HC asks collector to suspend BDO

The Madras high court has directed the Tiruvallur collector to place a block development officer in the district under suspension for failing to obey a court direction.

“The BDO has not understood the seriousness of the judicial proceedings and he has committed dereliction of duty and negligence in not bringing the files and also in not instructing the government advocate for defending the writ petition on behalf of the state. Thus, he miserably failed to perform his duty by not responding, both to the court as well as to the government advocate,” said Justice S M Subramaniam on Friday.

The issue pertains to a plea moved by former Poondi panchayat secretary G Jayaprakash to quash disciplinary proceedings initiated against him, and confer all consequential benefits to him. On July 25, when the plea came up for hearing, Justice Subramaniam directed S G Krishnan, the BDO of the panchayat, to be present before the court with relevant files on July 27.

On Friday, the government advocate submitted that he had already communicated the order to the collector and the BDO and asked the latter to bring original files and to explain as to why there was a long delay in concluding the disciplinary proceedings against the petitioner.

He further informed that theBDOcametothecourtonly at11.15am,thattoowithout any files. When the judge questioned the officer, who was present in the court, he was unable to provide any answer.

The court then directed the collector to place the BDO under suspension and initiate appropriate disciplinary proceedings under the Tamil Nadu Civil Service (Discipline and Appeal Rules). TNN
