Court acquits mother-daughter duo in ‘honour killing’ case
Prosecution failed to connect them with crime, says judge

A Delhi court has acquitted a mother-daughter duo in a case of ‘honour killing’ as the prosecution failed to connect them with the crime.

According to the prosecution, the accused, Saida, mother of victim and her sister Mohsina had smothered the victim when they saw her at midnight with a man, who was staying in the same building as their tenant, hours before she was to be engaged with the bridegroom of their choice.

The tenant, Israr alias Guddu, was married with three children. He was a prosecution witness and supported the case during the trial.

On the day of incident, he and the victim were together in his room when his wife and children had gone to their village. The accused barged into his room and took the victim away forcibly. The next morning he heard that she was killed by the duo, Israr said in his testimony.

He further said that the accused took the victim to her mother’s room. After a few minutes he heard her cries and got scared and hence locked his room and fled to his village.

However, Additional Sessions Judge Vidya Prakash rejected his evidence, saying that he was not a reliable witness.

“The testimony of this witness, when considered carefully in the light of all the facts and circumstances emerging on record from the testimonies of other prosecution witnesses and the documents proved during trial, does not inspire confidence of the court for several reasons,” the Judge said.

“Court is of the view that the prosecution has failed to bring home the guilt of both the accused beyond reasonable doubt. Consequently, the accused persons namely Saida and Mohsina are hereby acquitted of the charges levelled against them,” the Judge said.
