The Kerala High Court on Thursday declared unreasonable and arbitrary
a clause in the regulation of the Kerala University of Health Sciences
(KUHS) to the extent that candidates who failed in one subject, either
in theory or practical, should appear for all papers including theory
and practical.
Justice V. Chitambaresh passed the verdict while disposing of a batch of writ petitions filed by S. Geethu, Thiruvananthapuram, and other postgraduate students in various medical colleges in the State challenging the clause 3.16 of the regulation.

The court observed that the Medical Council of
India (MCI) regulations did not explicitly state that a candidate should
secure a minimum of 50 per cent marks in theory and practical
simultaneously in order to be successful. The MCI regulation did not
forfeit the marks obtained in theory or practical in case of shortcoming
in one subject, compelling the student to re-do the exercise all over
again. However, the regulation of KUHS was not consistent with or in
conformity with the MCI regulations.
