Lotus blooms again as BJP sweeps DK, Udupi

Mangaluru: Prime Minister Narendra Modi and BJP national president Amit Shah repeatedly said that the BJP would sweep the polls in the coastal districts of Dakshina Kannada and Udupi but even the BJP leaders in the region would not have imagined or expected such a landslide victory.

While the BJP bagged 7 out of 8 Assembly constituencies in Dakshina Kannada district, the BJP swept all 5 Assembly constituencies in Udupi district.

Food and Civil Supplies Minister and Mangaluru candidate U T Khader is the only Congress candidate to win in 13 seats in DK and Udupi. In fact, Khader has never lost any election that he contested.

Many new faces

Though rumours were doing the rounds that Congress may lose in 2 or 3 constituencies in DK (Moodbidri, Puttur and Sullia) and 2 in Udupi (Kundapur and Karkala), the Congress losing 7 out of 8 seats in DK and all seats in Udupi is hard to believe.

While 7 out of 8 Congress candidates in Dakshina Kannada were sitting MLAs, 3 out of 5 Congress candidates in Udupi were sitting MLAs. On the other hand, 3 out of 8 BJP candidates (D Vedvyas Kamath in Mangaluru South, Dr Bharath Shetty in Manglauru North, Harish Poonja in Belthangady) are first-time contestants and 3 others who have won this time had lost against the same Congress candidates in 2013 polls. They are U Rajesh Naik in Bantwal, Umanath Kotian in Moodbidri and Sanjeev Matandoor in Puttur. In the remaining two constituencies, Dr Raghu of Congress lost to S Angara in Sullia for the fourth time in a row. In Mangaluru, first time MLA contestant from BJP, Santhosh Boliyar, failed to make it against the giant killer U T Khader.

Losers in DK include the giants District-in-Charge Minister B Ramanath Rai and MLAs J R Lobo, Mohiuddin Bava, Abhaychandra Jain, Vasanth Bangera and T Shakunthala Shetty.On the other hand, in Udupi district, except the Congress candidate in Kundapur constituency (Rakesh Malli), all the 4 Congress candidates and all the 5 BJP candidates were either sitting MLAs or those who contested the 2008 or 2013 elections.

In 2008, the Congress and BJP shared 4 seats each in DK and BJP bagged 4 out of 5 seats in Udupi. In 2013, Congress bagged 7 out of 8 seats in DK and 3 out of 5 in Udupi district.

Huge margin

Unlike earlier elections wherein the winning margin was very thin in at least 1 or 2 constituencies, this time, the winning margin is huge in every constituency in DK as well as Udupi. While Moodbidri BJP candidate Umanath Kotian polled 87,027 votes, Congress candidate Abhaychandra Jain polled 57,374 (margin 29,653).

The lowest winning margin in DK was registered in Bantwal Assembly constituency. While Rajesh Naik (BJP) polled 97,802 votes, B Ramanath Rai (Cong) polled 81,831 votes (margin 15,971).

The total number of votes polled under NOTA in the district is 8,809

Similarly, Kundapur BJP candidate Haladi Srinivas Shetty (1,03,434) won with a margin of 56,405 votes against Congress candidate Rakesh Malli (47,029).The lowest winning margin in Udupi was registered in Kaup Assembly constituency. While Lalaji R Mendon (BJP) polled 75,893 votes, Vinay Kumar Sorake (Cong) polled 63,976 votes (margin 11,917).

Poor show

Quite interestingly, no candidate from CPM, JD(S), JD(U) or MEP managed to get more than 3,000 votes in DK and Udupi.

In fact, except the Congress and BJP candidates, all other candidates lost their deposit in the coastal region.

Madras High Court talks tough on arrears

Chennai: When a student is not able to clear arrears, except on genuine grounds, within the permitted duration, the authorities (university) should not issue notifications, permitting them to write the examinations subsequently, as it will always create unrest among students and the university will always be litigating over the matters in courts, Madras High Court said.

Justice S. Vaidyanathan dismissed the petition filed by a 1994-1998 batch student, which sought a direction to the Anna University to allow him to appear for examination papers P-MAI-26 Mathematics, MA3-03 Mathematics and MA5-10 Numerical Methods to be conducted in August 2018. According to the petitioner, he joined Anna University in 1994-1995 and completed in 1998 and cleared all papers except three. He was unable to complete the said three papers due to unforeseen circumstances.

