HC asks Centre to approve MCI notification on increasing age limit

Six govt. doctors affected by cap on upper age limit at 40 years
The Madras High Court has directed the Union Ministry of Health and Family Welfare to approve a draft notification forwarded by the Medical Council of India (MCI) for increasing the upper age limit for Senior Residents/Assistant Professors in government as well as private medical colleges from 40 to 45 years and publish it in the gazette within three weeks.
Justices S. Manikumar and Subramonium Prasad also directed the State Health Secretary to give effect to the change after the issuance of the gazette notification.
The orders were passed while disposing of a joint writ petition filed last year by six government doctors affected due to fixation of the upper age limit at 40 years with effect from June 8, 2017.
The petitioners’ counsel G. Sankaran feared that the fixation of age limit for Senior Residents/Assistant Professors by the Medical Council of India would seriously affect the career prospects of many doctors who might be denied further promotions.
He also brought it to the notice of the court that the State government itself had requested the Centre to relax the age limit.
On his part, advocate V.P. Raman representing the MCI, which had now been superseded by a Board of Governors (BOG), informed the judges that the BOG had decided to relax the upper age limit from 40 to 45 years and the decision was communicated to the Union Health Ministry on June 10 this year for follow-up action.
Centre’s stand
When the judges wanted to know the stand of the Centre, Assistant Solicitor General G. Karthikeyan acknowledged the receipt of the draft notification from the MCI and sought three weeks time to approve it and publish in the government gazette.
After recording all their submissions, the judges directed the Centre to complete the process within the stipulated time.
