Tax auditor for Nirav firm failed to raise red flag: CBI

Mumbai: The CBI alleged on Monday that a tax auditor for the Nirav Modi group did not raise a red flag despite being aware of three unsecured loans amounting ₹5,100 crore availed by group companies Diamond R US, Solar Export and Stellar Diamond, and that too from a single bank — PNB, Brady House branch, Mumbai. Countering CBI’s submissions made during the remand hearing of Sanjay Rambhia, who has been doing the companies’ audits since 2001, his lawyer said that he had done his job and pointed out the transactions to the tax authorities. He said that instead of being made an accused, Rambhia could be the “best witness” in the case.

Special CBI judge SR Tamboli remanded Rambhia, partner in CA firm Sampat and Mehta; former AGM (operation) of the Modi-owned Firestar International Manish K Bosamiya; former finance manager, Firestar International, Miten Pandya; and Aniyath Nair, then director of Mehul Choksi-owned Gili India Ltd, in CBI custody until March 17. The four accused were arrested on Sunday bringing the total number of arrested accused in the case to  18.

CBI special prosecutor A Limosin submitted that in the financial statements for the three firms for the year ending March 31, 2017, the auditor mentioned in the notes forming part of financial statements that the firms had availed buyer’s credit or payment of overseas payable for goods on letters of undertaking (LoU) from the bank and that they had not provided any security or guarantee. The auditor is duty-bound to check the background of unsecured loans, CBI submitted.

Seeking the CBI custody of Bosamiya and Pandya, the CBI told the court that former was in Firestar International from 2005-15, while the latter was still employed there. CBI said that they had knowledge since 2011 that the fraudulent LoUs were being issued by PNB and that they also helped prepare the applications for them. Advocates for the duo, Vijay Aggarwal and Yashwardhan Tiwari, opposed the need for custodial interrogation. Aggarwal said that they had been in CBI custody for more than 24 hours having been detained on Sunday morning, making the arrests illegal. The defence also moved a plea seeking preservation of the CCTV footage of the CBI office and register entries showing what time the duo entered the office. The court will hear the plea on March 12.

Trichy: A professor of Bharathidasan University created multiple email IDs allegedly to pose as external examiners for his own research scholars, the viva voce of his research scholars a few days before the Februray 21convocation found. The university then withheld the PhD.

While the vice-chancellor has ordered a detailed inquiry into the incident, seen as a first-of-its-kind in BDU, insiders say a comprehensive inquiry may lead to more skeletons tumbling out of the closet. It is mandatory for each PhD thesis to be evaluated by an external examiner, from within and outside the country. But the professor, by creating dubious email IDs, decided to evaluate the PhD work of his own students, a criminal offence.

Research guides are not authorised to know which external examiner is going to evaluate the PhD thesis of their students. However, they have to give a list of nine external examiners, of whom five should be from outside the country and the rest from within. When TOI spoke to the associate professor of the computer science department, he rejected such claims.

Stating that creating dubious email IDs posing as external examiner was a criminal offence, former Association of University Teachers president K Pandiyan said the guide would have known the PhD thesis of his student might not pass muster if scanned by an external examiner and decided to pose as an external examiner.

Former head of the department of defence studies of the university, Professor Gopalji Malviya, said there was rampant corruption in universities across Tamil Nadu, especially in PhDs. Terming it a highly skilled kind of corruption, he said “right from writing of PhD thesis, submission, viva voce and sending it to the external examiner, the whole process has been skillfully fabricated.”

He said weak and academically unskilled scholars resorted to such means but research guides were the real perpetrators. He gave the example of how the PhD of a professor in computer science department from one of the affiliated colleges of Madras University was withdrawn after his thesis was found plagiarised.

When contacted, vicechancellor P Manishankar said it would not be appropriate for him to say anything on the matter before the inquiry committee gave its report and the same got approved in the syndicate.

Property tax: Pvt colleges, schools to pay 60% surcharge

Chennai: Greater Chennai Corporation on Monday fixed property tax rate for private school and colleges following the January 11 order by Tamil Nadu government which abolished exemption granted to these institutions.

The government amended the Chennai City Municipal Corporation Act, 1919 to abolish the exemption from paying property tax granted to private educational institutions in the city. Across Tamil Nadu, this change was effected in the municipal corporations of Madurai and Coimbatore besides other municipalities.

On Monday, the city corporation said that it will evaluate private educational institutions based on the existing slab applied to residential buildings in the locality. A 60% surcharge will be added to this amount during assessment. This means that in an area like T Nagar, where the lowest tax rate is ₹1 per sq.ft for houses, a school of 2,000 sq.ft area will have to pay at least ₹3,200 as property tax every six months. When TOI reported on the government abolishing the exemption, private school administrations hinted that this would result in school fees going up. Corporation officials told TOI that they do not expect a significant rise in the property tax collection figures due to this change.

Madras varsity goes to police over missing answer scripts

Chennai: University of Madras on Monday lodged a complaint with the Anna Square police station regarding answer scripts going missing from the Institute of Distance Education (IDE) on Friday.

After a complaint was lodged by registrar R Srinivasan, a CSR (community service register), a precursor to the filing of a First Information Report (FIR), was issued and an investigation launched, he added.

The issue pertains to a few hundred answer scripts reported missing from the second floor of the IDE building located on the Chepauk campus of the university. The answer scripts were of exams held in March 2017 for which the results were published in April.

“Usually, the university has the practice of disposing the corrected answer scripts six months after the results are published. Such complaints are received every year,” a police officer said. The papers are sent to the Tamil Nadu Newsprint and Papers Ltd (TNPL).