  On November 22, 2017, a press release said that Anna University had granted one-time permission to students, who have not appeared for the examination, but however, the upper limit was fixed as students joined after 2000. When he requested that he may be permitted to write the examination and clear the arrears, the same was rejected, he added.

The judge said admittedly, the notification issued in 2017 has not been challenged. The petitioner was already given a chance in 2006 and that in 18 semesters from the date of his admission to the college, he has not cleared the papers and he was even though a student for engineering college, for the maximum period of six years to clear the arrears, he had been permitted to take up the examination for nine years. Permitting students to take up the arrear examinations was only a concession and it was given by the university on humanitarian grounds.

 The judge said the concession/benefit cannot be demanded as a matter of right by a student while taking up the arrear examinations in clearing the course itself.

“In this case, as the facts are not in dispute, the petitioner will not have a locus standi to demand as a matter of right that he should be permitted to take up the arrear examinations. The petitioner’s contentions cannot be accepted and if it is accepted, it would amount to opening the Pandora’s box. Though it is a fit case for imposing cost of `50,000, taking into consideration the fact that the petitioner wanted to avail the opportunity of appearing in the examinations, this court is not imposing any cost,” the judge added

Delhi High Court – 2 Important Decisions for NEET Undergraduate Exams

The Delhi High Court took two important decisions regarding NEET Undergraduate Examinations. In one decision High Court allowed open school students to appear for the National Eligibility cum Entrance Test (NEET) examination. This move by the High Court strikes down CBSE’s clause that barred students from open schools or those who have studied privately from appearing in NEET.

In another decision along with this, the HC has also dismissed a plea that was filed challenging the Central Board of Secondary Education (CBSE)’s notification that stated the age restrictions for medical aspirants. With this order, the age restriction stated in the notification will remain unchanged. According to this, the upper age limit of 25 and 30 yrs for general and reserved categories respectively fixed by the board will stay put.


The High Court back in February 2018 had stayed the CBSE’s notification on upper age limit and other criteria for NEET. The plea challenging the Medical Council of India’s decision to set an upper age limit of 25 years and 30 years for the reserved category along with disabled candidates was filed by two MBBS aspirants hailing from Kerala.

The Union government back in 2017, had introduced the upper age limit for medical examinations which had led to massive protests by medical aspirants in the country. It was when several petitions were filed in the court, that the apex court had allowed students above 25 years to sit for the exam.

The plea file in the High Court stated that the decision taken was against the Supreme Court direction which stated that there should not be any age limit for MBBS aspirants appearing for NEET. However, the same criteria for eligibility were introduced this year too. According to the eligibility criteria introduced, the students who have had biology as an additional subject, those who have taken more than two years to complete their 11th and 12th and students who have studied privately were not eligible to apply for the exam.

The Delhi High Court on Friday dismissed petitions challenging the Central Board of Secondary Education’s notification that laid down upper age limits for candidates appear for the National Eligibility-cum-Entrance Test, PTI reported. The court said candidates from general category above 25 years cannot appear for the exam while candidates from reserved categories older than 30 are ineligible.

Justices Sanjiv Khanna and Chander Shekhar, however, struck down a clause in the notification that bars students from open schools or those who have studied privately from appearing in the examination, The Times of India reported.

“Students or candidates, who have done class 12 from NIOS or recognized open school state boards, would not be treated as per se disqualified for selection and appearance in NEET,” the court said in its 81-page judgment, referring to the National Institute of Open Schooling. “Their NEET results, when otherwise eligible, would be declared with other candidates.”

உரிமையாகக் கோர முடியாது, அது மனிதாபிமான அடிப்படையில் பல்கலைக்கழகத்தால் வழங்கப்படும் வாய்ப்புகள் என உயர்நீதிமன்றம் தெரிவித்துள்ளது. 

சென்னை உயர் நீதிமன்றத்தில் ஜி.மேகநாதன் தாக்கல் செய்த மனுவில், அண்ணா பல்கலைக்கழகத்தில் நான் கடந்த 1994-ஆம் ஆண்டு முதல் 1998-ஆம் ஆண்டு வரையிலான காலகட்டத்தில் பொறியியல் படிப்பை நிறைவு செய்தேன். 3 பாடங்களில் நான் தேர்ச்சி பெறவில்லை.
இதனைத் தொடர்ந்து கடந்த 2006-ஆம் ஆண்டில் மீண்டும் தேர்வெழுதி தேர்ச்சி அடையவில்லை. இந்த நிலையில், தற்போது அண்ணா பல்கலைக்கழகம் 2000- ஆம் ஆண்டுக்குப் பிறகு "அரியர்' வைத்துள்ள மாணவர்கள் மறுதேர்வு எழுத வாய்ப்பு அளித்துள்ளது. ஆகவே, எனக்கும் தேர்வு எழுத வாய்ப்பு அளிக்க வேண்டும் என கோரியிருந்தார்.

