HC: Admission to Muthukumaran Med College can only be provisional

In a setback to Sri Muthukumaran Medical College and Research Institute based in Chennai, the Madras high court on Monday said that admissions made to the 150 MBBS seats available with the college through counselling scheduled on August 27 can only be provisional and subject to the final orders of the court.
Only on August 19, a single judge of the court allowed a plea moved by the college and directed the Tamil Nadu Dr MGR Medical University to grant affiliation to the institute and include 150 MBBS seats available with the college in the counselling.
Now, a week later, a division bench of Justice S Manikumar and Justice Subramonium Prasad passed the interim order making it clear that the admissions can only be provisional. This order has been passed in a writ appeal by K M Krishnan challenging the single judge order.
Earlier, the same petitioner had moved three PILs seeking directions to the authorities not to permit the college to participate in the counselling for 2019-20 academic year, as most of the buildings of the institute are unauthorised.
When the appeal came up for hearing, senior counsel for the petitioner R Singaravelan submitted that the college moved a separate plea before a single judge and obtained a favourable order without even adding the petitioner as a respondent in the plea.
It was further submitted that the counselling for the course is scheduled tomorrow (August 27) at 2.00pm.
Considering the submission, the bench said, “Let the counselling go on August 27 as scheduled. Provisional selection and admission of any student in Sri Muthukumaran Medical College Hospital and Research Institute, Chennai, would be subject to the further orders of this court. It is also made clear that the authorities will also publish in the official website of the Selection Committee, Director of Medical Education that provisional selection and admission of any student, is at the risk of the student and subject to further orders of this court, in the instant writ appeal.”
