HC awaits SC decision on med quota

Madras high court has chosen to await the Supreme Court’s decion on pleas for extending OBC reservation benefits in medical admissions under All India Quota. When a batch of PILs filed by almost every political party, besides the Tamil Nadu government, came up for hearing on Monday, a division bench refused to pass any interim orders.
“The apex court is already seized of the matter. Let us wait and see what transpires,” the bench of Justice R Subbiah and Justice Krishnan Ramaswamy said, and adjourned the hearing to July 9.
When the plea came up for hearing, senior counsel for DMK P Wilson said: “When the central government gave economically weaker section (EWS) reservation in AIQ, they never approached the Supreme Court for permission. There cannot be one law for EWS and another law for OBC. The central government never approached SC when it decided to give reservation to OBC in central educational institutions. Thus, they cannot drive the petitioners to SC on the ground that similar cases are pending before SC.”
Additional solicitor-general of India G Rajagopalan submitted that since 1986 no reservation had been provided in the AIQ seats for medical admission as per apex court directive. “The same was modified after 10 years providing reservation for SC/ST. In 2015, pleas were moved seeking OBC reservation which is still pending before the Apex court which has to take a call and modify the order,” he said.