இந்த மனு நீதிபதி எஸ்.வைத்தியநாதன் முன் விசாரணைக்கு வந்தது. அப்போது அண்ணா பல்கலைக்கழகத்தின் சார்பில், எந்த பொறியியல் மாணவருக்கும் 6 ஆண்டுகள் மட்டுமே "அரியர்' பாடங்களை மீண்டும் எழுதி தேர்ச்சி பெற அனுமதியளிக்கப்படும். ஆனால், மனுதாரர் 2006-ஆம் ஆண்டு தேர்வு எழுத அனுமதி வழங்கியும் தோல்வி அடைந்துள்ளார்.
தற்போது 2000-ஆம் ஆண்டுக்குப் பிறகு பாடத் திட்டங்கள் மாற்றப்பட்டு, கேள்வித் தாள்களும் மாற்றப்பட்டு விட்டது. எனவே மனுதாரர் தனது "அரியர்' பாடங்களை எழுத அனுமதிக்க முடியாது என மறுப்பு தெரிவிக்கப்பட்டது.
இதை ஏற்றுக் கொண்ட நீதிபதி, மனுதாரர் "அரியர்' பாடங்களில் தேர்ச்சி பெற வாய்ப்பு கோருவதை தனது உரிமையாகக் கோர முடியாது. இந்த வாய்ப்புகள் மனிதாபிமான அடிப்படையில் பல்கலைக்கழகத்தால் வழங்கப்படுகின்றன.
எனவே, இந்த விவகாரத்தில் மனுதாரரின் கோரிக்கையை ஏற்க முடியாது. மனுதாரருக்கு ரூ.50 ஆயிரம் அபராதம் விதித்து உத்தரவிடலாம் என்ற போதிலும் அபராதம் விதிக்கவில்லை எனக் கூறி மனுவைத் தள்ளுபடி செய்து உத்தரவிடுவதாக நீதிபதி பிறப்பித்த உத்தரவில் குறிப்பிட்டுள்ளார்.

நான்கு பேருக்கு தேர்வு எழுத அனுமதி மறுத்ததால் ஆயுர்வேத மருத்துவக் கல்லூரி மாணவர்கள் போராட்டம்!

கோட்டாறு அரசு ஆயுர்வேத மருத்துவக் கல்லூரியில் 4 மாணவர்களுக்குத் தேர்வு எழுத அனுமதி மறுக்கப்பட்டதைக் கண்டித்து மாணவ, மாணவிகள் தர்ணா போராட்டம் நடந்ததால் பரபரப்பு ஏற்பட்டது.

தமிழகத்தின் ஒரே அரசு ஆயுர்வேத மருத்துவக் கல்லூரி கன்னியாகுமரி மாவட்டம் கோட்டாரில் அமைந்துள்ளது. இங்கு 250-க்கும் அதிகமான மாணவ, மாணவியர் படித்து வருகின்றனர். இந்தக் கல்லூரியில் 4-ம் ஆண்டு மாணவர்களுக்கான தேர்வு நடந்தது. தேர்வுக்கான நுழைவுச்சீட்டு வழங்கியபோது அதில் நான்கு மாணவர்களுக்குத் தேர்வு எழுத பல்கலைக்கழகம் நுழைவுச்சீட்டு வழங்கவில்லை எனக் கூறப்படுகிறது.

அந்த மாணவர்களுக்குப் போதுமான வருகைப்பதிவு இல்லை எனப் பல்கலைக்கழகம் சார்பில் கூறப்படுகிறது. இதனால் அதிர்ச்சியடைந்த
4 மாணவர்கள் தங்களைத் தேர்வு எழுத அனுமதிக்க வேண்டும் எனக் கேட்டு கல்லூரி வளாகத்தில் தர்ணா போராட்டம் நடத்தினர். இந்த மாணவர்களுக்கு ஆதரவாகப் பிற மாணவர்களும் போராட்டத்தில் இறங்கியதால் பரபரப்பு ஏற்பட்டது. பின்னர், கல்லூரி நிர்வாகம் பேச்சுவார்த்தை நடத்தியதைத் தொடர்ந்து 4 மாணவர்களைத் தவிர பிற மாணவர்கள் தேர்வு எழுதினர்.
