnama and change advocates," said a veteran of motor accident claims cases. Many victims' families accept money upto 50,000 from lawyers to meet immediate expenses. This too is added to the final commission deducted in percentage terms.

Government doctors too take about 15,000 per case and this amount is also usually paid by the lawyer, who even offers to treat the victim in a private hospital at his own cost. "All that we look for is his job and salary. If we are sure of a decent compensation, we do not mind paying for their treatment and other expenses," he said. With a lot of hesitation he also admitted that 'court expenses' is between 3% and 5% of the compensation package.

Unless the victims and their kin refuse to engage unfamiliar advocates to conduct their cases, they would be caught in a trap from which there is hardly an escape, the lawyer said.

MACT area is full of anecdotes, including the one which narrates how one registrar-general of the Madras high court chided a group of lawyers from Poonamallee for having protested 5% commission demanded by a judicial officer. "The RG said the rate had gone up to 10% and hence 5% demand was reasonable. He said we need not have wasted our time by coming to high court from Poonamallee," a lawyer said.

So what is the fair fee for an advocate? "I tell my clients to meet all expenses themselves, and make it clear my fee will be 10% of the compensation. They need not pay anything during trial, but should give me cash and take home the cheque," said a senior member of the Bar. Though cheques are given in the names of the claimants, it is 'usual' practice to detain it till cash is paid or the cheque is deposited in a new bank account opened with the help of the lawyer. "Once they leave court campus with cheque, there is no way we could get our 'investment' back," said a lawyer.

Norms for appointments on compassionate grounds relaxed

The State government has relaxed the requirement that a person applying for appointment in government departments on compassionate grounds should have completed 18 years of age at the time of the death of the government servant, it has informed the Madras High Court.

During the hearing of a case before Justice D. Hariparanthaman recently, government advocate S. Gunasekaran stated that though a State G.O. dated December 10, 2014 of the Labour and Employment Department relaxed the earlier requirement of completion of 18 years.

On his submission, the judge quashed a G.O. which rejected the application of a petitioner for appointment on compassionate grounds on the ground that he was only 17 years old when the government servant died.

Petitioner G. Arun, son of an Office Assistant at Government Boys Higher Secondary School at Bagalur, who died in 2007 while in service, had sought for quash an order passed by the District Education Officer (DEO) at Hosur which rejected his application for appointment on compassionate grounds.

He was 17 years and five months when his father died in 2007.

After verifying his application with documents, the headmaster of the school recommended the appointment of the petitioner which was rejected by the DEO on the ground that he was only 17 years when his father died and hence the petition.

UGC prescribes dress code

The University Grants Commission (UGC) has prescribing a dress code for students and faculty in varsities and asked the vice-chancellors to ensure that only handloom fabric is used for ceremonial dresses worn on special occasions like convocation.

Issuing a directive in this regard on July 15, the higher education regulator cited Prime Minister Narendra Modi’s call for working towards welfare of weavers.

“The prime minister has emphasised on revival of handloom and improving earnings of the handloom weavers. Handloom fabric not only forms an integral part of our rich culture and heritage but also provides livelihood opportunity to lakhs of people living in the rural areas. Using ceremonial robes made of handloom fabrics would not only give a sense of pride of being Indian but also be more comfortable in the hot and humid weather. Greater usage of handloom garments for apparel would promote the handloom industry in the country,” it said.

This comes ahead of the Modi government’s plan to roll out “India Handloom” brand on August 7, the day Swadeshi Movement was launched on 1905. The objective behind rolling out of “India Handloom” brand is to promote handloom products in international market.


In another directive to the universities, the UGC has asked the vice-chancellors to introduce special chapters in universities’ curricula to sensitise students about weapons of mass destruction and disarmament.

The National Authority, Chemicals Weapons Convention (NACWC), which functions under the Cabinet Secretariat, has decided that Education and Awareness should be a thrust area to create mass awareness for chemical disarmament, it said.

The most important target is the youth studying in schools and colleges. The coverage of topics on such important and vital issues such as weapons of mass destruction, disarmament and peaceful uses of chemistry are “grossly inadequate” in curricula at University level, the UGC noted, referring to the recommendation of NACWC.

“The young students who are well conversant and profound with scientific principals and advanced technological applications are largely ignorant of important international conventions like chemical weapons convention (CWC), which have a bearing on the welfare of the entire humankind. You are requested to kindly take necessary measures for inclusion of vital issues such as weapons of mass destruction, disarmament, peaceful uses of chemistry in the university curricula,” UGC secretary Jaspal S Sandhu said in his letter to vice-chancellors.

The UGC also asked the vice chancellors to sensitise the departments of mass communication and journalism with the recommendation of second administrative reforms commission on combating terrorism.



Medical colleges asked to start PG couses in traumatology

The medical colleges affiliated to The Tamil Nadu Dr. M.G.R. Medical University have been requested to start post-graduate programmes in traumatology in view of the increasing number of road accidents, the resultant rise in trauma victims coming to the hospitals and the need to save them, according to D. Shantharam, Vice-Chancellor of the University.

He gave this information to newspersons on the sidelines of the one-day All India Undergraduate Research Symposium organised by the Christian Medical College at its campus here on Friday.

The V-C said that the University has opened the doors of research to MBBS graduates who can straightaway register for Ph.D. without doing any post-graduation in order to promote interest in research among them. The University already has an e-journal for UG students. It regularly conducted symposia in order to infuse interest in research among them. The University has started an e-consortium of libraries for medicine, dentistry and surgery, and is trying to get funds from the Indian Council for Medical Research for promoting research. “We are in the process of getting an index journal (a journal which will find a place in the international medical journal index) for the University”, he said.

Dr. Shantharam said that the Medical University has approved the starting of an M.Ch. programme in hand surgery and M.Ch. in hepato-biliary surgery, and DM in cytogenetics by the CMC from 2015-16.

Earlier, speaking at the inaugural function of the symposium, the V-C said that research is an integral part of development, more so in medical science which is constantly evolving to a state of perfection. “We will get easily outdated if we are not ready to cope with the changing situations and needs through continuous research. Research is an integral component of medical education, fostering creative thinking, learning skills and communication skills for medical students to be globally competitive”, he said.

The V-C said that considering the immense job opportunities available in the area of manufacture of medical equipment for research, the government was now trying to integrate research into medical education. However, it is regrettable that India’s contribution to the global publication of scientific papers was only 0.7%, he said, and asked the medical colleges to start M.D. and research programmes and implement a student mentor programme for research.

Philip Ninan, Affiliate Professor of Psychiatry and Behavioural Medicine, East Carolina University who delivered the keynote address said that thirst for knowledge, a mentor for guiding the researcher, training and perseverance are key factors for research. In medicine, the students can take up applied translational research, services research or prevention research, he said.

Nihal Thomas, Vice-Principal (Research), CMC said that the CMC cleared 700 research proposals every year.
