‘Man employed on compassionate grounds to give 25% of pay to mom’

The Madras high court came to the rescue of a woman, who was attacked, verbally abused and subsequently abandoned by her son. The court ordered payment of 25% of his monthly salary to his mother for failing to take care of her as promised.
T Desinguraja, a government school clerk, had obtained the job on compassionate grounds after his father’s death. His brothers and sisters did not object to him taking up the job since he promised to take care of the family, particularly their mother Valliyammal.
After joining duty on May 17, 2013, Desinguraja left her in the lurch, attacked her and also abused her using filthy language, Valliyammal said. Aggrieved by the continuous torture in the hands of her son, Valliyammal moved the present petitions.
Justice S Vaidyanathan passed the interim order while admitting the two petitions that sought departmental and disciplinary proceedings against Designuraja and his suspension from service pending inquiry.
“Admittedly, Desinguraja got the appointment on compassionate ground on the demise of his father, bypassing his elder sister, who was fully qualified and eligible to get appointment at that time, on the belief that he would provide all comfort/amenities to their mother,” the court said.
Though the petitioner sought for the interim prayer of suspension from service, this court cannot give such an interim direction, it added.
However, the judge observed that the petitioner is entitled to 25% of the gross monthly income of Desinguraja as an interim measure and directed the school education authorities to ensure that the said portion is deducted from his salary and paid directly to the petitioner till further orders. The court then adjourned the hearing to June14.