The missing answer scripts are important as the university is probing an alleged scam in the IDE exams held in November and December 2016. Based on the hand-writing and other evidence gathered from the answer scripts, university officials had deduced that there were irregularities. Most of the students, despite being from Chennai, had gone to centres like Hyderabad and Mumbai to write the exam, allegedly to escape tough supervision. Collusion of distance education centres is suspected, but a complete report is awaited.

University sources have not ruled out the possibility of the answer scripts pertaining to the alleged scam being among the missing papers. A detailed inquiry has been conducted. Sources say there has been a breach in the security of the room, but the motive of allegedly stealing the answer scripts is not yet clear. “It could just be for money which can be made by selling the papers,” a source said.

ஒரு பெண், தனது கணவரைவிட்டுப் பிரிந்து குழந்தைகளுடன் திருநெல்வேலியில் வசித்துவந்தார். தன் குழந்தைகளைத் தனது மனைவி கடத்திச் சென்று விட்டார் என்று கூறி அந்தப் பெண்ணின் கணவர் ஆட்கொணர்வு வழக்கு தாக்கல்செய்தார்.

குழந்தைகளை நீதிமன்றத்துக்கு அழைத்துவர அப்பெண்ணுக்கு நீதிமன்றம் நோட்டீஸ் அனுப்பியது. இரண்டு முறையும் நோட்டீஸைப் பெற்றுக்கொண்ட அந்தப் பெண் நீதிமன்றத்துக்கு வரவில்லை. இதையடுத்து, அவரை நீதிமன்றத்துக்குக் கொண்டுவருமாறு அந்த ஊர்க் காவல் துறை அதிகாரிக்கு நீதிமன்றம் உத்தரவிட்டது. குறித்த நாளில் குழந்தைகளோடு அந்தப் பெண்ணை நீதிமன்றத்தில் நிறுத்தியது காவல் துறை. நீதிபதிகள் பொதுவாக தங்கள் கேள்விகளை அரசு வழக்கறிஞரிடம்தான் கேட்பார்கள். அவர்கள்தான் அந்த நபர்களிடம் பதிலை வாங்கி நீதிபதியிடம் சொல்வார்கள். தேவைப்படும்போதுதான் நீதிபதிகள் வழக்காடிகளை அருகில் அழைத்துப் பேசுவார்கள்.

இந்த வழக்கு விசாரணை தொடங்கியபோது நீதிமன்றச் சூழல், நடைமுறை ஆகியவற்றால் மிரண்டுபோயிருந்த அந்தப் பெண்ணைப் பார்த்த நீதியரசர் ரத்தினவேல் பாண்டியன், கணவருக்குத் தெரியாமல் குழந்தைகளை ஊருக்கு அழைத்துப்போனது ஏன் என்று கேட்டார். அப்போது, தனது கணவர் செய்த கொடுமைகளைச் சொன்ன அந்தப் பெண், “அவரிடமிருந்து தப்பி, பத்திரமாக இருந்து குழந்தைகளைக் காப்பாற்றத்தான் அழைத்துச் சென்றேன்” என்று சொல்லி அழுதார்.

நீதியரசர் அந்தப் பெண்ணை தன் முன்னால் அழைத்து நேரடியாகக் கேள்விகள் கேட்கத் தொடங்கினார்.

“சரிம்மா, நீதிமன்றத்திலிருந்து இரண்டு முறை நோட்டீஸ் வந்ததா?”

“வந்ததுங்க அய்யா”

“நோட்டீஸ் வந்தும் நீ ஏன் நீதிமன்றத்துக்கு வரவில்லை?”

“வண்டிக்குக் குடுக்க காசில்லை அய்யா”

“சரி, இப்ப எப்படி வந்தாய்?”

“போலீசு வண்டில கூட்டிட்டு வந்தாங்க அய்யா”

நீதிமன்றம் நிசப்தமானது.

“எப்படித் திரும்பி ஊருக்கு போவாய்?”

“தெரியல அய்யா. போலீசு வண்டியிலேயே கொண்டுவந்து விடச் சொல்லுங்கய்யா”

மீண்டும் ஒரு துயரம்தோய்ந்த இறுக்கம் நீதிமன்றத்தை நிறைத்தது.

அந்தப் பெண்ணை அருகில் அழைத்த நீதியரசர் சொன்னார்:

“நான் தப்பு பண்ணிவிட்டேன் அம்மா. நீ பஸ்சுல போ” என்று சொல்லியபடி தன் பர்சில் இருந்து ஒரு நூறு ரூபாய் நோட்டை எடுத்து அந்தப் பெண்ணிடம் கொடுத்தார். “குழந்தைகளுக்குச் சாப்பாடு வாங்கிக் கொடுத்து அழைத்துப் போம்மா" என்றார்.

உடன் இருந்த நீதியரசரும் தன் பையில் இருந்து நூறு ரூபாய் எடுத்துக் கொடுத்தார்.

அந்தப் பெண் கும்பிட்டு நன்றி சொல்ல, வழக்கறிஞர்கள் கண்கலங்கினர். அத்துடன் வழக்கை முடிக்கவில்லை நீதியரசர் ரத்தினவேல் பாண்டியன். வழக்கு போட்ட அந்தக் கணவரை அழைத்து, இப்படி உண்மைகளை மறைத்துப் பொய்வழக்கு போட்டு மனைவியையும் குழந்தைகளையும் அலையவிட்டதைக் கடுமையாகக் கண்டித்து, எச்சரிக்கைசெய்து அனுப்பினார்.

வாழ்க்கைப் பாடம் என்பது அனுபவத்தில் விளைவது. அதற்குப் படிப்பு மட்டும் போதாது. பட்டறிவு வேண்டும் என்பதை நினைவூட்டிக் கொண்டே இருக்கும் வாழ்க்கைப் பயணம் நீதியரசர் ரத்தினவேல் பாண்டியனுடையது.
